Addition of Off - Street Parking Meter Zone 31
California Vehicle Code ( "CVC ") Sections 32 and 22508 and Newport Beach Municipal Code ( "NBMC ")
Section 12.44.030 allow the City to establish off - street parking meter zones by resolution. City Council
approved the Newport Boulevard and 32nd Street Modification Project ( "Project') in 2011, which among
other things, includes the renovation of a parking lot previously used exclusively by banking customers.
Staff recommends establishing the Marcus Avenue Lot, which was purchased by the City as part of the
Project, as an off - street parking meter zone to mitigate removal of on- street parking (the on- street parking
was also metered).
RECOMMENDATION:
Adopt Resolution No. 2015 -20, A Resolution of the City Council of the City of Newport Beach Establishing
an Off - Street Parking Meter Zone for the Marcus Avenue Parking Lot (Staff Report Attachment "A "), and
amending Resolution No. 2000 -38 to establish Parking Meter Zone 31.
FUNDING REQUIREMENTS:
If Council approves staff recommendation, one (1) pay station already in the City inventory will be moved
to the Marcus Avenue Lot. Parking signs and other nominal lot improvements can be funded from existing
budget appropriations. Because twenty -five (25) on- street parking meters will be removed and a minimum
of twenty -seven (27) parking spaces will be created for the Project, any change in parking revenues is
expected to be small.
DISCUSSION:
The City purchased the property located at 3204 Marcus Avenue and 3201 Newport Boulevard
(Attachment "B ") as part of the Project to mitigate the removal of on- street parking as a result of widening
Newport Boulevard. The parking lot located at 3204 Marcus Avenue ( "Marcus Lot') was previously used
for private bank customer parking. Although the Marcus Lot is still in the design stage, staff anticipates
that there will be at least twenty -seven (27) new parking stalls when the Project is complete. Twenty -five

(25) on- street metered parking stalls will be removed as part of the Project.
City staff recommends making the Marcus Lot a pay- station lot. Staff recommends a parking fee of $1.50
per hour, from 8:00 a.m. to 6:00 p.m., which would be consistent with most of the City's off - street parking
lot meter fees. The Marcus Lot will not be a designated Annual Parking Permit (Blue Pole) parking area,
as the twenty -five (25) on- street meters that will be removed are not Blue Pole meters.
CVC Sections 32 and 22508 and NBMC Section 12.44.030 allow for the establishment of off - street parking
zones. Resolution 2000 -38, as amended by Resolutions 2010 -39, 2013 -33, and 2014 -39, established 30
off - street parking meter zones and their fees within the City. The Marcus Lot would be the 31st off - street
parking meter zone.
ENVIRONMENTAL REVIEW:
This action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060
(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378), and categorically
exempt pursuant to Sections 15303 (Class 3, New Construction or Conversion of Small Structures -
installation of small new equipment) and 15311 (Class 11, Accessory Structures — construction or
placement of minor structures) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter
3.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at
which the City Council considers the item).

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH ESTABLISHING AN OFF - STREET PARKING METER ZONE FOR
THE MARCUS AVENUE PARKING LOT
WHEREAS, City Council approved the Newport Boulevard and 32nd Street
Modification Street ( "Project ") in 2011, which among other things, includes the renovation of a
parking lot that will contain a minimum of twenty -seven (27) parking spaces;
WHEREAS, the current parking lot was previously used exclusively by the customers
of the bank previously located there;
WHEREAS, approximately twenty -five (25) on- street parking meters will be removed
as part of the Project;
WHEREAS, California Vehicle Code Section 22508, Vehicle Code Section 32 and
Newport Beach Municipal Code Section 12.44.030 authorize the City to establish off - street
parking meter zones by resolution;
WHEREAS, California Vehicle Code Section 22508 further authorizes the City to
establish rates of fees for parking meter zones; and
WHEREAS, Resolution 2000 -38, as amended by Resolutions 2010 -30, 2013 -33, and
2014 -39, established thirty (30) off - street parking meter zones and their fees within the City.
NOW, THEREFORE, the City Council of the City of Newport Beach hereby resolves as
follows:
Section 1: Resolution 2000 -38, as amended, is hereby amended to establish the
following off - street parking meter zone:
Zone 31: The City owned property located west of Newport Blvd., East of Marcus Ave., north
of 32nd St. and south of Finley Avenue. Zone 31 is shown in Exhibit "A ", which is attached
hereto and incorporated by reference.
Section 2: The hours of operation for all meters within off - street parking meter Zone 31
shall be 8:00 a.m. to 6:00 p.m. daily.
Section 3: The fees for parking in Zone 31 when the parking meters are in operation
are One and 50/100 Dollars ($1.50) per hour.
Section 4: The City Council finds that the establishment of parking meter zones,
parking regulations and fees for parking is not subject to the California Environmental Quality
Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or
reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the
activity is not a project as defined in Section 15378), and categorically exempt pursuant to

small new equipment) and 15311 (Class 11, Accessory Structures — construction or

This Resolution was approved, passed and adopted at a regular meeting of the City Council
of the City of Newport Beach, held on the 24th of March, 2015, by the following vote to wit:
