The meeting of the Parks, Beaches and Recreation Commission
was called to order at 7:05 P.M.

Roll call was taken. Cohen, de Boom, Hopkins, King, Springer
and Stuart were present. Capretz was absent (excused).

II. ACTION ITEMS
Item #5 - Modification of Beach Closure Times

Ron Whitley reported the City Council received a petition
x
from residents to move the closing time from 12 midnight to
10:00 P.M. on the ocean front beach between the wedge and

"E" Street. The City Council has referred this matter to
the Parks, Beaches.and Recreation Commission for their
recommendation and input from the public. Ron emphasized
x
that the key is to enforce the beach rules, which is not
under the jurisdiction of the Parks, Beaches and Recreation
X

Department. This responsibility belongs to the Police
x
x
Department, whose representative, Sgt: Doug Fletcher, was

Marine Department was unable to provide a representative,
however, they have included a written report for informa-
tional purposes. Ron noted he received a communication
from Mrs. Valentine, 2106 E. Balboa Blvd., recommending
the beach area be closed at 10:00 P.M.
Following questions by the Commission, Chairman Hopkins
opened the meeting to public testimony. Mr. Charles Bauman,
2150 Miramar Drive, addressed the Commission. Mr. Bauman,
who initiated the petition, said the reason for the request
for ordinance change for closing the beach at 10:00 P.M.,
rather than midnight, was due to the unbearable noise until
2:30 -3:00 A.M. In addition, he mentioned such problems as
broken bottles, litter, vandalism, illegal parking, etc.
He suggested more visible signs be posted and pointed out
that Officer Tom Little of the Police Department told him
that since the shift change is at midnight, enforcement
would be easier if the beach closure time were at 10:00 P.M.
Mr. R. G. Mitchell, 2172 East Ocean Front,, addressed the
Commission. He noted that the beach is most accessible at
the end of Channel' Road and is a focus point for young
people. He, too, emphasized that the problems do not cease
at midnight, i.e., litter; noise, etc., and that there
should be more enforcement. He asked that the beach be
closed at 10:00 P.M., that a helicopter announce the closing,
more signs be posted, and that some system of citations be
implemented.
Mr. Curt Herberts, 2290 Channel Road, addressed the Commis-
sion. He recommended a helicopter announcing the closure,
more signs posted, citations be issued for one to two months,
and that a $100 fine be imposed for being on the beach after
closing.
Mr. Seymour Beek, 2149 Seville Avenue, addressed the
Commission. He, too, spoke of the excessive noise and
parking problems. Mrs. Virginia Herberts, 2290 Channel Road,
addressed the Commission and said she is in favor of an
enforced 10:00 P.M. curfew. Ms. Pat Eichenhofer, 2128 E.
Ocean Blvd., addressed the Commission. She favors the
10:00 P.M. closing time due to trespassing on private
property, litter, excessive noise and speed.
Sgt. Fletcher from the Newport Beach Police Department
•
answered questions of the Commission. He stated that the
`
wedge area is more difficult to enforce due to the geographi-
cal nature of the area and the fact that there is only one
officer at a time covering the beach. He personally felt the
laws would be more effective if the time of closure was
consistent for all the beaches.

Ms. Pat Eichenhofer, 2128 E. Ocean Blvd., addressed the
Commission and stated that the merchants might object to
a later closing and felt control by a jeep is needed.
Following discussion, Cohen moved recommending to the City
Council that the beaches in Newport Beach be closed at
10:00 P.M., that helicopters be used to give notice of
closing, that signs be posted, and citations issued to those
who won't leave the beach and /or remain after 10:00 P.M.
Kind seconded. Motion fails.
Following additional discussion, Stuart moved a committee
be formed to do a more extensive study of this matter and
report back at the Commission's next regularly scheduled
meeting on March 6, 1984. Springer seconded. Motion
carried.
King requested that the Director of the Marine Department
be present at the March 6 meeting. The committee will
consist of Cohen as Chair, Charles Bauman, R.G. Mitchell,
and Commissioners de Boom and Stuart.

pointed out by residents as a result of the park development.
Commissioner King, as Chair of the committee, handed out a
memorandum dated February 7 superseding the one dated
February 1. Changes were in paragraph 1. He pointed out
-
that residents Jennifer Park and Denise Newcomer were on the
committee and that Rich Edmonston, City Traffic Engineer,
participated.
Mr. Edmonston` felt an overpass would be too expensive and,
therefore, recommended traffic signals and lights be
implemented. King recommended the overpass in lieu of stop
signs and signals.
Ron Whitley reported he received a letter from Mary Hendricks
President of the PTA at Andersen School, who also supports
the recommendation of King and his committee. Ron reported
the Commission can recommend the Traffic Engineer implement
the signals and stop signs.

Following questions and discussion, Chairman Hopkins opened

the meeting to public testimony. Mr. Phil Glasgow, Board
member of Harbor View Hills Homeowners Association Phase I,
addressed the Commission. He spoke on behalf of the Associa-
tion which is opposed to the overpass concept. He said they

favor a means to slow traffic down, preferably via traffic
signs, and that they are willing to help get the signs
installed as soon as possible.
Denise Newcomer, Board member of Harbor View Hills Associa-
tion Phase II, addressed the Commission. She stated the
Association is opposed to the overpass due to its expense.
She feels stop signs do not deter traffic from stopping and
speeding, therefore, she recommends yellow flashing lights,
particularly for vehicles coming down Spyglass Hill Road.
She also pointed out there is not enough visibility on
Eastgate'and Newport Hills Drive, and that there is no
crosswalk or stop sign at Port Sutton and San Miguel Drive.
Jennifer Park, 2215 Port Harwick Place, addressed the
Commission. She is most concerned with.getting children to
and from the park -in the safest manner. She said she
realizes an overpass would cost too much and, therefore,

would like to see a signal installed at San Miguel and
Spyglass. She noted that she had talked to Mr. Bernard
Maniscalco of The Irvine Company who thought they would
provide half of the funds for the signal.
Ms. Mary Hendricks, President of the PTA for Andersen
School, addressed the Commission. She mentioned what a
beautiful park San Miguel will be and is concerned for
the children's safety. She, too, would like to see a signal
at San Miguel and Spyglass.
Following discussion, King motioned recommending to the City
Council and City Traffic Engineer that the 1984 -85 budget
include sufficient funds to install a 4 -way signal at the
intersection of San Miguel Drive and Spyglass Hill Road /
Eastgate, a 4 -way stop signat San Miguel Drive and Port
Sutton /Yacht Coquette, and a stop sign on Newport Hills
Drive East and Eastgate Drive. Cohen seconded. Unanimous.
Ron Whitley will forward the recommendation.
Item #7 - Storage and Staging Area for C =Class Catamarans

Catamarans on the 16th Street beach on the bay side of the

Balboa Peninsula from March, 1984 to August, 1985. Both the
Marine Department Director, Dave Harshbarger, and Ron felt
the Commission should make the recommendation since this
comes under their jurisdiction. Ron distributed a copy
regarding the history of the Cup to the Commission for their
information.

Following questions regarding fees, physical impact,
liability, and congestion during the summer, Chairman
Hopkins opened the meeting to public testimony. Mr. Ed
Hollaran, a representative from the C -Team, addressed the
Commission. He informed the Commission that the team is
comprised of five men who live locally, although not in
Newport Beach. They will be racing outside the harbor area
on evenings and weekends. He felt there would be minimal
impact to the beach area.
Following questions answered by Mr. Hollaran, Cohen moved
the C -Team be permitted to store their two Catamarans at
the 16th Street beach area on the bay side of the Balboa
Peninsula from March; 1984 to August, 1985. de Boom seconded
After discussion, Cohen moved to amend the motion stating
that this is contingent upon the C -Team duly qualifying as
a non-profit-.,group. de Boom seconded. Motion carries.
Staff will forward the Commission's recommendation to the
City Council.
III. INFORMATION REPORTS
Item #8 - Commission Budget Committee

Commissioner Cohen reviewed the results of the Budget
ommittee
Committee and Ron Whitley pointed out that comparisons from
one fiscal year to another cannot be made accurately since
some funds are removed from the M &O Account and funded
from another source. He also announced there will be a
Budget Committee meeting with the City Manager on February 21,
1984.
Item #9 - Recreation and Open Space Element

Commissioner Stuart gave an update on the status of the

Recreation and Open Space Element. He noted a redraft is
presently being done which should be available in four to
six weeks. There may be a joint hearing between Parks,
Beaches and Recreation and Planning in April or May.
Item #10 - Park and Street Tree Division

Jack Brooks reported 18 trees were lost during the recent

wind storm, most of which were broken at the tree trunks, '
and that the Westcliff area had the heaviest loss. There
were 25 calls on tree problems.
Chairman Hopkins opened the meeting to public testimony.
Ms. Virginia Herberts, 2290 Channel Road, addressed the
Commission. She expressed her concern about the trees on

the Peninsula, most of which have been removed on Miramar.
Ron Whitley reported this is a Public Works project being
done due to the deterioration of the sidewalks and-curbs.
Jack Brooks_ explained that this program is being done in
phases and that Public Works notified by letter the property
owners involved, result of which was a minimal response.
Item #11 - Recreation Division

Tom Line reported on the forthcoming agreement with the Sea
-Scout Base and the use of their Lido 14's for a new sai'li'ng
class. Interviews for-the new Recreation Supervisor will be
held on February 22, and the new Supervisor should be on
board the beginning of March.
Commissioner King asked that the Department support the
National Foundation of Wheelchair Tennis in such areas as
teaching, clinics, leagues, etc. Tom said he had talked to
a representative from the Foundation and she will be coming
back with additional information which would be required to
implement such a program.

We the members of Imua Outrigger Canoe Club are requesting permission
to make our new home at the new 'aquatic recreation area' known as North
Star Beach. J
Imua Outrigger team previously used the Newport Dunes for many years.
Newport Dunes finally got approval to start construction of a hotel and
additional boat docks so we were asked to le_ave_. _
- -'Our olnb 3oesigt need very` muoh space. 40' x 50' would be fine. We
don't require any construction of buildings or docks, just space on tke
'beach. For example, one of our rivals, Newport Outrigger 9anoe Club, uses
17th Street bay beach, and our requirements are similar to theirs.
The canoe season is from April to October, so if need be, we could
transport our canoes off the beach for the winter.'

SUBJECT: Commercial Use of Public Facilities
During the Study Session of February 27, the City Council reviewed
Council Policy G -4, and specifically Paragraph D -1 of said Policy which
reads as follows: "Meetings for personal gain or commercial enterprises
not related to civic purposes." The City Council then requested the
Parks, Beaches and Recreation Commission to review D -1 and submit a
recommendation to the Council as to whether this Policy should or should
not be amended to allow commercial enterprise use of a City facility,
provided market rent is charged.
For the Commission review, we will gather data of use facility patterns
and what other cities are doing on this matter. This material will be
available at the meeting of March 6, 1984.

RECREATION DIVISION
• FEBRUARY, 1984 PROGRESS REPORT
Senior Citizens
The attendance report for the OASIS Center has been completed. The report
covers October 1, 1.983 to December 31, 1983, a three month period. During
that time 17,782 participants frequented the OASIS Center and utilized the
facility to the fullest for games, classes, meetings, dances and social
get togethers. Volunteers are also an important statistic and during the
three month period there were 4,120 recorded volunteer hours.
Classes are going well at OASIS. Winter Coastline classes are very successful
and genealogy classes taught by Kathryn Ellis are going great guns. Several
new genealogy classes will start soon from 11 AM - 1 PM on Wednesdays.
The Human Services Department is. extremely busy this time of year. Meetings
are scheduled on Elder Abuse Legislation and several sessions are scheduled
to assts.t seniors with income taxes.
The conversion project which includes new office areas for the Human Services
Department is continuing on a daily basis. Carpentry and electrical work is
now being completed.
Events that have been completed in February and that are forthcoming in March
• are:
February 10 - Valentine Party for office volunteers.
February 10 - Brown Bag Meditation Program.
February 11 - Pancake Breakfast
February 12 - Tea Dance
February 17 - Shared Housing Mixer
February 18 - Rummage Sale
February 18 - Old Time Theatre
February 26 - Friends of the Arts. Program
February 27 - "California Aging Network" Seminar
March 2 - General Membership Meeting - Election of Board Members of
Friends of OASIS
Youth Sports
The Youth Track and Field Program will begin March 12. Flyers have already gone
out and the program will stress learning. There will be a clinic at Newport
Harbor High School which will include injury prevention and free injury examinations.
Former Olympian, Dallas Long, will help conduct the track and field clinic.
The City's Annual Track and Field Meet is scheduled for April 7 at Newport Harbor
High School.
Youth basketball will be ending its season this week, while Division winners will
• advance to the Orange County Championships. _

Adult Sports
• Registration for Spring Basketball Leagues is now being,accepted. Leagues
will begin play March 20, 1984. At this point registration is slow.
Softball flyers have been sent out for spring play. The response should be
excellent, especially with the probability of good weather.
Activity and Classes
The winter session for Special Activity classes is progressing smoothly. The
new Supervisor for this section should be on board soon and be able to evaluate
most classes and revenue estimates. Some classes have been cancelled but this
is very similar to past winters.
Sailing
Winter sailing classes are very slow. If anything, the month of February showed
a slight increase in enrollment. It looks as though there should be a great
increase for class enrollment during the spring months.
Brochure
The spring brochure is now out and looks quite good. Staff really hustled to
get it out on time even with the loss of a Supervisor. The clerical staff worked
very hard and gave us the time we needed to check and recheck the information.
The mailing service saved us time and money and they will be used again.
. Excursion
The ski excursion to Mammoth Mountain was a great success. The possibility of
again joining up with other cities to fill a bus will be done in the future.
The ski excursion made about $400 for the City after all costs were paid. Every-
one had a great time.
Aquatics
Staff recruitment for our summer program will begin soon. Qualified applicants
will come from Orange Coast College and U.C.I. They should provide some
excellent candidates.

PARK AND STREET TREE DIVISION
• FEBRUARY, 1984 PROGRESS REPORT
Our Park Crews performed the following tasks during the
month of February:
Planted trees and shrubs at Newport Pier restroom.
Packed and moved Dory Fleet Model from the City Hall Lobby.
to West Newport Library.
Wind storm clean up.
Transplanted shrubs from Tea House at City Hall.
Sandblast concrete trash containers.
Graded, installed steps, wall and concrete footing at
Riverside Scout House.
Our Street Tree Division performed the following.
• Trimmed 639 trees.
Removed 18 trees.
Root pruned 5 trees.
Completed 12 work requests.
Areas being trimmed are Corona del Mar and Corona del Mar Main Beach
Palms.
