INCLUDE WSAH ON CITY LAND USE MAPS AND ASSIGN THE LAND USE
CATEGORY DESIGNATIONS (PA2007- 2091GP2007 -007).
PROJECT SUMMARY
West Santa Ana Heights (WSAH) will be annexed into the City of Newport Beach
effective January 1, 2008. Newport Beach is required by the Local Agency Formation
Commission (LAFCO) to adopt land use designations and zoning for the property. This
proposed General Plan Amendment (GPA) will include WSAH on City land use maps
and assign land use category designations. Pre- Zoning that placed the majority of the
area into the Santa Ana Heights Specific Plan was approved by the City Council in
2004.
A comprehensive amendment to the GP that will update statistical data and exhibits in
all GP elements to reflect annexation of WSAH will follow after the annexation effective
date.
RECOMMENDATION
Action: a) Conduct public hearing; and b) adopt Resolution No. 2007 -_
approving General Plan Amendment No. GP2007 -007 to adopt land
use categories for the area known as West Santa Ana Heights to be
annexed into the City January 1, 2008 (PA2007 -209)

INTRODUCTION
Protect Setting
WSAH is approximately 70.6 acres and located adjacent to the northern area of the City
of Newport Beach and bounded by Mesa Drive, Santa Ana Avenue, Bristol Street, and
the Newport Beach Golf Course.
Protect Description
The General Plan Amendment, as proposed, assigns land use designations that are
consistent with the Santa Ana Heights Specific Plan and the County's General Plan
(see the chart below and the draft resolution map exhibits).
Zoning and General Plan
Land Use
The Zoning for most of the annexed property is Santa Ana Heights Specific Plan, except
for a small portion located adjacent to Santa Ana Avenue which is zoned RMD
(Residential Medium Density). The Zoning becomes effective January 1, 2008, at the
time of annexation.

Density
One inconsistency exists between the County's General Plan and the WSAH Specific
Plan. The County approved a 75 -unit, affordable housing project on 3.1 acres at 1621
Mesa Drive. The permitted density before the development was 2400 square feet per

dwelling unit (18 dwelling units per acre). A Use Permit was approved by the County to
increase the density to 1500 square feet per dwelling unit (29 dwelling units per acre) in
accordance with an amendment to the WSAH Specific Plan. The approval was based
on an incentive for higher density if 9 independent lots were combined into 1 lot. The
County did not amend their GP to reflect the new density in the WSAH Specific Plan
(See Exhibit 1 for WSAH Specific Plan Amendment and Districting Map).
The City's GPA and Pre - Zoning in 2004 approved this site as 29 units per acre which is
consistent with the Use Permit, WSAH Specific Plan, existing development and
adjacent properties (See Exhibit 2 for City Pre - Zoning Map).
The attached resolution (Exhibit 3) is in accordance with the increase of density as it
was approved by the County and reflected in the City's 2004 GPA and Pre - Zoning.
Background — Annexation Timeline
March 11, 2003
City Council directed staff to prepare an application to annex WSAH and surrounding
area. The annexation application was accompanied by a Sphere of Influence (SOI)
amendment to realign the SOI boundaries between Newport Beach and Costa Mesa.
November 20, 2003
The Planning Commission voted 7 -0 to recommend that the City Council approve the
General Plan and Pre - Zoning Amendments for WSAH and surrounding area.
January 13, 2004
The City Council voted 6 -0 (with one absent) to approve Resolution 2004 -5 and
Ordinance 2004 -1 approving GP land use designations and Pre - Zoning. A negative
declaration was approved with the GPA and Pre - Zoning.
July 25, 2006
The City of Newport Beach adopted the comprehensive GP update. However, as
WSAH was not in the SOI of Newport Beach, it was not included in the General Plan
update.
February 14, 2007
City Council adopted Resolution 2006 -15 requesting IAFCO to initiate proceedings for
the reorganization of territory at WSAH.
July 11, 2007
LAFCO approved the City's application to annex WSAH.
July 19 —August 17, 2007
Annexation reconsideration. period (a LAFCO commissioner that voted for the City's
annexation of WSAH can request LAFCO reconsideration of July 11, 2007 action).

City Charter Section 423
This GPA is not subject to Section 423 of the City Charter (Protection from Traffic and
Density) because the proposed GPA is only translating existing GP land use
designations from County to City GP format. The GPA has been formulated to correlate
to existing land uses and County land use designations. Therefore, they do not provide
for any increase in density or intensity and thus will not result in increases in peak hour
trips, dwelling units or square feet.
Environmental Review
Annexation requires California Environmental Quality Act (CEQA) documentation. A
negative declaration was prepared in conjunction with the Pre - Zoning and previous
GPA, and approved on January 13, 2004, and is adequate.
Public Notice
Notice of this hearing was published in the Daily Pilot, mailed to property owners within
annexed land and posted at the site a minimum of 10 days in advance of this hearing
consistent with the Municipal Code. The item appeared upon the agenda for this
meeting, which was posted at City Hall and on the City website.

The original Santa Ana Heights Specific Plan was prepared and adopted by
the Orange County Board of Supervisors to implement the Land Use
Compatibility Program for Santa Ana Heights.
Amendment 87 -1 and Zone Change 87 -22 (Resolution No. 88-412
Ordinance No. 36944 March 30, 1988
This is the first amendment to the Santa Ana Heights Specific Plan (SAHSP).
It provides minor technical refinements to the Land Use Plan Map and Land
Use District Map to adjust the boundaries of the PA "Professional and
Administrative" and OSR "Open Space/Recreation" Districts with the
vacated right-of-way of Orchard Drive (west of the Santa Ana-Delhi
Channel). It also changes the street cross - sections for Cypress Street, Mesa
and Orchard Drives and their descriptive text within Chapter III Community
Design Program to agree with the City of Newport Beach's cross - sections.
Amendment 89-1 and Zone Change 89.13 (Resolution No. 89 -1664
Ordinance No. 37761 December 6, 1989
This is the second amendment to the SAHSP. It provides a major change to
the alignment of the Birch/Mesa intersection. It also changes Mesa Drive
from Irvine Avenue to birch Street, and girth Street, from 60 foot righ"f`
way to a secondary arterial with an 80 foot right-of-way. Acacia Street and
Orchard Avenue (in the BP District) from 60 foot to 70 foot right -of -way.
Also, that property zoned REQ - Residential Equestrian north of the new
alignment was changed to BP- Business Park. Other sections of the Specific
Plan, including text and graphics,.were also revised to reflect these changes.
This amendment was previously approved by the City of Newport Beach.
Amendment 90-1 and Zone Change 90-077 (Resolution No. 91-601
Ordinanr Nn. U22) May 21, 1991
This is the third amendment to the SAHSP. It provides new site
develnpment standards for the RMF "Residential Multiple remily District"
that applies to the "Lange Drive" block off of Mesa Drive. The new site
development standards permit a decrease in the land area needed for each
dwelling ,.nit from the existing 2,100 square feet to 1,500 square fee( wily

Ordinance No. 3968) August 20, 1996
This is the fourth amendment to the SAHSP. It is a comprehensive
amendment to update general information in the text and graphics reflecting
land use changes and Infrastructure improvements that have occurred since
the plan's adoption. Also included in this amendment are revisions to the
land use regulations for the BP "Business Park" District, the PAC
"Professional and Administrative Consolidation" District, and acoustical
study requirements for the RK "Residential Kennel" District.
Amendment 99 -01 and Zone Change ZC 99 -o3; Community Profile
Amendment CPA 99-02 (Resolution No. 99.479, Ordinance No. 99-23
November 23, 1999.
This is the fifth amendment to the SAHSP. It approved a zone change and
Community Profile Amendment to permit the development of a three story
uffice building on Birch 5treeL It amended the Land Use District Map
rezoning certain land from REQ "Residential Equestrian" District to BP
"Business Park" District.
Amendment 00.01 and Zone Change ZC 00.01 - (Resolution No. oo -359,
Ordinance No. 00-10) September 12, 2000. ,
This is the sixth amendment to the SAHSP. It approves a zone change to
modify requirements in the BP "Business Park" District and REQ "Residential
Equestrian" District development standards. It amends the Community
Design program and refines other sections of the specific plan to reflect
recent changes in the county organization.

A RESOLUTION OF THE CITY COUCIL OF THE CITY OF NEWPORT
APPROVING GENERAL PLAN AMENDMENT NO. GP2007 -007 TO
ADOPT LAND USE CATEGORIES FOR THE AREA KNOWN AS
WEST SANTA ANA HEIGHTS TO BE ANNEXED INTO THE CITY
JANUARY 1, 2008 (PA2007 -209)
WHEREAS, pursuant to Section 65300 of the California Government Code, the City of
Newport Beach has prepared and adopted a comprehensive long -term General Plan for the
physical development of the City; and
WHEREAS, the California Government Code requires zoning to be consistent with the
City's General Plan designations; and
WHEREAS, land use and other General Plan designations for the subject annexation
area known as West Santa Ana Heights (WSAH) are not currently included in the General Plan
and therefore must be provided; and
WHEREAS, the Local Agency Formation Commission ( LAFCO) approved the City's
application to annex WSAH on July 11, 2007; and
WHEREAS, LAFCO recorded the annexation on September 12, 2007; and
WHEREAS, the annexation will be effective on January 1, 2008; and
WHEREAS, pursuant to the California Environmental Quality Act (CEQA) it was
determined that. the subject amendment will not have a significant effect on the environment,
and accordingly a draft Negative Declaration was prepared for the amendment and
annexations; and
WHEREAS, on November 15th, 2007, the Planning Commission of the City of Newport
Beach held a public hearing regarding the proposed General Plan Amendment and
recommended approval to the City Council; and
WHEREAS, the public was duly notified of the public hearing.
NOW THEREFORE BE IT RESOLVED:
Section 1. Adoption of General Plan Amendment GP2007 -007. The City Council adopts
the proposed amendment to include the West Santa Ana Heights Annexation Area on the land
use maps and assign the land use designations as depicted on the maps attached as Exhibit A.
Section 2. Statistical Area. The City Council adopts the amended maps of statistical
area J6 to include the WSAH annexation area as shown on Exhibit B.

public hearing for a General Plan Amendment in the West Santa Ana Heights Specific

Beach Golf Course. This General Plan Amendment will assign land use categories to
properties scheduled to be annexed on land use maps consistent with existing county
designations.
NOTICE IS HEREBY FURTHER GIVEN that a Negative Declaration has been prepared
in connection with the application noted above. It is the present intention of the City to
accept the Negative Declaration and supporting documents. Copies of the Negative
Declaration and supporting documents are available for public review and inspection at
the Planning Department, City of Newport Beach, 3300 Newport Boulevard, Newport

To the City of Newport Beach,
I wanted to take this moment to introduce myself to you and to voice only one concern here
tonight. My name is Lonnie Maurer - Upchurch and I have owned a commercial boarding kennel
on Riverside Drive in Santa Ana Heights since 1998. When I purchased this home and business
from the previous owners, Karla and Martin South, they were very adamant on my keeping
vigilant in regards to the zoning of our neighborhood. The court papers he showed me indicated
that the County of Orange had tried in the past to take over the properties in our area. Due to a
court order being won, our block was granted a decision of protection. If the County wanted our
land, they would have to pay fair market value for our land, house and 10 years of our livelihood.
I was told, by Martin South that this legal decision is what stopped the airport from expanding
any further in our direction. I have always been prepared for the possibility that the airport might
some day buy me out and send me packing. Now I have a different concern.
I have gathered many many signatures from clients, Costa Mesa and Newport Beach residents
in favor of our block. I had been told that the sphere of influence over our area was Costa Mesa I
had contacted Costa Mesa and had been reassured that their city was happy with our services to
our community and wouldn't interfere with our zoning once we were annexed. I felt secure to
continue with my life and business here in Orange County.
We provide a very vital need in the communities surrounding us. We are a very unique block
and if we are rezoned, there isn't any place for us to relocate that is near our clientele. The
veterinary clinics in our areas cannot and do not want to try to accommodate the large amounts of
animals that need to be boarded during all the holidays and summer months. Many refer to us
when their small space is filled. Many people in the cities own animals and they deserve to have
quality care for their pets when they go on vacation or are relocating. We are also a strong stop in
the expansion of the John Wayne Airport. If you rezone our block, the airport will quickly seek
imminent domain and rob us of having to pay for our livelihood. They will expand the airport
onto our block and only pay us for the value of our properties. They are willing to pay us off with
that amount and not the millions each individual property owner will justly deserve if they take
away our businesses too.
I attended the fust of the meetings with the fight over Santa Ana Heights. I was there and heard
what Newport wanted in the beginning. The City of Newport representative said that they did not
have ANY interest in annexing the Westside of SAH or the dog kennels in our area When I
pushed him for a response about what Newport Beach would do if we ended up within their city
influence, he looked me in the eye and said, "Newport Beach doesn't have ANY outdoor kennel
facilities and they never intend to have any." I was relieved to hear that they did not want to
annex the Westside. Unfortunately, several subdivisions in our area pushed and pushed and
actually convinced Newport Beach to take over the sphere of influence. Now I feel my business
and livelihood are threatened. I would like to know if I have to be concerned about being rezoned
after January 1`, 20087 Why would you agree to take over the influence when you knew we were
here and Costa Mesa wanted our services in their city? Many of my clientele come to Jungle Mist
Kennels knowing my expertise is vital to the well being of their pets. I am a veterinary technician
and animal trainer for over 25 years. They go on vacation knowing their pet(s) are safe, secure
and having fun too. My neighbors at Coast Canine Country Club have been in business for over
20 years and have a waiting list for boarders there. All of my other neighbors are also filled to
capacity most of the time and competition is non - existent. SunRuns, BZY Feet, Rebel Runs,
SunMark, Celestial Kennels, Four Paws Inn, Free Range Inn, Jo-Jans Kennels, Kind To Canines,
Second Chance Kennels are all busy helping out our communities. Please consider our
livelihoods, our workers and our clients before making a hasty decision to rezone! Thank you!

I vehemently dispute any intentions of changing the zoning on my property located (a3
20331 Riverside Dr. Santa Ana Heights. I have put my heart, life, and soul into my
business for apx 30 years and have made many sacrifices to make { as success. {cess. this Y
few years I am threatened with the fear of rezoning man to five Newport
I pay a lot of taxes and take care of many dogs who are owned by Y ewp
Beach residents who also pay a lot of taxes. I provide a service for their fair legged
children that would not be available if my zoning were to change. They don't want their
dogs boarded in cages in all indoor facilities, which would be their only alternative if my
kennel and my street didn't exist.
In addition to the time and effort I have put into my business I have also spent a
considerable amount of money ( apx 2 hundred thousand dollars) in the last few years in
improvements to my property- all of which I have received required permits for. If I
thought for a second that yet another threat of being rezoned would finally come to
fruition I would have never spent the money.
I have many more concerns reguarding the possible rezoning of my property but
I feel addressing them would be pre - mature until the meeting on Tuesday until I know
what battle I have in front of me. I just felt the need to submit something in venting as to
my intentions if there is indeed a risk of losing my business. I financially support many
people in my life (relatives and employees) and I love the dogs I care for and they need
me and my facility. I will fight with all that I am and all that I have for all of them as well
as myself and my future retirement.
