SUBJECT: Planning Commission Agenda for October 5, 2006
Report of the actions of the Planning Commission Meeting:
Item 1: The minutes of September 21, 2006 were approved as corrected. (6 Ayes,
1 Abstain)
Item 2: Minutes of the regular meeting of November 17, 2005 were approved. (5
Ayes, 2 Abstain)
Item 3: Newport Beach Brewing Company (Use Permit No. 3485)
2920 Newport Boulevard
The Newport Beach Brewing Company has operated a restaurant/brewpub
pursuant to Use Permit No. 3485 since 1994. This permit was issued by the
City in 1993 and it was subsequently amended in 1999. City has received
several complaints related to the operation of the use and the Planning
Commission will evaluate the complaints, the operational character of the
use and the conditions under which the use operates. At the conclusion of
the hearing, the Commission may require alteration of the operation or it
may delete or modify conditions of approval. The Commission also may
conclude that no changes are necessary and revocation of the Use Permit is
not being considered at this time.
This item was continued to October 19, 2006. (7 Ayes)
Item 4: Big Canyon Country Club (PA2006 -160)
1 Big Canyon Drive
General Plan Amendment to increase the maximum allowable gross floor
area allocated to the Country Club by 10,000 square feet, to a total of 75,000
square feet.

General Plan Amendment No. 2006 -006 was recommended for approval to
the City Council without discussion. (7 Ayes)
Item 5: Housing Element
Review of the Annual Housing Element Implementation Report
This report details the progress of implementation of the existing Housing
Element as required by the State office of Planning and Research (OPR)
and the State Department of Housing and Community Development
(HCD). The Planning Commission reviewed the report, discussed sections
related to the Inclusionary Housing Ordinance under preparation and
clarified the current status of the Ordinance. The report was then
forwarded the report to the City Council for review and approval. (7 Ayes)
Item 6: Newport Bay Marina formerly known as the Bridgeport Mixed Use
Development (2300 Newport Boulevard) (PA2001 -210)
Site Plan Review, Use Permit, Modification Permit and Vesting Tentative
Tract Map to allow the construction of a mixed -use development on a 2.4
acre site located north of the intersection of Newport Boulevard and
Balboa Boulevard. The project consists of the demolition of all structures
on site and the construction of approximately 36,000 square feet of
commercial uses and 27 dwelling units (condominiums). Eleven three -
story buildings are planned to be built over a subterranean parking
garage. The reconstruction /reconfiguration of the existing bulkhead,
boatways and docks is also planned. The Site Plan Review application
would authorize the entire project and the Vesting Tentative Tract map
would permit a subdivision map to allow for the residential units to be
individually sold. The Use Permit would establish a building height limit of
up to 35 feet and the Modification Permit would allow portions of the
proposed buildings to encroach within the 5 -foot front yard setback.
Finally, consideration of a Draft Environmental Impact Report (SCH#
2003071144) including mitigation measures.
Discussion of the Planning Commission included a wide variety of project
specks, including potential conflicts between the proposed residential
units and surrounding shipyard and restaurant uses, the use of the below -
grade parking as the required ground floor commercial in the mixed use
development regulations, the ability of the new marina to be used for
commercial charter activities, provisions for delivery and service vehicles
on -site, the need for detailed parking management and construction
management plans, the need for a more detailed landscaping plan, the
adequacy of the parking requirement for commercial marinas, the

proposed on -site circulation plan, site access and off -site circulation,
impacts of the project on seasonal peak traffic, and on -site pedestrian
circulation. Some Commissioners expressed concerns about the proposed
height of buildings and the encroachment into the setabck on Newport
Boulevard. The Commission request staff to provide additional information
and analysis of these issues, and also that the applicant consider other
design alternatives to address the concerns expressed. This item was the
continued to the Planning Commission meeting on November 2, 2006. (7

Reporting Program and approve Use Permit No. 2001 -038, Site Plan Review No.
2001 -004, Modification Permit No. 2006 -075 and Newport Beach Tract Map No.
2004 -003 subject to findings and conditions.
