SUBJECT: REQUEST FROM PROPERTY OWNER TO EXTEND THE EXISTING
PUBLIC ALLEY AND SIDEWALK WITHIN THE PUBLIC RIGHT -OF-
WAY ADJACENT TO 402 DAHLIA AVENUE

RECOMMENDATIONS:
Approve the Owner's request to construct a reinforced concrete alley extension
structure and a sidewalk extension with caissons and retaining walls within the
public right -of -way adjacent to 402 Dahlia Avenue.
Direct staff to proceed with the processing and recording of the required
encroachment agreement.
DISCUSSION:
The owner of 402 and 404 Dahlia Avenue submitted plans to remove the existing
residential dwelling occupying two legal lots (402 and 404 Dahlia Avenue) and to build a
2 -unit residential building on each of the legal lots. The Building and Planning
Departments have approved the plans for 402 and 404 Dahlia Avenue. The Public
Works Department has approved the plans for 404 Dahlia Avenue.
The existing easterly Dahlia Avenue public sidewalk terminates midway in front of the 404
Dahlia Avenue property frontage and does not provide pedestrian access to the proposed
building at 402 Dahlia Avenue. The existing public alley adjacent to the development site
terminates approximately two -feet north of the 402 Dahlia Avenue southerly property line
and does not provide sufficient turn - around space for vehicles exiting the proposed
building at 402 Dahlia Avenue.
The Public Works Department required the owner to submit a plan that will provide direct
and acceptable pedestrian and vehicle access to 402 Dahlia Avenue. Due to the site's

topography, retaining walls and caissons will need to be constructed in the public right -of-
way to support the sidewalk extension. The retaining walls will be constructed with
integrally colored masonry blocks to match the adjoining natural ground. The alley
extension will be supported by caissons and connected by vertical walls with no openings.
The southerly end of the new alley "deck' will have a monolithic built -in full width concrete
vehicle wheel stop and metal pedestrian perimeter pipe railing that comply with City
requirements. Landscaping will help camouflage the alley extension structure from view
along Bayside Drive. Drainage provisions will be installed in the public right -of -way and
connect to the existing public storm drain facilities.
The City will own and maintain the extended sidewalk, its associated retaining walls and
caissons, and the alley extension structure after City acceptance. The encroachment
agreement will stipulate the current owner-and future owners) to be responsible for the
maintenance of the impacted slopes and the new landscaping surrounding the approved
improvements.
The owner has submitted an $85,000 bond as surety for completing the work within the
public right -of -way and is seeking City approval to proceed with the development. The
Public Works Department will approve the plans for 402 Dahlia Avenue after the City
Council has approved the owner's request to construct the off -site alley and sidewalk
extension work.
The construction of the sidewalk and alley extension structure is tied to the residential
home construction. The work is considered a minor alteration and is therefore
categorically exempt from CEQA. A Coastal Development Permit is not required.
Environmental Review:
Categorically Exempt under Chapter 3, Article 19, Section 15301, Class 1(c) of Title 14,
California Code of Regulations. Exemption is for minor alteration of existing facilities
not expanding existing uses.
