guidelines adopted hereunder, this development:

Pier Permit Conditions

With reference to the plans currently under consideration to reconfigure or modify the dock
system, the following conditions will now be in effect on the above referenced pier.
1. The pier permittee is aware of the Harbor Permit Policies and Chapter 17 of the City of
Newport Beach Municipal Code. The pier permittee understands that the above referenced
pier is under the purview of these Policies and Codes.
2. Any future work on the above mentioned pier requires permits with the City of Newport
Beach and any other applicable agencies. Painting, replacement of rub rails and work
considered to be cosmetic in nature does not require a permit.
3. The conditions set forth in this document pertain to the current, proposed dock system under
consideration. Any future modifications or alterations to the dock system may require new
conditions which may override or change these conditions. These conditions supersede all
past conditions associated with this property.
4. Permit conditioned to allow berthing of one 22 foot maximum length vessel only.
5. Only marine oriented uses are allowed on the pier, pier platform, gangway and float. Patio
furniture, plants etc ... are not permitted.
6. Your side property lines extend in the water along their same bearing. Vessels shall not
encroach upon the neighbors property on either side.
7. Vessels may not extend beyond the end of the float by more than the width of their beam.

SUBJECT: Dock Reconstruction Appeal — 10 1 N. Bay Front
ISSUE:
Should the Harbor Commission allow an exception to Council Policy H-1 and permit the
appellant to add a 14'x 5' section of float to his existing dock on Balboa Island?
DISCUSSION:
Mr. Miller of 101 N. Bay Front proposes to increase the size of his float and to relocate (1) 12'
pile. The total square footage of his existing dock is 80 sq/ft. The proposed float addition (70
sq/ft) would increase the overall square footage of his dock to 150 sq/ft.
Council Policy H-1 states:
"Balboa Island: Revisions to existing piers will be permitted providing they do not lessen the
use of either the immediate water or land areas."
"Any revision of an existing pier or float shall be in strict conformance with this Policy and shall
not be approved if the addition or revision would, in comparison to the existing structure, further
restrict or impair the public's use of the bay or beach in the vicinity of the pier or floats. Revision
to existing structures shall be limited to the following:
1 The overall square footage of the revised structure shall be equal to or less than
the square footage of the permitted structure."
Mr. Miller maintains that the float addition will allow greater access to his already restricted
dock. He also claims that the addition will not lessen the immediate use of the water or land
areas because the dock is adjacent to the Collins Island bridge which at the end of a closed
channel.
Currently, the existing permit is conditioned to allow (1) 22' maximum length vessel only.

ENVIRONMENTAL REVIEW:
Environmental Review: This project is categorically exempt per Section 15301 (Existing
Facilities), Class 1, which "consists of operation, repair and maintenance ... of existing public or
private structures, facilities ... involving negligible or no expansion of use beyond that existing at
the time of the lead agency's determination."
PUBLIC NOTICE:
This agenda item has been noticed according to the Ralph M Brown Act (72 hours in advance of
the public meetings at which the Harbor Commission considers the item).

We would appreciate your endorsement of our applioatiou for dock remodeling for the
following reasons -
1. Our access to our dock has become restricted because of the extra large dock across
from our property at #8 Collins Island. This dock takes up more than 1/2 of the
available water area. The owner at #8 Collins Island has also installed a new 38 -foot
boat on this dock, which overlaps his property and restricts our access.
2. In addition, our immediate neighbor at 105 N. Bayfront is selling his property. He, is
advertising that thenew owners can moor a 35 foot boat there.
The potential 35 foot boat would nearly touch the existing 38 foot boat, We would not be
able to get in or out between them.
3. This proposed remodel would not impact either of the above neighbors or any boats
because we are at the end of the street next to the bridge.
4. The channel is posted as closed to through traffic.
In summary, this remodel would help us maneuver our boat to gain access to our
restricted dock moorage. It also would not lessen the immediate use, of the water or land
areas. Therefore, we respectfully request approval of our remodeling application.

Summary: Should the Harbor Commission allow an exception to Council Policy H-1
and permit the appellant to add a 14' x 5' section of float to his existing dock
on Balboa Island?
Discussion: Commissioner Beek was in favor of granting the request as there were no
other conflicting uses at that end of the channel. Commissioner Corrough
and Chairman Rodheim also agreed.
Public Comments: Brady Heim with Swift Slip, representing the appellant, explained that the
homeowner does not have any intention of increasing the size of their boat.
Their only concern is to achieve greater access to their dock. A longer
finger will allow a vessel to maneuver safely in this confined area.
Action: Commissioner Beek made the motion to allow the appellant to add on the
float section as described above. Commissioner Corrough seconded the
motion which passed. All ayes.

STANDARD CONDITIONS:
1 Notice of Receipt and Acknowledgment. The permit is not valid and development shall not
commence until a copy of the permit., signed by the permittee or authorized agent,
acknowledging receipt of the permit and acceptance of the terms and conditions, is returned to
the Commission office.
2. Expiration. If development has not commenced, the permit will expire two years from the date
this permit is reported to the Commission. Development shall be pursued in a diligent manner
and completed in a reasonable period of time. Application for extension of the permit must be
made prior to the expiration date.
3. Interpretation, Any questions of intent or interpretation of any term or condition will be resolved
by the Executive Director or the Commission.
4. Assignment. The permit may be assigned to any qualified person, provided assignee files. with
the Commission an affidavit accepting all terms and conditions of the permit.
5. Terms and Conditions Run with the Land. These terms and conditions shall be perpetual, and
it is the intention of the Commission and the permittee to bind all future owners and possessors
of the subject property to the terms and conditions.
SPECIAL CONDITIONS: See pages four to seven,.
EXECUTIVE DIRECTOR'S DETERMINATION (continued):
The Executive Director hereby determines that the proposed development is a category of
development, which, pursuant to PRC Section 30624, qualifies for approval by the Executive Director
through the issuance of an Administrative Permit. Subject to Standard and Special Conditions as
attached, said development is in conformity with the provisions of Chapter 3 of the Coastal Act of 1976
and will not have any significant impacts on the environment within the meaning of the California
Environmental Quality Act. If located between the nearest public road and the sea, this development is
in conformity with the public access and public recreation policies of Chapter 3.
FINDINGS FOR EXECUTIVE DIRECTOR'S DETERMINATION:
A. Proiect Location and Descriotion
The subject site is located at 101 North Bay Front in the City of Newport Beach (Exhibits #1 -2). Single-
family residences characterize the subject site and the surrounding area. The proposed project
involves the following: removal of an existing boat dock and installing a new 6' x 30' dock with a Tx 20'
lobe. In addition, the project involves relocating one (1) 12" diameter pile and re -decking the existing 3'
x 20'gangway (Exhibit #3). The dock will be constructed of Douglas fir. The proposed dock will be
within the U.S. Pierhead Line and is consistent with past Commission actions in the area.
Coastal public access to the beach is available adjacent to the site at the end of Park Avenue and
around the perimeter of Balboa Island via public walkway (Exhibit #1).
The dock project will be used for boating related purposes to serve single-family residential
developments. The site has been surveyed by the City of Newport Beach Harbor Resources Division
for eelgrass and no eelgrass was discovered within 15 -feet of the project area. The eelgrass survey
took place on October 10 2006 by the City of Newport Beach Harbor Resources Division and eelgrass

surveys completed during the active growth phase of eelgrass (typically March through October) are
valid for 60 -days with the exception of surveys. completed in August -October. A survey completed in
August - October shall be valid until the resumption of active growth (i.e., March 1). The project is
agendized for the April 2007 Coastal Commission Hearing and by this time the eelgrass survey would
not continue to be valid since it is now during the period of eelgrass active growth. Thus, an up-to-date
eelgrass survey must be conducted. In addition, the site has not been surveyed for Caulerpa taxifolia,
therefore a pre -construction Caulerpa taxifolia survey must be conducted. Caulerpa taxifolia surveys
are valid for 90 days. Therefore, the Commission imposes Special Conditions No. 2 and No. 3, which
identifies the procedures necessary to be completed prior to beginning any construction. Also, if any
Caulerpa, taxifolia is found on the project site, Special Conditions No. 3 also identifies the procedures
necessary to be completed prior to beginning any construction.
The proposed project has received an approval in concept from the City of Newport Beach Harbor
Resources Division. The Regional Water Quality Control Board (RWQCB) has determined that the
proposed project will not adversely impact water quality if standard construction methods and materials
are used. The applicant has applied for a permit from the U.S. Army Corps of Engineers.
Section 30600(c) of the Coastal Act provides for the issuance of coastal development permits directly
by the Commission in regions where the local govern ment'havi ng jurisdiction does not have a certified
Local Coastal Program. The City of Newport Beach only has a certified Land Use Plan and has not
exercised the options provided in 30600(b) or 30600.5 to issue its own permits. Therefore, the Coastal
Commission is the permit issuing entity and the standard of review is Chapter 3 of the Coastal Act. The
certified Land Use Plan may be used for guidance.
B. Marine Resources
The proposed recreational boat dockdevelopment and its associated structures are an allowable and
encouraged marine related use. The project design includes the minimum sized pilings and the
minimum number of pilings necessary for structural stability. There are no feasible less
environmentally damaging alternatives available. As conditioned, the project will not significantly
adversely impact eelgrass beds and will not contribute to the dispersal of the invasive aquatic algae,
Caulerpa taxifolia. Further, as proposed and conditioned, the project, which is to be used solely for
recreational boating purposes, conforms to Sections 30224 and 30233 of the Coastal Act.
C. Water Quality
The proposed work will be occurring on, within, or adjacent to coastal waters. The storage or
placement of construction material, debris, or waste in a location where it could be discharged.into
coastal waters would result in an adverse effect on the marine environment. To reduce the potential for
construction related impacts on water quality, the Commission 'imposes special conditions requiring,
but not limited to, the appropriate storage and handling of construction equipment and materials to
minimize the potential of pollutants to enter coastal waters. To reduce the potential for
post -construction impacts to water quality the Commission requires the continued use and
maintenance of post construction,BMPs. As, conditioned, ,the Commission finds that the development
conforms to Sections 30230 and 30231 of the Coastal Act.
D. Local Coastal Procirarn
The LUP for the City of Newport Beach was effectively certified on May 19, 1982. At the October 2005
Coastal Commission Hearing, the certified LUP was updated. As conditioned, the proposed
development is consistent with Chapter 3 of the Coastal Act and with the certified Land Use Plan for

the area. Approvale of the project, as conditioned, will not prejudice the ability of the local government to
prepare a Local Coastal Program that is in conformity with the provisions of Chapter 3.
E. California Environmental Quality Act (CEQA)
As conditioned, there are no feasible alternatives or additional feasible mitigation measures available
that would substantially lessen any significant adverse effect that the activity may have on the
environment. Therefore, the Commission finds that the proposed project, as conditioned to mitigate the
identified impacts, is the least environmentally damaging feasible alternative and can be found
consistent with the requirements of the Coastal Act to conform to CEQA.
SPECIAL CONDITIONS:
1. Water Quality
A. Construction Responsibilities and Debris Removal
(1) No construction materials, equipment, debris, or waste will be placed or stored

(2) Any and all construction material will be removed from the site within 10 days of
completion of construction.
(3) Machinery or construction materials not essential for project improvements will not
be allowed at any time in the intertidal zone.
(4) If turbid conditions are generated during construction a silt curtain will be utilized to
control, turbidity.
(5) Floating booms will be used to contain debris discharged into coastal waters and
any debris discharged will be removed as soon as possible but no later than the
end of each day.
(6) Non -buoyant debris discharged into coastal waters will be recovered by divers as
soon as possible after loss.
B. Best Management Practices Program
By acceptance of this permit the applicant agrees that the long-term water -borne
berthing of boat(s) in the approved dock and/or boat slip will be managed in a manner
that protects water quality pursuant to the implementation of the following BMPs.
(1) Boat Cleaning and Maintenance Measures:
a.. In -water top -side and bottom -side boat cleaning shall minimize the discharge of
soaps, paints, and debris.
b. In -the -water hull scraping or any process that occurs under water that results in
the removal of paint from boat hulls shall be prohibited. Only detergents and
cleaning components that are designated by the manufacturer as phosphate -
free and biodegradable shall be used, and the amounts used minimized.

c. The applicant shall minimize, the. use: of detergents and. boat cleaning and
maintenance .;Products containing ammonia; sodium hypochlorite, chlorinated
solvents, petroleum distillates or lye.
(2) Solid and Liquid Waste Management Measures:
a. All trash, recyclables, and hazardous wastes or potential water contaminants,
including old gasoline or gasoline with water, absorbent materials, oily rags,
lead acid batteries, anti -freeze, waste diesel, kerosene and mineral spirits will
be disposed of in a proper manner and will not at any time be disposed of in the
water or gutter.
(3) Petroleum Control Management Measures:
a. Boaters will practice preventive engine maintenance and will use oil absorbents
in the bilge and under the engine to prevent oil and fuel discharges. Oil
absorbent materials shall be examined at least once a year and replaced as
necessary. Used oil absorbents are hazardous waste in California. Used oil
absorbents must therefore be disposed in accordance with hazardous waste
disposal regulations. The boaters will regularly inspect and maintain engines,
seals, gaskets, lines and hoses in order to prevent oil and fuel spills, The use of
soaps that can be discharged by bilge pumps is prohibited.
b._ If. the bilge needs, more extensive cleaning,(e.,g., due to spills of engine fuels,
lubricants or other liquid materials), the boaters will. use a, bilge pump -out facility
or steam cleaning services that recover and properly dispose or recycle all
contaminated liquids. .
c. Bilge cleaners which contain detergents or emulsifiers will not be used for bilge
cleaning since they may be discharged to surface waters by the bilge pumps.
2. Eelgrass Survey(s)
A. Pre Construction Eelgrass Survey. A valid pre -construction eelgrass (Zostera
marina) survey shall be completed during the period of active growth of eelgrass
(typically March through October). The pre -construction survey shall be completed
prior to the beginning of construction and, shall be valid until the, next period of active
growth. The survey shall be prepared in full compliance with the "Southern California
Eelgrass Mitigation Policy" Revision 8 (except as modified by this special condition)
adopted by the National Marine Fisheries Service and shall be prepared in consultation
with the California Department of Fish and Game. The applicant shall submit the
eelgrass survey for the review and approval of the Executive Director within five (5)
business days of completion of each eelgrass survey and, in any event no later than
fifteen (15) business days prior to commencement of any development. If the eelgrass
su.rvey.id.entifies any ee.1grasswithin the project, area whic,h would,be impacted by the
proposed prbjebt,'the development shall' require an amendment to this'permit from the
Coastal Commission or a new coastal develoornent permit.
Post'Construction Eelgrass',survey. If any eelgrass. is identified in the project area
by the survey required in subsection A of this condition above, within one month after
the conclusion of construction, the applicant shall survey the project site to determine if
any eelgrass was adversely impacted. The survey shall be prepared in full compliance

with the "Southern California Eelgrass Mitigation Policy" Revision 8 (except as modified
by this special condition) adopted by the National Marine Fisheries Service and shall be
prepared in consultation with the California Department of Fish and Game. The
applicant shall submit the post -construction eelgrass survey for the review and approval
of the Executive Director within thirty (30) days after completion of the survey. If any
eelgrass has been impacted, the applicant shall replace the impacted eelgrass at a
minimum 1.21 ratio on-site, or at another location, in accordance with the Southern
California Eelgrass Mitigation Policy. All impacts to eelgrass habitat shall be mitigated
at a minimum ratio of 1.21 (mitigation: i m pact). The exceptions to the required 1.21
mitigation ratio found within SCEMP shall not apply. Implementation of mitigation shall
require an amendment to this permit or a new coastal development permit unless the
Executive Director determines that no amendment or new permit is required.
3. Pre -construction Cauterpa Taxifolia Surve
A. Not earlier than 90 days nor later than 30 days prior to commencement or
re -commencement of any development authorized under this coastal development
permit (the "project"), the applicant shall undertake a survey of the project area and a
buffer area at least 10 meters beyond the project area to determine the presence of the
invasive alga Caulerpa taxifolia. The survey shall include a visual examination of the
substrate.
B. The survey protocol shall be prepared in consultation with the Regional Water Quality
Control Board, the California Department of Fish and Game, and the National Marine
Fisheries Service.
C. Within five (5) business days of completion of the survey, the applicant shall submit the
survey:
(1) for the review and approval of the Executive Director; and
(2) to the Surveillance Subcommittee of the Southern California Caulerpa Action Team
(SCCAT). The SCCAT Surveillance Subcommittee may be contacted through
William Paznokas, California Department of Fish & Game (858/467-4218) or Robert
Hoffman, National Marine Fisheries Service (562/980-4043).
D. If Caulerpa taxifolia is found within the project or buffer areas, the applicant shall not
proceed with the project until 1) the applicant provides evidence to the Executive
Director that all C. taxifolia, discovered within the project and buffer area has been
eliminated in a manner that complies with all applicable governmental approval
requirements, including but not limited to those of the California Coastal Act, or 2) the
applicant has revised the project to avoid any contact with C. taxifolia. No revisions to
the project shall occur without a Coastal Commission approved amendment to this
coastal development permit unless the Executive Director determines that no
amendment is legally required.

Dear Mr. Miller:
Mayor Noyes has requested that I respond to your letter of July 28, 2000,
relative to Harbor Permit #150-101 for your float at 101 North Bay Front. As
background, I have reviewed the files for your permit, and the permits for #7
Collins Island and 105 North Bay Front. I have attached these permit drawings
for your reference.
The permits for the above structures were all issued in 1960 by the City Council
and presumably built around that time. There have been no permitted changes
in those structures since that date except for your revision in 1990. The floats at
#7 Collins Island and 105 North Bay Front are in the same location as originally
permitted and there have been no dimension changes.
Harbor Permit options for your property are limited by several factors; 1)
existing permitted structures that have been in place and unchanged for forty
years; 2) a very narrow waterway; and 3) City Council policies which limit
revision on Balboa Island.
I understand staff has met with you on several occasions to go over your options
and some of staffs suggestions resulted in your revision in 1990. It appears
from your letter that this revision has not solved your problem and you felt that if
we required the dock at 105 North Bay Front to pull back, it might help your
situation. In that regard, a note has been placed in their harbor permit file and
should they seek a revision, it will be discussed at that time.
On July 13, 1999, you met again with City staff and had a prepared drawing for
a proposed revision. Staffs opinion at that time was this proposal was contrary
to City Council Policies and could not be approved. Staff felt that this proposed

revision might have resulted from a misunderstanding based on an earlier
meeting on site.
At the July 13 meeting, you asked what your next step would be if you wished to
proceed subsequent to staff denial and were told that an appeal mechanism was
available but it would have to be after an official submittal. An official submittal
was made on July 25 and denied by staff on July 26.
Based on your letter to Mayor Noyes and our initial telephone conversation, I
have reviewed the file and I find no grounds for supporting your appeal of Tony
Melum's previous decision. Your dock constraints appear to be unchanged from
the time of your purchase, and in fact, have not changed for forty years. I
realize the limitations it places on accommodating a larger vessel, but I find no
compelling reason to deviate from City Council policies based on your issue.

Dave -By way of background I have attached four permit drawings marked exhibits 1-4. 1-3 are the original permit drawing
from 1960 for the properties at # 7 Collins Island (exhibit 1), 101 North Bayfront(exhibit # 2), and 105 North Bayfront
(exhibit # 3). Exhibit # 4 is for the revision to 101 North Bayfront granted by Council in 1990 to the Millers.
As you can see by exhibits 1-3 the docks were all approved and presumably constructed about the same time, 1960. The
only condition on the permits was on # 7 Collins which limited the use of the side of the float that faced 101 North Bayfront.
There have been no permitted changes since that date except for the Miller (exhibit # 4) and as far as I can tell and no
unpermitted changes.
I will address Mr. Miller's issues as they appear in his letter.
1. First paragraph, "navigational blockage by other docks and the bridge" When Mr. Miller purchased the property the
dock had been in the current configuration since 1960 (29 years). Based on their water frontage(42") they felt they should
be able to dock a larger boat but because of the existing permitted structures it was not possible.
2. Second paragraph. I am assuming he means # 7, its the one right across from him (exhibit # 1). It was approved by
council in 1960. It has not been changed since that approval and it doesn't totally obstruct the waterway as is evident from
the exhibit and the mentioned condition.
3. Third paragraph, # 7(8?) has not been modified since its construction in 1960. Our record show no request for
changes and review of aerial photos show it at originally permitted(l 960) dimensions.
4. Fourth paragraph. The drawing Mr.. Miller submitted for his revision (exhibit # 4) shows water area between the
structures (# 7 and 101 NBF)after revision to be 15 feet. That has not changed. Prior to 1960 there was a smaller
structure at # 7 but then there were no other structures in the channel.
5. Fifth paragraph. As mentioned above there have been no changes to # 7 since 1960. The earliest the owner at # 105
could have reached me would have been 1977 and that was definitely to late to disagree.
6. Sixth paragraph. The dock at # 7 was not built by Trautwien Bros. It was built by Croft and Neville around 1960. There
were no printed policy guidelines in 1960 and the owner only built what the City Council approved. I don't know the owner
at # 7 Collins Island.
7. Seventh paragraph. The Millers access limitations are a function of the property they purchased, its not a problem
unless you want to accommodate a larger vessel. There is no 'problem' to correct.. There is a note in the file at 105. The
dock at 105 has not been sold or remodeled, per our records. It has the same dimensions as it had in 1960 and is still
owned by the same family., the original owner Mr. Williams died in 1995 and his daughter took over the property. I did
not tell the Millers to move their float in six feet, my recollection is that their contractor suggested it but I warned them that
the reason it was out where it was was to give them sufficient depth under the dock but keep enough sand at the toe of
the wall to support the city's bulkhead.
8. Eighth Paragraph. This is what I told them would happen.
9. Ninth paragraph. See # 7 above.
10. Tenth paragraph. Its a navigable channel.
11. Eleventh paragraph. The signs were posted the rest of this paragraph is not true.

we purchased our hone in 1989 and at that time contacted Mr.
.jMelum of the Harbor Department because the dock, we have could not
accommodate a boat larger than 16 feet because Of th-- navigation

Also, aerial photos snowed a reduction of our watez- docking space
after the installation to ar opening of only 6 feet wide. The
aerial photos showed prior owners of our property with much
larger boats at the dock because the Collins Island house had
originally just had a pier (As on the Grand canal�.
Also, the neighbor nextdoor at 105 N. Bayfront did not give his
written agrearent. to the Collins Zslamd installation because he
was in Europe. lie cal2ed Mr. Melum when he returned but, was told
it was to late to disagree.

Trovtwein Brotliers dock Luilders told us that the permit g,ven to

Collins Island #8 was not limited to the existing harbor rules at
the time and that preference had been given by Mr. Melum because
the owner was a personal friend.
Mr. Melum claimed ignorance ct our access limitation and said
that he was not aware of any improprieties given, We asked Mr,
Mellon what he could do to correct the problem. Mr. Mellon said
that he would put a notice in the files of #105 and #109 Balboa
Island neighboring properties that if they were to be remodeled
they would be required to move in toward the bulkhead 6 feet
which would open up the channel somewhat. He also told us to
move our dock in six feet to provide a larger hole for the small
boat we have.
In the mean time, the harbor traffic down the channel was using
my slip for navigation because the Collins Island dock blocks the
channel access and people cut under the bridge in kayaks and
small boats,
we again asked Mr. Melum what he could do to correct the problem.
He said that he woul,d issue a permit allowing us to back up in
the vacant space. next to the bridge to give us a better angle to
parking our boat. But first he would need to post signs that the
channel was closed to through traffic, He asked us to get
permission letter from his friend at #8 Collins Tsland. We did
as reqvested and it took over a year to get the sign posted. We
got our remodeling plans done to put the dock at the bridge but
when the architects went to ,,4r. Melum's office he was told that
we were not going to 1;�e allowed to back up to the bridge.
We called Mr. Melun again and requested that he come out to the
property and tell -us what to do.
He met us at the dock and
:'decided that we needed only to extend the top of the dock and the
side (we are a Small L shape) and that we could tap the dock upon
entry, get off and walk the boat into the slip.' This would not

We did as requested even though this arrangement would not be of
great benefit and was less adequate than earlier options would
have been if mistakes in implementation had not been made Mr.
Melum. We personally went again to his office with the new plans
and he read to us from the Harbor Rules books that we would
qualify for additional footage and could be approved by him
without going to Coastal because were a "hardship case". He said
approval would be within two weeks.
Three weeks later, we received "he attached letter of July '13,
2000 from Mr. Melum denying any change and apologizing for
misleading us.
I personally contacted Mr. Melum again -telling him that I could
not believe what we had been put through and all the promises he
had broken and all the mistakes made. He simply said that he did
not want to be responsible for any changes and that we would have
to contact the City Manager or yourself for assistance.
I feel that oiir water access and consequently, our- property
values have been damaged by the actio'ns of Mr. Melum in
supporting his friends docking priviledges.

Dear Mr. Miller:
I am in receipt of your application to revise your residential dock bayward of 101
North Bay Front.
Based on the Harbor Permit Policies, staff is authorized to approve revisions to
existing permits that conform to the adopted Harbor Permit Policies. On Balboa
Island, the policies state as follows, "Piers presently in use on Balboa Island may
be repaired, but recommendations for any additions or remodeling shall be
restricted to such changes that do not lessen the use of either the immediate
water or land areas"'. In the past, the staff has interpreted this section of the
policies to mean existing docks may be rebuilt and revised using the existing
square footage, but any increase in size of the structure would be in violation of
this section of the policies.
As a result of the above quoted section, we are not able to approve your
application. City Council allow for exceptions in situations where special
circumstances or conditions affecting the harbor installation would impose
undue hardsl-dp on the applicant. We find that by denying you the ability to
increase the size of your dock, we are not imposing an undue hardship that we
are not imposing on every other resident on Balboa Island. Therefore, an
exception is not appropriate in this case.
Please be advised that you do have the ability to appeal staffs decision based on
Section 17.24.050 of the Municipal Code, your appeal may be made to the City
Manager by filing a written appeal with the City Manager" Office within 14 days
3300 Newport Boulevard, Newport Beach
from the notice of this decision. . The City Manager shall consider the appeal and
render a decision within 14 days from the date of the appeal. A decision by the
City Manager may then be appealed to the City Council within 14 days from the
notice of that decision.

Thank you for the opportunity to meet with you and your wife to discuss the
problems you are having with your dock.
City Council Permit Policies relative to Balboa Island states that, ""Revisions to
existing piers will be permitted, provided they do not lessen the use of either the
immediate water or land areas." We have in the past taken the position that any
increase in size was a "lesser -Ling of the immediate water or land areas"'. As a
result, we cannot approve your proposed changes since they do increase the size
of the structure. Changes could be achieved if the existing square footage could
be reconfigured to meet your needs.

found that the vessel "DAD'S DINGY" was tied in such a manner
that it did block the small ano-unt of channel at,this location.
Deputies resecured the vessel on the side tie that runs parallel
to the Collins Island Bridge. we then contacted the Newport
BeaQh Marine Department so that the pier permit records could be
reviewed reference the area in question.
We have been advised by the Marine Department that the City does
not consider the area in question to be a navigable channel. it
is our understanding that they were going to meet with the owner
of the dock, who is also the owner of "DAD'S DINGY" to review his
request to secure boats to his dock at that location.
As you probably know, there are several docks in that area
between Collins Island, South Bayfront and North Bayfront. At the
time the permits were issued to install these docks the City
granted special conditions for the mooring of vessels at
different locations. When we contacted them reference your
letter they requested that it be forwarded to them for
appropriate action. As a result your letter was forwarded to
then on Monday August 21, 1995.

Discussion:
This application is before the City Council as required by Sectio
23. V. of the Harbor Permit Policies, which states: ,
23.V. "Balboa Island. All new piers shall be subject to
special permits approved by the City Council. Revisions to
existing piers will be permitted providing they do not lessen the
use of either the immediate water or land areas."
The existing structure has a total.area of -120 square feet. The
proposed revision has a total area of 120 1/2 square feet.
Therefore it should not lessen the use of either the immediate
water or land area.
Section 20 of the Harbor Permit Policies requires that all piers
and floats for residential property shall be set back a minimum of
5 feet from the bayward projection of the property lines. The
applicant proposes essentially a zero setback at the landward end
of the ramp, going out bayward at an angle to a maximum of a three
foot setback at the baywardmost end of the float. This request
would be an exception to the Harbor Permit Policies. The Council
can make exceptions if there are special circumstances or
conditions affecting the harbor installation that would impose
undue hardship on the applicant or if it would not be detrimental
to the best interests of the City. The Marine Department is
recommending the exception to the five foot setback in this
particular location because the applicant does not share this
property line with another permittee, and by moving the dock over
closer to the property line there is, the potential for improving
navigation in the area for the applicant as well as f or the
permittees at #7 Collins Island and at 105 North Bay Front.

must cease until a coastal development permit is obtained or any discrepancy

The sidewalk adjacent to your residence is subject to "water
ponding" at certain times.7 We believe that a contributing factor
to this ponding is that private pier utilities are routed through
the public bulhead.
To remedy this problem at your location in the vicinity of your
pier, you must grout voids at two penetrations.
This work requires an encroachment permit from the Public Works
Department. This permit can be issued over the counter at City
Hall at a cost of $10-00. When yoiu acquire the permit, the Public
Works Department can answr any questions you may have relative to
your particular situation.

inspection of the structure was conducted on December 14, 1977.
As a result of this inspection, it was noted that bayward of
the bulkhead and not attached to the pier and slip, a non -conforming
4'x 8' platform has been constructed.
Please be advised that this platform is not part of.the permit which
is on record with the Marine Department and does not conform to the
standard drawings as set forth in the Harbor Permit Policies, Sections
3, 5 and 13 respectively.
In compliance with the Harbor Permit Policies, this non -conforming
structure must be removed. However, it has been decided to allow

Dear Mr. Swift:
Reference is made to your request of January 24, 1990 (Permit no. 90 -155 -
GS). Under the provisions of Section 10 of the Rivers and Harbors Act of
March 3, 1899 (33 U.S.C. 403), you are hereby authorized to rebuild the
existing dock and move it closer to the existing seawall in Newport Bay -at 101
North Bayfront, Balboa Island, Orange County, California, as shown on the
enclosed drawings and subject to the enclosed conditions.
The owner or authorized respons'ibl.e official must sign and date all copies
of this Letter of Permission (LOP) indicating that he/she agrees to the work
as described and to comply with all conditions.� One of the signed copies of
this Letter of Permission must be returned -to the Corps of Engineers (a pre -
addressed envelope is enclosed for your convenience). Notice of the
commencement of the activity must reach this office at least 10 days.before
the activity actually starts. Please use the enclosed card.
