RE: Vessel "Shakedown" at 1201 N. Bay Front, Balboa Island
Vessel Exceeding Overhang Limit
Dear Mr. Weinreb,
A recent field inspection of the dock located at 1201 N. Bay Front has revealed that the vessel
"Shakedown" is extending beyond the fingers of the dock by a distance greater than the width of its
beam. This is in violation of the Newport Beach Harbor Permit Policies which state:
Moorings — B: "Any boat moored at a pier, dock or float shall not extend bayward a distance
of more than the width of its beam beyond the pier, dock or float."
This letter will advise you that the vessel Shakedown must be relocated within thirty (30) days from
the date of this notice, otherwise an Administrative Citation may be issued and penalties will begin
to accrue ($100, $200, and $500 daily increments). Your cooperation will be greatly appreciated in
this matter.
Please see the attached picture of the infraction. If you have any questions regarding the
enforcement of the Harbor Permit Policies, please feel free to give me a call.

Commission permit #5-99-282 for maintenance dredging in Newport Harbor and that I
will comply with all of the conditions of those permits. I will further hold the City
harmless from and indemnify them against any claim for damages arising out of the
exercise of these permits. In addition, 1, as the applicant shall reimburse the City of
Newport Beach for all attorney's fees and other costs expended by them in defending

OUTLINE OF SAMPLE COLLECTION AND ANALYSIS
COLLECTION
Samples collected by a hand coring device driven into a representative area of the dredge
site and receiving beach, Stored in plastic containers and immediately delivered to the lab.
SAMPLE PREPARATION
Entire sample transferred into 1 liter glass containers, delonized water added, and
mixed to desalt and disperse the sediment. The sediment is allowed to completely
settle and the clear water is removed by siphoning. The sample is placed in a drying
oven at 50'C and occasionally stirred until the entire sarriple is completely dry. The dry
sample is transferred to a desiccator for cooling. The sample is disaggregated and a
Riffle sedimgnt splitter is used to everly split the sample to reduce the quantity of
material to be analyzed to an allowableetention weight for the sieves.
SAMPLE ANALYSIS
�he dry split fraction is processed through a * 10 U.S. standard sieve to remove the
gravellshell fraction of the sample- The material retained on the sieve is weighed and
value recorded, The material passing through the # 10 sieve is wet sieved through a
#230 sieve to remove the silt/clay fraction. The material retained on the sieve is
transferred back into the glass container and placed back into the drying oven at 50'C'
The remaining sample is 21lowed'to completely dry and the material is weighed and
recorded to yield the sand fraction. The siltfclay fraction is calculated oy subtracting
the cravel/shell and sand fractions from tl�e total analysis weight.

Dear Mr. Melum:
Reference is made to your letter dated May 5, 1995 in which you subn-dtted on behalf
of Mr. Lawrence A. Weinraub at 1201 No. Bay Front, a notification for the maintenance
dredging of 120 cubic yards of sand and silt material by hydraulic suction and disposal of the
dredged material to an adjacent beach replenishment area.
Based on the furnished information, we have determined that the proposed
maintenance dredging activity complies with the terms and conditions of Permit No. 89 -211 -
GS provided that Mr. Weinraub's contractor does not exceed the maximum dredging design
depth of -5 feet MLLW with a maximum allowable overdepth of -1 foot MLLW.

the above address. We are still receiving complaints from adjacent

the hydro -hoist. However, the length of time that has elapsed has
been more than sufficient to relocate the offending boat and
hydroho-ist.
If we have not heard from you by September 19, 1989, this matter
will be turned over to the City Attorney's office for followup.

Discussion
The applications require City Council approval under the conditions of
approval placed on the City of Newport Beach general permit for maintenance
dredging issued by the U. S. Army.Corps of Engineers, on February 12, 1974,
and subsequently amended on May 10, 1977 to allow beach restorati,on. The
locations and applicants for the proposed dredging : and beach restorations
are:

The staff has reviewed . the projects and has determined that the work will
be done within the parameters of the Corps of Engineers permit. The
dredging contractor will place a filter screen around the discharge site
to control turbidity. There is no known eel grass in the vicinity of the
projects.
All dredged material will be placed'on adjacent beaches. This will aid
in the restoration of:beaches bayward of private residences.

The enclosed permit drawing application(s) is being sent for your
information in accordance with conditions of approval under the
U.S. Army Corps of Engineers "blanket" permit for maintenance dredging.
This "blanket" permit was issued to the City of Newport Beach on
February 12, 1974, and subsequently amended on -May 10, 1977 to allow
beach restoration.
As requ ired by this permit, the Marine Department has inspected the
dredging site and found no eel grass within or near the project.
The City Council of Newport Beach will hear the application at its
November 12, 1979 meeting.

The Marine Department recently received an inquiry about a boat
davit that was attached to the pier at 1201 N. Bayfront and the
Catamaran hung from the davit.
The City Council Harbor Permit Policies which govern harbor structures
speak to the above issues as follows:
Section 3 A. PERMITS REQUIRED - No person shall build, maintain, extend
or make struc , tural alterations, on any building, pier, piling,
bulkhead, sea wall, reef, breakwater, or other structure in, upon
or over the waters of Newport Harbor or the Pacific Ocean or any
other water where the tide ebbs and flows within the City, or do
any filling, excavating or dredging in said waters or ocean, with-
out first obtaining a written permit to do so from the City.
Section 20 SETBACKS
A. All piers and floats for residential properties shall be
set back a minimum of 5 feet from the projection of the property
line.
C. The projection of the property line bayward of the same
bearing from the bulkhead shall generally be used in determining
the allowable set backs for piers and floats.
Section 21 A. MOORINGS - Boats moored at private or public docks shall
not extend beyond the projection of the property lines of the
property to which the dock facility is connected in accordance
with Section 20-C.
In reference to Sections 3A and 21A and C, davits are considered to be
part of the structure. Therefore, the davit attached to your pier at
1201 N. Bayfront is in violation of the Harbor Permit Policies.

not "moored" in the technical sense. It does violate the intent of
the Harbor Permit Policies as well as causing a possible nuisance and
hazard to beach users.

pliance with the City Council Harbor Permit Policies within (15)
fifteen working days from the date of this letter.

General Provisions:
1. Accevtance of Provisions: It is understood and agreed by the
Permittee thaT the doing of any work under this permit shall constitute an
acceptance of the provisions.
2. Permit from Other Agencies: The party or parties to whom this
permit is issued shall., whenever the same is required by law, secure the
written order or consent to any work hereunder from the War Department of
- 1 -
the United States or any other public body having jurisdiction, and this permit
shall be suspended in operation unless and until such order or consent is obtained.
3. Iransferring Permit. This permit is not transferable without the
written consent of the City Council of the City of Newport Beach,,
4. Notice Prior to StarLing Work: The Permittee shall notify the City
Engineer at least three (3) days in advance of the date work is to begin and its
completion.
5,, Lns2ftction: The work shall be subject to the supervision and approval
of the City Engineer. On work which requires the presence of an employee of the
City of Newport Beach as inspector, the, salary and other incidental expense of such
inspection during the work shall be paid by the Permittee upon presentation of a
bill therefore.
6. Protection of Traffic: Adequate provisions shall be made for the
protection of the traveling public. Barricades shall be placed on streets., with
red lights at night, also flagmen employed, all as may be required by the particular
work in progress.
The Permittee shall not attempt to forbid the full and free use by the
public of all navigable waters at or adjacent to the work or structure. If the
display of lights and signals on any work hereby authorized is not otherwise provided
by law, such lights and signals, as may be prescribed by Bureau of Light Houses,
Department of Commerce, shall be installed and maintained at the expense of the
Permittee.
7. Liabili±yfor Damages: The Permittee is responsible for all liability
for personal injury or property damage which may occur through work herein permitted,
and in the event any claim is made against the City of Newport Beach or any department,
officer or employee thereof, through, by reason of, or in connection with such work,
Permittee shall defend, indemnify and hold them, and each of them, harmless from such
claim. This Permit shall not be effective for any purpose unless and until the above
named Permittee files with the City of Newport Beach, a surety bond'in the form and
amount required by the said City, unless specifically exempted on the face hereof.
8. Expiration of Permitso If the structure or work Ilerein authorized is
not completed on or before the T" day of JANUARY _9 lq�L, this permit, if
not previously revoked or specifically extended, shall cease and be null and void.

PLEASURE PIERS
1. The City of Newport Beach shall never be held liable or
obligated for any injury or damage resulting to either persons or property
through the erection, use or possession of private piers.
2. The pier shall 'be so constructed as not to obstruct, interfere
With, or prevent the free use or passage of any sidewalks, street, alley,
public way or navigable channel.
3. The right given for the erection and maintenance of a pier
is -permissive only and the Permittee shall, upon revocation hereof, remove
said pier and appurtenances thereto, within thirty (30) days after date of
mailing written notice of the revocation of this permit, which notice may
be mailed to the last known address of the Permittee. I
4,, The City of Newpert Beach reserves full right, power and
authority to revoke this permit., and in the event the Permittee fail$ to
remove said pier within the time specified, then the City Engineer shall
have -the right to immediately remove same at the cost and expense of -the
Permittee.
5* Plea -a piers shall be constructed in accordance with
Standard Plan No. 10 for Pleasure Piers., adopted by the City
Council. Painting of Piers shall be designated by the City Engineer.
6. The Permittee shall keep the pier in good repair at all
times and shall paint the pier when required to do so. Failure to
repair or paint pier, when written notice has been given by the City
Engineer, shall be cause for revocation of the permit and removal of the
pier.
7. The pier to be constructed herein, shall not be sold, !eased.,
sublet or transferred, without the prior written consent of the City.

Gentlemen.?
Your consideration of the enclosed requests and explanations
will be greatly appreciated. This is an honest attempt to
respond to the letter sent me by Mr. Joseph T. Devlin dated
May 12, 1966.
While it is true that there is an occasional small boat tempor-
arily moored on the west side, or the street side, of my pier,
such mooring is rare, I have been diligent in keeping this,
the Amethyst Avenue, side of my pier clear of boats. In only
temporary or emergency situations have boats been moored there4
In no instance have 1 wilfully violated the conditions of my
permit.
As to the east side of my pier, it is true that recently there
have been two small boats there; one a 20 -foot open boat and a
dinghy. The 20 -foot boat I have owned for some time. This
boat was purchased for specific use of my wife so as to make it
easy for her to fish in the bay. It is a great joy for her to
have easy access to bay fishing. At times past, the 20 -foot
open boat was moored elsewhere. The other space is no longer
available to me. It is now my intention to sell this boat, and
I am now preparing for such sale. There is a considerable amount
of money tied up in this boat, and I would like to sell it for
a reasonable price. If you force me to remove this boat from
the east side of my pier immediately, it will have to be sold
at a forced sale at a sacrifice price. This would cause a real
hardship to me and quickly reduce my wife's fishing pleasures.
Therefore, I ask your permission to keep the boat where it is
for a reasonable period of time. Within three or four months
time, I can arrange for sale at a fair price. This, I feel, is
a reasonable period of grace in that I had not anticipated being
made to remove the boat from its present location at all. Dur-
ing this time, I will take all reasonable steps to keep the west
side or street side of the pier clear of boats.

As to my dinghy, please hear my special request. It is very
small. The boat does not interfere in the least with any bathers
wishing to swim in the bay. Yet it is too large to put on
board the boat kept within my finger slip. Nearly everyone of
my neighbors has one or more such boats alongside his pier. 1,
too, would appreciate your permission to keep this small dinghy
along the east side of my pier. I realize this is an infraction
of my permit; however, in view of harbor conditions as they
actually exist, this, I think, is a reasonable requesti Please
consider the foregoing6 Should you turn down this request, I
will take the necessary steps to remove the boat.
Thank you for your consideration. All I ask is for reasonable
relief of my situation.

type floet in lieu of the present 100201 float as this plan will allow
more swim frontage as your boat will be heading toward shore instead of

SUBJECT- Balboatsland Pier Permits
In- connection with.the letter from V. J. Swanson of Croft & Neville,, re-
submitting tothe Council pier permit requests from R. V. Marshall and
B. D. Lowe, the following information. is called to your attention:
The Joint Harbor Committee,. atits, meeting held February 7,. 1961,
recommended the approval of certain, pier and bulkhead applications,
including the two listed below:
,(l) B. D. Lowe, to attach additional 22'x40' slip to existing,float
bayward of Lot 8, Block 2,� Section 1, Balboa I.sland,(129 North
Bay Front).
(2) R. V. Marshall,, to install. slip float, to replace old -float bayward
.of Lot 16, Block, 18, Section 3, Balboa Island,,(1201 North Bay
Front), subject to,the, following restrictions- (l), no boat is, to
ba moored on,the. westerly side. of the finger slip that will
extend over-tbe prolongation of the easterly line of Amethyst
Avenue.
The Council, on Februlary-14,, 1961,, established a Council policythal:
no one may, change any pier,, orfloat,, or finger slip, on Balboa,,Is.land,
where, it would cover more square f eet over water than it, does at -the
present.time,, except for emergency repairs,, until such.time as a
definite policy for remodeling. or enlarging, of piers, floats, or1inger
slips,, is adopted by the Council..
The Council, therefore, directed that the-, application of B. D. Lowe
be. returned to Mr. Lowe. and that a.refund of the $50 -filing fee. be made
tothe- applicant. Italso, directed that the application of R. V. Marshall,,
conditionally recommended for approval,,, be. returned,to Mr. Marshall,
and,that the� $50 filing fee, be, refunded.
