HomeMy WebLinkAbout17 - Planning Commission Agenda and Action ReportCITY OF NEWPORT BEACH CITY COUNCIL STAFF REPORT Agenda Item No. 17 December 11, 2007 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: Planning Department David Lepo, Planning Director 949-644-3228;dlepo@city.newport-beach.ca.us SUBJECT: Planning Commission Agenda for November 29, 2007 Report of the actions of the Planning Commission Meeting: Item 1: North Newport Center Planned Community Fashion Island (PA2007 -151) Summary: Code Amendment to change the zoning classification of Block 600 from the Administrative Financial Professional (APF) District to the Planned Community (PC) District; Planned Community Development Plan Amendment to adopt a new Planned Community Development Plan for Fashion Island, Block 600 and portions of San Joaquin Plaza and Block 500 and to remove these areas from the San Joaquin Plaza Planned Community Development Plan and the Block 500 Planned Community Development Plan; Development Agreement to vest development rights and establish a public benefit contribution to the City; Traffic Study to evaluate potential traffic impacts and circulation system improvements; An Affordable Housing Implementation Plan specifying how the development will meet the City's affordable housing goal. This item was continued from November 15, 2007. After hearing testimony from the applicant, staff, and the public, the Planning Commission voted to recommend approval of the project with the following changes to the Planned Community Development Plan: ■ Reducing the maximum height of structures in Block 500 and Block 600 from 375 feet to between 275 to 300 feet. (All Ayes) Item 2: Coastal Residential Development Permit No. 2006 -003 (PA2006 -278) 1703 W. Balboa Blvd. The applicant requests approval of a Coastal Residential Development Permit (CRDP) to allow the demolition of a 10 -unit apartment building in the City's Coastal Zone. The apartment building is proposed to be replaced by three detached single - family homes. The purpose of the CRDP is to ensure compliance with Government Code Section 65590 (Mello Act) which regulates the demolition of low and moderate income dwelling units in the Coastal Zone. This item was continued to January 17, 2008 at the request of staff to allow for the completion of the Feasibility Study. (All Ayes) Item 3: Planned Community Text Amendment No. 2007 -004 (PA2007 -166) Amendment to Newport Tract Map No. 2004 -001 919 Bayside Drive The applicant requests to amend the Bayside Residential Planned Community District Development Regulations (Planned Community Text No. 55) to implement the conditions of approval of the Coastal Development Permit for the development of a 17 -lot single - family residential subdivision. Changes to the Planned Community Text are also proposed to simplify the administration of the Planned Community development regulations. To ensure consistency with the amended Planned Community Text and conditions of approval of the Coastal Development Permit, the applicant further requests amendments to Newport Tract Map No. 2004 -001 (Tentative Tract Map 15323) and the conditions of approval of said map. Originally recommended for approval by the Planning Commission in 2005 and adopted by the City Council in March 2006, revisions to the Planned Community text and the tract map were necessitated to incorporate conditions of approval Page 2 imposed by the Coastal Commission. Changes included removal of gates at the automobile and pedestrian entries from Bayside Drive, granting of an easement for public access over the private streets and walkways within the subdivision, and reconfiguration of lots to accommodate the partially- cantilevered public walkway along the waterfront. This item was recommended for City Council adoption. (All Ayes) Item 4: Joyce LCM RedWillow residence (PA2007 -152) 418 Redlands An appeal of the Zoning Administrator's decision to approve Modification Permit No. 2007 -060 on property located in the R -1 District, which would permit the minor interior remodel of, and a 1,203 square -foot addition to, a nonconforming single - family dwelling unit that encroaches 13 feet, 8 inches into the 20 -foot required front yard setback. The modification permit approval by the Zoning Administrator was appealed to the Planning Commission by the next -door neighbor. Concerns about obstruction of light and air and the alleged incongruity of existing improvements on the property with those typical of the neighborhood were among issues raised in the appeal. The Planning Commission ultimately based their decision on the fact that no evidence had been produced indicating that the part of the dwelling within the front yard setback had been legally constructed and that in any event, the facts on the ground did not support required findings for granting a modification. The decision on this item was to adopt resolution denying Modification Permit No. 2007 -060. Planned Community Text Amendment No. 2007 -004 (PA2007 -166) Amendment to Newport Tract Map No. 2004-001 919 Bayside Drive SUMMARY: The applicant requests to amend the Bayside Residential Planned Community District Development Regulations (Planned Community Text No. 55) to implement the conditions of approval of the Coastal Development Permit for the development of a 17 -lot single - family residential subdivision. ACTION: 1) Conduct public hearing; and 2) Adopt Resolution CEQA COMPLIANCE: All significant environmental concerns for the proposed project have been addressed in a previously certified environmental document. The City of Newport Beach intends to use said document for the above noted project. There are no additional reasonable aftematives or mitigation measures that should be considered in conjunction with said project. Copies of the previously prepared environmental document are available for public review and inspection at the Planning Department, City of Newport Beach, 3300 Newport Boulevard, Newport Beach, California, 92658- 8915 (949) 6443200. ITEM NO. 4.
