All materials excavated from the site if found suitable for beach replenishment shall be placed upon the beach. the location of deposition shall be determined in consul- tation with the City of Newport Beach Parks and Beaches and the State Department of Parks and Recreation. Any modification to such location shall be determined in the field in consultation with local representatives of said agencies. The applicant shall submit adequate analysis of the excavated material to the Executive Director and in consultation with the Scripps Institute shall determine the suitability of the excavation material for beach replen- ishment. ADDITIONAL FINDINGS Access. The Coastal Act in Sections 30210, 30211 and 30212 mated the provision of access for public to and along the shore. The Commission carefully considers all new shoreline development projects to ensure their consistency with Coastal Act. Sections 30210, 30211 and 30212. With respect to the currently proposed project the Commission finds that it is not feasible to require the provision of public access, The Commission notes that there is no usable beach area adjacent to the proposed project site. In addition the roadway serving the project site is private and therefore there is no means by which the public can gain access to the site. Thus, the Commission finds that there are unique circumstances associated with development of the -site that preclude the provision of public access. However, the Commission also makes the express finding that the approval of this project is no way intended to serve as a precedent in its consideration of other projects for consistency with the access provisions of the Coastal Act. It is my understanding in my last conversation with you regarding this matter, that Mr. Shattuck would prefer to wait until the Hausman pier is constructed before he makes a decision on relocating his pier. Unfortunately, I don't believe that the City Tidelands Administrator will process Mr. Hausman's application for a pier permit until the access issue for the Shattuck slip has been resolved. In the absence of some mutual agreement between the two property owners, the City may have no alternative but to have this matter reviewed by a committee of the City Council. In light of the condition placed on the MacLeod pier permit, the City will in all likelihood officially request Mr. Shattuck to remove or relocate his pier. Description of Lease Premises 8 The Lease Premises are those filled tidelands lying between the extension 9 of the sidelines of Lot 0t3 of Tract 802 from the adjudicated mean high tide line to 10 the United States bulkhead line, excepting therefrom those lands lying below the existing 11 mean high tide line. Use of water covered areas is not provided for herein. 12 2. Term 13 The term of this Lease shall be five (5) years, beginning on the date. this 14 agreement is executed by the County and ending five years from that date, unless sooner 15 terminated as hereinafter provided in this Lease. 16 3. Consideration 17 (a) Rental 17hall pay as annual rent an amount equal to the fair value 18 (1) Lessee s 19 of Lessee's exclusive, private use of the Lease Premises. It is understood by ereunder shall include rent attributable to 20 the parties that consideration h Premises from January 1, 1981, to the begin - 21 Lessee's occupation of the Lease 22 ning date of this Lease. 23 (2) Fair value shall be determined by a real estate appraiser mutuall' 24 selected by the County and the Harbor Island Community Association, and shall b 25 based on criteria set forth in instructions to the appraiser which shall be 26 approved by the County, the Harbor Island Community Association and staff of 27 the State Lands Commission. 28 (3) The appraiser's determination of fair value shall be subject to -2- t.. review and approval by the State Lands Commission or its staff and thereupon 2 shall be binding on the County and Lessee for purposes of setting the annual 3 rent. - 4 (4) It is expressly acknowledged by the County and Lessee that the 5appraisal provided for herein shall not be indicative of the fair market value 6 of the tidelands for purposes of a sale or exchange and skull not be used or 7 interpreted for any purpose other than to set the consideration for this Lease. 8 (5) All arangements to hire said appraiser shall be made by County. 9 The County shall pay one-half and Lessee shall pay a pro -rata share of the 10 remaining one-half of the cost of said appraiser. 11 (b) Adjusted Annual Rent The rent which has accrued between January 1, 1981, and the beginning 32 13 date of this Lease shall be paid by Lessee by adding this amount to the total rent due 14 during the 5 year term of the Lease and dividing by 5. This adjusted annual rent allows 15 the Lessee to pay the rent which has accrued prior to the commencement of the Lease Term 16 over the life of the Lease. As consideration for Lessee's paying the full amount of rent 17 retroactive to January 1, 1981, County agrees to waive collection of interest heretofore 18 and hereafter accruing on this sum. County will compute the adjusted annual rent and 19 will notify Lessee of the amount due hereunder. 20 (c) When Due 21 Lessee shall pay the adjusted annual rent on or before the beginning 22 date of this Lease and on or before each anniversary of its beginning date during each 23 year of the Lease Term. Santa Ana, California 92702 28 The designated place of payment may be changed at any time by County upon ten (10) days -3- written notice to Lessee. (d) Credit for Fees Paid Lessee shall received a credit against the adjusted annual rent in the amount of any fees paid by Lessee to County on or after January 1, 1981, to obtain a tideland encroachment permit. (e) Penalty and Interest If money, payable to the County as a condition of this Lease, is not he due date, a late charge of One Percent (1!) of the paid within ten (10) days after t payment due and unpaid plus Twenty Five Dollars ($25) shall be added to the payment and the total sum shall become immediately due and payable to,the County. An additional charge of One Percent (1X) of said payment, excluding late charges, shall be added for each additional month that ."said payment remains unpaid. (f) No Refunds The parties agree that no payment properly made by Lessee pursuant to this Lease is to be refunded to Lessee in the event legislation is obtained or for any other reason, except as provided in paragraph 11 hereto. 4. Land Use (a) Repairs and Maintenance Lessee shall, at his own expense, keep and maintain the Lease Premises and all improvements in good order and repair and safe condition. (b) Additions and Alterations (1) No additions or alterations other than non -permanent recreational and landscaping uses may be made of the Lease.Premises; (2) The placement of the following improvements shall constitute such non -permanent recreational and landscaping uses that may be made of the Lease Premises: (i) patios and decks; walks and steps, including dock access walks; -4- Vi (iii) planters and garden walls not exceeding ;i feet in height; (iv) benches; (v) statues; (vi) landscaping; (vii) sprinkler systems; and ,(viii) yard lighting. (b) Lessee recognizes and understands in accepting this Lease that it may be liable for a possessory interest tax imposed by a city or county on its leasehold interest and that its payment of such a tax shall not reduce the amount of consideration due County under this Lease and that County shall have no liability for the payment of such a tax. 7. Indemnity. (a) Neither County nor State shall be liable and Lessee shall indemnify, hold harmless and, at the option of County and State, defend Countand State, their y officers, agents, and employees against and for any and all liability, claims, damages of , occurring on the Lease Premises or improvements injuries 'of any kind and from any cause or arising out of or connected in any way with the issuance of this Lease. Default and Remedies (a) Default The occurrence of any one or more of the following events shall cons- titute'a default or breach of this Lease by Lessee: (1) Lessee's failure to make any payment of rental, or other Consideration as required under this Lease. (2) Lessee's failure to obtain or maintain liability insurance as required under this Lease. . r (3) Lessee's failure to observe or perform any other term, covenant or condition of this Lease to be observed or performed by the Lessee when -7- such failure shall continue for a period of sixty (60) days after County's giving written notice; however, if the nature of Lessee's default or breach is such that more than sixty (60) days are reasonably required for its cure. then Lessee shall not be deemed to be in default or breach if Lessee com- e mences such cure within such sixty (60) day period and diligently proceeds with such cure to completion. (b) Remedies In the event of a default or breach by Lessee and Lessee's failure to cure such default or breach, County may at any time and with or without notice do any more or more of the following: (1) Re-enter the Lease Premises, remove all persons and property and repossess and enjoy such premises. Lessee agrees to reimburse County for the reasonable costs of such removal. (2) Terminate this Lease and Lessee's right of possession of the Lease Premises. Such termination shall be effective upon County's giving written notice and upon receipt of such notice Lessee shall immediately surrender possession of the Lease Premises to County. (3) Maintain this Lease in full force and effect and recover any rental, or other consideration as they become due without terminating Lessee's right of possession regardless of whether Lessee shall have abandoned the Lease Premises. (4) Exercise any other right or remedy which County may have at law or in equity. 11. Termination (a) This agreement shall terminate as provided in paragraph 2 of this Lease, or sooner should State legislation be enacted and effective as the law governing i' and its terms fully implemented by the parties. the encroachments on the Lease Premises, (b) Should this Lease terminate prior to the expiration of its term as -8- I rovided in subsection (a), Lessee shall not be released from liability for any unpaid 2 but'accrued rent, including that rent which accrued between January 1, 1981, and the be - 3 ginning date of this Lease. r 4 _ (c) Should this Lease terminate prior to the expiration of its term as 5 provided in subsection (a), Lessee shall be entitled to a refund of the pro -rata, pro - 6 portion of the annual rent he has. paid in advance attributable to the months remaining 7 between the date of earlier termination of this Lease and the end of the year for which 8 such rent has been paid. 9 (d) Upon the earlier termination of this Lease as provided in subsection 10 (a), County shall compute the amount of any unpaid but accrued rent owed by Lessee, as 11 provided in subsection (b), offsetting from this sum the amount of any refund due Lessee, I 12 as provided in subsection (c), and Lessee shall pay this sum. If the computation deter- 13 mines that Lessee is owed a refund, County shall pay such refund. 14 12. Binding Effect 15 Each and all of the terms, agreements and conditions to this Lease shall 16 be binding upon and shall inure to the benefit of the respective heirs, personal repre- 17 sentatives, successors and assigns of the parties hereto. 18 13. Interpretation of Provisions 19 This Lease shall be construed according to its fair meaning and as if 20 prepared by both parties hereto. This Lease shall be construed in accordance with the 21 laws of the State of California in effect at the time of the execution of this Lease. 22 14. Amendment 23 Any alteration, change, or modification of or to this Lease, in order to 24 become effective, shall be made by a written instrument, and in each such instance' 25 executed on behalf of each party hereto. _ 26 15. Agreement. This Lease constitutes the entire understanding between the partit with respect to the subject matter hereof.. superseding all negotiations, prior discus- sions and preliminary agreements or understandings, written or oral. 17. Counterparts. This Lease, or any modifications thereof,., may be executed in counterparts and shall be valid and binding as .if all the parties' signatures were all on one document. - 18. Notice. All notices required to be given under this Lease shall be given in writing sent by United States. mail with postage prepaid to County at the offices of its Environmental Management Agency, Post Office Box 4048, Santa Ana, California 9270 4048, and to Lessee at the Harbor Island address specified on page 1 of this Lease. Lessee shall give County notice of any change in his name or address. Notwithstanding anything to the contrary contained in paragraph 3(c) of this agreement, it is agreed that the adjusted annual rent for the first lease year shall be due and payable by Lessee to Lessor within fifteen (15) days of receiving prior written notice from Lessor which notice shall set forth the amount of said adjusted annual rent. I Lessor shall provide Lessee with fifteen (15) days prior written notice of the date this agreement is to be executed in order to allow Lessee time to obtain the in- surance as provided in paragraph 8 of this agreement. 19. Consent -Cooperation. The consent required by paragraph 9 of this agreement shall not unreasonably be withheld and County (Director/EtLQ shall take appropriate action within thirty (30) days after. receiving Lessee's request to consent. MOTION: It was moved by Commissioner Grubb and seconded by Commissioner Woolley that Councilman Carl Kymla be elected as Chairman of the Joint Harbor Com- mittee. The motion was unanimously carried. Present: Commissioners Grubb, Woolley; Councilman Kymla Staff Present: Klinger, Ballinger, Oberg, Wingard; Dawes Others Present: Phil Tozier The meeting was officially called to order by Chairman Kymla at 11:05 A.M ORDINANCE REGULATING WATER ORIENTED COMMERCIAL ACTIVITIES n draft ordinance of the City of Newport Beach adding Chapter 17.41 entitled, "Commercial Activities on the Waters of Newport Harbor",to Title 17 of the ;�ewport Beach Municipal Code relating to harbor regulations was presented to the Joint Harbor Committee by George Dawes. A request by Mr. Tozier for a use permit to serve alcoholic beverages and live music for dancing on a commercially operated boat open to the public on a regular basis in Newport Harbor which had been presented to the Newport Beach City Council and referred to City staff to draft an ordinance to regu- late some control of commercial activities on the waters of Newport Harbor was reviewed by the Joint Harbor Committee. Discussion was held regarding the draft ordinance and the following changes were suggested: Page 3, Section 17.41.050 Public Hearing; Notice of Hearing should also include the Orange County Harbor District. Page 4, Section 17.41.060 Grounds for Issuance or Denial of Permit should include coordination with the Orange County Harbor District and brought before review by the Joint Harbor Committee before deter- mining whether to issue or deny the requested permit. Page 6, Section 17.41.090 Revocation, paragraph (d) should also include the "County of Orange". Page 6, Section 17.41.110 Public Liability Insurance should be changed to read X100,000 each incident under general liability insurance. Page 7, Section 17.41.110 should be amended to include a clause that agencies involved will be held harmless in case of any liability. Staff was instructed to prepare these changes and amendments and provide this ic information to the City Attorney for integration into the ordinance to present before the City Council. ELIMINATION OF PIER LIGHTS SIMILAR TO THOSE OF VESSELS Harbor Master Albert Oberg reported receiving complaints regarding several property owners placing red or green lights or spotlights on their pilings similar to those on vessels which is creating a hazard to navigation in the harbor. City and District staff were instructed to draft an ordinance for review by the Joint Harbor Committee. DISCUSSION OF DREDGING PERMIT PROCEDURES - NEWPORT HARBOR District staff requested the Joint. Harbor Committee to adopt policy that any dredging or placing of fill material on beaches within the harbor be reviewed by the Committee prior to approval by either the City or District. City and District staffs were directed to work together on proper wordage in drafting policy for dredging permit procedures for further review by the Joint Harbor Committee. MOTION: It was moved by Commissioner Grubb that City and District work jointly to draft a policy on dredging permit procedures for review by the Joint Harbor Committee at its next meeting. Seconded by Commis- sioner Woolley and unanimously carried. APPLICATION FOR PIER PERMIT (COMMERCIAL) - BALBOA YACHT CLUB Mr. Ballinger presented an application for commercial use of County tidelands from the Balboa Yacht Club for installing used floating docks to support addi- tional dinghy storage racks. MOTION: Commissioner Grubb moved that the Balboa Yacht Club application be favorably recommended to the Harbor Commission subject to the following condition: The salvaged floating docks to be installed are, upon completion, to be comparable in appearance to new construction. Seconded by Commissioner Woolley and unanimously carried. APPLICATION FOR PIER PERMIT (NON-COMMERCIAL) - JOHN MAC LEOD, HARBOR ISLAND An application for non-commercial use of County tidelands was made by Mr. John MacLeod for rebuilding an existing boat slip to accommodate a larger vessel. The boat slip, as requested, has its longitudinal axis parallel with the shore- line. In order to use the slip, a portion of the tidelands fronting on the adjac nt- lot must be used for maneuvering the boat into the slip. The District staff recommended approval subject to the following special condition: In the future, the applicant may be requested to remove or relocate the proposed floating dock, because the installation requires the use of a portion of the water area fronting on 2. Lot 19 for access into the dock. This access area does restrict the size of the water area that would normally be available to the Owner of Lot 19 for pier and float improvements. If so requested in writing by the Permittor, the applicant agrees to remove.or relocate the installation without delay at his expense. City staff said the City permit would be issued subject to the same condition. MOTION: Commissioner Grubb moved that the application be favorably recommended to the Harbor Commis- sion subject to the Special Condition suggested by staff. Seconded by Commissioner Woolley and unanimously carried. MISCELLANEOUS BUSINESS Mr. Ballinger reported a conversation with Dr. Wheeler North from Cal Tech. regarding plans to remove some kelp presently growing in the entrance channel for transplanting outside of the harbor area. A permit for diving in the channel is required, and City staff stated an application could be processed. Chairman Kymla stated, for the information of the Joint Harbor Committee, that 1. City of Newport Beach has gone on record to again support the retention of the Harbor District. A letter has been written to Senator Whetmore, and Councilman Rogers will appear before the State Legislature on Thursday morning, June 11. 2. Water quality studies in Newport Harbor will be performed for about 10 days by the State and County Health Departments beginning July 1, 1970. This is a continuation of water quality surveillance program. The last 10 -day study was made in 1968. 3. A proposed Joint Powers Agreement, which has been in the offing for several years between City of Newport Beach and the Orange County Harbor District, has been referred to the Harbor and Tidelands Administrator who is working on this agreement. Chairman Kymla requested that this item appear regularly on the Joint Harbor Com- mittee agenda until it is completed and signed. There being no further business, the meeting adjourned at 12 noon. K. Normal wooden ramp costs are as follows: 24' - $2,200,00 30'- $3,200.00 33' - $3,800, 00 This job requires a 33' ramp.. My agreement with the owners is to replace a 10' x 14` wood pier platform with a concrete .pier platform with same dimensions and set a customer supplied ramp. Originally we were going to replace the 2 - 12" square pier support piles but as the existing piles are 12" prestressed and in good condition they will be left in place and used.
