Report of the actions of the Planning Commission Meeting:
ITEM NO. 1. Minutes dated February 21, 2008
SUMMARY: This item was continued to April 3, 2008 as there were corrections proposed to the
transcript of the February 21, 2008. (All Ayes)
ITEM NO. 2. Minutes dated March 6, 2008
SUMMARY: This item was approved with corrections. (6 Ayes, 1 Abstain)
ITEM NO. 3. Fury Rok & Rol Sushi Lounge (PA2005 -018)

SUMMARY: Update on the revocation of Use Permit No. 3162 and Use Permit No. 2005 -018.
The Planning Commission received the report and requested an update from the
Planning Director at the April 3rd meeting on the new security plan. The
Planning Commission also directed Staff to return with a report from the Hearing
Officer for the May 8, 2008 meeting.
ITEM NO. 4. Pavilions Wine Tasting

SUMMARY: Request for a use permit for an on -sale wine tasting bar and area with a Type 42
On -Sale Beer & Wine Public Premise alcoholic beverage license.
This item was not heard because of inadequate public notice. The applicant did
not provide a complete set of mailing labels for notice; therefore, a new hearing
will have to be scheduled. This item was received and filed.

ITEM NO. 5. Hoag Memorial Hospital Presbyterian (PA2007 -073)

SUMMARY: Continued hearing from January 31, February 7, 2008, and March 6, 2008 for a
request to reallocate up to 225,000 gross square feet of permitted buildable area
from the Lower Campus to the Upper Campus through the approval of the
proposed General Plan and Planned Community Development Plan
Amendments. A Supplemental Environmental Impact Report with supporting
documents has been prepared in connection with the application.
Hoag will be required to install a sound wall and concerns of design, location,
height, and landscaping came into light. Representatives of Hoag Hospital
proposed a 105 -foot extension to the north with an additional extension possible
based on a recommendation from the noise consultant.
Residents of Villa Balboa condominiums expressed serious concerns about
steam plumes from the cogeneration facility on the lower campus.
Commissioners received a report from the City's consultant Fluor Enterprises on
possible plume abatement measures. Commissioners agreed that a fix to the
plume problem should be addressed and recommended that the City Council
consider implementing effective plume abatement for the Hoag cogeneration
facility during the Council's consideration of the amendment of the Development
Agreement.
This item was recommended for approval to the City Council and is scheduled to
be heard on April 8, 2008. (All Ayes)
ITEM NO. 6. Seashore Village (PA2007 -100)

SUMMARY: A request to approve a Use Permit for building height exemption; Modification
Permit for setbacks and building. separation; Tentative Tract Map established for
condominium purposes; Coastal Residential Development Plan for compliance with
the Mello Act; and Mitigated Negative Declaration.
This item was continued to April 3, 2008 to allow time to review a lengthy
comment on the draft Mitigated Negative Declaration that was received just prior
to the meeting. (6 Ayes, 1 No)
ITEM NO. 7. Sejour (PA2002 -167)
3400 Via Lido
SUMMARY: Revocation of use permit for an off -site alcoholic beverage outlet with accessory on-
site alcohol consumption, food service and live entertainment.
This item was continued to April 17, 2008. (4 Ayes, 3 No)

Quality Act under Class 21 (Enforcement Actions by Regulatory Agencies).

of the California Environmental Quality Act under Class 1 (Existing Facilities)
ITEM NO. 5. Hoag Memorial Hospital Presbyterian (PA2007 -073)

SUMMARY: Continued hearing from March 6, 2008, for a request to reallocate up to 225,000
gross square feet of permitted buildable area from the Lower Campus to the
Upper Campus through the approval of the proposed General Plan and Planned
Community Development Plan Amendments. Applicant also requests approval of
amendments to development regulations contained within the existing Planned
Community Development Plan, also known as the Hoag Master Plan or the PC
Text. The changes principally relate to the allocation and limit of permitted building
area between the Upper and Lower Campus, noise regulations, landscaping
requirements and sign standards. Lastly, applicant requests an amendment of the
existing Development Agreement to reflect the changes to the Master Plan as
summarized above and to provide additional public benefits principally in the form
of providing funds for improvements and community projects to public facilities
such as streets, parks, water quality and public safety facilities.
ACTION: 1) Conduct public hearing; and
2) Adopt resolution recommending City Council certification of Supplemental
Environmental Impact Report SCH #1991071003; and
3) Adopt resolution recommending adoption of General Plan Amendment No.
2007 -005, Planned Community Development Plan Amendment No. 2007 -001,
and Development Agreement Amendment No. 2007 -001

COMPLIANCE: A Supplemental Environmental Impact Report has been prepared in connection with
the application noted above. It is the intention of the City to accept the
Environmental Impact Report and supporting documents. Copies of the
Environmental Impact Report and supporting documents are available for public
review and inspection at the Planning Department, City of Newport Beach.
ITEM NO. 6. Seashore Village (PA2007 -100)

SUMMARY: Use Permit for building height exemption; Modification Permit for setbacks and
building separation; Tentative Tract Map established for condominium purposes;
Coastal Residential Development Plan for compliance with CA Government Code
Section 65590 and Chapter 20.86 of the City's Municipal Code; and Mitigated
Negative Declaration.
ACTION: 1) Conduct public hearing; and
2) Adopt a Resolution adopting the Mitigated Negative Declaration; and
3) Approve a Resolution approving Residential Development Permit CR2007 -001,
Tentative Tract Map NT2007 -001, Use Permit UP2007 -011 and Modification
Permit MD2007 -044

COMPLIANCE: A Mitigated Negative Declaration has been prepared by the City of Newport Beach
in connection with the application noted above in accordance with CEQA Guidelines.
The Negative Declaration states that the subject development will not result in a
significant effect on the environment.
ITEM NO. 7. Sejour (PA2002 -167)

SUMMARY: Revocation of use permits for an off -site alcoholic beverage outlet with accessory
on -site alcohol consumption, food service and live entertainment.
ACTION: 1) Conduct public hearing; and
2) Adopt Resolution revoking Use Permit Nos. 2001 -005 and 2002 -034.
