December 21,1998 Newport Beach Harbor Permittee Re: Harbor Permits 151-1305 and 151-1407 Dear Harbor Permittee: On December 14,1998, the City Council awarded the contract to do the Balboa Island Bridge seismic retrofit. This particular contractor will employ construction equipment that may necessitate the temporary relocation the floating portion of your residential dock. The reason for this relocation would be to permit the contractor to position his barge in close enough to the bridge to do the piling work. The cost of this relocation and reinstallation would be the responsibility of the Harbor Permittee as provided by Chapter 17.24 of the Newport Beach Municipal Code. The City, however, could assist you in finding a temporary location to store the float and the vessels that are now bayward of your residence. As quickly as the contractor gives us a schedule for this relocation, we will contact you. If you have questions or wish to discuss this further please contact me at 949-644-3041. As I told you on that date, it is my under- standing that the City's contractor will be reinstalling the shore buoys soon and, in fact, the moment we can free up a man for this purpose it will be done. in the interim, if you need a place to temporarily moor a vessel, the Harbor Depart- ment has indicated they can provide space for those people who have been displaced by the bridge construction. On another note, some time ago I mentioned to you that your pier appeared to have some structural problems, particularly with the pier stringers and wooden piles that support them. On a recent field inspection I noticed that several of these had rotted through and could pose a safety problem if not replaced or repaired, as required by Section 4H of the Newport Beach Harbor Permit Policies, which states: "Repairs: The Permittee shall keep the structures in good repair at all times. Failure to repair, when written notice has been given by the Marine Depart- ment, shall be cause for the revocation of the permit". Acceptance of Provisions: It is understood and agreed by the Permittee that the doing of any work under this permit shall constitute an acceptance of all the provisions. 2. Permit from Other Agencies: The party or parties to whom this permit is issued shall, whenever the same is required by law, secure the written order or con- sent of any work hereunder from the U.S. Corps of Engineers or any other public body having jurisdiction, and this permit shall be suspended in operation unless and until such order or consent is obtained. 3. Transferring Permit: This permit is not transferable without the written consent of the Public Works Department or of the City Council of the City of Newport Beach if Council approval is required. 4. Inspection: The work shall be subject to the supervision and approval of the Public Works Department. The Permittee shall notify the Public Works Department at least 3 days in advance of the date work is to begin and before its com- pletion. 5. Protection of Traffic: Adequate provisions shall be made for the protection of the traveling public. Barricades shall be placed on streets, with lights at night, also flagmen employed, all as may be required by the particular work in progress. The Permittee shall not attempt to forbid the full and free use by the public of all navigable waters at or adjacent to the work or structure. If the dis- play of lights and signals on any work hereby authorized is not otherwise provided by law, such lights and signals, as may be prescribed by Bureau of Light Houses, Department of Commerce, shall be installed and maintained at the expense of the Permittee. Structures shall be so constructed as not to obstruct, interfere with or pre- vent the free use or passage of any sidewalks, street, alley, public way or navigable channel. 6. Liability for Damages: The Permittee is responsible for all liability for personal injury or property damage which may arise out of work herein permitted, or which may arise out of the use or possession of said works, and in the event any claim is made against the City of Newport Beach or any department, officer, or employee thereof, through, by reason of, or in connection with. such work, Permittee shall defend, indemnify and hold them, and each of them, harmless from such claim. 7. Revocation of Permit: The rights given under this permit are permissive only, and the City of Newport Beach reserves full right, power, and authority to re- voke this permit at anytime. In the event the Permittee fails to remove said works within the time specified, then the City Engineer shall have the right to immediately remove same at the cost and expense of the Permittee. 8.
