SUBJECT: ORANGE COUNTY TRANSPORTATION AUTHORITY AMENDMENT
NO. 13 TO COOPERATIVE AGREEMENT NO. C-95 -985
RECOMMENDATION:
Approve Amendment No. 13 to Cooperative Agreement No. C -95 -985 between the
Orange County Transportation Authority.(OCTA) and the City of Newport Beach, and
authorize the Mayor and City Clerk to execute the Amendment.
DISCUSSION:
On May 24, 1995, the City entered into a Master Funding Agreement, known as
Cooperative Agreement No. C -95 -985, with OCTA. The purpose of the Agreement was
to define the roles and responsibilities of OCTA and the City with respect to the delivery
and funding of projects in the OCTA- administered Combined Transportation Funding
Program (CTFP). Twice a year, the City is asked to amend the agreement to update
the status of active projects.
Amendment No. 13 to the Agreement deletes the previous exhibit of projects to the
Agreement in its entirety and inserts a revised listing of CTFP allocations. Attached is a
copy of Amendment No. 13 and the list of CTFP allocations as of March 31, 2007. The
projects listed in Attachment 1 are in various stages of completion within the CTFP.
Following is a brief description of the current status of each project:
1. Jamboree Road Widening. This project will widen the westerly side of Jamboree
Road bridge over SR 73 to provide an additional southbound and northbound
through lane. Since the Toll Corridor Agencies backed out of this project, there
is currently a significant funding shortfall. Staff is exploring other funding options
to move forward with right -of -way acquisition and construction.
2. Superior Avenue Rehabilitation. This project includes grinding and overlaying
the street with rubberized asphalt concrete and removing and replacing
deteriorated asphalt concrete sections. Construction is scheduled for early 2008.

3. Hospital Road and Placentia Avenue Rehabilitation. This project included
grinding and overlaying and reconstructing portions of the streets with rubberized
asphalt concrete. Construction was completed in March 2007.
4. Jamboree Road Improvements (University Drive to Bristol Street South). This
project included grinding and overlaying the street with rubberized asphalt
concrete and re- establishing median curb heights. Construction was completed
in August 2006.
5. Birch Street Rehabilitation. This project includes grinding and overlaying streets
with rubberized asphalt concrete. Construction is scheduled for early 2008.
6. Jamboree Road Improvements (San Joaquin Hills Road to Ford Road). This
project included grinding and overlaying the street with rubberized asphalt
concrete and re- establishing median curb heights. Construction was completed
in December 2006.
7. Bristol .Street North (Jamboree Road to Campus Drive /Irvine Avenue). This
project included grinding and overlaying the street with rubberized asphalt.
Construction was completed in April 2007.
8. Jamboree Road Improvements (Bristol to Fairchild). This project is scheduled
for FY 08 -09 and provides funding to prepare a preliminary engineer's report to
investigate capacity needs for Bristol Street to Fairchild and the intersection of
Jamboree Road and MacArthur Boulevard.
9. Traffic Signal System Upgrade — Projects 1 and 2. These two projects provide
for new controllers and fiber interconnect along various arterial highways and
intersections. Design is underway and construction is scheduled for mid 2008.
Environmental Review:
Each of these projects will be presented to Council with the appropriate environmental
review at time of award of contract.
Public Notice:
Not applicable at this time.
Funding Availability:
Funding for these projects are included in the Capital Improvements Program budget
presented to the City Council for approval annually.

BETWEEN
ORANGE COUNTY TRANSPORTATION AUTHORITY
AND
CITY OF NEWPORT BEACH
THIS AMENDMENT NO. 13 is made and entered into this _ day of
2007, by and between the Orange County Transportation Authority, a public corporation of the State of
California (hereinafter referred to as "AUTHORITY"), and City of Newport Beach, a municipal
corporation (hereinafter referred to as "AGENCY").
WITNESSETH:
WHEREAS, by Agreement No. C- 95-985 dated May 24, 1995, as last changed by Amendment
No. 12 dated April 4, 2007, AUTHORITY and AGENCY entered into an Agreement which determined
that AGENCY was eligible to receive funding under the Combined Transportation Funding Programs
(CTFP) as specified in the CTFP Manual and also the Bicycle and Pedestrian Facilities Program; and
WHEREAS, periodic scheduled reviews approved by AUTHORITY and AGENCY may be
updated as required; and
follows:
WHEREAS, both parties have agreed to amend the list of projects set forth in Exhibit A;
NOW, THEREFORE, it is mutually understood and agreed by AUTHORITY and AGENCY as
Amend Exhibit A. "Combined Transportation Funding Programs (CTFP) Allocations ", to delete
the Exhibit in its entirety and in lieu thereof insert the revised "Combined Transportation Funding
Programs (CTFP) Active Project List", dated March 31, 2007, Included in this Amendment as
Attachment No. 1 which is incorporated into and made a part of the Agreement.

The balance of Agreement No. C- 95-985 remains unchanged.
This Amendment shall be made effective upon execution by both parties and shall remain in
effect until both parties agree to amend or terminate it.
