SUBJECT: INITIATIVE MEASURE AMENDING THE CITY OF NEWPORT BEACH
CHARTER TO LOCATE A NEW CITY HALL AT NEWPORT CENTER
RECOMMENDATION:
a) Approve the certification of the "Initiative Measure Amending the City of Newport
Beach Charter to Locate a New City Hall at Newport Center";
b) Adopt Resolution No. 2007 -_ Calling and Giving Notice of the Holding of a
Special /General] Municipal Election on [Date to be Determined], for the
Submission of a Proposed Charter Amendment;
c) Adopt Resolution No. 2007- Requesting the Board of Supervisors of the
County of Orange to Consolidate a [Special /General] Municipal Election to be
Held on [Date to be Determined], with the [Presidential Primary/Statewide Direct
Primary/General] Election to be Held on the Same Date Pursuant to §10403 of
the Elections Code;
d) After discussion, adopt Resolution No. 2007 - Setting Priorities for Filing a
Written Argument Against the Measure and Directing the City Attorney to
Prepare an Impartial Analysis;
e) Adopt Resolution No. 2007-_ Providing for the Filing of Rebuttal Arguments for
City Measure(s) Submitted at Municipal Elections; and
f) Approve a budget amendment (08BA -015) in the amount of $42,000 from
Unappropriated General Fund reserves to cover the cost of the signature
verification ($36,958), plus an additional $5,042 for ancillary expenses
associated with the election (translations, publications, etc.)
DISCUSSION:
Background:
On May 7, 2007, the proponents of the "City Hall in the Park" charter amendment
initiative filed the Notice of Intent with the City Clerk's office. On August 24, 2007,
subsequent to following the required steps required by the Elections Code, the

proponents submitted the petition containing approximately 15,028 signatures to the
City Clerk's office.
On October 1, 2007 the Orange County Registrar of Voters office finalized the signature
verification process and presented the following information to the City (copy attached):

Number of signatures found valid: 8,997
Number of signatures found invalid: 1,873
The proponents of the petition have been notified of the sufficiency of the petition and
pursuant to Elections Code §9114, this staff report serves as notice to the City Council
of my certification of the results of the examination of signatures conducted by the
County.
Based on the fact that the petition contained signatures representing not less than 15%
of the registered voters of the City according to the County election department's last
official report of registration to the Secretary of State, pursuant to Elections Code
§1415, the Council shall submit the proposed charter amendment to the voters at either
the next regular general municipal election occurring not less than 88 days after the
date of the order of election, or at a special election called for that purpose or at any
established election date pursuant to Elections Code §1000 occurring not less than 88
days after the date of the order of election.
The established election dates pursuant to EC §1000 are as follows:
a) The second Tuesday of April in each even - numbered year (April 8, 2008).
b) The first Tuesday after the first Monday in March of each odd - numbered
year (March 3, 2009).
c) The first Tuesday after the first Monday in June in each year (June 3,
2008).
d) The first Tuesday after the first Monday in November of each year
(November 4, 2008).
e) The first Tuesday in February of each year divisible by the number four
(February 5, 2008) [added by SB113, Chapter 2, effective 1/1/08].
In order to consolidate with the County, Council would need to select February 5, 2008,
June 3, 2008 or November 4, 2008 as the election date. All other dates would be
considered stand -alone elections. As per the Elections Code, the election date must be
set at least 88 days prior to the election. Based on a preliminary estimate from the
County, the estimated cost for each of the above named elections would be as follows:

The calculation of estimates for consolidated elections (February and June) is based
upon a projection of total jurisdictional participation and a 10% increase in voter
registration over current registration. The projection formulae are based upon
experience over past elections of this type.
The cost for placing this item on the ballot in November is so much less since this is the
date for the City's General Municipal election. The calculation of estimates for the
inclusion of measures in consolidated elections (November) is based primarily upon
additional translation, printing and mailing costs and an estimate of the length of the
measure, arguments and rebuttals.
The calculation of estimates for stand -alone elections is made on the same basis as
consolidated elections, but Newport Beach would bear the entire cost of the election.
At the same time that Council adopts the resolution calling the election, resolutions also
must be adopted requesting consolidation with the County, setting priorities for filing of
written argument(s) and directing the City Attorney to prepare an impartial analysis, and
authorizing rebuttal arguments.
The Elections Code ( §9282) provides that the persons filing an initiative petition may file
a written argument in favor of the measure, and the legislative body may submit an
argument against the measure. EC §9287 sets priorities for which argument is chosen
for printing by the Election Official if two or more arguments are submitted in favor of or
against a measure. Although some types of measures give the Council automatic first
priority to file arguments, if it is the Council's desire to ensure that they have first priority
in submitting arguments against the measure, formal action is required (adoption of
attached resolution). If Council does not authorize one to five Council Members to
submit the argument against the measure, they cannot designate anyone else or
designate members of Council in combination with non - members to submit the
argument. In these instances, the resolution would not be adopted and the priority for
the selection of the ballot arguments would fall to EC §9287. The arguments shall not
exceed 300 words in length and requires that at least one, but not more than five,
persons sign it. If Council orders the election to be held on February 5, 2008, the
deadline for submitting direct arguments is 5:30 p.m. on Tuesday, October 23, 2007.
In addition, Council may direct the City Clerk to transmit a copy of the measure to the
City Attorney to prepare an impartial analysis of the measure showing the effect of the
measure on existing law and the operation of the measure. The analysis shall not
exceed 500 words in length. If Council orders the election to be held on February 5,

2008, the deadline to submit the impartial analysis to the Election Official is 5:30 p.m.,
Tuesday, October 23, 2007.
In prior elections, the Council has authorized rebuttal arguments for ballot measures,
however the resolutions authorizing the arguments were only applicable to each
particular election, therefore, if it is the desire of Council to allow rebuttal arguments for
this measure, it is necessary to adopt the attached resolution authorizing rebuttal
arguments. If authorized, the rebuttal arguments (not to exceed 250 words) are due not
more than 10 days after the direct arguments are due. If the Council orders the election
to be held on February 5, 2008, the deadline for the submission of rebuttal arguments
will be 5:00 p.m., Friday, November 2, 2007.
If Council selects any of the other election dates, the deadlines for the submission of
direct arguments, the impartial analysis and rebuttal arguments will be determined just
prior to the elections once the County of Orange has established their calendars for
those elections. All interested parties will be properly notified of the deadlines.
In addition, at this time, it is necessary that Council approve a budget amendment in the
amount of $42,000 to cover the cost for the signature verification ($3.40 per signature x
10,870 signatures - $36,958) incurred by the County of Orange. The balance of the
funds will be used for ancillary election costs such as translations, publications, etc. The
balance of the election costs will be handled through a subsequent budget amendment.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, CALLING AND
GIVING NOTICE OF THE HOLDING OF A
[SPECIAUGENERAL] MUNICIPAL ELECTION ON
[DATE TO BE DETERMINED], FOR THE SUBMISSION
OF A PROPOSED CHARTER AMENDMENT
WHEREAS, Section 1003 of the Charter of the City of Newport Beach provides that the
powers of the initiative and referendum are reserved to the electors of the City and that the
provisions of the Elections Code of the State of California shall apply to the use of the initiative
and referendum in the City; and
WHEREAS, pursuant to authority provided by Article XI of the Constitution and Title 4,
Division 2, Chapter 3 of the Government Code and Division 9, Chapter 3, Article 3
(commencing at §9255) of the Election Code of the State of California, a petition has been filed
with the legislative body of the City of Newport Beach signed by more than fifteen per cent of
the registered voters of the city according to the county election department's last official report
of registration to the Secretary of State to submit a proposed charter amendment to the voters;
and
WHEREAS, the City Council is authorized and directed by statute to submit the
proposed charter amendment to the voters.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS
FOLLOWS:
SECTION 1. That pursuant to Article XI of the Constitution and Title 4, Division 2,
Chapter 3 of the Government Code and Division 9, Chapter 3, Article 3 (commencing at §9255)
of the Election Code of the State of California, there is called and ordered to be held in the City
of Newport Beach, California, on [Date to be Determined], a [General/Special] Municipal
Election for the purpose of submitting the following proposed charter amendment:

furnish any and all official ballots, notices, printed matter and all supplies, equipment and
paraphernalia that may be necessary in order to properly and lawfully conduct the election.
SECTION 5. That the polls shall be open at seven o'clock a.m. of the day of the election
and shall remain open continuously from that time until seven o'clock p.m. of the same day when
the polls shall be closed, except as provided in § 14401 of the Elections Code of the State of
California.
SECTION 6. That in all particulars not recited in this resolution, the election shall be
held and conducted as provided by law for holding municipal elections.
SECTION 7. That notice of the time and place of holding the election is given and the
City Clerk is authorized, instructed and directed to give further or additional notice of the
election, in time, form and manner as required by law.
SECTION 8. That the City Clerk shall certify to the passage and adoption of this
resolution and enter it into the book of original resolutions.

Section 1. Amendment.
Article IV of the City Charter of Newport Beach is amended by adding the following
provisions as Section 425:
"Section 425. City Hall. City Hall, and the administrative offices of the City of Newport Beach,
and related parking, shall be located on and within the 12.82 acres of real property owned by the
City of Newport Beach described as Parcel 3 of Parcel Map No. 90 -361 in the City of Newport
Beach, which is bounded by Avocado Ave. on the west, San Miguel Dr. on the north, and
MacArthur Blvd. on the east, and the Newport Beach Central Library on the south."
Section 2. Findings.
The people of Newport Beach find that adoption of this Charter amendment to locate a
new City Hall at Newport Center will serve their public convenience, health and safety, and
general welfare. A new City Hall at Newport Center will alleviate current poor conditions of the
existing structure and help serve the entire community through placement of City Hall at a more
central location to the population base of the city. Anew City Hall at Newport Center will
reduce emergency health and safety concerns associated with the existing location.
Section 3. Severability.
If any section, subsection, sentence, phrase, or clause of this initiative is declared invalid
by a court of competent jurisdiction, the remaining sections, subsections, sentences, phrases and
clauses shall remain valid and enforceable. The voters declare that they would have passed all
sections, subsections, sentences, phrases and clauses of this initiative without the section, phrase
or clause declared invalid by a court of competent jurisdiction.
Section 4. Consistency with Other Ballot Measures.
If another ballot measure is placed on the same ballot as this measure and deals with the
same subject matter, and if both pass, the voters intend that both measures shall be put into
effect, except to the extent that specific provisions of the measures are in direct conflict. In the
event of a direct conflict, the measure which obtained more votes will control as to the directly
conflicting provisions only. The voters expressly declare this to be their intent, regardless of any
contrary language in any other ballot measure.
Section 5. Amendments.
No provision of this initiative may be amended or repealed except by a vote of the people
of the City of Newport Beach.
Section 6. Conflict.
If any provisions of this initiative conflict with any provision of the City of Newport
Beach General Plan or the City of Newport Beach Municipal Code, the provisions of this
initiative shall supersede any conflicting provisions.
Section 7. Consistency.
To the extent permitted by law, the voters of the City hereby authorize and direct the City
to amend any elements or provisions of the City of Newport Beach General Plan and City of
Newport Beach Municipal Code and all other City ordinances, policies, and implementation
programs or policies, as soon as possible, in order to implement this initiative and to ensure
consistency and correlation between this initiative and other elements of the City of Newport
Beach General Plan and City of Newport Beach Municipal Code. This enabling legislation shall
be interpreted broadly to promote the requirement that a general plan constitute an integrated and
consistent document.

TO BE HELD ON THE SAME DATE PURSUANT TO

WHEREAS, the City Council of the City of Newport Beach, California called a
[General/Special] Municipal Election to be held on [Date to be Determined], for the purpose of

RESOLUTION NO.2007-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, PROVIDING FOR
THE FILING OF REBUTTAL ARGUMENTS FOR CITY
MEASURE(S) SUBMITTED AT MUNICIPAL ELECTIONS
WHEREAS, Sections 9220 and 9285 of the Elections Code of the State of California
authorizes the City Council, by majority vote, to adopt provisions to provide for the filing of
rebuttal arguments for City measures submitted at municipal elections.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH,
CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That pursuant to Sections 9220 and 9285 of the Elections Code of the State
of California, when the elections official has selected the arguments for and against the measure
which will be printed and distributed to the voters, the elections official shall send a copy of an
argument in favor of the proposition to the authors 'of any argument against the measure and a
copy of an argument against the measure to the authors of any argument in favor of the measure
immediately upon receiving the arguments.
The author or a majority of the authors of an argument relating to a city measure may
prepare and submit a rebuttal argument not exceeding 250 words or may authorize in writing any
other person or persons to prepare, submit or sign the rebuttal argument.
A rebuttal argument may not be signed by more than five.
The rebuttal arguments shall be filed with the City Clerk, signed, with the printed
name(s) and signature(s) of the author(s) submitting it, or if submitted on behalf of an
organization, the name of the organization, and the printed name and signature of at least one of
its principal officers, not more than 10 days after the final date for filing direct argument. The
rebuttal arguments shall be accompanied by the Form of Statement To Be Filed by Author(s) of
Argument.
Rebuttal arguments shall be printed in the same manner as the direct arguments. Each
rebuttal argument shall immediately follow the direct argument which it seeks to rebut.
SECTION 2. That all previous resolutions providing for the filing of rebuttal arguments
for City measures are repealed.
SECTION 3. That the provisions of Section 1 shall apply only to the election to be held
