HomeMy WebLinkAbout18 - Public Hearing Notice & CorrespondenceNOTICE OF PUBLIC HEARING Our Lady Queen of Angels Church Expansion (PA2005 -092) NOTICE IS HEREBY GIVEN that the City Council of the City of Newport Beach will hold a public hearing on an appeal of the Planning Commission's approval of a Use Permit for the expansion of Our Lady Queen of Angels Church. The project site is located at 2046 and 2100 Mar Vista Drive and is zoned Government, Educational and Institutional Facilities (GEIF). Our Lady Queen of Angels Church requests to expand their existing church and school facilities by relocating its church to the adjacent property located at 2100 Mar Vista Drive (presently used by St. Mark Presbyterian Church) and expanding its school within the existing boundaries at 2046 Mar Vista Drive. The expansion includes the construction of a 1,170 -seat sanctuary, additional classrooms, and a 9,450 square foot gymnasium. When combined, the new Our Lady Queen of Angels Church campus will be approximately 12.17 acres in size. The project, as proposed, requires approval of a Use Permit to allow the expansion of the existing church and school facility; to allow the church building to exceed the permitted building height of 35 feet (90 feet proposed for the steeple); to allow the transfer of development intensity from the new church site (2100 Mar Vista Dr.) to the school site (2046 Mar Vista Dr.) so as the square footage for the two properties when combined results in an overall FAR (floor area ratio) of 0.17 consistent with the General Plan; and to allow a total of ten portable classrooms to be located on the school site during the construction period. A traffic study is also required pursuant to the Traffic Phasing Ordinance. NOTICE IS HEREBY FURTHER GIVEN that a Mitigated Negative Declaration was prepared by the City of Newport Beach in connection with the application noted above. The Mitigated Negative Declaration states that, the subject development will not result in a significant effect on the environment. It is the present intention of the City to accept the Mitigated Negative Declaration and supporting documents. This is not to be construed as either approval or denial by the City of the subject application. The City encourages members of the general public to review and comment on this documentation. Appellant also requests that OLQA immediately cease and desist any and all attempts to install any `New' classrooms which are either of a temporary and or permanent nature. Appellant firmly believes that the new findings will validate our serious concern(s) as to any and all increase of students to the Our Lady Queen of Angels Church / School as well as the proposed enlarged seating capacity of One Thousand, One Hundred and Seventy (1170) parishioners in a Church which conducts Six (6) services per weekend - with the very real potential of approximately Seven Thousand (7000) attendees per weekend. The purpose of this letter is to advise the Council Members of the following: 1. I am currently out of the country on a previously arranged trip and cannot attend the hearing presently scheduled for Tuesday, November 14, 2006. 2. In my application to appeal this matter I made it specifically clear that I would be unavailable the entire month of November and requested that the hearing be set for a minimum of 120 days from the filing of my application for the reasons contained within and those included in my application. 3. For reasons unknown to me the hearing has been scheduled for a time when I, the applicant, cannot attend, which I believe to be prejudicial to me. As the petitioning party I believe I have the right to attend and participate in any hearing regarding my application and feel that my rights have been ignored. 11/13/2006 Page 2 of 5 4. For the record I have the %t to have a hearing scheduled with9thirty (30) days as stated on the application filing form. And I believe I made my position quite clear in filing the application that in the event the hearing would be scheduled during the month of November that I would exercise my right to insist on a hearing within thirty (30) days. 5. Despite my attempts to advise Our Lady Queen of Angles of said petition I have yet to hear from them or any of their representatives and therefore, in the interest of fairness ask that the hearing, scheduled for November 15, 2006, be rescheduled to insure the participation of all interested parties. Further, insofar as Our Lady Queen of Angels has been mulling this proposal around since 2000 I don't see how a one or two month continuance would cause them any unnecessary inconvenience. However, should the Council continue with the hearing, despite my objections, I will take this opportunity to briefly outline my objections regarding the proposed expansion plans of Our Lady Queen of Angels. There are several aggravating facts that I believe the Planning Commission failed to seriously consider in reviewing the proposed expansion plans for Our Lady Queen of Angels. They are as follows: First and foremost, while Our Lady Queen of Angel's purports that the new sanctuary seating capacity will be marginally smaller in size than the two (2) combined churches (St. Mark's and Our Lady Queen of Angels) the fact remains that St. Mark's only had one (1) service a week, wherein Our Lady Queen of Angels has a total of six (6) services a week. Therefore, the five (5) additional services that Our Lady Queen of Angels conducts every weekend combined with the additional of the soon to be former St. Mark's increases the proposed capacity by an estimated seating capacity of One Thousand, One Hundred and Seventy (1170) parishioners in a Church which conducts Six (6) services per weekend — with the potential of approximately Seven Thousand (7000) attendees per weekend. Our Lady Queen of Angel's proposal equates to an increase of Two Thousand (2000) people per weekend, not to mention the hundreds of additional vehicles that will bring said attendees into the direct vicinity of the Church and onto our already overcrowded residential streets. And even by the conservative traffic study presented by Our Lady Queen of Angel's statistics, which I disagree with, will bring an additional seven hundred (700) plus cars per weekend into the neighborhood, a number that I argue will be more in the vicinity of seven hundred and fifty (750) cars, which is unacceptable. And while statements from the church itself suggest that there would not be any ' significant impact on the traffic' all evidence suggests otherwise. The numbers simply don't add up. We are not talking math, this is simple arithmetic. The addition of another five to seven hundred plus cars a weekend is a substantial impact on those who live in the neighborhood. Furthermore, our Lady Queen of Angles suggestions that posting " parking dot fell" signs and or "parking attendants" is laughable since many of Our Lady Queen of Angels parishioners have and continue to reckless disregard to both the neighborhood by double parking, parking in No Parking Zones, jaywalking and by blocking intersection of Mar Vista and Domingo by dropping off and picking up family members and friends, suggests to me that they will disregard any such notices stating "lot full" and or any attendants that I don't sincerely believe that Our Lady Queen of Angels has any intention of spending funds on since they never have before. This equation does not even address the many special events held on site, inclusive of but not limited to weddings, funerals or other such events that Our Lady Queen of Angels promises to limit to no more than one thousand (1000) people and respective vehicles. More specifically, directing the Councils attention to an article published in 1990 addressing the traffic and proposed traffic study in and around Our Lady Queen of Angels wherein Councilman John C. Cox Jr. stated " that funding a study would be a 'waste of money' when the council is already aware of the traffic problems" further exacerbated by Councilman Clarence J. Turner who stated that, " he was previously unaware of how clogged the traffic is around the school between 7:30 and 8:05 each morning ". Turner said "solutions must be found to reduce the congestion before the Newport a ch 11/13/2006 Page 3 of 5 coast is devalop which�eVected to_cause...fs_juin in enrolont at the high school". For the record, nothing whatsoever has been done to reduce the 'congestion' expect the closure of Bison and restricting access to public streets (Mar Vista and Alba) which has only exacerbated the situation and put additional stress onto Eastbluff. Further, the 'new and improved drop off plan' instituted last year hardly addresses the problem, only moved it to the other side of the street, and in doing so eliminated bike lanes creating even more of a potential hazard to students, residents alike. Equally egregious is the fact that despite the steady development of the city, especially the home developments (inclusive of but not limited to Newport Coast) the fact that no high school as been constructed since 1960 constitutes, at the very least, negligence on the part of the Planning Commission in allowing hundreds, maybe thousands of four and five bedroom homes to be built without the foresight of furnishing the necessary schools to facilitate the ever increasing student body, which presently is increasing by one hundred (100) students per year it will only get increase expedientially. 2. While representatives from Our Lady Queen of Angels have, in fact, represented that they have' reached out to their neighbors' during the Planning Commission hearing it appears to me that all evidence suggests the contrary especially considering that Our Lady Queen of Angels proposal calls to relocate the two (2) main driveways that will serve as the major thoroughfares for both the sanctuary and school on Domingo, a residential street, suggests to me that neither the church nor its architects have demonstrated little, if any, respect for the neighborhood or those who reside within, by bringing traffic farther into the neighborhood rather than away from it. Upon fiuther review the Council will note that there are one driveways, and or entrances or exits on either Eastbluff and or Mar Vista, directing all the traffic to Domingo, farther into the neighborhood that Our Lady Queen of Angels purports to have claimed to "reach out too ". Furthermore, upon closer inspection you will can see for yourselves that the two (2) proposed driveways are located at the farther possible point on the property from the major intersection, Jamboree and Eastbluff, and will have an enormous negative impact on the hundreds of homeowners and residents who reside on Domingo and or Amigos Way. Furthermore, insofar as the two (2) proposed driveways serve as both ingress and egress I believe this will only exacerbate the unresolved traffic issues that compromise the quality of lives of those who live in the neighborhood, and given the similar situation at Corona del Mar Plaza wherein only one (1) driveway serves as the primary and only ingress and egress to the shopping complex and Public Library, should serve as a reminder of such poor planning. 3. In reviewing the voluminous report, prepared and paid for and submitted by Our Lady Queen of Angels, I believe there are several misrepresentations by Our Lady Queen of Angels that I feel compelled to address, they are as follows: First and foremost, notwithstanding the fact that the report attempts to argue that the low attendance of certain 'morning services' as mitigating issues to argue any potential traffic issues, the fact that Our Lady Queen of Angels has substantiated its request to expand both its sanctuary and school to accommodate the' growing needs of the church and its school or words to that effect, there is every reason to believe that expect to fill both to full capacity. Secondly, I don't feel that the traffic study presented by the Church is unrealistic in suggesting that by doubling the size of the schools enrollment will only add an estimated seventeen (17) cars on school days especially considering that there is no evidence of a bussing system and or car pooling program to make a concerted effort on the churches part to eliminate any excess traffic. Thirdly, no one on the Planning Commission even questioned the fact that the proposed gymnasium will remain open till 9:00 P.M. seven nights a week and or the extra traffic that brings into the equation. Fourthly, contrary to the sutmnary's claims that there will be' no aesthetic impact' by more than doubling the height of the proposed roof from twenty (20) feet to fifty -five (55) feet I suggest that the 'aesthetic impact' will be quite significant, since that and the proposed ninety (90) foot steeple both exceed the thirty -five (35) foot height restriction that the City has set as both excessive and particular insulting to the neighborhood. 11/13/2006 Page 4 of 5 4. Lastly, and most troubling is the aggravating fact is that both the Planning Commission and just about everyone else, including Our Lady Queen of Angels, seems to be ignoring the virtual ' elephant in the room' so to speak, Corona del Mar and the traffic issues that that, in and of itself, presents to the equation. Notwithstanding the fact that it has been over forty (40) years since a high school has been built, the student body enrollment is increasing exponentially, by at least one hundred (100) students a year, which seems to be of little, or no concern to the Planning Commission or Traffic Commission. Neither Corona del Mar High School itself nor the neighboring streets were designed to accommodate the overcrowding enrollment and or traffic burden especially considering that when the high school was built a majority of the student body traveled to and from via school buses. By closing off access to Bison and other such residential streets the City has only exacerbated an already out of control situation. In closing, I would ask that the Council give serious consideration to the oversights of the Planning Commissions decision wherein it did not in fact act in the City's best interests in properly investigating the proposed expansion. The Summary report prepared on behalf of Our Lady Queen of Angels is littered with gross misrepresentations from the true and actual numbers of parishioners to the traffic situation, I believe that that in and of itself speaks volumes of the Churches lack of veracity. The proposed expansion is far too large for a neighborhood and or streets that were never designed, nor have ever been redesigned to handle the number of vehicles that the Church, its school and C.D.M. high school bring into our neighborhood. For the Church and or its appointed representatives to misrepresent that the traffic will not be impacted is particularly insulting to those of us who reside here. Therefore, I am respectfully requesting that the hearing be postponed and or Our Lady Queen of Angels proposed expansion plans be denied for their less than forthright manner in misrepresenting the true and actual ramifications that the oversized proportions will have on the neighborhood and its residents. The Planning Commission considered the environmental document and associated technical reports during the consideration of the project.
