Alford, Senior Planner (949) 644 -3235 Palford@city.newi)ort-beach.ca.us SUBJECT: Marine Charter Land Use and Parking Regulations (PA 2006 -194) ISSUE: Should the City Council adopt a resolution of intent to amend Title 17 (Harbor Regulations) and Title 20 (Zoning Code) of the Newport Beach Municipal Code to revise land use regulations and parking requirements for marine charters? RECOMMENDATION: Adopt Resolution No. 2006- initiating amendments to Title 17 and Title 20 of the Newport Beach Municipal Code to revise land use regulations and parking requirements for marine charters. DISCUSSION: On February 14, 2006, the City Council adopted new permit procedures for regulating commercial activities on Newport Harbor, including marine charters. This was done, in part, to consolidate charter regulations to a single ordinance (Chapter 17.10) and establish a single regulatory authority within the City for commercial operations on Newport Harbor. However, Section 17.10.050 states that a commercial harbor activities permit cannot be issued if the "proposed commercial activity does not provide facilities to ensure adequate parking as required by Chapter 20.66.'° Chapter 20.66 (Off- Street Parking and Loading) requires that off - street parking be provided on -site and only the Planning Commission can waive or modify these requirements. Many marine charters provide parking on an ad hoc basis and often off -site. Since Planning Commission approval is required for off -site parking, this runs contrary to the intent of Chapter 17.10 to establish single regulatory authority for Harbor commercial activities. Moreover, the Zoning Code requires a use permit issued by the Planning Commission for marine charters in all commercial districts, with the exception of those in Mariner's Mile and Cannery Village/McFadden Square. Marine Charter Land Use and Parking Regulations September 26, 2006 Page 2 In order to fulfill the intent of regulating marine charters through the commercial harbor activities permits, it is proposed that the off- street parking regulations be revised so that the Harbor Resources Manager has the authority to issue the permit if it is demonstrated that the parking for the crew and passengers is adequate under the applicable standards of Chapter 20.66. This is similar to the procedure used for special events permits. The number of required parking spaces remains the same, the parking can be provided off-site and Planning Commission approval is not required. In addition, it is proposed that the Zoning Code be revised to permit marine charters by right in all commercial zones with a reference to commercial harbor activities permit requirements of Chapter 17.10. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH INITIATING AN AMENDMENT TO TITLE 17 AND TITLE 20 OF THE NEWPORT BEACH MUNICIPAL CODE TO REVISE LAND USE REGULATIONS AND PARKING REQUIREMENTS FOR MARINE CHARTERS (PA 2006 -194) WHEREAS, Title 20 of the Newport Beach Municipal Code authorizes the City Council to adopt a resolution initiating amendments to the Zoning Code of the City of Newport Beach; and WHEREAS, on February 14, 2006, the City Council adopted new permit procedures for regulating commercial activities on Newport Harbor with the intent of consolidating charter regulations to a single ordinance and establishing a.single regulatory authority within the City for commercial operations on Newport Harbor, and . WHEREAS, current land use and off - street parking regulations of the Zoning Code of the Newport Beach Municipal Code run contrary to the intent of consolidating charter regulations to a single ordinance and establishing a single regulatory authority within the City for commercial operations on Newport Harbor; and WHEREAS, Title 17 and Title 20 should be amended to correct this conflict.
