SUBJECT: PENINSULA POINT ENCROACHMENT SURVEYING
RECOMMENDATION:
Approve a Budget Amendment in the amount of $18,456 from the unappropriated
Oceanfront Encroachment funds for a boundary and topographic survey of structures
encroaching beyond private property on to the ocean front beach.
DISCUSSION:
In the early 1990's, when the Ocean Front Encroachment Policy was created by the
City, with approval by the California Coastal Commission, the Peninsula Point
Community Association decided that their community would not encroach into the
ocean front beach. At that time, a survey of Peninsula Point was prepared to ensure all
encroachments on Peninsula Point were removed. Currently, there are approximately
15 properties in the area between E Street and 1526 East Ocean Front with walls and
other structures encroaching in the public right -of -way. Preliminary surveys and
research have shown that the patio walls generally encroach 5 to 6 feet beyond the
property lines. The remainder of the Peninsula Point properties along East Ocean
Front may have patio walls that are built very close to the property line. The purpose of
this survey is to prepare an exhibit for review by the City. This exhibit would also assist
the homeowners should they desire to apply to the City and the Coastal Commission for
any future encroachment permits.
The City currently has an On -Call Professional Services Agreement with Coast
Surveying, Inc. They have submitted a proposal for $18,456 to complete the boundary
and topographic survey.

Environmental Review:
This survey is categorically exempt under the provisions of the Guidelines for
Implementation of CEQA Article 19, Sections 15306 through 15309, pertaining to
actions that the City must perform pursuant to CEQA.
