Item 2: Thirty First Street, LLC (PA2006 -031) 407, 409, 411 & 413 31st Street A Use Permit to establish a height limit of 31 -feet, exceeding the base height limit of 26 -feet, for the construction of four mixed -use buildings and approval of a commercial floor area ratio (FAR) less than the minimum 0.25 FAR required for mixed use development projects. In addition, the applicant is requesting the approval of a modification permit to allow parking spaces to encroach within the front and rear setbacks and a lot line adjustment to adjust the interior property lines of four lots into four equally sized parcels. This item was continued to the Planning Commission meeting of January 4, 2007 with no discussion (All Ayes). The applicant was unable to complete revised plans as requested by the Planning Commission at the prior hearing. Item 3: Isla Vista Homes (PA2004 -123) 1499 and 1515 Monrovia Avenue Zone Code Amendment, Tract Map and Modification Permit to develop 44 detached residential condominium units on a 3.25 acre site. The zoning district would be changed from M -1 -A (Controlled Manufacturing) to MFR (Multi - Family Residential) and a Modification Permit has been requested to allow setback encroachments, decreased distance between structures and increased wall height in required setbacks. Item 4. Item 5: Item 6: Planning Commission Agenda for November 16, 2006 Page 2 This item was continued to January 18, 2007 (All Ayes). A technical issue was found with the tentative map and revisions to the phasing of the project. Newport Beach Brewing Company (Use Permit No. 3485) 2920 Newport Boulevard The City is conducting a review of the Use Permit issued to the Newport com Beach Brewing Company due to plaints related to the operation.__ Planning Commission will evaluate the complaints, the operational character of the use, the conditions under which the use operates, staff analysis, police investigations etc. The Commission may conclude that changes to , the conditions are necessary or that revocation of the Use Permit is advisable. This item was continued to the Planning Commission meeting of January 4, 2007 (All Ayes). Staff continues to meet with the Brewing Company and neighbors to identify changes to the operation and conditions of approval to alleviate nuisances. Newport Bay Manna (PA2001 -210) 2300 Newport Boulevard The Planning Commission approved the Newport Bay Marina Project on November 16, 2006. The project consists of a mixed -use development with approximately 36,000 square feet of commercial uses and 27 residential units, bulkhead replacement and marina replacement. The Commission also certified an Environmental Impact Report prepared for the project. The revised resolution for project approval was considered on December 7, 2006 as there were changes to the conditions of approval. This item was reviewed and approved (All Ayes). The appeal period for project approval expired on November 30, 2006. Hoag Healthcare Center (PA2006 -113) 500 -540 Superior Ave. Use Permit was sought to allow the conversion of 97,000 square feet of research and development (R &D) /general office use to medical office use within the former Newport Technology Center. The project includes the demolition of one of the existing buildings and the construction of an additional parking structure that exceeds the maximum building bulk Planning: sharedlPlanning Commission\pcagendarpt.doc Planning Commission Agenda for November 16, 2006 Page 3 limitation for the site. Additionally, a traffic study was considered pursuant to the City of Newport Beach Traffic Phasing Ordinance (TPO). This item was approved (5 Ayes, 1 No). The appeal period expires on December 21, 2006. The Commission was concerned about a proposed shuttle between the project site and Hoag Hospital and it was permitted; however, it was restricted from operating on nearby residential streets. Item 7: Janet and James Walkie Ray Residence (PA2006 -247) 15 Bay Island A Use Permit was requested to allow alterations of up to 75% of the structural elements of the existing legal nonconforming dwelling in conjunction with a remodel, reconstruction and addition to the residence. A Modification Permit was requested to allow a second level deck to encroach up to 12 feet into the 15400t front setback on the bay side of the building site and a shade/trellis structure to encroach 1 foot into the 4-foot required side yard setback on the park side of the building site. Lastly, the applicant requested Planning Commission approval to allow the reconstructed portion of the dwelling to be 28 feet in height pursuant to the Bay Island Planned Residential Development regulations. This item was approved (5 Ayes, 1 No). Prior to the hearing, it was determined that the Modification Permit was not necessary for the proposed deck. The during the hearing, additional information came to light such that it was also determined that the proposed shadettrellis was a permitted architectural feature thus eliminating the need for a Modification Permit. The Commission was able approve the Use Permit as the reconstructed residence was being lowered in overall height and was deemed compatible with structures on Bay Island. ACTION: Adopt Mitigated Negative Declaration, including a Mitigation Monitoring and Reporting Program, and approve Use Permit No. 2006 -010 and Traffic Study No. No. 2006 -001. ITEM NO. 7. These actions have been determined to be categorically exempt pursuant to Section 15301 (Existing Facilities) of the Guidelines for Implementation of the California Environmental Quality Act. ACTION: Approve Use Permit No. 2006 -030 and Modification Permit No. 2006 -118, subject to the findings and conditions.
