SUBJECT: Centennial Contract Approval: Entertainment Contract with Sugar Ray for
Closing Event
RECOMMENDATION
Staff recommends that the City Council approve the attached contract with Sugar Ray for
providing entertainment at the Centennial closing event — 100 Years Between the Piers on
October 8, 2006.
DISCUSSION
Currently plans are underway for the closing Centennial event 100 Year Between the Piers to
be held on October 8, 2006. The event will be simultaneous beach parties at both the Balboa
and Newport Piers each featuring signature entertainment, games, family activities, food booths,
exhibits, and will close out the year long celebration with a fireworks display from each pier.
The entertainment line up at the piers will be as follows
Balboa
Common Sense
The Chanteys
Billy Vera and the Beaters
Dick Dale
Newport
The Young Dubliners
Pancho Sanchez
Stonebridge
Sugar Ray
Both headliners, Dick Dale and Mark McGrath of Sugar Ray, are from Newport Beach and we
are excited to have our hometown talent closing out the centennial year.
Gerald Ishibashi, with Stonebridge Productions, is a resident of Newport Beach and has
volunteered his time and entertainment industry expertise to again work with the events
committee assisting with entertainment needs. Gerald has worked with the Fashion Island
Concert Series and the Hyatt Jazz Festival locally and is highly regarded for his professionalism
and ability to produce high quality shows. We are fortunate to have Gerald working with the
Centennial, and appreciate that he has secured the above listed entertainment for this event.
Staff is working with Gerald on all of the entertainment contracts including the attached
agreement for Sugar Ray in order to be sure that we are not making commitments through this
contract that are not standard in the entertainment industry, nor committing to obligations that we
may not be able to keep.

The majority of the entertainment contracts fall within the City Managers authority to execute with
the exception for this contract for Sugar Ray. Staff understands that the manner in which this
contract is presented, with language crossed out and changed, is not consistent with what is
customarily put forth to the City Council for approval. However, in working with Gerald, staff has
been assured that this is generally how entertainment contracts are handled. The attached
contract and performance rider are standard for Sugar Ray and as the venue
operator /purchaser, we are asked to make any necessary changes to the agreement and submit
it to the Talent Agent for their approval. The changes we have proposed have been approved in
advance by the Talent Agent.
The performance fee for Sugar Ray is $60,000. Normally, their fee is $80,000 and higher,
however, Gerald has a prior relationship with them and was able to negotiate this fee. The fee is
due to be paid in two installments with the first due at the time of execution of this agreement and
the second the day of the performance. This fee does not include the productions costs
associated with this performance and the various other entertainment at the event.
