Danner, Administrative Services Director, 949 - 644 -3123 ddanner @city.newport- beach.ca.us SUBJECT: Application for Certificate of Public Convenience and Necessity APPLICANT NAME: OC Cruiser ISSUE: Should the City Council approve the application for certificate of public convenience and necessity to OC Cruiser to operate vehicles for hire? RECOMMENDATION: Staff recommends the City Council approve the issuance of a permit to OC Cruiser to operate two vehicles for hire subject to conditions. DISCUSSION: Background: Newport Beach Municipal Code Chapter 5.12 regulates public transportation vehicles, as defined, that are not subject to Public Utilities Commission regulation. The Public Utilities Commission does not regulate intra -city transportation services. Upon receipt of an application, Chapter 5.12 provides that the Police Department shall inspect vehicles proposed to be operated and provide a report on the adequacy and safety of the vehicles. The City Manager is authorized to approve increases or decreases in the number of vehicles operated by a permitted operation. Sabrina Dagostino and David Muller have applied for a certificate of public convenience and necessity to operate four, twenty passenger vans on three different routes within the City. The attached application and route map details the vehicles, routes and rates to be imposed. OC Cruiser Application June 13, 2006 Page 2 The Police Department has inspected and approved (with modifications) two of the four busses (busses #1 and #3). The applicants have indicated that busses #2 and #4 will be available for inspection this week. Traffic Engineering has reviewed and approved the proposed routes, with modifications to improve safety at certain stops. Section 5.12.060 specifies that a permit shall be denied if; a. The application is incomplete. b. The vehicles are inadequate or unsafe. c. The color scheme, name, monogram or insignia resembles that of another permitted business. d. The applicant has within the past two years been denied an application e. There are sufficient number of vehicles operating to fully serve the public or that the granting of the certificate would unduly congest traffic. Staffs investigation of the application has determined that the application is complete, the two vehicles inspected are safe, that OC Cruiser does not resemble another permitted business and that the applicant has not previously been denied a permit to operate a similar business. Staff has not investigated and offers no recommendation relative to the sufficiency of the number of vehicles operating to fully serve the public. Last year, the City approved the Charitable Alliance Group, LLC, to operate two vehicles (one 15 passenger and one 22 passenger) during evening hours. The Hopper's routes and stops primarily serve restaurant patrons. The Hopper's operator has related to staff that he does not object to the OC Cruiser application to provide transportation services. Environmental Review: None require. Public Notice: Alternatives: Council may deny the application if it determines that there are sufficient vehicles providing the type of service proposed by the applicants or that the best interests of the public do not demand and necessity does not require the issuance of the permit. Bayside Dr. Newport Beach, Ca. We've been approved to keep the 4 buses at the Newport Dunes from 9:30pm- 6:30am, daily. PENINSULA ROUTE (RED) STOP 1. NEWPORT BEACH PIER a. At the comer of 22 "d and Ocean Front Avenue there is a loading area b. At the comer of 21s` and Newport Blvd (in front of Coldwell Banker on Newport Blvd) there is a loading area *(we'd like to have both physical stops at this location because the Pier area is very big, so for the best way to serve the riders, we chose two locations at either end of the Newport Pier) STOP 2. BALBOA PIER a. Make a right on Palm Dr., there are seven (7) existing bus spaces for drop off in between the two major parking lots (next to the OCTA bus spaces, but not those). After picking up and dropping off patrons, the bus would drive around the parking lot on what becomes Washington. b. There's a stop sign at Washington and Balboa, the bus will go through Balboa along Washington to get to the next stop. STOP 3. BALBOA AUTO FERRY/FUN ZONE a. The bus will travel on Washington and make a left on E.Bay, go through Palm St. so as to not create traffic on Palm for cars and patrons getting on the auto ferry. The bus will stop on the other side of Palm on E.Bay. STOP 4. CORNER OF NEWPORT BLVD AND 32nd St. a. We do NOT propose to stop on either road. b. We propose to pull into the Albertson's shopping center via Newport Blvd. and pick people up on the comer but from the parking lot side. PCH ROUTE (BLUE) STOP 5. CORNER OF PCH AND RIVERSIDE a. Going South on PCH, we propose to make a left on Riverside, past the Wells Fargo parking lot. We'll of course put our hazard lights on while making the turn to warn people that we will be slowing down and stopping. STOP 6. BIG CORONA STOP 7. CORNER OF PCH AND MARGUERITE a. Centennial Plaza/Bandera's parking lot STOP 8. MARRIOTT VILLAS STOP 9. OASIS SENIOR CENTER a. Heading North on PCH (coming from the Marriott Villas), make a right on Marguerite, pull into the Oasis parking lot.
