Re: Harbor Permit 145-19 for property at 19'Harbor Island
Dear Mr. Hausman:
David Harshbarger., the director..of' the Marine Department, has
asked that I respond to your letter of.Ja.nuary 14, 1987.
The problem you describe in your letter can be rectified by
dredging in'the area where the sand bar has been built up.
For beach disposal the City of Newport"Beach has a'blanket
permit from the'U.S. Army Corps of Engineers and the California
Coastal'Commissi.on for dredging and beach disI. posal within the
City .,.of Newport. "'Beach.
Both dredging contractors in the harbor, Newport Dredging at
644-0550 and Intra 'Coastal'Dredging at 675-1071 are familiar
with' the permit process .and can give you a bid for the
dredging to be doneand can handle the permit process for
you'if you so desire.
Hopefully the problem you .describe can:be handled by a small
dredging procedure and beach disposal of the sand somewhere in
the general area of your pier.:,'If.th'is.'is not the case,.ocean
disposal of the sand w111 .be r. equ it ed. and at thi s ' time there is
no permit for ocean disposal' within the City limits.
I hope this answers- your questions. If you have further questions
please.call me at 644-3044.
Sincerely,
Tony MeV

Dear Sir:
I am writing to you in the hopes that you can recommenG a
problem which appears to have been created by the new bulkhead tn.- -,as
been installed by our neighbor.
Luring the holidays, both myself and my brother-in-law tried to enter
our slip at #19 Harbor Island in our electric boats. However, because
it seems as though a sand bar has been created by the newly installed
bulkhead, both times, we ran aground.
Perhaps, you can suggest a recommendation, or the best way to resolve
this problem.

Re: Administrative Permit No. 5-84-204 (Construction of single family
residence at 19 Harbor Island, Newport Beach, CA )
Dear Mr. Josephs:
I have been contacted by Mr. Dennis O'Neil, who represents the
applicant for the above referenced coastal development permit.
Mr. O'Nei>1 advises me that as a condition of approval of the coastal
permit, the applicant is required to cooperate with the City and State
regarding the use of materials excavated from the site for beach replenish-
ment in our area. Mr. O'Neil has indicated there will be approximately
1100 cubic yards of earth excavated from No. 19 Harbor Island construction
site..
With regard to the aforementioned coastal development permit condition,
please, be advised as follows: `The City of Newport Beach has numerous
locations along the ocean beaches, at Corona del Mar. State Beach, and on
Balboa Island which require sand replenishment from time to time. The
City can and will accept that portion of the sand excavated from No. 19
Harbor Island construction site if it is found to be suitable for beach
replenishment and if it is physically and practically feasible to carry
out such a procedure on'the selected beach sites.
This department will work with Mr.Harry Lawrence,Engineering Geologist
for the project, to insure that there will be compliance with .the conditions
of..zapproval of Permit No. 5-84-204. Should you require any further infor-
mation regarding this matter from the City of Newport Beach, please
contact me at 714-640-2156.

and the State Department of Parks and Recreation. Any

agencies. The applicant shall submit adequate analysis
of the excavated material to the Executive Director and
in consultation with the Scripps Institute shall determine
the suitability of the excavation material for beach replen-
ishment.
ADDITIONAL FINDINGS
Access. The Coastal Act in Sections 30210, 30211 and 30212
mated the provision of access for public to and along the
shore. The Commission carefully considers all new shoreline
development projects to ensure their consistency with Coastal
Act. Sections 30210, 30211 and 30212. With respect to the
currently proposed project the Commission finds that it is
not feasible to require the provision of public access, The
Commission notes that there is no usable beach area adjacent
to the proposed project site. In addition the roadway serving
the project site is private and therefore there is no means
by which the public can gain access to the site. Thus, the
Commission finds that there are unique circumstances associated
with development of the -site that preclude the provision of
public access. However, the Commission also makes the express
finding that the approval of this project is no way intended to
serve as a precedent in its consideration of other projects for
consistency with the access provisions of the Coastal Act.

CITY OF NEWPORT BEACH
Marine Department
MAYOR AND CITY COUNCIL
Marine Department
AGENDA ITEM F-21
HARBOR PERMIT APPLICATION 145-19 BY RICHARD HAUSMAN
TO CONSTRUCT A NEW PIER AND FLOAT BAYWARD OF
#19 HARBOR'ISLIAND
If desired, approve the application, subject to the following conditions:
1. That the applicant apply for a permit from the Army Corps of Engineers,
2. That the applicant apply for a permit from the State Coastal Commission,
3. That the applicant apply for a permit from the County of Orange.
Discussion:
This permit application is before the City Council as required by Section 5.B.
of the Harbor Permit Policies, which states:
5.B. "Prior approval of the City Council will be required before the
Marine Department may issue any permit that does not conform to the
standard harbor drawings andthe adopted Harbor Permit Policies."
As the applicant's drawing indicates, the construction of .his pier and float
would potentially restrict the access to the float at #20 Harbor Isl.46d.
City Staff discussed this potential problem with both the applicant and the
current'permittee of #20 Harbor Island. The permittee at #20 has elected
not to oppose the design of the applicant slip at #19, and if it is necessary
in the future to reconfigure his slip to improve his access, he would do so
at his own expense.
This course of action is consistent with conditions placed on the permit for
#20 Harbor Island, when it was originally issued, which stated: "In the
future, the applicant may be requested to remove or relocate the proposed
floating dock, because the installation requires the use of a portion of the
water area fronting on Lot 19 for access into the dock. This access area does
restrict the size of the water area that would normally be available to the
owner of Lot 19 for pier and float improvements. If so requested in writing
by the Permittor, the applicant agrees to remove or relocate the installation
without delay at his expense".

Res Richard Hausman Pier Permit Application
(No. 19 Harbor Island, Newport Beach)
Dear Mr. Shattuck:
This will confirm a telephone conversation between John
Besselo of your company and Tony Melum, the Newport Beach
Tidelands Administrator regarding the application of Mr.
Richard Hausman for a pier and boat slip permit bayward of his
property at No. 19 Harbor Island Drive. It is my understanding
that you are fully aware that the proposed construction and
location of the Hausman pier will severely impair the access to
your existing pier and slip at No. 20 Harbor Island. It is
further acknowledged that it will likely be necessary to
relocate your pier in compliance with the condition imposed by
the City of Newport Beach on the original pier permit
application for your pier at such time as and when Mr.
Hausman's pier and boat slip are installed.
Having the above understanding of the situation in mind,
Mr. Besselo on your behalf, has advised Mr. Melum that you have
elected not to relocate your pier at this time pending an
evaluation of the extent of the need for such relocation after
the Hausman pier is constructed. If for any reason I have not
accurately reflected your position with regard to this matter
in this letter, would you please contact Mr. Tony Melum at
(714) 640-2156 on or before April 12, 1984 and so advise
Mr. William Shattuck
April 6, 1984
Page 2
Mr. Melum of any inaccuracy. Unless Mr. Melum hears from you
to the contrary on or before April 12, 1984, I am advised that
the city will proceed in processing Mr. Hausman's request for a
pier and boat slip application.
Very t ly yours,

Re: Hausman Pier Permit - No. 19 Harbor Island
Dear Mr. Besselo:
Enclosed for your information is a copy of the Newport
Beach Joint Harbor Committee Minutes of June 9, 1970. In
particular, see page 2, "Application for Pier Permit - John
MacLeod, Harbor Island," which makes specific reference to
the requirement to relocate the pier bayward of No. 20
Harbor Island if requested by the City. I have also
enclosed a copy of the profile map showing the proposed
location of the Hausman pier and slip in relation to the
existing Shattuck pier and slip.
It is my understanding in my last conversation with
you regarding this matter, that Mr. Shattuck would prefer
to wait until the Hausman pier is constructed before he
makes a decision on relocating his pier. Unfortunately, I
don't believe that the City Tidelands Administrator will
process Mr. Hausman's application for a pier permit until
the access issue for the Shattuck slip has been resolved.
In the absence of some mutual agreement between the two
property owners, the City may have no alternative but to
have this matter reviewed by a committee of the City
Council. In light of the condition placed on the MacLeod
pier permit, the City will in all likelihood officially
request Mr. Shattuck to remove or relocate his pier.
Mr. John Bessolo
April 4, 1984

I am still hopeful that this latter alternative will
not become necessary. Any assistance you can provide in
resolving this matter will be appreciated.

Re: Richard Hausman Pier Permit --No. 19 Harbor Island
Dear Mr. Shattuck:
I have been retained by Mr. Richard Hausman to repre-
sent him in obtaining various agency permits needed as a
prerequisite to the construction of his new home and pier
on Lot 19, Harbor Island. Construction of the new boat
slip will interfere with the current access to your pier at
No. 20 Harbor Island.
It is my understanding that you have reached a mutual
agreement with Mr. Hausman regarding the relocation of your
pier so that both properties can make reasonable use of the
respective water rights adjacent to Lots 19 and 20. This
is consistent with the condition attached to the applica-
tion for the original pier permit at No. 20 Harbor Island.
For your information, I have included a copy of the June 9,
1970 minutes of the Newport Beach -Orange County Harbor
District Joint Harbor Committee which discusses this matter.
In order to process Mr. Hausman's request for a pier
permit with the City and County, it will be necessary for
you to indicate in writing to the Newport Beach Marine
Department that you will relocate the pier bayward of
Lot 20 so that Mr. Hausman's new pier and float improve-
ments will not restrict access to your pier. For your
convenience, I have drafted a suggested letter to Mr. Tony
Melum, the Newport Beach Tidelands Administrator, setting
forth your agreement with regard to the relocation of your
pier. On behalf of Mr. Hausman, I would like to thank you
for your cooperation and assistance in resolving this
matter.
Very kruly yours, r

The staff of the State Lands Commission has received your
letter dated February 7, 1984, and copies of the permit drawing
relative to the construction of your client's docking facilities
in Newport Bay.
This is to advise that the tide and submerged lands over
which the proposed project will extend are sovereign lands of

You should also apply to all other agencies having approval
authority.
This action does not constitute, nor shall it be construed

Re: Administrative Permit No. 5-84-204 (Construction
of Single Family Residence at No. 19 Harbor Island
Drive, Harbor Island, Newport Beach)
Dear Mr. Josephs:
I have been contacted by Mr. Dennis O'Neil, who repre-
sents the applicant for the above -referenced coastal develop-
ment permit. Mr. O'Neil advises me that as a condition of
approval of the coastal permit, the applicant is required to
cooperate with the City and State regarding the use of materials
excavated from the site for beach replenishment in ou ea.
Mr. O'Neil has indicated there will be approximately 11, 00
µ0
cubic yards of earth excavated from No. 19 Harbor Island
construction site.
With regard to the aforementioned coastal development
permit condition, please be advised as follows. The City of
Newport Beach has numerous locations along the ocean beaches,
at Corona del Mar State Beach, and on Balboa Island which
require sand replenishment from time to time. The City can
and will accept that portion of the sand excavated from No. 19
Harbor Island construction site if it is found to be suitable
for beach replenishment and it is physically and practically
feasible to carry out such a procedure on the selected beach
sites.
This department will work with Mr. Harry Lawrence,
Engineering Geologist for the project, to insure that there
will be compliance with the condition of approval of Permit
No. 5-84-204. Should you require any further information
regarding this matter from the City of Newport Beach, please
contact me at (714) 640-2156.
Very truly yours,

A• HARBOR ISLAND is located in lower Newport Bay within the i

B., The tidelands subject:to-this Lease are held in trust by the County at

C. Over the years, certain private yard improvements appurtenant to the
residences have been developed which encroach into portions of the above described tide
lands which, as the result of either natural or artificial occurrences, are today dry

to the tidelands held in trust by the -County have, to different degrees, such encroa ca-

It is the intent of the parties to cooperate in all reasonable efforts

4 enactment of such legislation.
5 NOW, THEREFORE, incorporating the recitals set forth above, it is mutually
6 agreed and understood as follows:
7 1. Description of Lease Premises
8 The Lease Premises are those filled tidelands lying between the extension
9 of the sidelines of Lot 0t3 of Tract 802 from the adjudicated mean high tide line to
10 the United States bulkhead line, excepting therefrom those lands lying below the existing
11 mean high tide line. Use of water covered areas is not provided for herein.

27 the State Lands Commission.
28 (3) The appraiser's determination of fair value shall be subject to

8 (5) All arangements to hire said appraiser shall be made by County.
9 The County shall pay one-half and Lessee shall pay a pro -rata share of the

NEWPORT BEACH - ORANGE COUNTY HARBOR DISTRICT
JOINT HARBOR COMMITTEE
June 9, 1970
Mr. Dawes
A meeting of the Joint Harbor Committee was held in the Harbor District
Conference Room beginning with election of officers.
MOTION: It was moved by Commissioner Grubb and seconded
by Commissioner Woolley that Councilman Carl Kymla
be elected as Chairman of the Joint Harbor Com-
mittee. The motion was unanimously carried.
Present: Commissioners Grubb, Woolley; Councilman Kymla
Staff Present: Klinger, Ballinger, Oberg, Wingard; Dawes
Others Present: Phil Tozier
The meeting was officially called to order by Chairman Kymla at 11:05 A.M
ORDINANCE REGULATING WATER ORIENTED COMMERCIAL ACTIVITIES
n draft ordinance of the City of Newport Beach adding Chapter 17.41 entitled,
"Commercial Activities on the Waters of Newport Harbor",to Title 17 of the
;ewport Beach Municipal Code relating to harbor regulations was presented to
the Joint Harbor Committee by George Dawes.
A request by Mr. Tozier for a use permit to serve alcoholic beverages and
live music for dancing on a commercially operated boat open to the public on
a regular basis in Newport Harbor which had been presented to the Newport
Beach City Council and referred to City staff to draft an ordinance to regu-
late some control of commercial activities on the waters of Newport Harbor
was reviewed by the Joint Harbor Committee. Discussion was held regarding
the draft ordinance and the following changes were suggested:
Page 3, Section 17.41.050 Public Hearing; Notice of Hearing should also
include the Orange County Harbor District.
Page 4, Section 17.41.060 Grounds for Issuance or Denial of Permit should
include coordination with the Orange County Harbor District and
brought before review by the Joint Harbor Committee before deter-
mining whether to issue or deny the requested permit.
Page 6, Section 17.41.090 Revocation, paragraph (d) should also include the
"County of Orange".
Page 6, Section 17.41.110 Public Liability Insurance should be changed to
read X100,000 each incident under general liability insurance.
Page 7, Section 17.41.110 should be amended to include a clause that agencies
involved will be held harmless in case of any liability.
Staff was instructed to prepare these changes and amendments and provide this
ic
information to the City Attorney for integration into the ordinance to present
before the City Council.
ELIMINATION OF PIER LIGHTS SIMILAR TO THOSE OF VESSELS
Harbor Master Albert Oberg reported receiving complaints regarding several
property owners placing red or green lights or spotlights on their pilings
similar to those on vessels which is creating a hazard to navigation in the
harbor. City and District staff were instructed to draft an ordinance for
review by the Joint Harbor Committee.
DISCUSSION OF DREDGING PERMIT PROCEDURES - NEWPORT HARBOR
District staff requested the Joint. Harbor Committee to adopt policy that any
dredging or placing of fill material on beaches within the harbor be reviewed
by the Committee prior to approval by either the City or District.
City and District staffs were directed to work together on proper wordage in
drafting policy for dredging permit procedures for further review by the Joint
Harbor Committee.
MOTION: It was moved by Commissioner Grubb that City and
District work jointly to draft a policy on dredging
permit procedures for review by the Joint Harbor
Committee at its next meeting. Seconded by Commis-
sioner Woolley and unanimously carried.
APPLICATION FOR PIER PERMIT (COMMERCIAL) - BALBOA YACHT CLUB
Mr. Ballinger presented an application for commercial use of County tidelands
from the Balboa Yacht Club for installing used floating docks to support addi-
tional dinghy storage racks.
MOTION: Commissioner Grubb moved that the Balboa Yacht Club
application be favorably recommended to the Harbor
Commission subject to the following condition:
The salvaged floating docks to be installed are,
upon completion, to be comparable in appearance to
new construction. Seconded by Commissioner Woolley
and unanimously carried.
APPLICATION FOR PIER PERMIT (NON-COMMERCIAL) - JOHN MAC LEOD, HARBOR ISLAND
An application for non-commercial use of County tidelands was made by Mr. John
MacLeod for rebuilding an existing boat slip to accommodate a larger vessel.
The boat slip, as requested, has its longitudinal axis parallel with the shore-
line. In order to use the slip, a portion of the tidelands fronting on the
adjac nt- lot must be used for maneuvering the boat into the slip. The District
staff recommended approval subject to the following special condition:
In the future, the applicant may be requested to remove or
relocate the proposed floating dock, because the installation
requires the use of a portion of the water area fronting on
2.
Lot 19 for access into the dock. This access area does
restrict the size of the water area that would normally
be available to the Owner of Lot 19 for pier and float
improvements. If so requested in writing by the Permittor,
the applicant agrees to remove.or relocate the installation
without delay at his expense.
City staff said the City permit would be issued subject to the same condition.
MOTION: Commissioner Grubb moved that the application
be favorably recommended to the Harbor Commis-
sion subject to the Special Condition suggested
by staff. Seconded by Commissioner Woolley and
unanimously carried.
MISCELLANEOUS BUSINESS
Mr. Ballinger reported a conversation with Dr. Wheeler North from Cal Tech.
regarding plans to remove some kelp presently growing in the entrance channel
for transplanting outside of the harbor area. A permit for diving in the
channel is required, and City staff stated an application could be processed.
Chairman Kymla stated, for the information of the Joint Harbor Committee, that
1. City of Newport Beach has gone on record to again support the
retention of the Harbor District. A letter has been written to
Senator Whetmore, and Councilman Rogers will appear before the
State Legislature on Thursday morning, June 11.
2. Water quality studies in Newport Harbor will be performed for
about 10 days by the State and County Health Departments beginning
July 1, 1970. This is a continuation of water quality surveillance
program. The last 10 -day study was made in 1968.
3. A proposed Joint Powers Agreement, which has been in the offing for
several years between City of Newport Beach and the Orange County
Harbor District, has been referred to the Harbor and Tidelands
Administrator who is working on this agreement. Chairman Kymla
requested that this item appear regularly on the Joint Harbor Com-
mittee agenda until it is completed and signed.
There being no further business, the meeting adjourned at 12 noon.
K. C. KLINGER, Secretary
Joint Harbor Committee

Attn: Tom Rossmiller
Re: Simon Residence, #19 Harbor Island
Dear Tom,
The dock at this address has a total area of 1;.778 square feet. Costs for a new wood
dock range from $35.00 to $45.00 per square foot.
There are 7 guide piles for the dock. Present costs per pile are approximately
$2,500.00 per pile.
Normal wooden ramp costs are as follows:
24' - $2,200,00
30'- $3,200.00
33' - $3,800, 00
This job requires a 33' ramp..
My agreement with the owners is to replace a 10' x 14` wood pier platform with a
concrete .pier platform with same dimensions and set a customer supplied ramp.
Originally we were going to replace the 2 - 12" square pier support piles but as the
existing piles are 12" prestressed and in good condition they will be left in place and
used.
The value of new wood construction for this whole system is:
Floating dock -1,778 sq. ft. x $45.00/sq. ft. $80,010.00
7 prestressed dock piles @ $2,500.00/each $17,500.00
2 pier support piles @ $2,000.00/each (they are shorter
than dock piles) $4,000.00
1 33' ramp $3,800.00
1 pier platform 10' x 14' - 140 sq. ft. @ $35.00/sq. ft $4:900.00
Total Value $110,210.00
We have contracted to cast and set the pier deck section, furnish and set 2 pier piles
and a install customer supplied ramp for $9,046.00

General Engineering Contractors/License No. 561434/Marine Construction and Dredging
As we do not need to replace the piles I am subtracting $4,000.00 from my price
Leaving a balance of $5,040.00. Add this to a ramp cost of $3,800.00 for a total of
$8,846.00.
This is $.1 %Q of the value of the complete system, far below the 20% which I understand
is the threshold for going to the Coastal Commission.
What do we need to do to get this project moving?
If you have any questions, please call.
Sincerely,
Loren C. Miller
Vice President
