Shellmaker. The sample consists of a Sandy Silt (SM): dark yellowish brown to black
(1 OYR 4/6-2/1); saturated; with abundant shells and shell fragments. The sample was
obtained from the Elliott Residence, 23 Harbor Isand, Newport Beach at a depth of -5 to
-8 feet MLLW.

the terms and conditions of Coastal Development Permit 5-99-282. Any change in the project may
cause it to lose its status as consistent with CC -078-99 and/or CDP 5-99-282. This certification is
based on information provided by the recipient of this letter. If, at a later date, this information is
found to be incorrect or incomplete, this letter will become invalid, and any development occurring

This is in reply to your application dated October 18, 2001, for a Department of the Army
Pen -nit to perform maintenance dredging bayside of the Richard Elliot residence at 23 Harbor
Island in Newport Bay (Newport Beach, Orange County, California), and ocean deposition of
540 cubic yards of dredged material, impacting approximately 0.04 acre of waters of the U.S.
Based on the information you have provided, the Corps of Engineers has determined that
your proposed activity complies with the terms and conditions of Regional General Permit
(RGP) No. 54.
As long as you comply with the general permit conditions of RGP No. 54, an individual
permit is not required. This letter of verification is valid until July 24, 2005, when RGP No. 54
will expire. A general permit does not grant any property rights exclusive privileges. Also, it
does not authorize any injury to the property or rights of others or authorize interference with
any existing or proposed Federal project. Furthermore, it does not obviate the need to obtain
other Federal, State, or local authorizations required by law.

Recommendation
If desired, approve the Maintenance Dredging Harbor P ermit Applications.
Discussion
This application.requires City Council approval under the conditions of
approval of the City.of Newport Beach "blanket" permit for maintenance
dredging issued on February 12, 1974, by the U. S. Army Corps of Engineers.
The locations and applicants for the proposed maintenance dredging are:
110-1304 Louis Hahn, 1304 E. Balboa Blvd.
135-121 William Hadley, 121 Harbor Island Drive
144-23 Richard Nabers, #23 Harbor Island
258-305 Peter Vail, 305 S. Bayfront
The staff has reviewed the proposed dredging and has determined that the
work to be done is within the parameters of the Corps of Engineers permit.
There is no anticipated adverse affect on proximity beaches or contigous
bulkheads.
Shellmaker, Inc., the dredging contractor, will minimize turbidity as much
as is possible and will barge the dredged material to the Environmental
Protection Agency's designated disposal site, four miles at sea.

ACTIVITY: Install a new seawall in front of an existing deteriorated seawall,
and modify an existing dock at 23 Harbor Island, Lo t 23, Tract 802, in Newport
Bay, Pacific Ocean, City of Newport Beach, County of Orange, California, as
shown on the drawing accompanying this notice.
PURPOSE AND USE: To protect private property against beach erosion and to
provide larger docking facilities.
FEDERAL,, STATE AND LOCAL AUTHORIZATIONS: Approvals have been received from
the City of Newport Beach and the Water Quality Control Board. Approval will
also be required from the California Coastal Zone Conservation Commission,
prior to issuing permit.
ENVIRONMENTAL IMPACT: This office does not intend to prepare an Environ-
mental Impact Statement on this activity unless significant detrimental
effects are brought to our attention.
PUBLIC HEARING: Any person who has an interest which may be adversely
affected by the issuance of a permit may request a public hearing. The
request must be submitted in writing to the District Engineer within ,
thirty (30) days of the date of this notice and must clearly set forth the
interest which may be affected and the manner in which the interest may be
affected by the activity. Activities under Section 10 3 of the Marine
Protection, Research and Sanctuaries Act (PL 92-532) and Section 404 of
the Federal Water Pollution Control Act (PL 92-500) will be considered in
conjunction with this notification.
CRITERIA: Your written comments or objections, should include t he number and
date of this notice and must reach this office within thirty (30) calendar
days. The dec ision whether to issue a permit will be based on an evaluation
of the probable impact of the activity on the public interest. That decision
will reflect the national concern for both protection and utilization of
important resources. The benefit which reasonably_may be expected to accrue

DISCUSSION
This application is being brought to the Council because of the
construction of two groins'beyond the U. S. Bulkhead Line.
The Joint Harbor Committee at their August 26 meeting reviewed the'
application and recommended that the City Council approve the permit.
The applicant desires approval of the new bulkhead beca use the exist -
in ' g seawall installed in the early 1940's is of minimal length and
is in a deteriorated condition with reinforcing steel exposed, also
at high tide water overtops the walls. The new wall will be constructed
at a proper elevation to prevent overtopping and will provide adequate
protection for the upland property. The five foot bayward location
will allow the contractor to install the new wall without undue demoli-
tion and damage to -the property. The proposed location will still be
landward of the U. S. Bulkhead Line. The groins will be installed to
provide protection for the adjoining properties in the event future
dredging is required. Dredging is not required at this time. Groins
have been installed on Harbor Island in the past, therefore, this
installation does have some precedent. The groins have had no appar-
ent adverse affect on beaches.around the island.

Discussion
