CITY OF NEWPORT BEACH CITY COUNCIL STAFF REPORT Agenda Item No. 17 February 14, 2006 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: Planning Department Janet Johnson Brown, Assistant Planner (949) 644-3236, 'brown(a- )citv.newport- beach.ca.us SUBJECT: Telecommunications Facility Permit TP2005 -018 (PA2005 -244) LOCATION: 20662 Newport Coast Drive APPLICANT NAME: Sprint PCS ISSUE: Should the City Council approve Telecommunications Facility Permit No. 2005 -018 for the purpose of allowing an existing wireless telecommunications facility to be modified? The application requires special review by City Council because the relocated antennas are proposed to exceed the maximum height limit by 15 feet. RECOMMENDATION: Staff recommends that City Council approve Telecom Permit No. 2005 -018 subject to the Findings and Conditions of Approval attached to the staff report. DISCUSSION: Background The project site is developed with the Laidlaw Gas Recovery facility which is part of the closed Coyote Canyon Landfill. The site is located on a hill surrounded by open space approximately an eighth of a mile south of the San Joaquin Hills Transportation Corridor and east of Newport Coast Drive. The Sage Hill School is located approximately a quarter of a mile to the north and the Newport Coast/Newport Ridge Planned Communities are to the south of the project site. The site is accessed by way of a private road from Newport Coast Drive. Telecom Permit No. TP2005 -018 February 14, 2006 Page 2 Prior to annexation to Newport Beach, this area was part of the County of Orange and was zoned for general agricultural uses. Wireless telecom facilities were a permitted use in the general agricultural zone with approval of a site development permit. The existing telecom facility received approval from the Orange County Planning and Development Services Department in October, 2000. This facility is one of four wireless facilities currently operating on the subject property. The other three facilities are operated by AT & T Wireless (now known as Cingular Wireless), Verizon Wireless and Nextel. The AT & T and Verizon facilities received permits from the County of Orange, and the Nextel facility received approval from the Newport Beach City Council in January, 2005. When the area was annexed, the zoning of the project site was changed to the Open Space- Passive District. This zoning change caused the existing wireless telecom facilities to become nonconforming uses because wireless telecom facilities, which are considered a major utility, are not permitted in the OS -P District. Section 20.62.050 A ( "Expansion, Increase and Intensification of Nonconforming Uses ") of the Zoning Code states: "A use normally permitted by right or by the approval of a use permit, but which is nonconforming by virtue of the required conditions of the district in which it is located, may be expanded, increased or intensified by way of a change in operational characteristics upon the approval of a use permit." In this particular circumstance, staff has determined the proposed modifications to the existing wireless telecom facility do not constitute an expansion, increase or intensification of use, and therefore; the approval of a use permit for modifications to the existing facility is not required. Project Description & Proposal Sprint PCS does need an amendment to their Telecom Permit for their request to modify an existing wireless telecommunications facility located at the Laidlaw Gas Recovery Facility. The applicant proposes to remove 2 antenna arrays and replace them with two single antennas mounted at 43 feet above grade on the existing smokestack. The Telecom Ordinance includes a provision (Section 15.70.090 A "Changed Circumstance ") that grants the City the right and jurisdiction to review and modify a permit based on changed circumstances, including an increase in the height of any part of the facility and substantial change in location on the site. In addition, the project site is located in the 24/28 Height Limitation Zone, and the proposed location of the two new antennas would exceed the upper maximum height limit of 28 feet by an additional 15 Telecom Permit No. TP2005 -018 February 14, 2006 Page 3 feet. Therefore, pursuant to Section 15.70.070 F of the Telecom Ordinance, special review and approval by City Council is required. The existing wireless telecom facility consists of 3 antenna arrays of 4 panel antennas each. One of the antenna arrays is pole- mounted adjacent to the easterly perimeter wall of the gas recovery facility, and the other 2 arrays are located on the south and north perimeter walls. There are 7 support equipment cabinets that are ground - mounted within an 8 -foot tall block wall enclosure. A 2 -foot diameter microwave dish is mounted at 65 -feet above grade on the existing smokestack, and there are 2 small GPS antennas, one of which is mounted next to the microwave dish on the smokestack and the other is mounted on the block wall equipment enclosure. The applicant proposes to modify the facility by removing 2 of the existing antenna arrays that are currently mounted on the south and north perimeter walls. These 2 arrays, which consist of a total of 8 panel antennas, will be replaced with 2 new single panel antennas and are proposed to be mounted on an existing handrail located on the existing gas recovery facility smokestack at 43 -feet above grade. The new antennas will measure 48 inches in length by 12 inches in width and 4 inches in depth. A copy of the project site plans and elevations which depict the existing and modified conditions are attached as Exhibit No. 3. Photographic visual simulations from two different vantage points which depict the existing and modified location of the antennas at the site have been prepared by the applicant. They are attached for your review as Exhibit No. 4. Analysis Due to the potential for greater- than -usual visual or other impacts on nearby property owners, residents, and businesses, the Telecom Ordinance specifies that proposals for the installation of telecom antennas above the upper maximum height limit require special review by City Council. The City Council may approve antenna installations up to 15 feet above the upper maximum height limitations if it makes the following findings: a. The approval is necessary to allow the facility to function as intended and identified alternatives to the proposal are not feasible. The applicant states they have been experiencing degradation in the performance of 2 of the existing antennas arrays due to the growth of the trees in the area. Landscaping has been installed around the outside perimeter of the gas recovery facility for screening purposes and has matured overtime. The loss of signal propagation causes calls to be dropped or blocked, resulting in numerous customer complaints. Due to the location of the project site at the top of a hill and the existing 105 -foot tall smokestack, the applicant determined the most viable solution would be to relocate the underperforming antenna arrays from their present location to the smokestack. Telecom Permit No. TP2005 -018 February 14, 2006 Page 4 Sprint engineers evaluated alternative options, including moving the entire telecom facility to another location, such as an existing SCE transmission tower on the west side of the San Joaquin Hills Transportation Corridor. This location was deemed unacceptable when SCE's environmental division indicated that the existing soil was contaminated due to its close proximity to the Coyote Canyon Landfill. The other site considered was the Sage Hill School, but the school officials declined Sprint's request to install a wireless telecom facility on their campus. The project site is surrounded by undeveloped land and a vast majority of the landfill is to remain as passive open space. Section 15.70.050.4 of the Telecom Ordinance specifically prohibits telecom facilities in the Open Space- Passive zoning district. However, in this particular circumstance, the existing wireless telecom facility is located on property that is developed with the Laidlaw Gas Recovery Facility, along with three other existing wireless telecom facilities. Relocating the Sprint facility to an alternate location in the immediately surrounding undeveloped areas would not meet the intent of the Telecom Ordinance to limit the proliferation of telecom sites in the City and minimize the impact of telecom facilities to the surrounding community. b. The approved facility will not result in conditions which are materially detrimental to the nearby property owners, residents, and businesses, or to public health and safety. The proposed modifications to the wireless telecom facility will not result in detrimental conditions to nearby property owners, residents or businesses because the applicant requests to reduce the number of antennas associated with this facility, from the previously approved 12 antennas, to a total of 6 antennas. The continued operations of the wireless telecom facility will remain a passive use and will not have any impact on other properties in the surrounding area. There are no activities associated with the wireless telecom facility that would produce airborne emissions, odor, vibration, heat, glare or noxious and toxic materials. The existing wireless telecom facility, which has been in operation for 4 years, has and will continue to comply with the applicable rules, regulations and standards of the Federal Communications Commission and the California Public Utilities Commission (CPUC), thus ensuring public health and safety. Based on the foregoing information, staff believes City Council can make the two above findings pursuant to Section 15.70.070 F (3) and approve the proposed relocation of the existing facility antennas to exceed the 28 -foot height limitation up to a maximum of 43 feet above grade. Telecom Permit No. TP2005 -018 February 14, 2006 Page 5 Environmental Review: The project has been reviewed, and it has been determined that it is categorically exempt from the requirements of the California Environmental Quality Act under Class 1 (Existing Facilities), because the proposal is for minor alterations to an existing wireless telecommunications facility. Public Notice: A notification describing the proposal and the date and time of the City Council special review was mailed to property owners of record within 300 feet of the location of the existing telecom facility a minimum of 10 days in advance of the Council review date. Alternatives: 1. The City Council has the option to alter the proposed location of the new or existing antennas, or alter the conditions of approval in order to address any specific concerns the Council or public may have. 2. The proposed modifications to the existing wireless telecommunications facility meet the intent of Chapter 15.70 of the Newport Beach Municipal Code, while ensuring public safety, reducing the visual effects of telecom equipment on public streetscapes, protecting scenic ocean and coastal views, and otherwise mitigating the impacts of such facilities for the following reasons: • The existing telecom facility will continue to comply with the applicable rules, regulations and standards of the Federal Communications Commission (FCC) and the California Public Utilities Commission (CPUC). • The existing telecom facility is located on the site of a methane gas recovery facility where other telecom facilities by different carriers exist. The co- location of telecom facilities on the project site limits the adverse visual effects of proliferation of facilities in the City. • Due to the modified location of the antennas and design of the facility, there is no impact to scenic ocean, coastal or public views. 2. The modified telecommunications facility as proposed conforms to the technology and design standards set forth in Chapter 15.70 for the following reasons: • The modified telecom facility approved under this permit utilizes the most efficient and diminutive technology available and the proposed changes will effectively reduce the total number of panel antennas from 12 to 6 antennas. • The modified location of antennas for the telecom facility approved by this permit will be mounted on the existing smokestack of the methane gas recovery facility and painted to match the structure on which they are mounted, consistent with the design standards of this chapter. 3. The project site is located in the 24/28 Height Limitation Zone, as specified in the Zoning Code. The applicant requests to exceed the upper maximum height limit of 28 feet allowed by the Telecom Ordinance by installing 2 panel antennas on an existing smokestack at 43 feet above grade. Pursuant to the provisions in Section 15.70.070 F of the Wireless Telecommunications Facilities Ordinance, the findings can be made to approve the proposed height of the antennas for the following reasons: • In order to accommodate the intended functioning level of technical coverage and capacity objectives of the existing telecom facility, the 2 new antennae would need to be mounted on the existing smokestack at the requested height due to the mature landscaping and topography of the surrounding area. p Telecom Permit No. TP2005 -018 Findings and Conditions of Approval Page 2 • Telecom facilities are specifically prohibited to be located in the Open Space- Passive zoning district, and therefore, relocating the existing telecom to an area in the undeveloped open space surrounding project site would not be feasible. • The project site has been used as a gas recovery facility and includes telecom facilities operated by four different carriers. The existing uses have not resulted in conditions that are materially detrimental to the nearby property owners, residents or business in the area. • The modified telecom facility will not result in detrimental conditions to nearby property owners, residents or business because the number of antenna components associated with this facility is being reduced from 12 to 6 antennas. • The modified telecom facility will not be materially detrimental to public health or safety because it is required to comply with the applicable rules, regulations and standards of the Federal Communications Commission (FCC) and the California Public Utilities Commission (CPUC). 4. This project has been reviewed, and it has been determined that it is categorically exempt from the requirements of the California Environmental Quality Act under Class 1 (Existing Facilities). Conditions: 1. The development shall be in substantial conformance with the approved plot plan, antenna and equipment plans, and elevations, except as noted in the following conditions. 2. Anything not specifically approved by this Telecom Permit is not permitted and must be addressed in a separate and subsequent Telecom Permit review. This Telecom Permit shall supersede the site development permit issued by the County of Orange. 3. The two new panel antennas shall be a maximum dimension of 48 inches in length, by 12 inches in width and 4 inches in depth, as depicted on the plans submitted with this application. 4. The two new panel antennas shall be mounted on the existing handrail on the gas recovery smokestack at a maximum height of 43 feet above existing grade below. The antennas shall be painted to match the color of the existing smokestack structure. 5. The two antenna arrays located on the south and north facing perimeter walls of the gas recovery facility and identified on the plans submitted with this application shall be removed. Any repair or maintenance required to restore the south and north facing perimeter walls to their original condition shall be completed prior to the final of the building permits issued for this project. 7. All other components of this wireless telecom facility shall remain in their current location, as depicted on the plans submitted with this application. 8. Prior to the issuance of any permits to install the facility, the applicant shall meet in good faith to coordinate the use of frequencies and equipment with the Communications Division of the Orange County Sheriff - Coroner Department to minimize, to the greatest extent possible, any interference with the public Safety 800 MHz Countywide Coordinated Communications System (CCCS). Similar consideration shall be given to any other existing or proposed wireless communications facility that may be located on the subject property. The applicant recognizes that the frequencies used by the cellular facility located at 20662 Newport Coast Drive are extremely close to the frequencies used by the City of Newport Beach for public safety. This proximity will require extraordinary "comprehensive advanced planning and frequency coordination" engineering measures to prevent interference, especially in the choice of frequencies and radio ancillary hardware. This is encouraged in the "Best Practices Guide" published by the Association of Public- safety Communications Officials- International, Inc. (APCO), and as endorsed by the Federal Communications Commission (FCC). 9. The applicant shall not prevent the City of Newport Beach from having adequate spectrum capacity on the City's 800 MHz radio frequencies at any time. 10. Prior to activation its facility, the applicant shall submit to a post - installation test to confirm that "advanced planning and frequency coordination" of the facility was successful in not interfering with the City's Public Safety radio equipment. This test will be conducted by the Communications Division of the Orange County Sheriff - Coroner Department or a Division - approved contractor at the expense of the applicant. This post - installation testing process shall be repeated for every proposed frequency addition and /or change to confirm the intent of the "frequency planning" process has been met. 11. The applicant shall provide a telephone number that shall be monitored 24 hours per day to which interference problems may be reported. 12. The applicant shall provide a "single point of contact" in its Engineering and Maintenance Departments to insure continuity on all interference issues. The name, telephone number, fax number and e-mail address of that person shall be provided to the Newport Beach Police Department's Support Services Commander upon activation of the facility. �a Telecom Permit No. TP2005 -018 Findings and Conditions of Approval Page 4 13. Should interference with the City's Public Safety radio equipment occur, use of the facility shall be suspended until the radio frequency is corrected and verification of the compliance is reported. 14. The applicant shall insure that lessee or other user(s) shall comply with the terms and conditions of this permit, and shall be responsible for the failure of any lessee or other users under the control of the applicant to comply. 15. Should the property be sold or otherwise come under different ownership, any future owners or assignees shall be notified of the conditions of this approval by either the applicant, current property owner or leasing agent. 16. The telecom facility approved by the permit shall comply with any easements, covenants, conditions or restrictions on the underlying real property upon which the facility is located. 17. The telecom facility shall not be lighted except as deemed necessary by the Newport Beach Police Department for security lighting. The night lighting shall be at the lowest intensity necessary for that purpose and such lighting shall be shielded so that direct rays do not shine on nearby properties. Prior to the final of building permits, the applicant shall schedule an evening inspection by the Code Enforcement Division to confirm compliance with this condition. 18. No advertising signage or identifying logos shall be displayed on the telecom facility except for small identification, address, warning and similar information plates. Such information plates shall be identified in the plans submitted for issuance of building permits. 19. The telecom facility shall comply with regulations and requirements of the Uniform Building Code, Uniform Fire Code, Uniform Mechanical Code and National Electrical Code. Prior to the issuance of any building, mechanical or electrical permits, drawings and structural design plans shall be submitted to the City for review by the applicable departments. All required permits shall be obtained prior to commencement of the construction. 20. Within 30 days after installation of the telecom facility, a radio frequency (RF) compliance and radiation report prepared by a qualified RF engineer acceptable to the City shall be submitted in order to demonstrate that the facility is operating at the approved frequency and complies with FCC standards for radiation. If the report shows that the facility does not so comply, the use of the facility be suspended until the facility is modified to comply and a new report has been submitted confirming such compliance. 21. The operator of the telecom facility shall maintain the facility in a manner consistent with the original approval of the facility. The City reserves the right and jurisdiction to review and modify any telecom permit approved pursuant to Chapter 15.70 of the Newport Beach Municipal Code, including the conditions of approval, based on changed circumstances. The operator shall notify the Planning Department of any proposal to change the height or size of the facility; increase the size, shape or number of antennas; change the facility's color or materials or location on the site; or increase the signal output above the maximum permissible exposure (MPE) limits imposed by the radio frequency emissions guidelines of the FCC. Any changed circumstance shall require the operator to apply for a modification of the original telecom permit and obtain the modified telecom permit prior to implementing any change. 23. This telecom permit may be modified or revoked by the City Council should they determine that the facility or operator has violated any law regulating the telecom facility or has failed to comply with the requirements of Chapter 15.70 of the NBMC, or this telecom permit. 24. Any operator who intends to abandon or discontinue use of a telecom facility must notify the Planning Director by certified mail no less than 30 days prior to such action.
