SUBJECT: Planning Commission Agenda for November 15, 2007
Report of the actions of the Planning Commission Meeting:
Item 1: The minutes of October 18, 2007, were approved.

Item 2: Hoag. Health Center (PA2007 -013)
500- 540 - Superior Avenue
The project includes: (1) the conversion of the remaining 232,414 square feet of
General Office and Research & Development floor area of the existing 329,414
square feet of floor area to medical office use; and (2) the construction of an
additional 20,586 square feet of medical office space on -site, for a total of 350,000
gross square feet of medical office floor area. The total new medical office floor area
requested in the proposed Use Permit amendment is 253,000 square feet.
Additionally, approval of a traffic study is being requested pursuant to the City of
Newport Beach Traffic Phasing Ordinance (TPO). A total of 1,985 parking spaces
are provided to accommodate the development, including 427 surface parking
spaces and 1,558 spaces in two parking structures. Total parking exceeds the
minimum on -site parking requirement of 1,750 spaces required by the City's. Zoning
code.
Summary: After reviewing the Draft Environmental Impact Report (DEIR) for.this project,
CalTrans indicated that the left -turn lane from northbound Newport Boulevard to
westbound Hospital Road was not of sufficient length to accommodate vehicle
queues. As requested by CalTrans, the City conducting a queuing analysis that
indicated the left -tum lane would need to be lengthened by approximately 120
feet. The Planning Department and the City Attorney's Office advised Hoag
officials that the queuing problem at Newport Boulevard and Hospital Road
represented a new, significant, impact that required recirculation of the DEIR
before action.should be taken by the Planning Commission. A motion was made
and seconded to deem this impact less than significant and dispense with
recirculation. The Chairman asked Dennis O'Neil, attorney for Hoag Hospital, to
comment on the recommended recirculation. After hearing from Mr. O'Neil, the
motion was withdrawn. The Planning Commission agreed that the DEIR should
be recirculated for an additional 45 days.

Item 3: West Santa Ana Heights (PA2007 -209)
General Plan Amendment in the West Santa Ana Heights Specific Plan area
bounded by Mesa Drive, Santa Ana Avenue, Bristol Street, and the Newport Beach
Golf Course. This General Plan Amendment will assign land use categories to
properties scheduled to be annexed on land use maps consistent with existing
county designations.
Summary: Only hours before the Planning Commission meeting, the planner who prepared
what was merely to a bookkeeping adjustment stumbled upon an apparent
discrepancy between the County of Orange land use designation for one of the
annexation properties and the land use map included with the City's pre- annexation
agreement. Apparently, a density bonus granted by the County for inclusion of
affordable units in an apartment complex on Mesa Drive was not reflected in the
pre- annexation agreements. As a result, the density shown on the City's proposed
land use designation for the property was greater than that intended under the
County General Plan. Additional research would be needed to confirm this as fact.
After receiving a verbal report on this last minute discovery, the Planning
Commission voted to recommend City Council adoption of the General Plan
Amendment. The Planning Commission resolution was re- worded to allow staff to
verify the existence of the affordable housing density bonus and adjust the
underiying land use density designation before submitting this item for City Council
approval.
This item was recommended for City Council adoption. (7 Ayes)
Item 4: North Newport Center Planned Community
Fashion Island (PA2007 -151)
Code Amendment to change the zoning classification of Block 600 from the
Administrative Financial Professional (APF) District to the Planned Community (PC)
District;
Planned Community Development Plan Amendment to adopt a new Planned
Community Development Plan for Fashion Island, Block 600 (bounded by Santa
Cruz Drive, San Joaquin Hills Road, Santa Rosa Drive, and Newport Center Drive
East), and portions of San Joaquin Plaza (bounded by Jamboree Road, San
Joaquin Hills Road, Santa Cruz Drive, San Clemente Drive, and Santa Barbara
Drive) and Block 500 (bounded by Santa Rosa Drive, San Joaquin Hills Road,
Avocado Avenue, San Nicholas Drive, and Newport Center Drive East) and to
remove these areas from the San Joaquin Plaza Planned Community Development
Plan and the Block 500 Planned Community Development Plan;

Summary: Notice of the public hearing on this matter was required to be mailed to property
owners within 300 feet of the site, but the notice was not mailed to all such property
owners. Consequently, after a presentation by the Irvine Company and staff
reports on each of the proposed entitlement actions, Planning Commissioners
provided comment, asked questions, and requested additional information, then
continued this item to an adjourned regular meeting. Public hearing notices for the
November 299' meeting have been mailed to area property owners. The Irvine
Company and staff will reprise their presentations at the meeting of the 29" so that
all affected property owners have an opportunity to review and understand the
project as proposed.

Item 5: Arches Grill

In accordance with Section 20.60.015 (Temporary Structures and Uses) of the
Newport Beach Municipal Code, the Planning Director provided notice to the
Planning Commission of his approval of an extension of the temporary use
permit allowing lunchtime meal service for a period not to exceed an additional
90 days. The extension allows the applicant additional time to revise on -site
parking as part of a new use permit application that, if approved, would allow
lunchtime meal service on a permanent basis.
Summary: The Commission voted to receive and file this report. (6 Ayes, 1 Absent)

SUMMARY: The project includes: (1) the conversion of the remaining 232,414 square feet of

application noted above. It is the present intention of the City to accept the
Environmental Impact Report and supporting documents. Copies of the
Environmental Impact Report and supporting documents are available for public
review and inspection at the Planning Department, City of Newport Beach.
ITEM NO. 3. West Santa Ana Heights (PA2007 -209)
SUMMARY: General Plan Amendment in the West Santa Ana Heights Specific Plan area
bounded by Mesa Drive, Santa Ana Avenue, Bristol Street, and the Newport Beach
Golf Course. This General Plan Amendment will assign land use categories to
properties scheduled to be annexed on land use maps consistent with existing
county designations.
ACTION: 1) Conduct public hearing; and
2) Adopt Resolution recommending approval of General Plan Amendment
GP2007 -007 to the City Council.

COMPLIANCE: A Negative Declaration has been prepared in connection with the application noted
above. It is the present intention of the City to accept the Negative Declaration and
supporting documents. Copies of the Negative Declaration and supporting
documents are available for public review and inspection at the Planning
Department, City of Newport Beach.
ITEM NO. 4. North Newport Center Planned Community
Fashion Island (PA2007 -151)
SUMMARY: Code Amendment to change the zoning classification of Block 600 from the

Addendum to Final Environmental Impact Report (SCH No 2006011119) for the City
of Newport Beach General Plan 2006 Update and adopt the draft resolutions
recommending City Council approval of Code Amendment No. CA2007 -007,
Planned Community Development Plan Amendment No. PD2007 -003,
Development Agreement No. DA2007 -002, Traffic Study No. TS2007 -001, the
Affordable Housing Implementation Plan, and Transfer of Development Rights.
CEQA
COMPLIANCE: An Addendum to the Final Environmental Impact Report (SCH No 2006011119)
certified on July 25, 2006 was prepared in accordance with the provisions of the
California Environmental Quality Act (CEQA), Public Resources Code § §21000, at
seq., and the State CEQA Guidelines, California Code of Regulations § §15000, at
seq. The purpose of the Addendum is to analyze the potential differences
between the impacts evaluated in the General Plan EIR and those that would be
associated with the proposed project. The potential impacts associated with these
proposed changes would either be the same or less than the anticipated levels
ascribed in the certified General Plan EIR. In addition, there are no substantial
changes to the circumstances under which future development projects subject to
the 2006 General Plan and PC Development Plan would be undertaken.

ITEM NO. 5. Arches Grill

SUMMARY: In accordance with Section 20.60.015 (Temporary Structures and Uses) of the
Newport Beach Municipal Code, the Planning Director has authorized the
authorized an extension to the temporary use of an existing eating and drinking
establishment for a period not to exceed an additional 90 days. The action
specifically allows the existing eating and drinking establishment to continue
operating under the conditions of approval of Use Permit No. 3611 with an
exception that would allow a temporary expansion in the hours of operation to
accommodate weekday lunch service.
ACTION: Receive and file
CEQA
COMPLIANCE: The project qualifies for a Categorical Exemption pursuant to Section 15301
(Existing Facilities) of the Implementing Guidelines of the California
Environmental Quality Act (CEQA).
