SUBJECT: Marine's Mile B.O.A. Temporary Banners for the City Centennial; Request
for exception from Council Policy K -11
ISSUE:
Should the City Council allow an exception from Council Policy K -11 in order that the
Mariner's Mile Business Owner's Association may install temporary banners honoring
the City Centennial under a single temporary sign permit?
RECOMMENDATION:
Approve request by the Mariner's Mile Business Owner's Association for an exception
from the specific requirements of Council Policy K -11, to allow the group to obtain a
temporary sign permit.
DISCUSSION:
In celebration of the City's centennial, members of the volunteer Mariner's Mile
Business Owner's Association would like to install temporary banners celebrating the
City Centennial at a number of sites in the commercial village. These banners (see
attached) would all have the same graphic design, and be installed for the same
duration of time.
To accomplish this, the group requests the Council's permission, through an exception
from Policy K -11 (Temporary Signage for City- Sponsored, Co- Sponsored or for Non -
Profit and Charitable Organizations and Events), to obtain a single 'blanket' temporary
sign permit that would authorize members of the MMBOA to install:
• a single banner per site;
• at a size appropriate to the site but no larger than 4' x 12' (although the
customary size would likely be 3' x 10');

• for a duration only from the time a 'blanket' permit is approved through October
11, 2006 (approximately 190 days, three days following the City's official Pier -to-
Pier Celebration); and
• for a single filing fee (currently $38.50).
This request deviates from Council Policy K -11 in that the Policy suggests that a single
temporary sign permit for each sign is required; the Policy also expressly prohibits the
duration of a sign installation for more than 90 days.
If this exception from Policy K -11 is granted by the City Council, the 'blanket' permit will
be required and approved by the Planning Department, and each individual business or
property owner desiring to install a temporary banner will be responsible for filing a
'rider' to it, providing the required information about their particular address, contacts,
and precise installation method and location on each site.
If this request is approved by Council, all banners will be paid for by the individual
business or property owners, and professionally fabricated from fade- and tear - resistant
fabric suitable for the longer than normal duration of the permit. Initially, approximately
six to ten property owners are expected to take advantage of the opportunity to promote
the Centennial; as the season moves forward, it is expected that perhaps another five to
ten property or business owners will participate.
Environmental Review:
The granting of this dispensation from a City Council Policy is not a project as defined
by CEQA.

TEMPORARY SIGNAGE FOR CITY- SPONSORED, CO-
SPONSORED OR FOR NON - PROFIT AND
CHARITABLE _ORGANIZATIONS AND EVENTS

The purpose of this policy is to establish definitive standards and to set forth City policy
concerning the administration, control and placement of temporary off -site and on -site
signs, which recognize City- sponsored, co- sponsored or charitable organizations and
events at various locations or facilities within our community. It is not the desire of the
City Council to promote a facility, event, or activity that is not located within the
community.
The Zoning Code allows off -site signs in a commercial or industrial district with first
securing approval through the Modification Permit process. It is the desire of the City
Council, however, to obviate that process by recognizing and allowing the use of
temporary off -site and temporary on -site banners for appropriate organizations and their
activities.
In cases involving City- sponsored, co- sponsored or charitable organizations there is a
need to allow for the placement of temporary off -site or on -site banners. Therefore, if a
nexus exists between the location of the event or facility and the location of the off -site or
on -site sign, then it would be the City Council's desire to allow such off -site or on -site
signage with the first securing and approval of a temporary sign permit.
POLICY
It is the policy of the City Council to allow temporary off -site or on -site signage on public
property for City- sponsored, co- sponsored or charitable organizations and events at
various locations or facilities within the community subject to the following standards:

to be or is an imitation of, or resembles, an official traffic sign or signal or which attempts
to direct the movement of traffic or which hides from view any official traffic sign or
signal. Also, no sign shall be installed that blocks or obstructs from view any traffic
safety/control signs.
Note: Any temporary sign for a charitable or non - profit organization located on Newport -
Mesa Unified School District property shall be exempt from these restrictions.
