Kathleen Burnham, the FouAon's Director and the only staff me.. 0 who will be paid with
grant funds will personally provide Support Services with the exception of volunteers /interns
from participating Community Colleges. Ms. Burnham will train college students to function as
interns who help participants select classes that satisfy Drug Court requirements and assist them
with enrollment, registration, counseling opportunities and financial aid information. Ms
Burnham has more than three years experience working with the Drug Court Program — as a paid
educational liaison and a volunteer working under the direction of Judge Wendy Lindley - and
she is currently providing some of the proposed Support Services as a volunteer. Ms. Burnham
has a certificate in Drug and Alcohol counseling and has attended numinous seminars relevant to
the Drug Court Program. Ms Burnham will also utilize the wide - ranging resources available
through NCADD -OC. The Director will devote approximately 30 hours a week to provide
Support Services and will have no other employment or contractual relationship.
Grant McNiff, the Executive Director of NCI ADD-OC will devote approximately five percent of
his time to the Foundation but this time will not be compensated with grant funds. Ms. Burnham
will work in cooperation with the Drug Court Coordinators and the Foundation's Advisory Board
to identify the specific needs for each of the; five adult Drug CourL% and will attend Drug Court
Team meetings to better understand how the Foundation t= be of assistance to the Drug Court
Program and participants.
2 Very low and low income benefit

Income documentation is maintained by the Orange County Probation
Depamnent and the income level for each participant will be available
to the Foundation. The Foundation will be able to provide the City of
Orange with the income level of each City of Orange who is a
participant in the Drug Court Program. Virtually all of the Drug Court
participants are low or.very low income persons.

SUBJECT: Contract with Former City Attorney
Approve and authorize the City Manager to sign the proposed Temporary Employment
Agreement with Robert Burnham.
DISCUSSION:
Background:
City Council Policy F -20 provides that contracts with former employees shall require the
approval of the City Council. City Attorney Bob Burnham, retired effective August 20,
2004. He has agreed to assist both the City Manager and the Acting City Attorney
during the recruitment process for hiring a new City Attorney as well as any transition
Period after the new City Attorney is selected. The attached Temporary Employment
Agreement will provide for those services through the end of this current fiscal year at
an hourly rate of $120.00 per hour.
Examples of the types of issues Mr. Burnham would be working on include the
following: Sphere issues, John Wayne Airport, Friends of Oasis Cooperative Agreement
and Group Home issues.

AGREPENT FOR TEMPORARY EMPLO NT
This Agreement is made effective as of the 25" day of August 2004, by and between the
City of Newport Beach, a Municipal Corporation ( "City") and Robert H. Bumham
( "Employee ") with reference to the following:
A. The City desires to employ Employee on at -will basis and to enter into an
Agreement with Employee for temporary employment services upon the terns and
conditions in this Agreement.
B. Employee is willing to accept such employment on the terms and conditions set
forth in this Agreement.
NOW, THEREFORE, it is mutually agreed by and between the undersigned parties as
follows:
The term of this Agreement shall commence upon the 25" day of August, 2004,
and terminate on June 30, 2005, unless terminated earlier as provide in paragraph
5 below.
2. Services To Be Performed By Emolovee:
Provide legal consulting services with regard to the following projects: Sphere
Issues; Friends of Oasis Cooperative Agreement, John Wayne Airport and other
issues as may be requested from time to time by the City Manager or the (Acting)
City Attorney.
3. Compensation:
As consideration for the performance of specified services under this Agreement
Employee shall be compensated as follows:
a. Pay of $120.00 per hour for hours worked pursuant to this Agreement. Pay
shall be subject to State and Federal income tax withholding. $120.00 per
hour shall be considered just compensation and no additional benefits or
holiday pay will be provided under this Agreement.
b. City shall pay Employee no later than 30 days after the City Manager's
approval of a statement of hours worked. The statement shall include a
brief description of the legal services performed and/or specific project
Involved, and the date and number of hours worked.
4. Hours:
No hours of work are guaranteed. Employee's services will be provided 10 to 20
hours per week, or as agreed upon from time to time, but not to exceed 78 hours
per month.

5. Termination:
Employee understands and agrees that:
a. Employee's employment is at will which means that Employee's
employment with City may be terminated at any time, with or without cause,
by either party by giving 30 days prior written notice to the other party.
b. Employee's at -will status cannot be changed except in writing on a form
signed by both the City Manager and Employee. No representative or other
employee of the City, other than the City Manager, has any authority to
enter into an agreement with Employee for any specific period of time or to
change Employees employment contrary to the at -will status provided in
this Agreement.
C. No promises or representations regarding regular employment have been
made to Employee and Employee has no expectation of permanent
employment with the City.
d. Upon termination of this Agreement, the City shall pay to Employee that
portion of compensation specified in this Agreement that is earned and
unpaid prior to the effective date of termination.
6. Integrated Contract This Agreement represents the full and complete
understanding of every kind or nature whatsoever between the parties hereto and
all preliminary negotiations and agreements of any kind or nature are merged
herein. Any modification of this Agreement will be effective only by written
execution signed by both Employee and City Manager.
IN WITNESS WHEREOF, the parties have caused this Agreement to be execrated on the

FOR TEMPORARY EMPLOYMENT
This Agreement is made effective as of the 2nd day of June, 2004, by and between the City of
Newport Beach, a Municipal Corporation ( "City ") and Catherine Martin Wolcott whose address is
( "Employee ") with reference to the following:
RECITALS
A. The City desires to employ Employee on at -will basis and to enter into an Agreement with
Employee for temporary employment services upon the terms and conditions in this
Agreement.
B. Employee is willing to accept such employment on the terms and conditions set forth in this
Agreement.
NOW, THEREFORE, it is mutually agreed by and between the undersigned parties as follows:
1. Commencement: The term of this Agreement shall be effective as of the 2' day of
June, 2004, and shall terminate on thirty (30) day notice by either party.
2. Services To Be Performed By Employee: Services shall include the following: Legal
research, review or drafting of agreements, ordinances and policies at the direction of
Assistant City Attorney and such other duties as may be requested.
3. Compensation: As consideration for the performance of specified services under this
Agreement Employee shall be compensated as follows:
a. Pay of fifty five dollars ($55.00) per hour for hours worked pursuant to this
Agreement. Employee shall be paid on a bi- weekly basis subject to State and
Federal income tax withholding. Fifty five dollars ($55.00) per hour shall be
considered just compensation and no additional benefits or holiday pay will be
provided under this Agreement.
b. Employee shall maintain and submit complete records of time expended pursuant to
this Agreement corresponding to City's payroll schedule.
4. Hours:
a. No hours of work are guaranteed. Employee's services will be provided
approximately twenty (20) hours per week, or as agreed upon from time to time.
b. Employee's workweek shall be designated weekly, as agreed by the Parties.

Employee's employment is at will which means that Employee's employment with
City may be terminated at any time, with or without cause, by either party by giving
24 hours priorwritten notice to the other.party.
b. Employee's at -will status cannot be changed except in writing on a form signed both
by the Human Resources Manager and Employee. No representative or other
employee of the City, other than the City Manager, has any authority to enter into an
agreement with Employee for any specific period of time or to change Employees
Employment contrary to the at -will status provided in this Agreement.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH, CALIFORNIA,
ADOPTING AN UPDATED DESIGNATED
EMPLOYEES LIST FOR 2007
WHEREAS, the California Political Reform Act, Government Code Section
81000 et seq requires every local Governmental agency to adopt and promulgate a Conflict of
Interest Code; and
WHEREAS, the Fair Political Practices Commission has adopted regulations for
compliance with the Act under Title 11, Division Vl of the California Code of Regulations Me
Regulations"; and
WHEREAS, Section 18730 of the Regulations provides that incorporation by
reference of the terms of Section 18730, along with the designation of employees and the
formulation of disclosure categories, constitutes the adoption and promulgation of a Conflict of
Interest Code as required by Government Code Section 87300 or the amendment of a Conflict of
Interest Code within the meaning of Government Code Section 87307; and
WHEREAS, on February 26, 1990 the City Council adopted Resolution No. 90-
21 which adopted Section 18730 as provided under the Regulations, along with a Designation of
Employees; and
WHEREAS, subsequent to February 26, 1990 the City Council adopted
Resolution Nos. 96-28, 97 -8, 97 -82, 98-I2, 99-1, 20W -12, 2000 -99, 2002 -08, 2002 -86, 2W3 -64, .
2004 -96 and 2006 -1 amending the list of designated employees. Since the adoption of these
resolutions, .there have been furtherr personnel changes, therefore the City Council has
determined that the City's Designated, Employees List should be updated to reflect these
changes. The 2007 Designated Employees List, which reflects staffing changes during the year,
is attached hereto as Exhibit "A ".
Now, THEREFORE, BE rr RESOLVED, by the City Council of the City of
Newport Beach, California, as follows:

disclosure categories is hereby adopted and incorporated as part of the City's Conflict of Interest
Code for the City of Newport Beach.
