be within the subject matter jurisdiction of the Planning Commission.
Speakers must limit comments to 3 minutes. Before speaking, please state
your name for the record and print your name on the tablet provided at the
podium.

Any writings or documents provided to a majority of the Planning Commission regarding any item on this
agenda will be made available for public inspection in the Planning Department located at 3300 Newport
Blvd., during normal business hours.
ITEM NO.1 Minutes dated August 7, 2008
ACTION: Approve as written and order filed
PUBLIC BUSINESS
ITEM NO. 2 General Plan Amendment (PA2008 -131)
SUMMARY: The Fire Department has recently prepared a LHMP, which is a comprehensive
assessment of hazards that could affect the City including flood, earthquake,
tsunami, and fire disasters. Assembly Bill 2140 limits the amount the City may
receive to 75% of post- disaster reimbursement costs unless the City incorporates
a LHMP into the Safety Element. When incorporated, local jurisdictions may
receive up to 100% of post - disaster reimbursement costs.
ACTION: 1) Conduct public hearing; and
2) Adopt resolution recommending City Council adoption of the General Plan
Amendment (GP2008 -006) incorporating the LHMP into the Safety Element.
CEQA
COMPLIANCE: This activity is covered by 1506.1(b)(3) the general rule that CEQA applies only to
projects which have the potential for causing a significant effect on the
environment. It can be seen with certainty that there is no possibility that this
activity will have a significant effect on the environment and it is not subject to
CEQA.
ITEM NO. 3 Megonical Residence (PA2007 -133)
2333 Pack Drive
SUMMARY: A request for a modification permit to allow planter walls and a water feature to
exceed the 3 -foot height limit in the front yard setback in association with the
construction of a new, three -story single - family dwelling. The property is located in
the Single - Family Residential (R -1) Zoning District.
The Planning Department also requests a determination on whether the proposed
project complies with City Council Resolution No. 2007 -3, which requires that all
new development comply with applicable polices of the General Plan.
ACTION: 1) Conduct public hearing; and
2) Find that the proposed project complies with applicable policies of the General
Plan; and
2) Adopt resolution approving Modification Permit No. 2007 -080.
CEQA
COMPLIANCE: This project has been determined to be categorically exempt under the
requirements of the California Environmental Quality Act under Class 3 (New
Construction or Conversion of Small Structures) as the proposed project is one,
single - family residence in a residential zone that contains no environmentally
significant resources on site.

Summary: Approved as corrected and order filed. ( AII Ayes)

Item No. 3 Megonical Residence (PA2007 -133)

Summary: A request for a modification permit to allow planter walls and a water feature to
exceed the 3 -foot height limit in the front yard setback in association with the
construction of a new, three -story single - family dwelling.
The Planning Commission received presentations by staff and the applicant.
Twelve residents expressed their opposition to the project due to impacts to
public views from Begonia Park and Begonia Avenue. The Planning
Commission found the project in substantial conformance with the policies of the
General Plan and approved the Modification Permit with the changes and
conditions recommended by staff. The Planning Commission also required the
applicant to dedicate a view easement restricting landscaping and accessory
structures on the proposed terrace and in open areas.
This item was approved. (All Ayes)
