Dear Sir:
The City of Newport Beach has received a complaint Regarding
the pier and float bayward from 105 N. Bay Front, Balboa
Island.
�pecifically, the complaint is that a vessel is berthed
in violation of Section 21.A. of the City Harbor Permit
policies, which states:
21.A. "boats moored at private or public docks shall
not extent beyond the projection of the property lines
of the property to which the dock facility is
connected... 11.
A field inspection revealed that a vessel, is berthed in a
position that has it extending across the property line at
101 North Bay Front, and is in violation of the above stated
code.
Please relocate the boat to conform with the Harbor Permit
Policies.

Dear Sir:
The City of Newport Beach has received another complaint
Regarding the pier and float bayward from 105 N. Bay Front,
Balboa Island.
Specifically, the complaint is that a vessel ( CF7211JC,
aluminum skiff) is berthed in violation of Section 21.A. of
the City Harbor Permit policies, which states:
21.A. "boats moored at private or public docks shall
not extent beyond the projection of the property lines
of the property to which the dock facility is
connected... 11.
A field inspection revealed that the vessel, is still berthed
in a position that has it extending across the property line
at 101 North Bay Front, and is in violation of the above
stated code. I
Please relocate the boat to conform with the Harbor Permit
Policies. Failure to do this within fifteen (15) days will
result in this matter being turned over to the City Attorney.

Dear Harbor Permittee at 105 North Bay Front:
The sidewalk adjacent to your residence is subject to "water
ponding" at certain times. We believe that a contributing factor
to this ponding is that private pier utilities are routed through
the public bulhead.
To remedy this problem at your location in the vicinity of your
pier, you must re- grout voids at two penetrations, remove one
conduit and grout the void.
This work requires an encroachment permit from the Public Works
Department. This permit can -be issued over the counter at City
Hall at a cost of $10. 00. When you, acquire the permit, the Public
Works Department can answr any questions you may have relative to
your particular situation.

Dear Mr. Williams:
The City of Nepwort Beach has received a complaint regarding the
use of your residential float at the above address. Specifically
the complaint is that vessels are being berthed at the float in
violation of Section 21.A. of the Harbor Permit Policies. This
states:
21.A nBoats moored at private or public docks shall not
extend beyond the projection of the property lines of the property
to which the dock facility is connected....
To preclude further action by the Marine Departmentr any vessels
encroaching across common property lines between your float and
the float at 101 North Bay Front must be relocated.

Dear Mr. Coffin:
We are in receipt of your letter to Mr. Williams, dated October 6,
1982 regarding the pier located at 505 North Bay Front, Balboa
Island. Your letter has been filed in the permit file 'for Mr.
Williams.
The City Council Harbor Permit Policies,contain two sections that
indirectly apply to the situation described by your, letter. These
sections, quoted below are:
"Section 20. SET BACKS
A. All piers and floats for residential properties shall be
set back a minimum of 5 feet from the projection of the
property line.
B. All piers and floats for commercial properties may extend
to the projection of the property line.
C. The projection of the property line bayward of the same bearing
from the bulkhead shall generally be used in determining the
allowable set backs for piers and floats. Because there are
certain physical conditions which preclude the strict application
of this policy without prejudice to adjoining properties,
Council approval will be required in areas where precise
projections of the propertv line have not been determined
and the following conditions exist:
1. Where property lines are not approximately perpendicular
to the bulkhead line.
2. Where curves or angles exist in the bulkhead line.
3. Where bridges, topography, street ends or publicly -
owned facilities adjoin the property."

"Section 28. ENCROACHING PIERS AND FLOATS
In areas where existing piers and floats encroach in -front of
abutting upland property owned by others, a new permit, approved
by the City Council, shall be required upon:
1. Any change in type of existing use of the piers and floats.
2. Any change in type of existing use of the abutting upland
property owned by the permittee.
3. Any change of existing ownership of the abutting upland
property owned by the permitee or upon the death of the
permittee.
4. Any destruction of the pier and float in which over 60% of
the replacement value of the pier and float has been destroyed.
Before the City Council acts on the new permit, the owner of the
abutting upland property, in front of which the harbor facility
encroaches, shall be notified in writing of the meeting in which
.the new permit will be considered."
In the event the situation should change, requiring a new permit, as
required by Section 28 oil the Harbor Permit Policies, we will contact
the affected parties.
