SUBJECT: Planning Commission Agenda for August 17, 2006
Report of the actions of the Planning Commission Regular Meeting:
The Planning Commission recognized Scott Peotter as the newest member.
Item 1: The minutes of August 17, 2006 were approved as corrected. (4 Ayes, 2
Abstain, 1 Absent)
Item 2: Implementation Program of the General Plan
The Planning Commission's discussion included direction to staff to clarify
the language regarding development agreements in the Airport Area (Imp.
13.1) and direction to list all federal, state and local agencies and
jurisdictions in the Interagency Coordination section. The Commission
also determined that specific references to Banning Ranch in sections
where annexations are discussed should be changed to language that is
more generic. Finally, the Commission determined that the City's various
Committees and Commissions should be recognized in the Community
Involvement section. The Commission voted to recommend that City
Council adopt the Implementation Program (5 Ayes, 1 Abstention, 1
Absent).
Item 3: Our Lady Queen of Angels Church Expansion (PA2005 -092)
2046 and 2100 Mar Vista Drive
Our Lady Queen of Angles Church proposes to expand their existing
church and school facilities by relocating its church to the adjacent
property located at 2100 Mar Vista Drive and expanding its school within
the existing boundaries at 2046 Mar Vista Drive. The expansion includes
the construction of a 1,170 -seat sanctuary, additional classrooms, and a
9,450 square foot gymnasium. The proposed project, requires approval of a

Use Permit to allow the expansion of the existing church and school facility;
to allow the church building to exceed the permitted building; to allow the
transfer of development intensity between the two properties; and to allow a
total of ten portable classrooms on a temporary basis. A traffic study is also
required pursuant to the Traffic Phasing Ordinance.
The Planning Commission received a presentation of the project by the
applicant. The primary issue raised during public testimony was traffic
circulation in the neighborhood, particularly during peak hours related to
the schools in the area and during church service hours on weekends.
There was also concern about the location of proposed parking and
whether it would contribute to congestion on local streets. The
Commission directed staff to address the following issues in preparing
findings and conditions for consideration at the next hearing: vehicle and
pedestrian conflicts, timing of Church School operations in relation to the
High School, parking management, recorded chimes and Planning
Commission reviews after the expanded school and church are in full
operation. This item was continued to September 7, 2006. (5 Ayes, 1
Absent, 1 Abstain)
Item 4: Newport Beach Brewing Company (Use Permit No. 3485)
2920 Newport Boulevard
The Planning Commission reviewed the use permit issued to the Newport
Beach Brewing Company after receiving complaints from nearby
residents. The central issues are whether or not the Brewing Company is
operating outside its use permit by operating a bar after approximately
10PM, and the nuisance created by patron behavior in the late evening
and early morning hours. The Planning Commission concluded that
conditions of approval need to be modified and that the Brewing Company
needs to modify its operation. The Commission continued the hearing to
September 21, 2006, for staff, the Brewing Company and concerned
residents to work together to find solutions to alleviate the problems
reported by the neighborhood and prepare revised conditions of approval.
The Commission also directed staff to provide notice for the next hearing
that would allow consideration of permit revocation, if effective conditions
cannot be developed. (5 Ayes, 1 Absent, 1 Abstain)

routine and will all be enacted by one motion in the form listed below. The Planning Commission Members
have received detailed staff reports on each of the items recommending an action. There will be no
separate discussion of these items prior to the time the Commission votes on the motion unless members
of the Commission, staff or the public request specific items to be discussed and/or removed from the
Consent Calendar for separate action.
Members of the public who wish to discuss a Consent Calendar item should come forward to the lectern
upon invitation by the Chairman, state their name and Consent Calendar Item number.

SUMMARY: Implementation Plan of the General Plan
ACTION: Review and recommend that the City Council approve the Implementation Program
of the updated General Plan.

ACTION: Staff recommends that the Planning Commission conduct a public hearing,
provide direction to staff on the preparation of findings and conditions, and
continue the item to September 7, 2006.
ITEM NO. 4. Newport Beach Brewing Company (Use Permit No. 3685)

SUMMARY: The Newport Beach Brewing Company has operated a restauranUbrewpub pursuant
to Use Permit No. 3485 since 1994. This permit was issued by the City in 1993 and
it was subsequently amended in 1999. City has received several complaints related
to the operation of the use and the Planning Commission will evaluate the
complaints, the operational character of the use and the conditions under which the
use operates. At the conclusion of the hearing, the Commission may require
alteration of the operation or it may delete or modify conditions of approval. The
Commission also may conclude that no changes are necessary and revocation of
the Use Permit is not being considered at this time.
ACTION: Staff recommends that the Planning Commission take public testimony and direct
staff to prepare revised conditions of approval for potential adoption at the next
meeting.
