Commission staff have reviewed the information submitted and determined that the above referenced dredging
events conform with Consistency Certifications CC -078-99 and/or CC -077-01 and that no further federal
consistency review is necessary from the Commission for the dredging components of the,projects. In addition,
the proposed beach disposal events have been reviewed and found by the Executive Director to be consistent with
Special Conditions 1-3 and 9-12 of Coastal Development Permit 5-99-282, as amended. No further review is
necessary from the Commission for the beach disposal components of the projects.
Please be advised that only the projects described in the materials submitted for the sites listed above have been
found to conform with Consistency Certification CC -078-99 and CC -077-01 and/or conform with the terms and
conditions of Coastal Development Permit 5-99-282, as amended. Any change in the projects may cause them to
lose their status as consistent with CC -078-99 and CC -077-01 and/or CDP 5-99-282, as amended. This
certification is based on information provided by the recipient of this letter. If, at a later date, this information is
found to be incorrect or incomplete, this letter will become invalid, and any development occurring at that time
must cease until a new determination regarding conformance with CC -078-99 and CC -077-01 and/or CDP 5-99-
282, as amended, is obtained.

This is in reply to your applications dated January 23, 2004 and April 19, 2004, for
Department of the Army Permits to conduct maintenance dredging, per Regional General Permit
No. 54 in Newport Bay, Newport Beach, Orange County, California. This letter authorizes
maintenance dredging at three sites within Newport Bay (see below) and transport of dredged
material for ocean disposal at LA -3.

Based on the information you have provided, the Corps of Engineers has determined that
your proposed activity complies with the terms and conditions of Regional General Permit (RGP)
No. 54. Furthermore, you must comply with the following non -discretionary Special
Condition:

1. The permittee shall ensure that there are no direct impacts to onsite eelgrass beds
and/or patches to be avoided. Prior to the commencement of construction activities, the
permittee shall flag with surface buoy(s) the limits of the dredging footprint, as shown on the
approved dredge application, to delineate areas of impact permitted within waters of the U.S.
Any additional acreage impacted outside of the approved dredge footprint resulting in a direct
impact to eelgrass would require mitigation at a 1.2:1 ratio, per the Southern California Eelgrass
Mitigation Policy.
As long as you comply with the general permit conditions of RGP No. 54 and the Special
Condition, an individual permit is not required. This letter of verification is valid until
July 24, 2005, when RGP No. 54 will expire. A general permit does not grant any property
rights exclusive privileges. Also, it does not authorize any injury to the property or rights of
others or authorize interference with any existing or proposed Federal project. Furthermore, it
does not obviate the need to obtain other Federal, State, or local authorizations required by law.

Guys: There are good sized patches of eelgrass on either side of 28 HI, (between 27 and 28, and between 28 and 29
slips). We also noted extensive amounts of trash dumped on the bottom between 27 and 28 Harbor Island, on
the inside edges of the docks. We did not find eelgrass directly
underneath the dock, but within 15 feet of the dock. Also, small patches of eelgrass within the 27 HI slip.
Hope this helps. (I used California Grid Coordinates on the City site to check our positions on the eelgrass maps.)

any development occurring must cease until a coastal development permit is obtained or any discrepancy is
resolved in writing.

PROPOSED DEVELOPMENT: Replacing an existing 12' x 48' float and three (3) 12' guide piles with a new
"U' shaped dock consisting of two (2) 5' x 51' fingers and.a 4' x 30' backwalk, installing three (3) new 14"
guide piles, replacing, an 'existing 3' x 22' gangway with a new 3' x 24' gangway, shortening the existing pier
from 10'. x 28' to UY x 1.4',and replacing two (2) existing 144' 'T" piles with two (2) now 14" "T' piles. No
work Will be d6ne . on th . 6 existing bulkhead and the floating dock will only . be used for boating related
purposes.
RATIONALE: The subject site is a lot located between the first public road and the sea and is a bayfront lot.
The subject site is also located in the locked gate community of Harbor Island in the City of Newport Beach.
No public access currently exists through the site. However, the project will have no impacts on existing
coastal access. Public access to the harbor exists in the area across the channel from the Harbor Island
community along the public walkways on Lido Island and Balboa Island. An inspection by the City of
Newport Beach Fire and Marine Dep artment states that no del grass is present within 15' of the project area,
thus no eel grass will be impacted by the proposed project. In addition, the Regional Water Quality Control
Board has determined that the pr o0osed project will not adve rsely impact w . ater quality if standard
construction methods and materials are used. The proposed project design is compatible with the character
of surrounding development and does not have any negative affects on visual or coastal resources, public
recreation or coastal access. Also, the proposed development will not prejudice the City's ability to prepare a
Certified Local Coastal Program and is consistent with the land use designation in the City's certified Land
Use Plan, past Commission actions in the area and Chapter Three policies of the Coastal Act.
This waiver will not become effective until reported to the Commission at their february 13-16, 2001 meeting
and the site of the proposed development has been appropriately noticed, pursuant to 1 3054(b) of the
California Code of Regulations. The enclosed Notice Card shall remain posted at the site until the waiver has
been validated and no less than seven days prior to the Commission hearing. If four (4) Commissioners object
to this waiver of permit requirements, a coastal dbvelopmert permit will be required.

the provisions of Section 10 of the Rivers and Harbors Act of March 3,1899 (33 U.S.C. 403), you
are hereby authorized to modify an existing dock located just bayward of 28 Harbor Island in
Newp6rt Bay in the City of Newport Beach, Orange County, California, as shown on the enclosed
drawings. The proposal does not require any dredging or discharge of fill in waters of the United
States and will not impact eelgrass resources.
The owner or authorized responsible official must sign and date all copies of d -Lis Letter of
Permission (LOP) indicating that he/she agrees to the work as described and will comply with all
conditions. One of the signed. copies of this Letter of Permission must be returned to the Corps of
Engineers (a pre -addressed envelope is enclosed). In addition, please use the two attached
postcards to notify this office as to the dates of commencement (within 10 days prior to the start of
construction) and completion of the activity (within 10 days following the end of construction).

The structure was inspected on 5-24-79 at.which time it was determined
that the following deficiencies exist:

Structural deficiencies must be corrected..." A permit for this work

The electrical and/or plumbing problems noted above have been forwarded
to the Community Development Department. They will make a field inspection
and forward the results to the Marine Department.
If deficiencies exist, the property owner will be notified of the need for
corrections. A building permit for this work will be required from the
Community Development Department.

4. GENERAL PROVISIONS FOR HARBOR PERMITS
A. Acceptance of Provisions: Itis understood and agreed by the Permittee
that the doing of any work under the permit shall constitute an acceptance
of all the provisions.
B.- Permit from Other Agencies: The party or parties to whom the permit is
issued shall, whenever the same is require& by law, secure the written
order or consent to any work hereunder from the U. S. Corps of Engineers
or any other public body having jurisdiction, and the permit shall be
suspended in operation unless and until such order or consent is obtained.
C. Transferring Permit: The permit is not transferable without the written
consent of the City of Newport Beach.
*D. Inspection: The work shall be subject to the supervision and approval of
the Marine Department.
E. Protection of Traffic: Adequate provisions shall be made for the protection
of the traveling public. Barricades shall be placed on streets, with lights
at night, also flagmen employed, all as may be required by the particular
work in progress.
The Permittee shall not attempt to forbid the full and free.use by the public
of all navigable waters at or adjacent to the work or structure. If the
display of lights and signals on any work hereby authorized is not otherwise
provided by law, such lights and signals, as may be prescribed by Bureau of
Light Houses, Department of Commerce, shall be installed and maintained at
the expense of the Permittee.
Structures shall be so constructed as not to obstruct, interfere with or
prevent the free use or passage of any sidewalks, street, alley, public
way or navigable channel.
F . Liability for Damages: The Permittee is responsible for all liability for
personal injury or property damage which may arise out of work herein
permitted, or which may arise out of the use or possession of said works,
and in the event any claim is made against the City of Newport Beach or
any department, officer, or employee thereof, though, by reasons of, or
in connection with such work, permittee shall defend, indemnify and hold
them and each of them, harmless from such claim.
G. Revocation of Permit: The rights given under this permit are permissive
only and the City of Newport Beach reserves full right, power and authority
to revoke this permit at any time. In the event the Permittee fails to
remove said works within the time specified, then the Marine Safety Depart-
ment shall have the right to immediately remove same at the cost and expense
of the Permittee.
H. Repairs: The Permittee shall keep the structures in good repair at all
times. Failure to repair, when written notice has been given by the
Marine Department, shall be cause for the revocation of the permit.

HARBOR PERMIT POLICIES -
I. Pollution Control: The Permittee shall maintain the area delineated on
the harbor permit free and clear from beached or floating rubbish, debris
or litter at all times. Adequate safeguards shall be maintained by the
Permittee to avert any other type of pollution of Newport Harbor from
recreational and/or commercial use of the tidelands. Failure to comply
with the provisions of this section shall be cause, after written notice
has been given to the Permittee by the City, for the revocation of the
permit. When unusual circumstances arise with respect to the collection
of debris or litter, the City Manager may authorize by the use of City
forces or by contract the' removal of said debris.
J. Rights to impose rental or other charges: The approval of the foregoing
permit by the City of Newport Beach shall not constitute a waiver of any
rights which it may now have or hereafter have to impose rental or other
charges in conjunction with the maintenance of the proposed facility and
user of the same. The imposing of tidelands rental, or use, fees shall
not be extended to include private residential piers and slips, constructed
and used solely by the abutting uplands owner for recreational purposes,
unless otherwise directed by State Mandate.
*K. In those areas of the harbor where the piers and floats are bayward of
residential zoned areas and are reserved for the occupants of the
abutting upland property, liveaboards shall not be permitted.
SAFETY REQUIREMENTS
A. All commercially operated boat docking facilities shall be equipped with
fire fighting facilities as specified by the Fire Chief of the City of
Newport Beach.
B. Any electrical service upon any pier, dock, or float shall be installed
under a permit obtained from the City of Newport Beach Community Development
Department.
C. Any domestic water service upon any pier, dock or float shall be installed
under a permit obtained from the City of Newport Beach Community Development
Department.

Recommendation
If desired, approve the Maintenance Dredging Harbor Permit
applications.
Discussion
These applications require City Council approval under the conditions
of approval of the City of Newport Beach "blanket'! permit for main--
tenance dredging issued on February 12, 1974, by the U. S. Army Corp's
of Engineers.
The locations and applicants of the proposed maintenance dredging
applications are:
1000 W. Bay Avenue - Mr. Al Schwab
28 Harbor Island - Mr. John Bond
The staff has reviewed the proposed dredging and have determined that
the work -to be done is within the parameters of the Corps of Engineers
permit. There is no anticipated adverse affect on proximity beaches
or contiguous bulkheads.
Shellmaker, . Inc., the dredging contractor, will minimize turbidity
as much as is possible and will barge the dredged material to the
Environmental Protection Agency's designated disposal site, four
miles at sea.
