BACKGROUND
The City Council conducted a public hearing for this project on July 22, 2008. The
hearing was continued to this meeting. During the hearing, testimony was given and
questions were raised regarding geologic stability of the site, the project's visual impact
from the harbor and noise impacts from construction. As a result, staff determined, and
the applicant concurs, that an Environmental Impact Report should be prepared.
RECOMMENDATION
Remove this item from calendar.
DISCUSSION
Keeton Kreitzer Consulting prepared the prior Mitigated Negative Declaration and is
familiar with the project and staff has requested a proposal to prepare the EIR. Using a
different consultant would not be efficient and would cause additional delays. The EIR
will include discussions of Aesthetics, Air Quality, Biological Resources, Geology &
Soils, Hazards & Hazardous Materials, Land Use & Planning, Hydrology & Water
Quality, Noise and Transportation/Traffic along with other mandatory elements required
by law. Other issues may be included if identified during the process. The anticipated
cost for preparation of the EIR is approximately $95,000, although this amount may

change pending the submission of final subconsultant proposals for certain technical
studies to be performed. Council Policy F -14 authorizes the City Manager to execute a
Professional Services Agreement on behalf of the applicant up to $100,000 provided the
City Council is notified and the applicant deposits funds with the City to cover the cost of
the agreement.
The anticipated schedule has the EIR and project returning to the Planning Commission
for review in January of 2009 with Council hearings to follow. Notice of future hearings
will be provided in accordance with local and State law.
