This is in reply to your application (File No. 199915674-dlc) dated April 20, 1999, for a
Department of the Army Permit to conduct maintenance dredging at 129 N. Bay Front in
Newport Bay in Newport Beach, Orange County, California.
Based on the information you have provided, the Corps of Engineers has determined that
your proposed activity complies with the terms and conditions of Regional General Permit
(RGP) No. 18.
As long as you comply with the general permit conditions of RGP No. 18, an individual
permit is not required. This letter of verification is valid until August 29,1999, when RGP No.
18 will expire. A general permit does not grant any property rights exclusive privileges. Also, it
does not authorize any injury to the property or rights of others or authorize interference with
any existing or proposed Federal project. Furthermore, it does not obviate the need to obtain
other Federal, State, or local authorizations required by law.

(Sec. 7031d.5, Business and professions Code). Any City or County which requires a permit to
construct, alter, improve, demolish, or repair any structure, prior to its issuance, also requires
the applicant for such permit to file a signed statement that he is licensed pursuant to the
provision of the Contractors License Law (Chapter 9, commencing with Section 7000, of
Division 3 of the Business and Professions Code) or that he is exempt therefrom and the basis
for the alleged exemption. Any violation of Section 7031.5 by any applicant for a permit

Dear Harbor Permittee at 125 and 129 North Bay Front:
The sidewalk adjacent to your residence is subject to ."water
ponding" at certain times. We believe that a contributing factor
to this ponding is that private pier utilities are routed through
the public bulhead.
To remedy this problem at your location in the vicinity of your
pier, you must remove one conduit and grout the void.
This work requires an encroachment permit from the Public Works
Department. This permit can be issued over the counter at City
Hall at a cost of $10-00. When you acquire the permit, the Public
Works Department can answr any questions you may have relative to
your particular situation.

Sirs:
The City of Newport Beach Marine Department has received a request
to transfer pier permit #0150-125 for the property located at 125
North Bay Front, Newport Beach, CA. The facility was inspected
on 7/15/89.
We cannot transfer the pier permit until the following
deficiency(ies) has/have been corrected and WE HAVE BEEN NOTIFIED
OF THE CORRECTION:
1. A City approved anti -syphon device is required at the water
connection to the pier and float. A drawing and description of
the device approved by the City is enclosed.
2. The electricity must be run to the bottom of the ramp and
connected there to a junction box.
3. The structure does not conform to the drawing that we have on
file in the Marine Department. We need to have a drawing
submitted showing the current dimensions and configuration.

vessel, the "Diet Pop" is being berthed at your float

Dear Newport Beach Harbor Permittee:
The City Finance Department has informed me that the annual Pier
Administration Fee for your harbor facility has not been paid.
The Newport Beach Municipal Code reads as follows:
n17.22.050.Penalty_fgj�_ Failure_to_.E?jy Any owner or permit
holder who fails to pay any fee required by this Chapter within
thirty (30) days after same is due shall be subject to a penalty
in the amount of twenty-five percent (25%) of said fee on the
first day of each month after the due date thereof; provided,
however, that the amount of such penalty to be added shall in no
event exceed one hundred percent (100%) of the amount of the fee
due. Failure to pay the fee plus any accrued penalty within one
hundred and fifty (150) days after the fee was originally due
shall constitute grounds for revocation of the permit by the City
Council (Ord. 1801 sl (part), 1979; Ord. 1667 sl, 1976; Ord. 1387
sl (part) 1971."
Therefore, you are hereby notified that this matter will. be
referred to the Newport Beach City Council with a recommendat.Lon
from the Marine Department that the Harbor Permit for your
facility be revoked if the fee and any penalties have not been
received by the City Council prior to December 10, 1988.
Upon revocation of a Harbor Permit, action may be taken to remove
the structure in accordance with Chapter 17.24.100 of the
Municipal Code, which reads as follows:
"17.24.100. Structure Without Permit Declared a Nuisance -
Abatement. Every structure maintained in or over the waters of
Newport Beach or the Pacific Ocean without a current valid permit
existing therefore when required by this Chapter, or maintained in
a manner or for a purpose other than or different from that
provided in the permit, shall be immediately abated and may be
removed. If upon written notice to remove any such structure the
owner thereof fails, refuses or neglects to do so within a
reasonable time specified in the notice, being not less than five
(5) or more than thirty (30) days after such notice, the City
shall abate or remove it and the cost thereof may be recovered
from the owner o. -L" such structure in a civil action. (Ord. 1090
(part), 1964; 1.949 Code 10404)".

Harbor Permit 150-125 is a Joint Permit. Currently it is shared
by the property owners at 125 and 129 North Bay Front. It is our
information that the property owner at 125 North Bay Front has
sold his property and wishes to transfer the pier permit to the
new owner. The Harbor Permit Policies require that the joint
permittee, which is you, should sign the transfer card. We have
been informed by the escrow company that you have refused to sign

Dear Mr. and Mrs. Varon:
Welcome to Balboa Island. I hope that you and your
family will enjoy it here as much as I have over the
years.
Your house has had several owners in recent years,
an,3 I feel that so -me of them have not been considerate
with regard to the use of the float and ramp which our
two properties share. I think that now would be a good
time to have an agreement covering the subject. I suggest:
We would cooperate in painting and otherwise
maintaining the float and ramp and related items,
the owners of each property bearing one-half of
the expense.
Neither of us would rent the float to anyone,
nor permit tenants of our property to use it for
any purpose. The float could be used for mooring
boats of our guests for no longer than five days
per month, except that my son who now moors his
boat on the float would be able to continue to do
so (I do not have a boat).
Any use of the float would comply with applicable
laws and ordiances.
Our agreement would terminate whenever your property
or my property is sold, so that any buyer would be free
to negotiate a new agreement.
I hope this meets with your approval. If it does,
please sign and return to me the enclosed copy of this
letter.

Dear Mr. Lowe:
Harbor Permit 150-125 is a Joint Permit. Currently it is shared
by the property owners at 125 and 129 North Bay Front. It is our
information that the property owner at 125 North Bay Front has
sold his property and wishes to transfer the pier permit to the
new owner. The Harbor Permit Policies require that the joint
permittee, which is you, should sign the transfer card, We have
been informed by the escrow company that you have refused to sign
this card. Is there a reason for your refusal to sign? If so,
please contact me at 644-3044, so that we can discuss this problem.
if we have not heard from you within 30 days, we will proceed to

This letter is to confirm our telephone conversation this morning, concerning the pier
transfer at 125 and 125-2 No. Bayfront on Balboa Island Calif.
We have just discovered that the shared pier transfer was not completed at the above
address, even though residental Escrow Co. sent the fee for the transfer on July
15, 1986.
We have been told, the co-owners of the pier, 1.1r. Bernard Lowe, has refused. to
acknowledge that Mr. Greg Varon(the new owner) has a shared. interest in the pier. Mr.
Lowe's address is 129 No. Bay Front Balboa Island.
We would appreciate your office contacting Mr. Lowe, and completing this transferfor
Mr. Greg Varon as soon as possible. Iam sure Mr. Lowe must allow this transfer. In fact
I have never had this problem before and I have been involved in many shared pier transfers.
