Dear Sir:
The City of Newport Beach received a complaint regarding alterations made to the dock
bayward from 1203-1205 North Bay Front. An inspection has revealed that there has
been additional footage added to your dock that was not part of the original drawing
pen--nitted by the City.
The additional dock included additions to the bayward end of the dock that extends
beyond the pier project line, and additional footage to the rear of the dock nearest the
seawall.
This is notice that the additional dock footage must be removed within one month from
the date on this letter or a permit must be obtained from the Building Department for
harbor construction to alter your dock. Both Joint Pier Permittees must sign the
application for this work. If you decide to seek a permit for an alteration to your facility,
the process requires an Approval In Concept from the Harbor Resources Division, and
approval from the State Coastal Commission.
City of Newport Beach Municipal Code Chapter 17.24.010 "No person or agency shall
build, maintain, extend or make structural alterations on any building, pier, piling,
bulkhead, sea wall, reef, breakwater, or structure in, upon or over the waters of Newport
Harbor or the Pacific Ocean or any other water where the tide ebbs and flows within the
City, or do any filling, excavating or dredging in said waters or ocean, without first
obtaining a written permit to do so from the City."
One other point is that the City Council has not allowed increases to the size (square
footage) of dock on Balboa Island. Therefore, the new design must retain the same square
footage as the previous design.

STANDARD CONDITIONS: '
Notice of Receipt and Acknowled_qment, The permit is not valid and development shall not
commence until a copy of the permit, signed by the permittee or authorized agent,
acknowledging receipt of the permit and acceptance of the terms and conditions, is returned to
the Commission office.
2. Expiration. If development has not commenced, the permit will expire two years from the date
this permit is reported to the Commission. Development shall be pursued in a diligent manner
and completed in a reasonable period of time. Application for extension of the permit must be
made prior to the expiration date.
3. Interpretation. Any questions of intent or interpretation of any term or condition will be resolved
by the Executive Director or the Commission.
4. Assignment. The permit may be assigned to any qualified person, provided assignee files with
the Commission an affidavit accepting all terms and conditions of the permit.
5. Terms and Conditions Run wi*Lh_+Lhe Land. These terms and conditions shall be perpetual, and
it is the intention of the Commission and the permittee to bind all future owners and possessors
of the subject property to the terms and conditions.

The Executive Director hereby determines that the proposed development is a category of
development which, pursuant to PRC Section 30624, qualifies for approval by the Executive Director
through the issuance of an Administrative Permit. Subject to Standard and Special Conditions as
attached, said development is in conformity with the provisions of Chapter 3 of the Coastal Act of 1976
and will not have any significant impacts on the environment within the meaning of the California
Environmental Quality Act. If located between the nearest public road and the sea, this development is
in conformity with the public access and public recreation policies of Chapter 3.
A. Pro ect Description and Backaround
L
The proposed project (Exhibit #3) involves installation of two (2) new 2-1/2' x 1 O'float extensions. No
new piles are proposed. The floating dock system will only be used for boating related purposes.
The subject site is located at 1205 North Bay front in the City of Newport Beach (Exhibits #1-2). The
dock project is for boating related purposes and is associated with an existing single family home. The
site has been surveyed by the City of Newport Beach Harbor Resources Division for eelgrass and no
eelgrass, was discovered within 15 feet of the project area. Lateral public access is available along an
existing public walkway, which occurs bayward of the proposed development and fronts the harbor
bulkhead along the perimeter of Balboa Island. Vertical public access is available at the Amethyst
Avenue street end, approximately 60 feet west of the subject site and at the Onyx Avenue street end,
approximately 90 feet east of the subject site (Exhibit #2). The proposed project has received an
approval in concept from the City of Newport Beach Harbor Resources Division. The Regional Water
Quality Control Board (RWQIZW has determined that the proposed project will not adversely impact

water quality if standard construction methods and materials are used. The applicant has applied for a
permit from the U.S. Army, Corps of Engineers.
B. Water Quality
The proposed work will be occurring on, within, or adjacent to coastal waters. The storage or
placement of construction material, debris, or waste in a location where it could be discharged into
coastal waters would result in an adverse effect on the marine environment. To reduce the potential for
construction related impacts on water quality, the Commission imposes special conditions requiring,
but not limited to, the appropriate storage and handling of construction equipment and materials to
minimize the potential of pollutants to enter coastal waters and for the use of on-going best
management practices following construction. As conditioned, the Commission finds that the
development conforms with Sections 30230 and 32031 of the Coastal Act.
C. Local Coastal Program
The LU P for the City of Newport Beach was effectively certified on May 19, 1982. The certified LU P
was updated on January 9, 1990. As conditioned, the proposed development is consistent with
Chapter 3 of the Coastal Act and with the certified Land Use Plan for the area. Approval of the project,
as conditioned, will not prejudice the ability of the local government to prepare a Local Coastal
Program that is in conformity with the provisions of Chapter 3.
D. California Environmental Quality Act (CEQA)
As conditioned, there are no feasible alternatives or feasible mitigation measures available which
would substantially lessen any significant adverse effect which the activity may have on the
environment. Therefore, the Commission finds that -the proposed project, as conditioned to mitigate
the identified impacts, is the least environmentally damaging feasible alternative and can be found
consistent with the requirements of the Coastal Act to conform to CEQA.
SPECIAL CONDITIONS:
A. Construction Responsibilities and Debris Removal
(a) No construction materials, equipment, debris, or waste will be placed or stored where it
may be subject to wave, wind, or rain erosion and dispersion.
(b) Any and all construction material will be removed from the site within 10 days of
completion of construction.
(c) Machinery or construction materials not essential for project improvements will not be
allowed at any time in the intertidal zone.
(d) If turbid conditions are generated during construction a silt curtain will be utilized to control
turbidity.
(e) Floating booms will be used to contain debris discharged into coastal waters and any
debris discharged will be removed as soon as possible but no later than the end of each
day.
(f) Non -buoyant debris discharged into coastal waters will be recovered by divers as soon as
possible after loss.

Z. Best r4nagement Practices Program
By acceptance of this permit the applicant agrees that the long-term water -borne berthing of
boat(s) in the approved dock and/or boat slip will be managed in a manner that protects water
quality pursuant to the implementation of the following BMPs.
(a) Boat Cleaning and Maintenance Measures:
i. In -water top -side and bottom -side boat cleaning shall minimize the discharge of soaps,
paints, and debris.
ii. In -the -water hull scraping or any process that occurs under water that results in the
removal of paint from boat hulls shall be prohibited. Only detergents and cleaning
components that are designated by the manufacturer as phosphate -free and
biodegradable shall be used, and the amounts used minimized.
iii. The applicant shall minimize the use of detergents and boat cleaning and maintenance
products containing ammonia, sodium hypochlorite, chlorinated solvents, petroleum
distillates or lye.
(b) Solid and Liquid Waste Management Measures:
i. All trash, recyclables, and hazardous wastes or potential water contaminants, including
old gasoline or gasoline with water, absorbent materials, oily rags, lead acid batteries,
anti -freeze, waste diesel, kerosene and mineral spirits will be disposed of in a proper
manner and will not at any time be disposed of in the water or gutter.
(c) Petroleum Control Management Measures:
Oil absorbent materials shall be examined at least once a year and replaced as
necessary. The applicant will recycle the materials, if possible, or dispose of them in
accordance with hazardous waste disposal regulations. The boaters will regularly
inspect and maintain engines, seals, gaskets, lines and hoses in order to prevent oil
and fuel spills. Boaters will use preventive engine maintenance, oil absorbents, bilge
pump -out services, or steam cleaning services as much as possible to clean oily bilge
areas. Bilges shall be cleaned and maintained. Detergents will not be used for
cleaning. The use of soaps that can be discharged by bilge pumps is prohibited.

This office has received complaints from Mr. Rasmussen at 1205 North Bay Front
regarding the boat side tied on the west side of your float. He contends that it encroaches
across the extension of the side property line separating your property from his. This
office conducted a field inspection, and found that it was too close for our staff member
to make a call whether there was a violation. Consequently, we notified Mr. Rasmussen
that it was up to him to have a licensed surveyor provide us with the necessary
verification regarding the prolongations of the side property line and the position of your
boat in relation to that line.
Mr. Rasmussen has provided us with that information (see attached). It shows 4'8"
between your float and the property line. Your boat was recently measured and it is 5'1"
at the widest section of the boat. The width in these cases is not measured at the water
line but from gunwale to gunwale since any portion of the boat that is across the property
line constitutes an encroachment.
Therefore, based on this information provided by Mr. Rasmussen, you must relocate your
boat within 10 working days from the date on this letter. Fai I I -are to do this may result in
the issuing of an Administrative Citation. Continued failure to relocate the boat may
result in additional citations and possible referral to the City Attorney's Office.

In consideration of NB Notice of Violation # HP 02012. We have contacted Buz Person,
Attorney, in regards to this matter as well as our own real estate attorney, Jim Miller.
Buz has declined to represent us at this time stating that if this became a legal matter and
were to go to court, it would be out of his line of practice. However, he has agreed to
confer with Jim Miller if the occasion should require his assistance.
We are currently investigating all avenues of dealing with this situation in a manner that
will bring the least amount of difficulty to all parties concerned and are exploring the
possibility of modification to our float. As this will necessarily involve some time to
accomplish, we respectfully request a reasonable amount of time to implement the
necessary investigation in order to come to an equitable solution for 0 persons involved.

The Harbor Resources Division has reviewed your comments regarding the proposed
work to the dock at 1205 North Bay Front. From the text of your letter, this office is
assuming at this point that you are not in opposition to Mr. Rasmussen's application
because you have the same right to apply for a revision to your dock, as did Mr.
Rasmussen. Regarding the issue of any agreement between Mr. Rasmussen and
yourselves, the City has no influence over any agreement that you and Mr. Rasmussen
may have regarding berthing vessels at the side ties that separate your permit areas.
The City of Newport Beach Harbor Resources Division will issue an Approval In
Concept for the application.

Dear Mr. Melum:
We have no contest with the City of Newport Beach granting Mr. Douglas Rasmussen an
Approval in Concept for the existing revision of a 2 1/2' x 10' bayward extension of his
half of his pier at 1205 N. Bay Front, as long as the City and Mr. Rasmussen agree to
allow us, in writing, the same rights to exceed the allowed square footage and extend our
pier at 1207 N. Bay Front when desired and without issue.
Alternatively, we file no appeal to the issuance of an Approval in Concept to Mr.
Rasmussen if Mr. Rasmussen would like to retract his complaint regarding waterway
rights and, in writing, agree to the original arrangement made between 1205 and 1207 N.

Bay Front owners to allow a boat of no more than 7' beam to be tied to the side of the

We have no contest with the City of Newport Beach granting Mr. Douglas Rasmussen an
Approval in Concept for the existing revision of a 2 1/2' x 10' bayward extension of his
half of his pier at 1205 N. Bay Front, as long as the City and Mr. Rasmussen agree to
allow us, in writing, the same rights to exceed the allowed square footage and extend our
pier at 1207 N. Bay Front when desired and without issue.
Alternatively, we file no appeal to the issuance of an Approval in Concept to Mr.
Rasmussen if Mr. Rasmussen would like to retract his complaint regarding waterway
rights and, in writing, agree to the original arrangement made between 1205 and 1207 N.
Bay Front owners to allow a boat of no more than 7' beam to be tied to the side of the
1207 N. Bay Front dock which faces the 1205 N. Bay Front dock. The Greers, will, in

3. Where bridges, topography, street ends or publicly owned facilities adjoin

MOORINGS
A. Boats moored at private or public docks shall not extend beyond the projection
of the property lines of the property to which the dock facility is connected in
accordance with Section 20-C.
B. Any boat moored at a pier, dock, or float shall not extend bayward a distance of
more than the width of its beam beyond the pier, dock or float.
C. Mooring Fees for both onshore and offshore moorings shall be set annually by
Resolution of the City Council.
BALBOA ISLAND
No new, non-commercial piers on Balboa Island shall be recommended unless it is in
the public interest or unless it is at such a location that it is not usable for swimming or
bathing. Piers presently in use may be repaired but recommendations for any additions
or reibodeling shall be restricted to such changes that do not lessen the use d either- the
immediate wat&r or land areas. Whenever any application to install a new,
noit-commercial pier is to be takenunder consideration, all occupants within 300 feet of
the proposed work shall be notified in writing by the Harbor Resources Division.
*BAYWARD LOCATION OF PIERS AND FLOATS
A. U.S. Bulkhead Sta. No. 107 to No. 109. Piers will be permitted to extend out to
the U.S. Pierhead Line. Creosote anchor piles will be permitted in this section.
B. U.S. Bulkhead Sta. No. 109 to No. 110. Piers may be permitted to extend -16 feet
channelward of the U.S. Pierhead Line.
C. U.S. Bulkhead Sta. No. 110 to 112. Piers will be permitted to extend out to the

Based on our meeting of June 30,1997, it is my understanding that there is
a consensus between the two property owners relative to the relocation of
the shore mooring adjacent to both the floats at 1205 and 1207 North Bay
Front. The shore mooring will be relocated shoreward of its present
location approximately 20 feet and positioned approximately 8 feet off the
common property between 1205 and 1207. Attached is an exhibit
showing its present location and its proposed relocation.
It is further agreed by the parties that should the buoy in this location
routinely come in contact with the structure at 1207 North Bay Front due
to wind or tidal conditions it could be relocated closer to the center of the

Sirs:
The City of Ne�qport Beach Marine Department has received a request
to transfer pier permit 0151-1205-1 for the property located at
1205 North Bay Front, Newport Beach, CA. The facility was
inspected on April 27, 1995.
We cannot transfer the pier permit until the following deficiency
has/have been corrected and wE HAVE BEEN NOTIFIED OF THE
CORRECTION:
1. A City -approved anti -syphon device is required at the water
connection for the water supply to the pier and float. A sketch
showing the approved type of device and its installation is
enclosed. The device presently on the water service is no longer
an approved backflow prevention device. This requirement is in
accordance with Title 17 of the California Administrative Code.
2. The electrical receptacles must be either GfI or twist lock for
use in a water environment. Some of the outlets on the pier must be
converted to the aviDroved tvoe.
A permit for plumbing or electrical work may be obtained from the
Building Department of the City.
The Newport Beach City Council Harbor Permit Policies state:
10.D. ,At the time of transfer, all harbor structures
shall be inspected for compliance with the City Is minimLun
plumbing, electrical and structural requirements, and the
conditions of the existing permit. All structural
deficiencies must be corrected prior to transfer of the
permit."

Dear Sir:
The City of Newport Beach Marine Department has received a request
to transfer pier permit 0151-1205 for the property located at 1205
North Bay Front, Newport Beach, CA. The facility was inspected on
12/12/91.
We cannot transfer the pier permit until the following deficiency
has/have been corrected and WE HAVE BEEN NOTIFIED OF THE
CORRECTION:
1. The electricity supply to the pier has a questionable aspect: on
one socket the wires have been cut and the excess wire is hanging
out under the socket cover. This should be repaired.
The Newport Beach City Council Harbor Permit Policies state:
10.D. "At the time of transfer, all harbor structures
shall be inspected for compliance with the City's minimum
plumbing, electrical and structural requiremenmts, and
the conditions of the existing permit. All structural
deficiencies must be corrected prior to transfer of the
permit."
A permit for plumbing or electrical work may be obtained from the
Building Department of the City.
PLEASE ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE BEEN

Another inspection will be made, and when the problem is solved the pier permit

The applications require City Council approval under the conditions of approval
placed on the City of Newport Beach General Permit for Maintenance Dredging
issued by the U.S. Army Corps of Engineers on February 12, 1974, and subsequently
amended on May 10, 1977, to allow beach restorations. The locations and appli-

The staff has reviewed the projects and has determined that the work will be
done within the parameters of the Corps of Engineers' permit. The dredging
contractor will place a filter screen around the dredge area to control turbidity.
There is no known eel grass in the vicinity of the projects.
All dredged material, except for the project at 844 Via Lido Nord, will be
placed on adjacent beaches to aid in their restoration. The material from the
project at 844 Via Lido Nord will be hauled to sea and dumped.

Pier will serve two existing adjacent residences.
I. The Executive Director of the South Coast Regional Commission hereby grants, subject to
condition(s), a permit for the proposed development, on the grounds that the development
as conditioned will be in conformity with the provisions of Chapter, 3 of the California
Coastal Act of 1976, will not prejudice the ability of the local government having juris-
diction over the area to prepare a Local Coastal Plan conforming to the provisions of
Chapter 3 of the Coastal Act, and will not have any significant adverse impacts on the
environment within the meaning of the California Environmental Quality Act.
II. Conditions: None.

III. This permit may not be assigned to another person(s) except as provided in Section
13170 of the Coastal Commission Rules and Regulations.
IV. This permit shall not become effective until:
A. Completion of the Regional Commission review of the permit pursuant to the notice

B. A copy of this permit has been returned to the Regional Commission, upon which copy
all permitees or agent(s) authorized in the permit application have acknowledged
that they have received a copy of the permit and have accepted its contents.
V. Any development performed on this permit prior to the review by the Regional Commission
is at the applicant's risk and is subject to stoppage upon completion of the review
pending the Regional Commission's approval and/or completion of any appeal of the
Regional Commission's decision.
VI. Work authorized by this permit must commence within two years from the date of approval.
Any extension of time of said commencement date must be applied for prior to expiration
of the permit.

1. Approval of the U. S. Army Corps of Engineers.
2. Approval of the South Coast Regional Coastal Commission.
Discussion
The prior approval of the City Council is required on this application because
the abutting upland property is a dedicated public right of way.
The proposed revision is to an existing pier and float bayward of 1205 N. Bay-
front on Balboa Island. Revisions to existing piers and floats are permitted
on Balboa Island by the Harbor Permit Policies, Section 23.V, which states in
part:
"Balboa Island ........ Revisions to existing piers will be permitted
providing they do not lessen the use of either the immediate water
or land areas."
The applicants want to rebuild the existing pier and float and relocate it
from its current location, bayward of 1205 N. Bayfront, to a location on the
common property line between 1203 and 1205 N. Bayfront. The principal reason
for doing this is that since this is a joint pier and float, this new location
would more equitably serve the uses of the two joint permittees. The joint per-
mittee at 1203 N. Bayfront has agreed to this rebuilding and relocation and a
letter to that effect is on file with the Marine Department.
The Balboa Island Improvement Association has also reviewed the proposed re-
visions and approved same. Their letter is attached.
The proposed revision will not lessen the use of the water or land area, and in
fact, there will be a small gain, as the revised structure is somewhat smaller
than the existing one.

In addition to the above, there is a shore mooring, #N-124, in front of
1203 N. Bayfront that must be relocated. The permittee (Harold E. Simpson)
on this mooring is the property owner at 1205 N. Bayfront and has consented
to its relocation. This relocation will not lessen water or beach use.

transfer pier permit # 151-1205 for the property located
at 1203 North Bay Front.
The structure was inspected on 1-26-79 at which time it
was determined that the following deficiency exists.
A continuous pressure anti -siphon device must be attached
to the municipal water service, bayward of the bulkhead,
in compliance to title 17 of the California Administrative
Code.
In accordance with Section 10-D of the City Harbor Permit
Policies, "All structural deficiencies must be corrected...
A permit for this work must be obtained from the Community
Development Department.
Would you please advise this department when this require-
ment has been met. If you have any questions, please con-

This letter is in response to your request regarding the status
of the permit for the pier located at 1205 N. Bay Front, Balboa
Island. The records on file at the Newport Beach Marine Depart-
ment indicate this permit is a joint ownership pier permit and
as such is shared by the properties located at 1203 and 1205
North Bay Front, Balboa Island.
If either of the properties mentioned above is sold, the required
pier transfer application must be approved by the City of Newport
Beach City Council as outlined in the Newport Beach Harbor Permit
Policies Section 28 (3):
"In areas where existing piers and floats encroach in front
of abutting upland property owned by others, a new permit,
approved by the City Council, shall be required upon:
Any change in type of existing use of the abutting
upland property owned by the permittee."

If desired, approve or deny the waiver of the pier transfer fee.
Discussion
A letter from Michael Lawler, Jr. for Mr. Merlin Norton (attached) requests
permission to transfer a harbor permit from Mr. Norton's company to himself
without paying the harbor permit transfer fee.
The City Council, on November 8, referred this letter to the Marine Department
for review and report back.
The Newport Beach Municipal Code Setion 17.24.030 TRANSFER OF PERMIT states,
in part, that no person shall transfer a permit for a pier, float or similar
structure without prior written approval of the City. In addition, this
section vests the right of use of the Harbor Permit structure with the City
until such time as the City issues a permit to the new owner or lessee
of the abutting upland property. Section 17.24.040 APPLICATION FOR PERMIT -
PLANS - FEE., allows for transfer fees by City Council resolution.
The City Council's Harbor Permit Policies, Section 10. Transfer of Permits
requires, in part, that at the time of transfer all harbor permit structures
shall be inspected for compliance with the City's minimum plumbing, electrical
and structural requirements and that all deficiencies be corrected within six
months from the date of transfer. Section 12. Fees., of these policies,
establishes harbor permit transfers at a fee of �1-50. The harbor permit
transfer fee is for administrative processing of the transfer and includes
staff costs for inspection and follow up as needed.
The staff does not have the discretionary authority to waive pier permit
transfer fees. The Marine Department processes approximately 100 transfers
per year. The majority of these transfers occur when the abutting upland

property is sold during escrow. Infrequently, the staff is requested to transfer
harbor permits because of an inheritance, estate change or business transaction,
without the benefit of a transfer fee. These requests, if discretionary are
referred to the Council for disposition.

CdM Traffic
Plan Citizens Advisory Committee regarding the
Survey
Corona del Mar traffic survey.
The following people addressed the Council in
favor of the survey: Frank Jank, President of the
Corona del Mar Chamber of Commerce, and Per
Trebler.
Calvin McLaughlin, Secretary of the Transportation
Plan Citizens Advisory Committee, addressed the
Council regarding the Committee's report.
John Cole and Roy Giordano addressed the Council
and opposed the survey.

Councilman McInnis made a motion to establish a
subcommittee to consist of six members from the
Transportation Plan Citizens Advisory Committee to
be appointed by the Chairman, and six members from
the Corona del Mar Coordinating Council of Com-
munity Associations to be appointed by the head of
that organization, and to specifically direct this
Committee to divide a questionnaire into two major
parts with first consideration aimed at getting
the community concepts of short-term problems that
can be implemented by the Council within one or
two years. At the time that report is brought
back to Council, consideration can be given to
developing a questionnaire for long-range solu-
tions.
Councilman Kuehn asked that the motion be amended
to ask that the report be brought back to the
first meeting in February, or sooner, which
amendment was accepted by the maker of the motion.
