SUBJECT: BIOLOGICAL RESOURCE SERVICES FOR NEWPORT COAST —
AMENDMENT NO. 1 TO PROFESSIONAL SERVICES AGREEMENT
WITH CHAMBERS GROUP, INC.
RECOMMENDATIONS:
1. Approve a Budget Amendment transferring $8,500 from the Morning Canyon
Stabilization Project (7014- C5100805) to the Newport Coast Watershed Assessment
and Monitoring (7014- C5100851).
2. Approve Amendment No. 1 to the Professional Services Agreement with Chambers
Group, Inc. of Irvine, California for a not -to- exceed fee of $8,500 and authorize the
Mayor and City Clerk to execute the Amendment.
DISCUSSION:
Under the original $28,000 contract, Chambers Group walked the eight canyons in
Newport Coast and mapped the canyon vegetation and habitats. The 1 -1/2" thick
volume, replete with 25 11" x 17" color figures, has received accolades from the
General Services Parks Division and the California Department of Parks, El Morro
office, and declared to be an important categorization of watershed resources.
However, the level of effort to negotiate the steep terrain (often vegetated with poison
oak) was higher than anticipated, and additional survey time was required. More work
and time than anticipated for GIS was also required. Staff believes the increase in
compensation is appropriate for the additional time on the project.
Environmental Review:
All tasks fall under the Information Gathering class of projects and are therefore
categorically exempt pursuant to CEQA Guidelines, Article 19, Section 15306.

The surveys were performed with cooperation from the California Department of Parks
and The Irvine Company.

AMENDMENT NO. 1
TO
PROFESSIONAL SERVICES AGREEMENT
WITH CHAMBERS GROUP
FOR BIOLOGICAL RESOURCE SERVICES FOR NEWPORT COAST
THIS AMENDMENT NO. 1 TO PROFESSIONAL SERVICES AGREEMENT, entered
into this day of , 2006, by and between the CITY OF
NEWPORT BEACH, a municipal corporation, (hereinafter referred to as "City ") and .
CHAMBERS GROUP, INC., a California corporation, whose address is 17671 Cowan
Avenue, Suite 100, Irvine, California, 92614, (hereinafter referred to as "Consultant'), is
made with reference to the following:
RECITALS
A. On May 17, 2005, City and Consultant entered into a Professional
Services Agreement, (hereinafter referred to as "Agreement'), for
biological survey and habitat assessment services for the Biological
Resources Services for Newport Coast, (hereinafter referred to as
`Project'). Total compensation due consultant under the agreement was
$28,000. This Agreement expired on December 31, 2005.
B. City desires to enter into this Amendment No. 1 to reflect additional
services and work not included in the Agreement and to extend the term
of the Agreement to June 30, 2006.
C. City desires to compensate Consultant for additional professional services
needed for Project.
D. City and Consultant mutually desire to amend Agreement, (hereinafter
referred to as "Amendment No. 1 "), as provided here below.
NOW, THEREFORE, the parties hereto agree as follows:
1. Consultant shall be compensated for services performed pursuant to this
Amendment No. 1 according to "Exhibit A" dated March 17, 2006 attached
hereto.
2. Total additional compensation to Consultant for services performed
pursuant to this Amendment No. 1 for all work performed in accordance
with this Amendment, including all reimburseable items and subconsultant
fees, shall not exceed Eighty Five Hundred Dollars ($8,500.00).
3. The term of the Agreement shall be extended to June 30, 2006.
4. Except as expressly modified herein, all other provisions, terms, and
covenants set forth in Agreement shall remain unchanged and shall be in
full force and effect.
IN WITNESS WHEREOF, the parties hereto have executed this Amendment No. 1 on
the date first above written.

Subject: Request for Budget Amendment for the Newport Coast Biological Resource
Surveys, City of Newport Beach, Orange County, California.
Dear Mr. Stein:
The purpose for this letter is to request a budget amendment for services rendered in support of
the biological resource surveys conducted in Newport Coast (Agreement dated May 17, 2005).
Several factors have been encountered resulting in a larger demand on field personnel and
material costs.
The steep terrain, abundance of poison oak, and overall difficult accessibility to the study areas
contributed to additional survey time while in the field. The magnitude of these constraints and
the effect on our cost estimate were not forecasted in the original cost estimate. Additionally, the
demands on our Geographic Information Systems (GIS) were greater than originally anticipated.
A number of additional hours were spent correcting the stream layers, digitizing the vegetation
communities, and extrapolating jurisdictional areas.
The original budget amount was $28,000.00. We are requesting an additional $8,500.00 to be
added to the overall contract amount, bringing the new total to $36,500.00. We appreciate your
understanding of this situation. Chambers Group found it a pleasure to work with the City on this
project and we look forward to ways we can assist the City in the future. Please contact me at
