The City of Newport Beach has received a second complaint regarding the
activity within your pier permit area. Specifically, the complaint relates to the
tenants to whom you rent slip space at your dock and as outlined in the
February 1, 1999 letter (attached), your tenants are creating a nuisance to the
adjoining property owner.
The City of Newport Beach Harbor Permit Policy LA. states "Shore connected.
piers and floats bayward of residential zoned areas shall be reserved for the
occupants of the abutting upland property and controlled by the Harbor
Permittee. Vessels moored at residential piers shall not create a nuisance with
regard to vehicle parking, vessel waste, liveaboards, or noise disturbances to
adjoining residents.
Please take whatever steps necessary to correct this situation. Failure to resolve
this issue may result in the matter being referred to the City Attorney.

Dear Mr. Pernworth:
The City of Newport Beach Fire and Marine Department has received a
complaint regarding the pier and docks bayward from yourproperty on Collins
Island. Specifically, the complaint is that the tenants you rent slip space to are
creating a nuisance to the adjoining property owners by impacting the parking
on the island and invading privacy.
The City of Newport Beach Municipal Code does not forbid renting out dock
space. However, the City Harbor Permit Policy does give the Fire Chief the
authority to impose conditions on the permit to assure that the use does not.
affect the health, safety or welfare of the residents of Newport Beach.
Please take whatever steps needed to correct the above mentioned problem.
Requiring your tenants to park off Collins Island would be one suggestion.

OWNER -BUILDER DECLARATION
I hereby affirm that I am exempt from the contractor's license law for the following reasons: (Sec.
7031d.5, Business and Professions Code). Any City or County which requires a permit to construct, alter,
improve, demolish, or repair any structure, prior to its issuance, also requires the applicant for such permit
to file a signed statement that he is licensed pursuant to the provision of the Contractors License Law
(Chapter 9, commencing with Section 7000) of Division 3 of the Business and Professions Code) or that
he is exempt therefrom and the basis for the alleged exemption. Any violation of Section 7031.5 by any
applicant for a permit subjects the applicant to a civil penalty for not more than five hundred dollars ($500).
I, as owner of the property, or my employees with wages as their sole compensation, will do the
work, and the structure is not intended or offered for sale (Sec. 7044, Business and Professions Code:
The Contractor's License Law does not apply to an owner of property who builds or improves thereon, and
who does such work himself or through his own employees, provided that such improvements are not
intended or offered for sale. If, however, the building or improvement is sold within one year of
completion, the owner -builder will have the burden of proving that he did not build or improve for the
purpose of sale.)
