I hereby affirm that I am exempt from the contractor's license law for the following reasons:
(Sec. 7031d.5, Business and professions Code). Any City or County which requires a permit to
construct, alter, improve, demolish, or repair any structure, prior to its issuance, also requires
the applicant for such permit to file a signed statement that he is licensed pursuant to the
provision of the Contractors License Law (Chapter 9, commencing with Section 7000, of
Division 3 of the Business and Professions Code) or that he is exempt therefrom and the basis
for the alleged exemption. Any violation of Section 7031.5 by any applicant for a permit
subjects the applicant to a civil penalty for not more than five hundred dollars ($500).

Dear Mr. Hurray:
Attached you will find drawings on file with the City of Newport
Beach relative to the above permits. As indicated on each drawing,
there appears to be a -total of 15 feet between the' structures at
the permit addresses. Specifically, on' permit 151-803 it appears
that from structure to the permit line there is approximately
10 feet. On permit'151-805 it appears there is approximately five
feet from the property line to'the structure. Phis makes a total
of 15 feet betw -een 'the two docks.

Dear Ms. Sutton:
On Larch 1 of this year, in accordance with Chapter 17 (Pier
Registration Fees) of the City o Newport Beach Municipal
Code, a statement was mailed to all bayfront property ownerswao have a pier and float facility bayward of 'rein property.
According to our records, payment of the subject fee has not
been received by the City's Finance Department.
Section 17.33.050 of the Municipal Code states:
PENALTY FOR FAILURE TO PAY FEES. Any owner or
ermi.Lt holder lder Who fails to pay any 'Lee required by this
Chapter within thirty (30) days after the same is due
shall be subject to a penalty in the amount of ten per
cent (10%) of the uncollected fee. Failure to pay the
fee plus any accrued penalty within sixty (00) days a''fter

revocation of the perm3-t by the City Council.
To avoid further action by the City on this .mutter, please

Dear Mr. Simpson:
July 11, 1063
With -further reference to my letter to you of May 10.,
1963, and your appreciated reply of May 16, 1963, permit me to
state that on or about April 1, 1962, 1, in entirely good faith,
-entered into an agreement with jack and Thelma Stater, the then
owners thereof; to purchase an undivided one-half interest in
L, the pier and dock in front of 803 North Bay Front, Balboa I
for $��,000.00. I further agreed to pay one-half of the cost of
painting and otherwise improving the same. Mrs. Spading and I
are, and for many years have been, the owners of, and year --round
residents of 306 Diamond Avenue, Balboa island, & our L.A. home.
Neither the Staters nor 1 were aware of the "Harbor
Permit Policies" enclosed with your said -letter to me of May 16,
1963, nor did I ever dream that the City i,.yould have attempted 1-do
regulate the right to use, or restrict the ownership, of such a
-p-.L ivat'ely owned -wharf, pier, ]-andingi; or similar structure so

of citizens
I paid said Staters said $5,000.00 in cash; plus
approximately 000.00 for repairs and -improvemenl5s, and obtained
(in the name of my wife, Rhea R. Sparling) their Grant Deed to
an undivided one-hallP interest -in said "privately owned" pier and
dock, ---which IT caused to be recorded in the Office of the County
Recorder of Orange County on June 7, 1962, in -Book 6136 at Page 931
of Official Records,---ali, wholly without arty_ knowledge or even a

suspicion that such was contrary to any 11Earbor Permit _ 04 _L e s tr
Of the Cities Joint Harbor Committee. Tne Staters no longer live
in Orange County.
Furthermore, for many months prior to such purchase, I
had been leasing such pier and dock from the owners prior to the
Staters, and had continuously been in open possession thereof,
with my boat docked thereon®
Furthermore, in reliance upon my purchase of said one-
half -interest in said pier and dock and in reliance upon my believed
right to the use of half thereof ---I purchased a new Cabin Cruiser --
docked at said dock --at an additional expense of several 'thousands

of dollars. I mention this because of the valued statement of
the Joint Harbor Committee that it will consider "exceptions" to
its "Permit Policies" where application thereof It would impose
undue hardship" or "be detrimental to the best interest of the
City" ---and T feel that my contentions and position would bring
me within that exception. Such "except -ion" is hereby respectfully
requested.
Furthermore, I note that the presently existing "Harbor
C)
Permit Policies", approved by the City Council, was so approved,
and apparently adopted, after I had acquired my interest and
rights in and to the pier and dock in question.
Furthermore, the pier and dock here involved, was origJ
nally built and erected by M. L. Degrasse, 308 Diamond Avenue,
Balboa Island, about 1022-23; at a time when there were no such
purported present restrictions or conditions as to the ownership
or use thereof; and I am a direct successor to all of the rights
of the original Lvaner
Furthermore, I am informed that the City has never, by
Eminent- Domain, acquired any of the original rights of the original
owner, ---who had the right to allow anyone to use such pier or
dock.
Furthermore, in my opinion, and in the opinion of pother,
Superior Court Judges, and attorneys, the "Harbor Permit, Policies"

are unconstitutional and unenforceable for various reasons:
First: An owner of what the "Policies" refers to as a
privately owned, wharf, pier", etc., is basically, legally entitled
to exercise all of the usual rights and privileges of such owner-
ship (subject, of course, to reasonable Police Power and Safety
R e gii- lations). The "Harbor Permit Policies" attempts to illegally
restrict such right in that it provides that. "The use of Resi-
dential Piers shall be reserved for the enjoyment- of the occupants
of the abutting upland property." In other words, it attempts to
arbitrarily restrict the use of such a pier or dock to a very limi—
bed "class" of citizens, and to deprive the owner ofc' the right to
permit anyone, without the limited exception, to even "use" the
same. Obviously, such constitutes "class legislabion and "class
restriction" and the taking of property without due process of law,
and constitutes an unwarranted and unreasonable encroachment upon
the property rights of the owner.
Second: The "Harbor Permit Policies" provides that such
a pier or 7o_c7k_""shall not be sold in whole or in part, leased, or
transferred, without the written consent of the City.11
It will be noted that at the time such pier and dock was
erected no such restriction existed; and that the City has never,
by Eminent Domain, acquired such a right. Irrespective of such
fact, it will be further noted that such purported "restriction"

imposes an arbitrary and unreasonable impairment of an owners
absolute property right ---to wit: the right of sale, transfer,
or lease of his property ---no Police Power or Safety measure
being involved. Even the "t-ransfer" of ownership by operation
of law (transfer by reason of death) is prohibited. Obviously,
such is unconstitutional.
The present owners of said real property at 803 Nort]-i
Bay Front acquired title and possession thereto subject to know -
!edge of the writer's (and Mrs. Sparling's) heretofore mentioned
claims to said pier and dock and subject to knowledge of the
writer's said $5,000-00 payment for a half interest therein; azid
have continuously acknowledged and respected the writer's right
thereto and use thereof ---and no dispute or question of the writer's
right thereto has -ever arisen.
Under all of the circumstances, (and, I may say there
are also other legal and constitutional questions involved) I
respectfully request that Mrs. Sparling and 1 be exempted from
the provisions of said "Harbor Permit Policies" to the extent,
only, cf -recognizing our claims and rights to the title and use
of said pier and dock; and to that end, a personal conference
with Honorable Joseph 11.1. Devi -in, Secretary of the Cities joint
Harbor Committee, or with the Committee or other members thereof,

With further reference to my letter to you of July 11, 1963,
and my appearance before you on August 6, 1963 --- at which
time you suggested that I have Dr® Delbert L. Von Voorhis
write you a letter confirming his knowledge of my claimed
ownership of an undivided one-half interest in and to and to
the use of the subject dock --- permit me to state:
1. You will recall that 7" stated that I had no doubt but what
Dr. Von Voorhis would execute such a suggested letter®
2® Following my said meeting with you, I informed Dr® Von Voorhis
thereof and asked him if he would execute such a letter and he
said that he would do so, providing that I inserted therein that
the Staters had informed him that he had the right to repurchase
said one-half interest in the pier and dock over some sort of a
sliding scale. He admitted to me., however, that he thereafter
talked to me, before agreeing to purchase the property, and I
informed him that no such right of repurchase was reserved to
him.
3. 1 thereupon prepared the enclosed letter, dated August 7,1963,
for his signature, but was unable to contact him until yesterday
afternoon at which time I presented the letter to him, and he
stated that he was not agreeable to signing anything.
4. It is now apparent that Dr. Von Voorhis, a dentist of Pomona
or San Bernardino, as I recall, has been informed by real estate
agents, and others, that the City of Newport Beach will refuse
to recognize Mrs. Sparling's and my claim to a one-half interest
to the use of such pier and dock --- and that he can sell the
clear and unencumbered title thereto, and thus gain for himself

the one-half interest we claim, and for which we paid in excess
of $5,000.
5. Dr. Von Voorhis informed me that he had spent two hours
with the City Attorney, one-half hour with Mr. Simpson, and
had talked with two other members of your committee, and that
all of them understood his present position, and that, as
previously stated, he would now refuse to acknowledge that prior
to buying the property he knew that we claimed a one-half inter-
est therein. He immediately thereafter informed me, however, that
he had a sale of the place now in escrow and that he had informed
the prospective purchasers that we did claim such a one-half
interest and that they would have to settle the matter as between
themselves, us, and your committee.
6. Dr. Van Voorhis also stated that prior to his purchase of the
property, I had implied that the owner of a Bay Front pier and
dock might be obligated to share the same with an adjoining owner.
7. Since Dr. Von Voorhis is now unwilling to honestly state the
facts in writing, I hereby particularly request that you accept
my statement here made under the penalty of perjury that Dr. Von
Voorhis did in fact know of our interest and claim to the subject
pier and dock before purchasing the premises at 80 North Bay
Front, Balboa Island; that he, on or about July 12, .1962, received
a duplicate original of my letter to you of July 11 , 1963; and that
he has to me personally and up to this time constantly acquiesced
in and acknowledged our ownership and right to use said pier and
dock --- excepting to the extent hereinabove stated.
8. You are respectfully requested not to transfer or to permit
a transfer of your permit relative to said pier and dock without
informing the proposed transferee of our said claim.
By telephone conversation with Mr. Simpson today, I have requested
that your committee take no further action in regard to this matter
pending the receipt of this letter (realizing that your committee
meets today).
Regretting my inability to send you the requested letter from Dr.
