SUBJECT: BACK BAY SCIENCE CENTER— COMPLETION AND ACCEPTANCE
OF CONTRACT NO. 3460 WITH SOUTHERN CALIFORNIA GRADING,
GAMUT FRAMING CO., VANCE & ASSOCIATES, INLAND BUILDING
COS., S.H. FISH ELECTRIC, AND ROMERO GENERAL
CONSTRUCTION CORP.
RECOMMENDATIONS:
1. Accept the work performed and completed by Southern California Grading,
Gamut Framing Co., Vance& Associates, Inland Building Cos., S.H. Fish Electric,
and Romero General Construction Corp.
Authorize the City Clerk to file a Notice of Completion for each trade contractor.
3. Authorize the City Clerk to release the Labor and Materials bonds 35 days after
the Notice of Completions have been recorded in accordance with applicable
portions of the Civil Code.
4. Release the Faithful Performance Bonds 1 year after Council acceptance.
DISCUSSION:
On February 28, 2006, the City. Council authorized the award of 12 trade contracts for
construction of the Back Bay Science Center. Three more trade contracts were
awarded on August 22, 2006. The total value of the 15 trade contracts awarded is
$4,735,709.00. The work of nine of the trade contractors has been previously accepted
by the City Council (Junior Steel Co. on May 22, 2007; Kewaunee, Dow Diversified, and
Metropolitan Floor Coverings on June 12, 2007; and J.G. Tate Fire Protection,
Standard Drywall, U.P. Landscaping, Control Air, and Continental Plumbing on
September 11, 2007.)
The work of the remaining six trade contractors has been completed to the satisfaction
of the Public Works Department and is recommended for acceptance. Southern

California Grading performed the site earthwork and constructed the parking area and
driveway pavement. Gamut Framing Company constructed the building walls and
siding, the roof trusses and sheeting, and the "trek" walkways. Vance and Associates
furnished and installed the asphalt roof shingles, roof vents, and eave gutters and down
drains. Inland Building Companies furnished and installed building signage (interior and
exterior) and restroom partitions and furnishings. S.H. Fish Electric furnished and
installed the project electrical systems and telecommunication conduits. Romero
General Construction Corporation handled the project's concrete construction work
which included reinforced concrete mat foundations for all three buildings, parking area
curbs and flatwork, segmental gravity retaining walls, and entry place walkways and
decorative hardscape.

The majority of the increases are the result of adding the construction of the
Administration Building to complete the third wing of the overall project. Funding for
costs associated with the Administration Building is being provided by The State
Department of Fish and Game. The City Council authorized adding the Administration
Building Construction on January 23, 2007. A tabulation of the contract change orders
for the six trade contractors is included with this report as Exhibit 1. The increased cost
for materials as compared to the earlier initial bids is evident in some of the change
order amounts.
Environmental Review:
A Mitigated Negative Declaration was prepared and processed to assess the
environmental impact .associated with constructing the Back Bay Science Center.
Identified mitigation measures have been included in the project design and
construction. The California Department of Fish and Game was the lead agency for the
environmental review and the documentation was completed in September 2003.

Geotechnical /Survey Services:
Compaction testing of trench backfill was provided by Bagahi Engineering, Inc., the
Project geotechnical engineering firm. Construction staking and alignment verification
for underground pipelines and structures was provided by Walden & Associates, the
project civil engineering firm. Walden & Associates also provided the building height
verifications. Deputy inspection and materials testing was provided by Harrington
Geotechnical Engineering, Inc.
Construction Management:
On February 28, 2006, the City Council approved a guaranteed maximum price
agreement with Douglas E. Barnhart to provide construction management at risk services.
Under this agreement, Barnhart has been serving as the general /prime contractor on
behalf of the City, scheduling and managing the various construction activities of the 15
trade contracts as well as handling administrative efforts for the project. On January 23,
2007, the City Council approved two amendments to the agreement allowing for costs
incurred from delays relating to the nesting of ospreys and for fees relating to Barnhart's
expanded scope, including the construction of an additional Administration Wing, trade
contracts that were awarded in August 2006 and requested change orders by the County
of Orange. The original agreement also includes provisions whereby Barnhart is eligible
for a 30 percent share of the unused balance of contingency allowances that were
incorporated into each trade contract and .fees resulting from. aggregate change orders
that increase the value of all trade contracts.

The work work of these six trade contractors was completed in a timely manner and
consistent with the overall project construction schedules established by the
Construction Manager, Douglas E. Barnhart, Inc. The completion date for the scope of
work covered by the initial contracts was June 7, 2007. The change order work added
to the contracts for construction of the Administration Building extended the completion
date to September 7, 2007. A final report on this project will be provided to the City
Council in October, 2007.
