Webb, Public Works Director- (949) 644 -3330, dawebb @newportbeachca.gov PREPARED BY: Antony Brine, City Traffic Engineer PHONE: (949) 644 -3329 TITLE: Adopt Resolution Establishing Two -hour Parking Restrictions on Old Newport Boulevard from Hospital Road to Catalina Drive ABSTRACT: In an effort to improve the overall parking conditions on Old Newport Boulevard, staff recommends adoption of a Resolution for Establishing Two -hour Parking Restrictions on Old Newport Boulevard from Hospital Road to Catalina Drive. RECOMMENDATION: a) Rescind Resolution No. 2014 -21; and b) Adopt Resolution No. 2015 -36, A Resolution of the City Council of the City of Newport Beach Limiting the Parking of Vehicles on Certain Streets and Rescinding Resolution No. 2014 -21, for the establishment of two -hour parking restrictions on Old Newport Boulevard from Hospital Road to Catalina Drive. FUNDING REQUIREMENTS: The current adopted budget includes sufficient funding for this item. DISCUSSION: Staff has received a petition from fourteen (14) business and property owners on Old Newport Boulevard asking the City to limit parking to two (2) hours for seventeen (17) parking spaces in the City parking lot south of Hospital Road. It is stated in the petition that, with no time restrictions, vehicles are currently parking in the area for extended periods of time. Local business owners have told staff that employees from adjacent properties are using the parking lot for all -day parking. The concern is that the unrestricted parking is negatively affecting the businesses along Old Newport Boulevard, particularly small businesses without any private off - street parking. The parking lot area on the west side of Old Newport Boulevard, located south of Hospital Road, has twenty -nine (29) striped parking spaces, which includes one (1) handicapped space. Additionally, there are eleven (11) spaces along the Old Newport Boulevard right -of -way north of the parking lot, which include 22 -1 two (2) handicapped spaces Staff believes that the request for seventeen (17) two -hour spaces is too large. Many of the area businesses, including retail and medical office buildings, have their own off - street or reserved parking spaces. The primary issue is the use of the parking lot by the employees of area businesses and medical practices. Staff is concerned that if too many spaces in the parking lot are designated for two -hour parking, these employees will migrate to park in the nearby residential neighborhood. The challenge is to provide for enough parking for the customers of the Old Newport Boulevard businesses, while not potentially impacting the surrounding residential neighborhood. Municipal Code Section 12.44.010 B. states that "When authorized signs are in place or the display of a parking meter gives notice thereof, no person shall stop, stand, or park any vehicle between the hours of 8:00 a.m. and 6:00 p.m. of any day for a period of longer than two hours upon such streets or portions thereof as the City Council shall designate by resolution ". The Resolution being presented defines the limits of Old Newport Boulevard where two -hour parking restrictions can be established. Staff proposes to restrict parking within the defined limits, but only where authorized signs are installed. The Resolution will provide the flexibility to adjust the number of spaces with time restrictions based on changing parking conditions in the area. For example, should ten (10) parking spaces prove to be insufficient in number, more two -hour spaces can be established and signs can be posted without having to return to City Council. This is important for an area where business and residential areas are located immediately adjacent to each other. It is staffs recommendation that ten (10) parking spaces initially be designated in the parking lot for two - hour parking restrictions 8:00 a.m. to 6:00 p.m., except Sundays and holidays. Letters were sent to current business owners, property owners, tenants and homeowners in the surrounding area notifying them of the request to change the on- street parking conditions on the street (Attachment D). The letter also indicated that individuals would have an opportunity to provide comments at the May 12, 2015 City Council meeting. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach as follows: Resolution No. 2014 -21 is rescinded and replaced with this Resolution. 2. ATTEST: City Clerk Mayor 162 M r ATTACHMENT C PETITION FOR DESIGNATING 17 PARKING SPACES IN THE CITY OF NEWPORT BEACH PARKING LOT LOCATED IMMEDIATELY SOUTH OF 325 OLD NEWPORT AS TWO -HOUR PARKING We, the undersigned, own stores and businesses in the vicinity of the city parking lot located just south of and adjoining 325 Old Newport Boulevard, Newport Beach, CA. There are 29 parking spaces in the main lot and 6 spaces on Old Newport Boulevard, all unlimited parking, with no time restriction. In both the parking lot and the on- street spaces, some cars are parked there for hours —if not all day long —but not by our customers. In some cases, the spaces are being used by people going elsewhere, like PCH, and in other cases, by employees of other businesses in the area, who want to avoid using up the parking at their own sites. The resulting shortage of parking has driven customers away and seriously affected our businesses. We are asking the City to designate 17 of those 35 parking spaces as time-timited parking. Restricting 17 spaces to 2 -hour parking would increase turnover of spaces, allowing our customers to park and shop in our stores. The rest of the parking spaces— 50% of the total — will remain long term, unlimited parking. Without any time restrictions on parking spaces in this area, employees and others can park for extended periods of time, which affects the local businesses. The City is planning to designate 10 spaces in the parking area for 2 -Hour parking, to provide for a better balance of parking needs along the street. This item will be included on the City Council Agenda for the May 12, 2015 meeting. If you would like to provide comments on this matter, you are encouraged to attend the City Council meeting.
