The facility was inspected on August 24,1998. We cannot transfer the pier permit until the following deficiency has/have been corrected and we have been notified of the corrections: 1. A City approved anti -syphon device is required at the water connection for the water supply to the pier and float. A sketch showing the approved type of device and its installation is enclosed. This requirement is in accordance with Title 17 of the California Administrative Code. The Newport Beach City Council Harbor Permit Policies state: 10.1). "At the time of transfer, all harbor structures shall be inspected For compliance with the City's minimum plumbing, electrical, and Structural requirements and the conditions of the existing permit. I again also advised that the Captain was still living on the boat which is I understand against the Harbor Permit Policy. I explained that this was second incident of a boat encroaching on our property since Mr. Hargraves was notified that there was to be no more encroaching on our property. I have also requested that you carbon copy any letter to either the owner of the property at 331 East Bayfront and/or the Prowler Two so that I will be aware of what action is being taken by your department. I have to date received two copies of letters written. A letter to Messrs Hargraves and Henrix dated 9/24/87. Also a letter written by Mr. Hargraves dated 9/1/87 to Johnnie Crean. Hargrqaves and Hendrix 623 Pacific Boulevard Huntington Park, CA 90255 Re: Harbor Permit 152-331 for the property at 331 East Bay Front, Balboa Island Dear Sirs: On May 27, 1988 1 correspended with you regarding some problems bayward of your property at 331 East Bay Front. Specifically, the problems were that a boat was extending across the side property lines between 331 and 337 East Bay Front and that a liveaboard situation was occurring on the vessel berthed on the westerly side of the dock at 331 East Bay Front. It is my understanding, based on a phone call from Mr. Hargraves, that the encroachingf vessel the "Good Tern" has been removed and that the situation regarding living aboard the "Prowler II" has been terminated. In that regard, unless those problems recur, we will consider that these problems have been resolved. For your information, I am including with this letter a copy of a letter received by the Marine Department on May 30, 1988 signed by four property owners who live in the general area of 331 East Bay Front. As you can see by their letter, they feel that a serious nuisance situation has occurred at your dock in the past and they hope to have the Marine Department resolve this problem if possible.
