BACKGROUND: The City Council Harbor Permit Policies, specifically the section titled, "Balboa Island", restrict the construction of non-commercial piers on Balboa Island as follows: "No new, non-commercial piers on Balboa Island shall be recommended unless it is in the public interest or unless it is at such a location that it is not usable for swimming or bathing. Piers presently in use may be repaired but recommendations for any additions or remodeling shall be restricted to such changes that do not lessen the use of either the immediate water or land areas." Based on this section, staff has not allowed any new piers constructed on Balboa Island since 1964. City Council Harbor Permit Policies do allow for exceptions to these requirements as indicated in the sections titled "Exceptions" as follows: "Exceptions may be approved to any of the requirements and regulations set forth if there are special circumstances or conditions affecting the harbor installations that would impose undue hardship on the applicant, or a waterfront property owner's access to the water is impacted by a public works project, or if it would be detrimental to the best interest of the City." Currently a Public Work's project is underway to seismically retrofit the Balboa Island Bridge. The project requires the placing of new pilings and pile caps adjacent to the existing bridge for additional support. In the case of the applicants, two of these piles and pile caps will encroach 8' into their permit zone directly bayward of their property. It is the applicant's position that this encroachment impacts their access to the water and therefore bringing them within the above quoted exception section. As a result, they are requesting they be granted an exception to the policy section titled, "Balboa Island", and that they be allowed to build two new non-commercial piers as depicted in the attached drawings. As required by the Harbor Permit Policies, residents within 300 feet of both projects have been notified of the Council's consideration of these applications. The Balboa Improvement Association and the Little Balboa Island Property Owner's Association have also been notified. The Fire and Marine Department has received the attached letters of support from the Little Balboa Island Property Owner's Association and the Balboa Island Improvement Association. The purpose of this letter is to inform you of that decision and that those moorings will not be reinstalled once the bridge retrofit is complete. Notice of Receipt and Acknowledgment. The permit is not valid and development shall not commence until a copy of the permit, signed by the permittee or authorized agent, acknowledging receipt of the permit and acceptance of the terms and conditions, is returned to the Commission office. 2. Expiration. If development has not commenced, the permit will expire two years from the date on which the Commission voted on the application. Development shall be pursued in a diligent manner and completed in a reasonable period of time. Application for extension of the permit must be made prior to the expiration date. 3. Compliance. All development must occur in strict compliance with the � proposal set forth in the application for permit, subject to any special conditions set forth below. Any deviation from the approved plans must be reviewed and approved by the staff and may require Commission approval. 4. Interpretation. Any questions of intent or interpretation of any condition will be resolved by the Executive Director or the Commission. 5. Inspections. The Commission staff shall be allowed to inspect the site and the project during its development, subject to 24-hour advance notice. 6. Assignment. The permit may be assigned to any qualified person, provided assignee files with the Commission an affidavit accepting all terms and conditions of the permit. 7. Terms and Conditions Run with the Land. These terms and conditions shall be perpetual, and it is the intention of the Commission and the permittee to bind all future owners and possessors of the subject property to the terms and conditions. SPECIAL CONDITIONS: 1. Storage of Construction Materials, Mechanized Equipment and Removal of Construction Debris Disturbance to the harbor bottom and intertidal areas shall be minimized. The applicant agrees not to store any construction materials, oils or liquid chemicals or other waste where it is subject to wave erosion and dispersion into the harbor waters. The applicant shall remove from the beach, bulkhead and dock area any and all debris resulting from the removal of the existing dock and the construction of the new dock.
