SUBJECT: BALBOA ISLANDS BULKHEAD AND SEAWALL REPAIR - AWARD OF
CONTRACT NO. 3962
Recommendations:
1. Approve the project plans and specifications.
2. Declare the bid submitted by Kitson Specialty Contracting, Inc., of Santa Fe
Springs non - responsive.
3. Award Contract No. 3962 to Surfside Restoration & Waterproofing, Inc., for the
Total Bid Price of $196,385, and authorize the Mayor and the City Clerk to
execute the contract.
4. Establish an amount of $45,615 (23 %) to cover the cost of unforeseen and
anticipated work not covered in the original scope.
Discussion:
At 10:00 a.m, on September 18, 2008, the City Clerk opened and read the following
bids for this project:

The low bid total amount is significantly lower than the Engineer's Estimate and could
be due to the following reasons:
(1) The Engineer's Estimate was prepared using bid prices received from previous
identical projects. Surfside Restoration & Waterproofing, Inc. (Surfside)
indicated to staff that his unit prices reflect the current construction environment
for his company. The average of the other submitted bids was within the range
of the Engineer's Estimate;
(2) Surfside is relatively small staffed, which allowed for less administrative and
overhead costs; and
(3) Surfside specializes in concrete, bulkhead, and seawall repairs giving it a
competitive advantage to provide lower costs than its competitors.
A check of Surfside's references indicates they have satisfactorily completed similar
repair projects for other public agencies. Surfside has satisfactory completed four
projects involving identical work for the City within the past twelve years. Despite
Surfside's low bid prices there was no compromise in the quality of work performed.
Surfside possesses a California State Contractors License Classification "C -61" for
concrete - related services as required by the project specifications.
Due to the low unit prices bid by Surfside, staff recommends Council establish a
contingency amount of $45,615, equaling approximately 23% of the contract amount.
These additional funds will provide an opportunity for the City to take advantage of the
low unit prices to negotiate additional bulkhead and seawall repairs at other locations.
This project provides for repairing concrete cracks and spalls, sealing joints, and installing
shotcrete to the bulkheads and seawalls along the perimeter of Balboa Island and Little
Balboa Island. These repairs will mitigate some of the high tide seawater infiltration
caused by non - structural deficiencies. The existing abandoned streetlight pull boxes
within the bulkhead copings will be removed and backfilled.
Pursuant to the contract specifications, Surfside will have 120 consecutive working days
to complete the work with an estimated completion of no later than April 21, 2009. All
work under contract shall be inspected for water- tightness during an extreme daytime
high tide of at least 6.9 feet before the City will accept the work. The final release of
retention will be made at the end of the one -year warranty period.
Environmental Review:
The project is Categorically Exempt from the California Environmental Quality Act
(CEQA) pursuant to Section 15301 of the CEQA Implementing Guidelines. This

exemption covers the repair, maintenance and minor alteration of existing public
facilities with negligible expansion.
Public Notice:
The Notice Inviting Bids was advertised in the City's official publication. Prior to starting
work, City - prepared notices will be distributed by the contractor to both residents and
businesses in the area ten days and 48 -hours prior.
Geotechnical, Material Testinq, and Surveying Services:
Geotechnical, material testing, and surveying services are not anticipated for this project.
