SUBJECT: Resolution declaring that LCP Land Use Plan Amendment Nos. 2005 -001 and
2006 -001 are intended to be carried out in full conformance with the California
Coastal Act
INTRODUCTION
On January 10, 2006, the City Council approved an application made by Lennar Homes for
the development of 79 condominiums on a 4.25 -acre site that presently is developed with an
•outdoor tennis complex operated by the Newport Beach Marriott Hotel located at 900 Newport
Center Drive.
On February 14, 2006, the Council took action to remove the residential possibilities on the
property known as CalTrans West and designated the subject site for a neighborhood park
with active sport fields and support facilities. The property is located at 4850 West Coast
Highway, more specially at the northwest corner of the intersection of Superior Avenue and
West Coast Highway.
DISCUSSION
On March 2, 2006, staff submitted the amendments to the California Coastal Commission for
their review and approval. Attached to each of the requests was a project description followed
by applicable staff reports, resolutions and ordinances.
On March 17, 2006, staff received a letter from the Coastal Commission requesting additional
information and directing the City to include certain specific findings within the Council's
adopted resolutions. Specifically, Coastal Commission staff wants a clear finding that the
projects are intended to be implemented in full compliance with the Coast Act as required by
Section 13544 of the California Code of Regulations. Additionally, Coastal Commission staff
wants a clear statement as to when the amendments will become effective. Both resolutions
indicate that they are not effective until adoption by the Coastal Commission and staff has
•prepared a new finding clarifying that the amendments will become effective immediately
upon adoption by the Coastal Commission and that any modifications made by the Coastal
Commission will necessitate future consideration by the Council and adoption prior to
becoming effective.
