Commission staff have reviewed the information submitted and determined that the above
referenced dredging events conform with Consistency Certification CC-078-99 and that no
further federal consistency review is necessary from the Commission for the dredging
components of the projects. In addition, the proposed beach disposal has been reviewed and
found by the Executive Director to be consistent with Special Conditions 1, 2, and 3 of
Coastal Development Permit 5-99-282. No further review is necessary from the Commission
for the beach disposal components of the project.
Please be advised that only the project described in the materials submitted for the sites listed
above have been found to conform with Consistency Certification CC-078-99 and/or conform
with the terms and conditions of Coastal Development Permit 5-99-282. Any change in the
project may cause it to lose its status as consistent with CC-078-99 and/or CDP 5-99-282.
This certification is based on information provided by the recipient of this letter. If, at a later
date, this information is found to be incorrect or incomplete, this letter will become invalid,
and any development occurring at that time must cease until a new determination regarding
conformance with CC-078-99 and/or CDP 5-99-282 is obtained.

Sirs:
The City of Newport Beach Marine Department has received a
request to transfer pier permit 0150-0121-1 for the property
located at 121 North Bay Front, Newport Beach, CA. The facility
was inspected on October 18, 1995.
We cannot transfer the pier permit until the following deficiency
has/have been corrected and WE HAVE BEEN NOTIFIED OF THE
CORRECTION:
1. A City -approved anti -syphon device is required at the water
connection for the water supply to the pier and float. A sketch
showing the approved type of device and its installation is
enclosed. The device presently on the water service is no longer
an approved backflow prevention device. This requirement is in
accordance with Title 17 of the California Administrative Code.
2. The electrical receptacles must be either GfI or twist lock
for use in a water environment.
The Newport Beach City Council Harbor Permit Policies state:
10.D. "At the time of transfer, all harbor structures
shall be inspected for compliance with the City's
minimum plumbing, electrical and structural
requirements, and the conditions of the existing
permit. All structural deficiencies must be corrected
prior to transfer of the
permit."

SUBJECT: Waiver of Coastal Development Permit Requirement/De Minimis
Developments -Section 30624.7 of the Coastal Act
Based on your project plans and information provided in your permit
application for the development described below, the Executive Director of the
Coastal Commission hereby waives the requirement for a Coastal Development
Permit pursuant to Section 13238.1, Title 14, California Administrative Code.
If, at a later.•date, this information is found to be incorrect or the plans
revised, this decision will become invalid; and, any development occurring
must cease until a coastal development permit is obtained or any discrepancy
is resolved in writing.
WAIVER # 5-89-1165 APPLICANT: Pauline Woodruff
LOCATION: 121 N. Bay. Front, NEWPORT BEACH
PROPOSED DEVELOPMENT: Revise/replace existing residential boat dock within
U.S. Pierhead line.
RATIONALE: The proposed project will have no adverse impacts on coastal
resources, is consistent with the Coastal Act, the City's Land Use Plan and
past Commission actions.
This waiver will not become effective until reported to the Commission at their
January 9-12, 1990 , meeting and the site of the proposed
development has been appropriately noticed, pursuant to 13054(b) of the
Administrative Code. The enclosed Notice Card shall remain posted at the 'site
until the waiver has been validated and no less than seven days prior to the
Commission hearing. If four (4) Commissioners obj ct to this waiver of permit
requirements, a coastal development permit will b required.

Dear Harbor Permittee at 125 and 129 North Bay Front:
The sidewalk adjacent to your residence is subject to "water
ponding" at certain times. We believe that a contributing factor
to this ponding is that private pier utilities are routed through
the public bulhead.
To remedy this problem at your location in the vicinity of your
pier, you must remove one conduit and grout the void.
This work requires an encroachment permit from the Public Works
Department. This permit can be issued over the counter at City
Hall at a cost of $10.00. When you acquire the permit, the Public
Works Department can answr any questions you may have relative to
your particular situation.

berthing of your vessel the "LIBRE" at the above address.
Specifically, the complaint is that the vessel is being berthed in
violation of -Section 21.B of the Harbor Permit Policies, which
states:
21. B. "Any boat moored at a pier, dock, or float shall not
extend bayward a distance of more than the width of its beam beyond
the pier, dock or float."
To preclude further action by the Marine Department, the vessel
must be so berthed that it does not extend beyond the float the
width of its beam. If,you have questions please call me at 644-

The staff of the State Lands Commission has received your
letter dated. August 22, 1989, and attached drawing relative to the
proposed float modification located in the City of Newport Beach.
The tide and submerged lands over which the proposed project
will extend are waterward of the adjudicated mean high tide line
as set forth in Superior Court Case No. 23692 onto sovereign lands
of the State of California that the Legislature granted in trust
to the City of Newport Beach pursuant to. Chapter 74, Statutes of
1978, and as subsequently amended. Therefore, you need not apply
to the State Lands Commission for project authorization. You
should, however, apply to all other agencies having approval
authority.
This action does not constitute, nor shall it be construed as,
a waiver of any right, title, or interest by the State of

WOODRUFF TO REVISE THE RESIDENTIAL FLOAT
BAYWARD OF 121 NORTH BAY FRONT, BALBOA ISLAND
Recommendation
If desired approve the application subject to the following
conditions:
1. Approval of the California Coastal Commission
2. Approval of the Army Corps of .Engineers
3. Approval of the plans and specifications by the
City Public Works Department.
Discussion_
This application is before the City Council as required by Section
23.V. of the Harbor Permit Policies, which states:
23.V. "All new piers shall be subject to special permits
approved by the City Council. Revisions to existing piers
will be permitted providing they do not lessen the use of
either the immediate water or land areas."
The applicant is proposing a revision to an existing float that
reduces its width but makes it longer. The.square footage of the
old float is approximately 160 sq. ft.; the new square footage,
will be 195 sq. ft. The present location of the float is in an
area where there is no beach and the revision is not likely to
lessen the use of the immediate water areas or land areas.

Dear Sir:
A check of the City's Harbor Permit files has revealed that the
permit for the pier and float at 121 N. Bay Front, Balboa Island, Newport
Beach is registered to Willis I. Sutcliff.
A transfer application must be completed and a transfer fee
paid each time the permit has changed ownership.
Chapter 17.24.030 of the Municipal Code addresses the transfer of
a permit and reads as follows:
"No person shall transfer a permit for a pier, float or
similar structure granted under the provisions of this
chapter without prior written approval of the City".
Failure to pay the transfer fees can be grounds for revocation of
the Harbor Permit in accordance with Chapter 17.24.090 of the
Municipal Code.
Your cooperation in bringing this permit up to date will avoid
any action by the City.

The City of Newport Beach Marine Department has received a complaint
regarding the docks.bayward of your residence at the above
address.
Specifically, the complaint'is that the docks have fallen i'nto a
state of disrepair and have become a safety hazard.
It is the obligation of the harbor permittee to maintain hi's dock,
as pointed out in Section 4.(H) of the Harbor Permit Poli.ci'es which
states:
4.H. "Repairs: The permittee shali keep the structures- in good
repair at all times. Failure to -repair, when written notice h.as
been given by the Marine Department, shall be cause for the
revocation of the permit."
Please notify the Newport Beach Marine Department within fifteen days
of receipt of this letter of your plans to resolve th.e:'above
problems.
