SUBJECT: UTILITY AND SEWER EASEMENT RESERVATION OVER THE BIRCH
STREET PUBLIC RIGHT -OF -WAY IN SANTA ANA HEIGHTS
APPLICANT: H F Guity -Mehr of 20412 and 20422 Birch Street
RECOMMENDATIONS:
1. Approve a sewer easement reservation requested by the Costa Mesa Sanitary
District (CMSD) within the Birch Street public right -of -way.
2. Reserve a City utility easement concurrent with the CMSD easement.
3. Direct staff and the City Clerk to proceed with the easements recordation through
the Orange County Recorder.
DISCUSSION:
In October 1999, the CMSD requested the County of Orange to reserve an utility
easement to protect an existing CMSD sewer main along the old street alignment. When
the City annexed Santa Ana Heights, the County of Orange did not reserve the easement
for CMSD.
As depicted in Exhibit A, the portion of the Birch Street right -of -way located between the
current Birch Street cul -de -sac terminus and the Mesa Drive right -of -way where the
CMSD easement is requested, when vacated, will consist of multiple ownerships. Instead
of processing multiple easement reservations with various owners at different times,
CMSD through the owner of 20412 and 20422 Birch Street, H F Guity -Mehr, prefers the
City reserve a 15 -foot wide utility easement for their operations.
Staff has reviewed the CMSD easement reservation request and found it to be
acceptable. In addition, staff has determined that an additional City utility easement
reservation occupying the same strip.of land as the CMSD easement would be useful for
future City operations.

Environmental Review:
Pursuant to Section 15305, Minor Alterations in Land Use Limitations — Class V of
CEQA Guidelines, the requested easement reservations are exempt from
environmental review.

STATE OF CALIFORNIA PER MAP FILED IN BOOK 21, PAGE 25 OF MISCELLANEOUS MAPS IN THE
OFFICE OF THE COUNTY RECORDER OF SAID COUNTY, BOUNDED AS FOLLOWS.
SOUTHWESTERLY BY THE EASTERLY, SOUTHEASTERLY AND SOUTHERLY CONTINUATION OF
THAT CERTAIN CURVE DESCRIBED IN PARCEL 134.2 AS HAVING A RADIUS OF 46.00 FEET, IN A
DEED TO THE COUNTY OF ORANGE, RECORDED FEBRUARY 15, 1996 AS INSTRUMENT NO.

NORTH 40 037'46" EAST 260.81 FEET ALONG THE CENTERLINE OF SAID BIRCH STREET TO THE
NORTHEASTERLY CONTINUATION OF THAT CERTAIN CURVE DESCRIBED IN PARCEL 134.2 AS
CONCAVE SOUTHEASTERLY AND HAVING A RADIUS OF 46.00 FEET, IN A DEED TO THE COUNTY OF
