AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH APPROVING CODE
AMENDMENT NO. 2006 -002 AMEMDING TITLE 20
OF THE MUNICIPAL CODE TO ADD A FIRE
FACILITY ( "FF") OVERLAY DISTRICT TO THE
SANTA ANA HEIGHTS SPECIFIC PLAN AND TO
APPLY SAID OVERLAY TO THE SELECTED FIRE
STATION SITE (PA 2006 -033).
WHEREAS, the City of Newport Beach intends to construct a fire station and
fire training facility on a site encompassing two lots at the northwest comer of Mesa
Drive and Acacia Street based upon the demonstrated need for the facilities; and
WHEREAS, it is necessary to amend Title 20 to add a "Fire Facility" overlay
designation to the Santa Ana Heights Specific Plan text and to apply the
designation to the selected fire facility site; and
WHEREAS, pursuant to the California Environmental Quality Act (CEQA),
the code amendment and zone change are categorically exempt from the need
for environmental review per Section 15305 of the CEQA Guidelines (Class 5:
"Minor Alterations in Land Use Limitations ") because the overlay district can
apply only to the subject site per the provisions of the amendment; and
WHEREAS, on February 23, 2006, the Planning Commission of the City
of Newport Beach held a noticed public hearing regarding the proposed project at
the conclusion of the hearing, the Planning Commission voted 7 -0 to adopt a
Resolution No. 1688 recommending the adoption of the proposed amendment;
and
WHEREAS, on March 14, 2006, the City Council held a noticed public
hearing the proposed amendment; and
WHEREAS, the amendment is consistent with the General Plan and the
proposed amendment to the Santa Ana Heights Specific Plan portion of the
Zoning Code provides for a needed fire station facility in a location which will not
significantly impact residential or other land uses. The amendment will be
compatible with the neighborhood and will not adversely affect the public health,
safety and general welfare of the community because the operation of the facility
will be subject to an operations policy approved by the Planning Director after a
public meeting is held.
THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DOES HEREBY
ORDAIN AS FOLLOWS:
SECTION 1: Title 20 of the Newport Beach Municipal Code is hereby amended
to add a "Fire Facility" overlay designation to the Santa Ana Heights Specific Plan
(Chapter 20.44), as set out in Exhibit "A ", attached hereto, and to apply the
designation to the selected fire station site in the Santa Ana Heights Specific Plan,
as shown on Exhibit "B" attached hereto.
SECTION 2: The Mayor shall sign and the City Clerk shall attest to the
passage of this Ordinance. This Ordinance shall be published once in the official
newspaper of the City, and the same shall become effective thirty (30) days after
the date of its adoption.
This Ordinance was introduced at a regular meeting of the City Council of the
CitX of Newport Beach held on the 141" day of March, 2006, and adopted on the
28 day of March, 2006, by the following vote, to wit:

Amendment to Zoning Code Relating to the Santa Ana Heights Specific
Plan
IN MUNICIPAL CODE TITLE 20, Chapter 20.44.071 is hereby added to read as
follows:
20.44.071 Fire Facility Overlay District
A. Purpose. The Fire Facility ( "FF ") Overlay District shall be established solely to
provide for municipal fire protection and a municipal fire training center that serves
residents and businesses in and around Newport Beach and surrounding communities.
The District shall allow a municipal fire station, a classroom -style fire training room, and
a municipal Fire Training Center ( "FTC') that includes one four -story training tower. The
tower may be of a height and design that will allow Fire Department personnel to train for
fire suppression and rescue activities that could reasonably occur within the city limits of
Newport Beach, given the height and size of residential and commercial buildings in the
city. In no instance shall the FF Overlay District be assigned to properties that do not
directly involve municipal fire suppression and municipal fire training activities.
B. Principal Uses Permitted. A municipal fire station, a fire training classroom, and a
municipal FTC only are permitted within the Business Park District when assigned an
"FF" overlay designation, subject to the approval of a Use Permit by the Planning
Director which considers input from the Santa Ana Heights Project Advisory Committee
and includes conditions related to the design and operation of the facility.
C. Site Development Standards.
1. Building Height: The maximum building height for a FTC in the FF overlay shall be
forty -five (45) feet above nearest adjacent grade to the top of parapet, top of ridge,
and top of miscellaneous building elements such as mechanical roof screens,
guardrails, cowels, vents, and antennae. The maximum height for other structures
shall be per Specific Plan BP District criteria in Section 20.44.050 F.4.
2. Building Design. All buildings, including the FTC, shall maintain a consistent design
theme through the use of similar and compatible building materials, finishes, and
colors.
3. Lighting. Fixed or permanent fighting on the site shall comply with the following:
a. Lighting shall be in compliance with applicable standards of the Zoning Code.
Exterior on -site lighting shall be shielded and confined within site boundaries. No
direct rays or glare are permitting to shine onto public streets or adjacent sites or
to create a public nuisance. Valpak" type fixtures are not permitted. Parking
area lighting shall have zero cut -off fixtures and light standards shall not exceed
twenty -five (25) feet in height.
b. The site shall not be excessively illuminated based on the luminance
recommendations of the Illuminating Engineering Society of North America, or, if
in the opinion of the Planning Director, the illumination creates an unacceptable
negative impact on surrounding land uses or environmental resources. The
Planning Director may order the dimming of light sources or other remediation
upon finding that the site is excessively illuminated.
c. Prior to the issuance of a building permit, the applicant shall prepare a
photometric study in conjunction with a final lighting plan for approval by the
Planning Department.
d. Prior to the issuance of a Certificate of Occupancy or final building permits, the
applicant shall schedule an evening inspection by the Code and Water Quality
Enforcement Division to confirm control of light and glare.
4. Other Standards. All other site development standards shall follow the Business Park
District's site development standards as shown in Chapter 20.44.050.
D. Land Use Map Designator. The FF Overlay District shall apply to all parcels shown
on the "Specific Plan District #7 Land Use Map" (Exhibit 20.44 -1) with an " -FF"
designator.

SUBJECT: An Amendment to Title 20 of the Newport Beach Municipal Code to
add a Fire Facility ( "FF ") Overlay District to the Santa Ana Heights
Specific Plan (PA 2006 -033)
Introduce Ordinance No. 2006- approving Code Amendment 2006 -002
adding the Fire Facility ( "FF ") Overlay District to the Santa Ana Heights Specific
Plan text, and applying the overlay to the proposed fire station site.
BACKGROUND
The City has acquired two lots at the corner of Mesa Drive and Acacia Street as a
site for the future Santa Ana Heights Fire Station (Fire Station No. 7). In order to
recognize the station, the Santa Ana Heights Project Advisory Committee (PAC)
requested the City to amend Title 20 to designate the fire station land use at the
selected location via the application of a zoning overlay district on the site.
On February 23, 2005, the Planning Commission held a public hearing on the
proposed code amendment, and discussed it after a detailed presentation by the Fire
Chief. in order to assure that the Santa Ana Heights PAC was satisfied with the
required Fire Training Facility (FTC) Operations Policy, the Commission added
language to require an advisory vote by PAC prior to the initial approval of the Policy.
This would be in addition to having a public meeting with the surrounding community.
The Commission then adopted Resolution No. 1688, recommending approval of the
code amendment to the City Council (Attachment 4).

ANALYSIS
General Plan Consistency
The Land Use Element of the City's General Plan designates the site Administrative,
Professional and Financial Commercial. This designation provides predominantly for
office uses, but also accommodates support retail and service uses. The fire station
is considered to be a use that provides a service that is supportive of the
predominant uses in the area, so the use is consistent with the General Plan.
Compatibility with the Speck Plan and the Surrounding Neighborhood
The principal reason for this overlay is to allow the training facility included in the
project to have a height limit greater than the Business Park (BP) District of the
Speck Plan allows. The current height limit of the BP zone is 37 feet where the
training tower will be 45 feet in height. Public facilities, such as fire stations, are
generally considered to be compatible with commercial uses and this is supported by
the fact that Civic and Governmental Uses are currently permitted by the underlying
zoning designation of BP.
Surrounding land uses include a golf course to the west and south, nonconforming
residential uses to the north and commercial office uses to the east.
Due to concerns expressed by residents and business owners in the area, the
overlay district as recommended by the Planning Commission set forth a
requirement for a Fire Training Facility Operations Policy. This policy would be
approved by the Planning Director after a public meeting with the surrounding
community and an advisory vote of PAC. The overlay district as recommended by
the Commission species the components of the policy in detail.
Upon further review and analysis, staff believes that some components of the
recommended code language are not appropriate for the zoning code. Specifically,
an advisory vote from a community group is not a requirement in any other section of
the zoning code. The code does require notification of any known homeowners
association, business association or other resident group for any discretionary
application. Since the code amendment will require a Use Permit for the fire station
and training facility considered by the Planning Director, notice to the SAHPAC will
be given, and they will have the opportunity to give input into that consideration.
The original proposal also required the Planning Director to consider and approve a
Fire Training Facility operations policy. The policy is to define how the Fire Training
Facility is to operate. This is not considered by staff to be an appropriate zoning
provision. The Fire Chief, not the Planning Director, is the appropriate staff person to
approve this policy. Staff also believes that the requirement for a Use Permit is the ^')

Permit is the best way to assure that the training facility will be compatible with the
neighborhood, through the application of conditions of approval, which would likely
include adherence to the policy to address neighborhood concerns related to design
and operation.
Staff understands the importance of these two provisions to the Santa Ana Heights
community. However, we believe they are not needed in the Speck Plan, because
the City has already complied with both of them. The SAHPAC reviewed the design
of the fire station and the Fire Chiefs draft of the Fire Training Facility operations
policy. Moreover, staff believes that including adherence to this policy as a Use
Permit condition of approval provides greater legal standing than the Planning
Director's approval provided in the ordinance as recommended by the Planning
Commission.
Need for this Public Facility
The adequacy of fire services in this and the greater Airport Area have not been
sufficient since the closure of the Orange County Fire Authority fire station on
Campus Drive near John Wayne Airport. Because of this as well as the annexation
of East Santa Ana Heights, the City established a temporary fire station on Zenith
Avenue. The City then began seeking a location for a permanent facility, and
eventually acquired the subject property for the purpose of constructing a permanent
fire station.
Environmental Review
The zoning amendment is categorically exempt from environmental review per
Section 15305 of the CEQA Guidelines (Class 5: "Minor Alterations in Land Use
Limitations ") because the overlay district can apply only to the subject site per the
provisions of the amendment, and, other than the allowance for the height of the
training tower, all other development standards of the underlying zone must be
met.
Public Notice
Notice of this hearing was published in the Daily Pilot with the agenda, mailed to
property owners within 300 feet of the property and posted at the site a minimum
of 10 days in advance of this hearing consistent with the Municipal Code.
Additionally, the item appeared upon the agenda for this meeting, which was
posted at City Hall and on the city website.

CONCLUSIONS
The zoning amendment described in this report will provide for a needed fire
station and training facility at an underserved area of the City. The new code
section provides for the facility, but, as now recommended, makes it subject to
stringent requirements to minimize any adverse impacts on surrounding
properties. Therefore, staff recommends that the amendment be approved by the
City Council.

Overlay shall apply to the single consolidated property.

recommends that the City Council approve CA 2006 -002, consisting of an
amendment to Title 20 of the Newport Beach Municipal Code to add a "Fire
Facility" overlay designation to the Santa Ana Heights Specific Plan, as set out
in Exhibit "ZA -1 ", attached hereto, and to apply the designation to the selected
fire station site in the Santa Ana Heights Specific Plan, as shown on Exhibit
"M -1" attached hereto.

SAHPAC and approved by the City Council. SAHPAC shall be notified and may review any
proposed changes to the approved Materials and Colors Palette.
3. Lighting. Fixed or permanent lighting on the site shall comply with the following:
a. Lighting shall be in compliance with applicable standards of the Zoning Code. Exterior
on -site lighting shall be shielded and confined within site boundaries. No direct rays or
glare are permitting to shine onto public streets or adjacent sites or to create a public
nuisance. "Walpak" type fixtures are not permitted. Parking area lighting shall have zero
cut -off fixtures and light standards shall not exceed twenty -five (25) feet in height.
b. The site shall not be excessively illuminated based on the luminance recommendations
of the Illuminating Engineering Society of North America, or, if in the opinion of the
Planning Director, the illumination creates an unacceptable negative impact on
surrounding land uses or environmental resources. The Planning Director may order the
dimming of light sources or other remediation upon finding that the site is excessively
illuminated.
c. Prior to the issuance of a building permit, the applicant shall prepare a photometric study
in conjunction with a final lighting plan for approval by the Planning Department.

d. Prior to the issuance of a Certificate of Occupancy or final building permits, the applicant
shall schedule an evening inspection by the Code and Water Quality Enforcement
Division to confirm control of light and glare.
4. Fire water spray. Training operations involving water shall be conducted in a manner that
minimizes water overspray on adjacent properties or vehicles. Where overspray has been
conclusively determined by the City's Risk Manager to have impacted property or vehicles,
the City shall address potential impacts via the City's claims process.
5. Facility Operations Policy. The Fire Chief shall develop, subject to the Planning Director's
approval following one public meeting with the surrounding community and an advisory vote
by PAC, an FTC Operations Policy that shall govern the operations of the facility(s). Any
changes to or deviations from the approved FTC Operations Policy that constitute an
intensification of use or a recurring nuisance to the surrounding community must be
approved by the Planning Director after a public meeting and an advisory vote by PAC. The
Policy shall generally identify:
a. Hours and days of operation for the FTC, including any night -time or weekend training
activities;
b. The City's policy regarding allowing outside agencies to use the FTC;
c. The Fire Department's planned use of water, smoke, or imitation smoke; and
d. A plan to inform the surrounding community via electronic means, such as a Web site
notification, if a specific training exercise may add to noise, traffic, or other activity levels
outside of normal training patterns.
6. Other Standards. All other site development standards shall follow the Business Park
District's site development standards as shown in Chapter 20.44.050.
D. District Location. The FF Overlay District shall be confined to the properties at 20401
Acacia Street and at 1971 Mesa Drive, and the overlay District is hereby applied to said
properties on Exhibit 20.44 -1 (Land Use Map) in the Santa Ana Heights Specific Plan, as shown
on Exhibit "M -1 ", attached hereto. If such properties are consolidated into one address, the
Overlay shall apply to the single consolidated property.

An amendment to Title 20 of the Newport Beach Municipal Code to add a Fire Facility ( "FF ")' Recommended
Overlay District to the Santa Ana Heights Specific Plan text and to apply the overlay to the; for approval
proposed fire station site located at the northwest corner of Mesa Drive and Acacia Street
Ms. Temple gave a brief overview of the City's application noting that this is a special fire.
facility overlay on a property that is owned by the City and is for the purpose of constructing a
new fire station in the Santa Ana Heights Specific Plan area. The language of the overlay was,
developed by the Fire Department in association with residents and property owners in the
Santa Ana Heights area. The overlay is the preferred approach in order to preclude any future
changes that might affect the stated height limits and allows a slightly higher structure for
training purposes. This application does not include a review of the fire station and is a zoning
issue only.
Commissioner Eaton noted the stated inconsistencies in the role of the Project Advisory
Committee (PAC).
Chief Tim Reilly, Fire Chief for the City of Newport Beach, noted:
• The overlay is a preferred method for addressing the concerns that no other changes or
modification to the requirements not related to the fire department and training facility
are made.
• The proposed language has been prepared to address issues and concerns of the PAC
such as height restrictions, light spillage, noise, water spray issues.
• The policy has been discussed and agreed upon by members of the PAC.
• A draft fire training center operations policy addresses the issues of lighting, hours of
operation and was compiled with members of the PAC.
• PAC members are in agreement with this proposal.
• This proposed overlay addresses the operational and training needs and is a collaborative
effort.
Commissioner Eaton suggested adding language, 'after an advisory vote by PAC' to the initial
approval of the facility operation policy. Chief Reilly agreed.

Amendment to Zoning Code Relating to the Santa Ana Heights Specific
Plan
IN MUNICIPAL CODE TITLE 20, Chapter 20.44.071 is hereby added to read as
follows:
20.44.071 Fire Facility Overlay District
A. Purpose. The Fire Facility ( "FF ") Overlay District shall be established solely to
provide for municipal fire protection and a municipal fire training center that serves
residents and businesses in and around Newport Beach and surrounding communities.
The District shall allow a municipal fire station, a classroom -style fire training room, and
a municipal Fire Training Center ( "FTC ") that includes one four -story training tower. The
tower may be of a height and design that will allow Fire Department personnel to train for
fire suppression and rescue activities that could reasonably occur within the city limits of
Newport Beach, given the height and size of residential and commercial buildings in the
city. In no instance shall the FF Overlay District be assigned to properties that do not
directly involve municipal fire suppression and municipal fire training activities.
B. Principal Uses Permitted. A municipal fire station, a fire training classroom, and a
municipal FTC only are permitted within the Business Park District when assigned an
"FF" overlay designation, subject to the approval of a Use Permit by the Planning
Director which considers input from the Santa Ana Heights Project Advisory Committee
and includes conditions related to the design and operation of the facility.
C. Site Development Standards.
1. Building Height: The maximum building height for a FTC in the FF overlay shall be
forty -five (45) feet above nearest adjacent grade to the top of parapet, top of ridge,
and top of miscellaneous building elements such as mechanical roof screens,
guardrails, cowels, vents, and antennae. The maximum height for other structures
shall be per Specific Plan BP District criteria in Section 20.44.050 F.4.
2. Building Design. All buildings, including the FTC, shall maintain a consistent design
theme through the use of similar and compatible building materials, finishes, and
colors.
3. Lighting. Fixed or permanent lighting on the site shall comply with the following:
