(Sec. 7031d.5, Business and professions Code). Any City or County which requires a permit to
construct, alter, improve, demolish, or repair any structure, prior to its issuance, also requires
the applicant for such permit to file a signed statement that he is licensed pursuant to the.
provision of the Contractors License Law (Chapter 9, commencing with Section 7000, of
Division 3 of the Business and Professions Code) 'or that he is exempt therefrom and the basis
for the alleged exemption. Any violation of Section 7031.5 by any applicant for a permit

Dear Mr. Salter:
The City of Newport Beach has received a complaint regarding the
use of the residential float at the above address. Specifically,
the complaint is that the float is being used in violation of
Section 5.R. of the Harbor Permit Policies, which states:
5.R. "In those areas.of the harbor where the piers and floats
are bayward of residentially zoned areas and are reserved for the
occupants of the abutting upland property, liveaboards shall not
be permitted."
To preclude further action by the. Marine Department, the
liveaboard situation on the vessel bayward of 805 North Bay Front,
must cease immediately.

Dear Mr. Salter:
The City of Newport Beach has received a complaint regarding
the use of your residential pier and float bayward of 805 North
Bay Front, Balboa Island, California.
Specifically, the complaint is that five vessels are currently
moored at your residential float in violation of Section 1.A.
of the Harbor Permit Policies, which states:
I.A. "Shore connected piers and floats bayward of resienti'al
zoned areas shall be.reserved for the occupants of the abutting
upland property and controlled by the Harbor Permittee. Vessels
moored at residential piers shall not create a nuisance with
regard to vehicle parking, vessel waste, liveaboards, or noise
disturbances to adjoining residents."
A check with the Department of Motor Vehicles indicates that
none of these five vessels belongs to you or is registered in your
name.
Please contact the Marine Department within fifteen (15) days
to indicate to us the steps you have taken to resolve this
problem.

Dear Sir:
A complaint has been received by the Marine Department regarding
the mooring of your catamaran at 805 N. Bayfront. A check by
the Harbor District has confirmed that your vessel is improperly
moored in as much as it crosses the prolongation of your side
property line into the adjacent street end.
Section 21 paragraph A of the City Council Harbor Permit Policies
reads.as follows:
"Boats moored at private or public docks shall not extend beyond
the projection of the property lines of the property to which the
dock facility is connected..........."
Therefore, you are hereby notified to correct this situation on or
before October 20, 1976. If this has not been done, the Harbor
District will be requested to impound your vessel.

the mooring of vessels adjacent to your float at 805 No. Bayfront,
Balboa Island.
Please be informed that the City Council Harbor Permit Policies
regulates vessel mooring as stated in Section 21 Paragraph A
which reads as follows:
"A. Boats moored at private or public docks shall
not extend beyond the projection of the property lines
of the property to which the dock facility is connected
in accordance with Section 20.C."
To avoid further action on this matter you are requested to moor
your vessels at your dock in accordance with the above policy.

APPLICATION TO: Convert an existing rectangular float to a slip float
bayward of his residence.
RECOMMENDATION: if desired, approve Harbor Permit No. 151-805.
DISCUSSION:
A. This application requires Council action because
Harbor Permit Policies state:
"Piers presently in use may be repaired but
recommendations for any additions or remodeling
shall be restricted to such changes that do not
lessen the use of either the immediate water or
land. area. "
B. The application has been reviewed with a repre-
sentative of the Board of Directors of the Balboa
Island Improvement Association who indicated his
concurrence with the proposal. Additionally,
notification has been sent to the Board of Directors
and to all residents within 300 feet and no response
has been received.
