History of General Plan Update
• Mid -2000 - General Plan Update Committee (GPUC) formed
• Mid -2002 - Citizens' General Plan Advisory Committee (GPAC) appointed
• 2003 -2006 - Planning Commission and City Council study sessions and meetings conducted
• July 2006 - City Council approved General Plan Amendment
• November 2006 - Voters approved General Plan Amendment
• January 2007 - City and TIC began updating existing zoning code and applicable Planned Community (PC)
development plans
• March 2007 - City Council approved ordinance requiring a Development Agreement for Newport Center
entitlements
• April 2007 - City Council Ad -hoc Committee formed to negotiate Development Agreement for Newport Center
• May- October 2007 - Negotiation of Development Agreement terms and provisions and City staff/TIC
discussions on requirements to bring zoning into compliance with the new General Plan

Scope of Conforming Zoning
• Creates North Newport Center Planned Community
• Merges 4 separate, existing mixed use blocks (San Joaquin Plaza, Block 600, Block 500 and
Fashion Island) to ensure cohesive future development
• Follows and enhances the development standards in place which have successfully guided
Newport Center development to date
• Reinforces design standards to serve as guidance for future development

Scope of Development Agreement Negotiations
• Recognize existing contractual relationships between City and TIC
• Ensure all allowable uses are traffic neutral and consistent with Measure S

Key Terms of Development Agreement
• The city will receive $27 million for a development fee (to be used to build a City Hall facility,
regardless of location, or other municipal facilities)
- City option to purchase a site within Block 500 for a City Hall at City's appraised value
- A guaranteed use of required parking spaces to exclusively serve City Hall
- Transferring to the city the use of 72,000 sq ft of the company's 278,000 sq ft of unbuilt office
entitlement, which will be transferred to Block 500 to accommodate City Hall and related office
uses
• $5.6 million toward the construction of new Oasis Senior Center
• $5.6 million toward park improvements
• $4.7 million in road improvements and ROW dedication within Newport Center
• The proposal is within the framework of the updated General Plan and does not increase
development intensity
