HomeMy WebLinkAbout15 - City Council Ad Hoc Committe on Group Residential UsesCITY OF NEWPORT BEACH CITY COUNCIL STAFF REPORT Agenda Item No. 15 October 9th, 2007 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: City Manager's Office Dave Kiff, Assistant City Manager 9491644 -3002 or dkiff @city.newport- beach. ca. us SUBJECT: Resolution 2007 - Relating to the City Council Ad Hoc Committee on Group Residential Uses ISSUE: Should the City; Council appoint a 3- member ad hoc committee to interact with special counsel and serve as liaison to the full City Council on group residential issues? RECOMMENDATION: Adopt Resolution 2007 -_ creating the City Council ad hoc Committee on Group Residential Uses, whose purpose shall be to interact with special counsel and serve as liaison to the full City Council on group residential issues; and 2. Appoint Council Members and to the City Council ad hoc Committee on Group Residential Uses. DISCUSSION: In recent months, the City Council, the Planning Commission, City staff, residents, certain businesses and others have discussed a series of changes to the City's codes relating to group residential uses. These uses include, but are not limited to: Boarding and Lodging Houses; Residential Care Facilities, Large and Small, Licensed and Unlicensed; and Parolee - Probationer Homes. At the September 11, 2007 meeting, the Council adopted Resolution 2007 -_ that formed an ad hoc committee to interview law firms that would serve as special counsel on this issue and would report directly to the City Council. After reviewing the qualifications of several firms, the Committee selected Richards Watson Gershon (RWG and at www.rwgiaw.com) as special counsel to the City. Following the Council's Ad Hoc Committee on Group Residential Uses October 9, 2007 Page 2 selection of special counsel on September 25`", 2007, the ad hoc Committee's term and jurisdiction concluded. This agenda. item authorizes the creation of a new ad hoc committee to work on group residential uses. The Committee would interact directly with RWG and would serve as a liaison to the full City Council on these same issues. Activities anticipated during the Committee's term include the re- authorization of the current moratorium on certain group residential uses, the adoption of new ordinances relating to group residential uses, and the initial implementation phase of the new ordinances. Environmental Review: The City Council's approval of this Agenda Item does not require environmental review. Public Notice: This agenda item may be noticed according to the Brown Act (72 hours in advance of the public meeting at which the City Council considers the item). Submitted by Dave Kiff Assistant City Manager Attachments: Resolution 2007- 0 Ad Hoc Committee on Group Residential Uses October 9, 2007 Page 3 RESOLUTION 2007- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH FORMING THE CITY COUNCIL AD HOC COMMITTEE ON GROUP RESIDENTIAL USES WHEREAS, the City of Newport Beach is considering the adoption of new ordinances relating to Group Residential Uses; and WHEREAS, Group Residential Uses include boarding and lodging houses, short term lodgings, group care facilities, and related uses; and WHEREAS, the City Council has retained special legal counsel to advise the City Council, the Planning Commission, and City staff on these matters; now, therefore be it RESOLVED by the City Council of the City of Newport Beach that it hereby creates the Ad Hoc Committee on Group Residential Uses, with. the following duties and requirements: 1. To interact with special counsel regarding group residential uses; and 2. To serve as a liaison to the full City Council on group residential uses; and 3. The Committee shall consist of three members of the Newport Beach City Council; and 4. The Committee's term shall expire at the later of December 31, 2008 or earlier should the City Council deem the Committee no longer necessary. ADOPTED this 91h Day of October, 2007.
