The agenda was adopted as presented with the addition of

II. PRESENTATION OF YOUTH TRACK AND FIELD AWARDS
Chair Brenner turned the meeting over to Mark Deven who
announced that the Annual Youth Track and Field Meet held
on April 22 was a big success. Mr. Deven thanked the
Newport-Balboa Rotary Club for the outstanding job their
volunteers did in training and supervising officials, timers
and scorers. This Meet also provided a cultural exchange
with the City's Sister City, Okazaki, Japan, who donated
the trophies for the most valuable female and male athlete.
We are also in the process of comparing scores of the City's
Meet and Okazaki's Meet.
Mr. Terry Zimmerman of the Newport - Balboa Rotary Club
presented individual trophies to Erin Stoval and Joey Miller
which were awarded on a point performance system.
Director Whitley and Chair Brenner each thanked Mr. Zimmer-
man for all the help and effort provided by the volunteers
of the Rotary Club.

Item #5 - Beach Volleyball Applications

Mark Deven reviewed the volleyball posting procedure and

applications received for court installation at Fern Street/
West Ocean Front and Marinapark (1770 W. Balboa Blvd.).
The two locations were reviewed with the Marine and General
Services Departments and it is staff's recommendation they
be approved for installation.
Residents within 200' of the proposed courts were also
notified and two comments were received after the agenda
was mailed. Mr. Griffith, 6808 Ocean Front, supported the
Fern Street /West Ocean Front location. Beverly Rainbolt,
a Marinapark resident at Space 10 -A, favored the alternate
location at Space 8 -A.
Chair Brenner opened the meeting to Public Testimony.
Jean Peake, 1770 W. Balboa, Space 8- A,•addressed the
Commission. She stated the residents are in favor of
keeping the existing court which has been there about 14
years. The net is only up when it is in use and there are
no view problems.
Mark Deven reported the General Services Director recommende
the court be moved 4' away from the fence to facilitate
beach cleaning.
Ms. Peake advised there would be no objections to this
alternative.
Beverly Weinfurtner, 1770 W. Balboa, Space-10-A, addressed
the Commission and stated she. is in support of the present
court location since there have never been any problems.

Item #6 - St. James Street Median Island

Director Whitley reported there have been requests for the

City to assume the maintenance responsibility for St. James
Island

This would be a small maintenance item of minimal cost to
the City, however, by Policy, the Department cannot perform

association's responsibi'li'ty. Policy I -4 lists similar
areas grandfathered in as exceptions for the City's
responsibility. To include St. James Island would require
an amendment to the Policy.
Commissioner Grant questioned if, in fact, the island wasn't
already a City responsibility; it is surrounded by public
property and there is no real association, nor does the
informal association own any'property.
Chair Brenner opened the meeting to Public Testimony and
Mr. Mike Taylor of the Cliff Haven Homeowners Association
addressed the Commission. Mr.- Taylor reported the Associa-
tion spent $1,500 refurbishing the median and neighbors
have been maintaining it. The Association is asking that
the City mow and edge the area and they will water it.
Mr. Joseph McCarthy, 734 St. James Place, addressed the
Commission. He reported his neighbor used to take care of
the island but he is doing it now and would appreciate
any help the City can give them.
Director Whitley stated this might be a precedent setting
situation, however, any area requested for City maintenance
would be reviewed on an individual basis.

The Commission determined that In the meantime the City
will mow and edge. By amending the Policy, however, the
island will be the total maintendhce-'responsibi'lity of the
City.
Director Whitley will transmit the-.Commission's decision
to the homeowners association. .
Item #7 - Tree Removal Appeal - 527 Hazel Drive

Director Whitley reported Mr. Stephen Prough, 527 Hazel
Appeal
Drive, is appealing the Street Tree Committee's decision
to retain the two street trees.
Commissioner Wolfe, Jr. stated he felt the trees are an
asset to the street and present no liability problems,
however, he recommends they be trimmed.

Commissioners Konwiser and Grant felt that although no
liability exists; the trees are out of proportion to the
street scene and should be replaced.

should first be trimmed; then their removal could again be
reviewed at the next meeting.

Item #8 - Beach Playground Equipment

Director Whitley reported staff recommends the request for

replacement swings on the Ocean Front at llth Street be

referred to the Oceanfront and Beach Committee for their
review as to liability, precedent, funding, etc. He pointed
out that the swings were rusty and deemed to be unsafe.
The City assumes liability by allowing them to be there as
it does on al'l playground equipment in the City.
Commissioner Herberts suggested the equipment be re- chained
and new wood chairs /seats be added.
Chair Brenner stated her opinion is'th'at since the beaches
serve as parks for residents during the winter months,
there is a definite need for play equipment and recommended
that when the committee meets, they also consider present
and future locations for play equipment on the beach.
Commissioner Konwiser suggested the swings be removed during
the summer when they present more of a hazard due to con-
gestion during the summer months.

Item #9 - Mariners Park Name Change

Director Whitley reported additional letters and petitions

to the community. Requests have also been received to have

Chair Brenner opened the meeting to Public Testimony. Mrs.
Barbara de Boom, 1743 Bayport Way, addressed the Commission
and strongly urged the name change since Mr. Jorgensen was
so active throughout the City.
Mr. Jim de Boom, 1743 Bayport Way, addressed the Commission
and presented more petitions favoring the name change. He
noted the different areas Mr. Jorgensen was actively involved
with, such as the arts, YMCA, church and Hoag Hospital.
Commissioner Herberts stated she has received suggestions
that the Commission first receive input from the Mariners
Community Association and Library Board before making a
decision. She pointed out the confusion that might occur
by renaming the park inasmuch-as the area includes Mariners
School, Mariners Library and Mariners Fire Station and
suggested one alternative might be to rename the multi-
purpose community building. '
Commissioner Konwiser referred to the name recognition
factor and agreed that input from the Mariners Community
Association is needed. Commissioner Wolfe, Jr. agreed
and added it would be a diss'ervi.de to Mr. Jorgensen if the
park were renamed and still referred to as Mariners Park.
Commissioner Grant recommended the Mariners School PTA also
be consulted and involved. Due to cost implications, he
suggested other alternatives be pursued.
It was suggested by Chair Brenner that input from the
community be obtained at the forthcoming July 4 celebration.
Mark Deven will transmit this suggestion to the July 4th
Committee.
Commissioner Springer opposed the name change since she felt
a name change.should be reserved for someone who contributed
directly to parks -and recreation within the City of Newport
Beach.

Commissioner Grant asked that a written policy be developed
for requested name changes such as the one recently submitted
Item. #10 - Proposed Bond Issue

Whitley reported that after reviewing this matter,
staff recommends the bond issue not be submitted for the
November, 1988 ballot since promotion, identification of
sites for acquisition, committee formulation, etc., are a
long process for the election to be successful. He suggested
looking at the November,-1989 general election which would
cost less and give an appropriate amount of time to put the
package together with a better chance of success.
Commissioner Grant suggested a review of the open space and
implementation plan first be completed. Funding should be
addressed and homeowners associations input provided so a
list identifying sites that meet the community's needs could
be finalized. Commissioner-Grant also suggested that it is

important to not only provide funds for specific sites
and improvements, but also to provide "reserves" for
those areas that are park deficient but where sites are not
et identified, and he gave the Clay Street request as an
example.

Turner's idea to place a bond issue on the ballot in 1989
for the acquisition of open space and /or improvement of park
land, and that Council be asked to name a Steering Committee
so that work on the issue can proceed. Unanimous.
Item #11 - Kite Flying in Public Parks

Director Whitley referred to the report submitted and stated

it is staff's recommendation to refer the matter to the
Recreation Program Committee to report back to this
Commission. He reviewed dissent and flight patterns around
the John Wayne Airport and pointed out that should an
Ordinance be passed prohibiting kite flying in public parks,
enforcement would be'both difficult and costly.
Chair Brenner opened the meeting to Public Testimony and Mr.
Michael Donnelly, 310 E. Balboa Blvd., addressed the
Commission. Mr. Donnelly, a member of the American Kite
ssociation, said they were planning to have a kite festival
at Peninsula Park. He called the John Wayne Airport and
ound they will not be in a restricted area. Mr. Donnelly
eviewed the restricted lines and safety oriented kites that
re made today. He also pointed out that the Palo Alto.in-
cident was a result of misuse of equipment.

Mr. Stephen Kent, 615 Clubhouse, addressed the Commission.
Mr. Kent is a member of the-American Kite Association, owns
Kites, Inc. at the Fun Zone, and is also a pilot. Mr. Kent
reported kites in the Peninsula Park area are 5,000 - 10,000'
away from planes and there are never rolls over 500'. Small
planes are restricted to 1,000'.

boogie boarding at 41st Street.
Chair Brenner suggested uses of the beach, including scuba
diving, be included in this review and addressed as to
liability, authorization of use, etc.

Tree Maintenance Superintendent regarding the tree program

in memorandum form. It was agreed to discuss the bond
issue also.

Commission and handed out her report concerning her request
to remove the Brazilian Pepper Tree in the parkway at 2201
Aralia. She is appealing the Street Tree Committee's
decision and is asking for•removal. and replacement at her
expense. She pointed out that she is relandscaping and it
is difficult to grow anything due to the size of the tree
and'its roots. The sidewalk is lifting; there is a crack
in the driveway and curb in addition to standing water in
the gutter.
Chair Brenner thanked Mrs. Cirillo for going through the
proper process. If not resolved by the Street Tree
Committee, the matter will be addressed at the July 5, 1988
Commission meeting.

Director Whitley presented the new Commission Operations
Manual
Manual which, he explained, is very flexible in that addi-
tions and-deletions can easily be implemented.
Identification and description of committees will be
addressed at the July 5 meeting and will then be included
in the manual.
Commissioner Grant suggested a Study Session be held after
new Commissioners are seated so that they can be oridnted
and goals /objectives developed and defined.
Chair Brenner thanked Director Whitley for the excellent
manual.

information as to'sidewalk, curb and gutter replacement in
Harbor Highlands.
Jack Brooks advised City staff is root pruning and putting
in root barriers in order to try to save the trees.

Council is for the Commission's information. It states the
reasons why they are no longer pursuing a boat launch
facility at De Anza but will continue to pursue other
locations. The Commission asked to be updated on their
search.

a. Capital Improvements : Director Whitley reported

Council will be considering capital projects at their
June 13 meeting. "Swim for the Gold" will also give
their presentation on that date.
Director Whitley will have the City Manager's report
on June 9 and will mail it to the Commissioners.
b. Street Tree - Commissioner Herberts reported the
Committee did not meet this month.
Cliff Drive Park /Wetlands - Commissioner Herberts re-
ported she got the original grant deed dated 1929.
This was given to the City under the condition that the
Property be used for public parkland only. Director
Whitley advised a parking area would be acceptable if
it is for a park.
c. Recreation Program - Commissioner Springer reported
they did not meet this month.
d. Oceanfront and Beach - Commissioner Springer announced

Commissioner Springer handed out and reviewed their
report on Ocean Blvd. Encroachments. Director Whitley
stated he and Jack Brooks will look at them individually
to determine if they are on private or City property.
Commissioner Springer suggested getting the City Attorney's
opinion on reclaiming property if violations of encroach-
ments are not complied with. Director Whitley and Jack
Brooks will report back.
e. Facility Evaluation - Commissioner Konwiser passed out
his report and questioned the missing slide at Begonia
Parka Jack Brooks advised the new slide was too fast
and hazardous; another slide will be put in.
Mark Deven briefly reviewed liability factors and
safety precautions of playground equipment.
Director Whitley was asked to create a method of
tracking facili'ty evaluation requests to insure their

completion.

a. Friends of Oasis - Commissioner Wolfe, On. reported he

had a meeting with the new Recreation Supervisor,
Celeste Jardine -Haug. Out of this meeting came his
concern for the lack of attention to more human
services to be provided-for those older citizens in
frail health. He will be working closer with Ms.
Jardine -Haug to develop this area for more discussion.
b. Friends of the Theatre Arts Center - Director Whitley
met with Rae Cohen and Councilman Turner to start the
tree approval process at the Theatre Arts Center.
Item #22 - Status of Capital Projects

Park is June 18 and the Community Youth Center will be
dedicated July 9.

Commissioner Grant stated `there are bumps on the field at
Bonita Creek Park which should be fixed. The Community
Youth Center looks great, however, dust on the parking lot
should be controlled.
Walk Through at Grant Howald Park /Harbor View School -
Commissioner Grant reviewed his walk through with Council-
man Sansone. They suggested access from the Youth Center
to the school be opened up in order to use the athletic
field. Director Whitley will investigate the matter.
Commissioner Grant advised the turf at Grant Howald field
needs work.
Commissioner Herberts stated the Horace Ensign playground
needs refurbishment and suggested Eucalyptus Citriodora be
planted outside the fence. Director Whitley will investi-
gate the matter.

SUBJECT: Appeal of Tree Removal Request Denied by
Street Tree Committee - 1260 Somerset Lane
The attached letter represents an appeal of the decision by the Street
Tree Committee to retain the street tree•at 1260 Somerset Lane.
This appeal was misplaced and has now been reactivated for Commission
review. A field observation would be helpful in reaching a decision
on this matter.

I would like to thank you for responding to my request for the removal
of a tree in front of my home and for the subsequent action. However,
I would request that you reconsider the verdict to remove only the one
tree on the'following grounds:
With the first tree removed you have stopped the cause of the sidewalk
and kerbstones heaving. When you replace the kerbstone you will not
have resolved the water collection problem in front of that tree
because the remaining second tree is already causing the kerbstone in
front of it to again heave out of position.
Surely to get the situation resolved it makes good sense to fix the
IF problem once and for all. This means removing the second tree and
replacing the kerbstone, which shows at least eight cracks in its
sixty foot length, so that no high spot exists to trap water and
resurrect the mosquito breeding problem.
If you replace all sixty feet of kerbstone without removing the second
tree then within 2 -3 years the problem will be back. I say 2 -3 years
as you last fixed the problem in 1985 by resurfacing the sidewalk and
replacing the kerbstone.
If you fix only the kerbstone in front of the removed tree _then water
will enter the subsoil between the old section and the new section of
kerbstone, so feeding the tree and generating the same problem that
exists now. We had, over the years, noticed an increase in mosquito
activity in our yard but have only just realised that the standing
water is the problem. Because neighbors are not having the same
incidence of these pests and there is no other local standing water it
seems reasonable to deduce that the insects breed in the nearest
standing water.

RE: Request to remove Brazilian Pepper tree in parkway at above address
The following is a brief recap and explanation of the attached materials;
During the months of 'February and March I was in contact with Mr. Jack Brooks,
Park and Street Tree Superintendent, regarding the problems relating to the tree
in my parkway. I requested the removal because of the problems and because I
was doing a major relandscaping project.
After several phone conversations and the referral of this issue to the Tree
Committee, I received the attached memo denying my request.
I would now like to explain once again the reasons for my request:
1 - I am doing a major renovation of my landscaping, and I have not been able
sucessfullly grow anything in the parkway because of the size of the tree
and its roots.
• 2 - Even though the City has periodically worked on the tree and its roots, the
sidewalk is still lifting. In 1984 a section of sidewalk was replaced, in
1986 that same area was patched because the sidewalk was lifting again.
Refer to page 1 of the pictures.
3 - I have also called the City to check out the standing water in the gutter
alongside the tree because I often have standing water. Is this caused by
the slight lifting of the gutter from the tree roots and hampering the
natural flow of water? Refer to page 2 of the pictures.
4 - Page 2 also indicates a large crack in the driveway, which could be caused
by the tree roots. There is also a crack in the curb in the immediate area
of the tree.
5 - Page 3 of the pictures also indicates the standing water and the cracks in
the driveway and the curb.
6 - I am only requesting permission to remove the tree and replace the tree
with whatever the City would suggest. Several other Brazilian Pepper trees
on my block have been removed; some by the City, some just disappeared.
Originally each lot had one and sometimes two Brazilian Pepper trees. In
looking at the pictures you can see that many lots are without any trees.
The City has replaced some with Carrotwoods and my landscape designer sug-
gests either a type of camphor or the Carrotwood.

I would like to again request that the Brazilian Pepper tree in my parkway
be removed. If the City is unable to do this because of Parkway Tree budget
allocations, I would ask the City to give me permission to remove the tree at
my expense and replace it with a tree recommended by the City.
As you can see by the pictures, my landscape project is well under way and so
time is of the essence. If I can provide any further information I will gladly
do whatever I can.
I appreciate your time and tolerance in this matter and I thank you for the
opportunity to plead my case and appeal the decision of the Tree Committee.
I hope to have a favorable decision from this Commission so that I may carry
out my landscape project and do my little bit to beautify the Eastbluf£ area
of the City.

Recommendation:

volleyball courts:

b. Approximately 16.0' east of 61st Street and Oceanfront.
c. At 43rd Street and Oceanfront:.
d. Between 24th and 25th Streets.
. 2. Do not approve the following beachfront locations and authorize the removal
of existing volleyball courts:
a. Approximately 100" east of 43rd Street.
b. Approximately 100' east of 40th Street.
3. Delete from the Approved Beach Volleyball Court list and authorize the immediate
removal of the existing court at 38th Street and'Oceanfront.
Background:
As required by Resolution 88 -14, the Department posted various beachfront locations
for removal in 30 days. With the exception of the 38th Street location, applications
to retain the volleyball courts were received and have been reviewed by the Marine
and General Services Departments. The 38th Street location was not posted; however,
its status became subject to review following a complaint from a resident and review
of the beachfront area between 43rd and 24Th Streets. In that area, normal tidal
action and past winter storm conditions have reduced the width of the beach. At
the 38th -and 40th Street locations, volleyball court users have relocated poles
closer to residences in order to find an acceptable playing surface. The courts
at both locations are closer than the usual distance of 50' and residents are im=
pacted by noise, struck volleyballs and other nuisances. Both the Marine and
General Services Departments are concerned about vehicle access to lifeguard towers
and trash bins, and Marine safety super -:is °ion -of the water is difficult during busy
summer weekend and holiday periods.
•
Should the Commission accept the staff recommendation, a total of 12 volleyball
courts remain on the Approved Location list between Orange Street and Newport Pier.

SUBJECT: Vacation of Bolsa Avenue for Park purposes
The proposal to vacate Bolsa Avenue between Clay and Broad Streets has been
reviewed. In general streets are dedicated for the purpose of conveying
vehicular and pedestrian traffic. If that use is discontinued and the street
is vacated by the City, the property reverts to the adjoining property owner.
In Plan's A and B the City would have to buy the adjoining parcels before the
vacation of the street.
In Plan C the southerly one -half of the street would revert to the adjoining
property owner when it ceases to be used as a street and the City would have to
purchase the parcel if it is to be used as a park.
In Plan D the street would revert to the adjoining property owners and have to
be purchased if it was to be used as a park.
To further complicate matters, there is an existing water line in the southerly
side of Bolsa Avenue. Unless this line is removed and rerouted, an easement to
operate, maintain and reconstruct the water line must be kept by the City.
To vacate a public street, the City Council must hold a public hearing and take
testimony concerning the present and future need of the street for public street
purposes. At the close of the hearing the City Council would have to make a
finding that there is no present or future public need for the street to serve
vehicular and related uses. While Bolsa Avenue is not a major thoroughfare, it
is a part of the local circulation system. Anytime one element of the system is
closed off it will divert traffic onto other streets in the area. The system
today seems to be working quite well and there does not appear to be a need for
a change.

Approve the following rules regulating volleyball court use in China Cove and
authorize the posting of a sign as a means of notifying users and residents:
1. Use Prohibited Daily, 12 Noon - 4 P.M., June 15 - September 15.
2. Use Prohibited on Weekends,and Holidays, 12 Noon - 4 P.M., September 16 -
June 14.
3. Drinking Prohibited.
4. Loud and Unreasonable Noise Prohibited.
• 5. Volleyball Nets Shall Be Removed Daily at Sunset.
Failure to observe these regulations may result in the removal of this volleyball
court.
Background:
At the meeting of May 3, 1988, %the Commission directed staff and the Beach and
Oceanfront Committee to develop rules and regulations for the China Cove volleyball
court. The Commission directed that the rules include the daily removal of the
net, that China Cove residents and volleyball players be consulted regarding
development of the proposed rules, that the Commission ~review and approve the
rules prior to posting, and that a "trial period" be established to insure a
follow up report.
On June 9, the Committee met with China Cove residents, Debbie Ogorek and Jack
Hall, to discuss negative conditions which result in the use of the volleyball
court. Following the meeting, proposed rules were reviewed by staff with Dave
Beauchamp,.another China Cove resident and supporter of the volleyball court.
All parties involved in the development and review of the proposed rules are in
agreement.regarding the use and application of the rules, as a condition of
retaining the volleyball court.
The Beach and Oceanfront Committee and staff will continue to monitor the situation
and report back to the Commission at the meeting of October 4, 1988. The attached
• sections of the Municipal Code assisted in the development of the proposed rules.

able person of normal sensitivity residing in the area. The factors to be con-
sidered in determining whether a violation of the provisions of this section
has been committed include the following:
(A) The level of the noise;
(B) Whether the nature of the noise is usual or unusual;
(C) Whether the origin of the noise is natural or unnatural;
(D) The level and intensity of the background noise, if any;
(E) The proximity of the noise to residential sleeping areas;
(F) The nature and zoning of the area within which the noise
emanates;
(G) The density of inhabitation of the area within which the noise
emanates;
(H) The time of day and night the noise occurs;
(I) The duration of the noise;
(J) Whether the noise is constant or recurrent or intermittent; and
(K) Whether the noise is produced by a commercial or noncommercial
activity;
(L) If the noise is produced by a commercial activity, whether the use
is lawful under the provisions of Title 20 of the Newport Beach Municipal
Code and whether the noise is one that could reasonably be expected from

At the Parks, Beaches and Recreation Commission meeting of June 7, the Commission
referred correspondence from Laurie McKenzie, 1051 W. Balboa Boulevard, to the
Beach and Oceanfront Committee for further study. 'Ms. McKenzie requested that
the Commission authorize the Department to maintain play equipment located in
the vicinity of 10th Street on the beach area.
In considering Ms. McKenzie's request, the Beach and Oceanfront:Commiittee reviewed
an internal Department memorandum of March 10 which' is attached for the Commission's
review. In addition, staff summarized the concerns of the General Services Director
and Risk Manager regarding the existence of various kinds of equipment on bay and
oceanfront beaches. Written correspondence was requested and is attached for the
Commission's review. The •posting'process outlined i'n the Recommendation has been
reviewed by the Assistant City Attorney.
During,discussion of this item at the'June 7 meeting, the Commission considered
the seasonal or permanent placement of pl.ayground equipment at.beachfront locations,
specifically Corona del Mar Beach. Within a short distance of the beach are two
City parks which contain play- equipment= Bayside Drive and Begonia Parks. Thirteen
additional City parks contain play equipment. Since Fiscal Year 1985 -86, new play
equipment has been installed at Las Arenas, West Newport, Channel Place, Cliff
Drive, Mariners, Bonita Creek, and Buffalo Hills Parks. In Fiscal Year 1988 -89,
playground improvements are scheduled at- Eastbluff and Grant Howald Parks in
addition to the southern portion of Buffalo Hills Park. The recently completed
and planned improvements should encourage increased use of equipment on park
facilities.

various play installations that have been implanted on
the beach by local residents. Please be aware that know-
ingly permitting the use of such equipment and installations
by the public exposes the City to the risk of liability that
may be extremely costly. It is to be expected that injuries
arising from equipment lacking professional design and proper'
maintenance, particularly in the case of the trampoline pit,
will be severe.
As you are aware, the City is unable to acquire liability
insurance. Thus, the burden of costs will be placed directly
on the community for claims of liability.

The various pieces of privately owned beach play equipment are not
only a safety problem because of their condition, but an eyesore as
well. All of the described equipment should be removed by private
owners or by City crews at homeowner's expense. However, the
equipment does not present a beach maintenance problem since the items
area located in the dunes area.
I do not recommend the City taking over the responsibility of repair
and replacement. My own opinion is that play equipment has no place
on the beach, there are too many other activities to warrant this dual
placement and expense. Play equipment belongs in City parks.

SUBJECT: Miscellaneous Ocean Front Conditions
During a recent survey of beach volleyball courts, a•number of conditions impacting
the beaches came to my attention. Although the conditions do not impact beach
volleyball, the obvious encroachment onto public beach areas could present a
liability problem. Therefore, please be advised of the following conditions:

In July, 1986, I advised residents westerly of 10th Street that the play equipment
would need to be removed. A number of residents voiced their opposition and our
initiative was cancelled. It is recommended that the following approach be pursued
subject to review by the Risk Manager, City Attorney and Parks, Beaches and
Recreation Commission.
1. Contact nearby residents and research encroachment status.
2. If an encroachment exists, we should determine the extent which the City
needs to seek indemnification similar to the condition with the trees on
Lindo Street.
3. If an encroachment does not exist, we should confer with residents and
•determine the extent of the opposition to removal; if opposition exists,
we should determine ff an encroachment is applicable to this situation
and seek indemnification.
Some of the equipment surveyed was in a state of disrepair and appeared hazardous
even if used in supervised situations. However, the equipment's location is in
the vicinity of the lower peninsula and many residents look upon the beach in a
parochial manner. Upon your approval, it is recommended that we begin simultaneous
study of the issues presented with the Commission's Beach and Oceanfront4Committee,
Risk Manager and City Attorney.

SUBJECT: Preliminary Plan Approval - Lincoln Athletic Center
Recommendation:
Approve the Preliminary Plan for the Lincoln Athletic Center and authorize the
development of final plans and specifications for the project.
Background:
The Fiscal 1987 -88 budget contained an appropriation of $756,000 for the
Rehabilitation of Athletic Facilities at Lincoln •Intermediate School. The
scope of the project included improvements to baseball /softball diamonds,
soccer fields, hardcourt areas and the gymnasium. As required by a grant
application to the State of California, the Commission, City Council and
Newport -Mesa Ureified School Board approved a conceptual plan in September,
• 1986, describing the improvements at Lincoln.
As the plan was better defined following a topographical study and as a
result of an updated cost estimate, the project was scaled back from three
lighted ball diamonds to two. In addition, the School'District requested
that additional hardcourt area be retained in the event that part of the
facility is reopened as an elementary school should the downcoast residential
development require additional classroom space. The Department maintained a
continuous dialogue with youth sports organizations and, as a result of a May 19
meeting with representatives of Little League, Soccer and football groups, the
ball diamonds were•relocated to avoid a potential "sun field" hazard. Therefore,
the plan as presented is well within the construction budget and addresses
various elements of the project to the satisfaction of the groups identified as
the primary users.
At this time, approximately $690,000 should be available for the construction
phase of the project. The estimated $115,000 surplus will be held in reserve for
contingency costs•and for additional improvements outs.ide the scope of the
current project, including interior /exterior painting and remodeling of locker
rooms for activity /storage use. A large scale color drawing depicting the
layout will be presented at the Commission meeting.

• Analysis
Attached for the review and consideration of the Planning Commission is the
proposed revised draft of Chapter 20.52, Open Space District, with the
proposed revisions in the "strike -out and underline" format to show the
additions and deletions.
The following discussion summarizes the proposed changes to the ordinance.
20.52.010 Intent and Purpose: Language was added to this Section that
provides for the regulation of commercial activities in areas
designated as Open Space.
20.52.030 Establishment of OS Districts: This Section establishes the
parenthetical designation of (A) for active recreation areas and (P)
for passive recreation areas and open space. In addition, virtually all
of the original language in this Section has been deleted.
20.52.040 Uses Permitted: This Section has been revised to provide
for the permitted uses within each of the two proposed open space
classifications. Subsection A establishes the uses permitted within
the OS(A) District, which are primarily active recreation uses such as
parks, playgrounds, beaches, agricultural and horticultural uses, bike
routes And hiking trails, public parking, marinas, dry boat storage
• areas, and other similar uses. Subsection B establishes the passive
recreational and open space uses permitted within the OS(P) District,
such as marine and wildlife preserves, public hiking trails, public
viewing facilities, drainage channels, or other similar uses.

20.52.050 Uses Requiring Use Permit: Subsection A establishes the
specific uses within the OS(A) District that require approval of a use
permit. These uses include a residential structure for an on -site
watchman or caretaker, any public or private recreation facility or use
that requires the payment of an admission or use fee or where
membership is required, night lighting, or other similar use.
Subsection B.states that any use permitted within the OS(P) District by
Subsection 20.52.040 that requires the issuance of a grading or
building permit shall be subject to the approval of a use permit in
each case.
Planning Commission Action
If it is the desire of the Planning Commission to approve the proposed
changes to Chapter 20.52 of the Municipal Code and accept the environmental
document, the findings in the attached Exhibit A are suggested.

This involves an amendment to Title '20 of the Newport Beach Municipal Code
so as to establish within Chapter, 20.521 Open Space District two
classifications of open space, which are to be identified by a parenthetical •
('A) for active recreational areas, and a parenthetical (P) for areas where
only passive recreational uses or open space is permitted. In addition, this
amendment also establishes within Chapter 20.52 the uses permitted in each
of the two classifications of open space. Amendment procedures are set
forth in Chapter 20..84 Hof the Municipal Code..
Environmental Significance
In accordance with the California Environmental Quality Act (CEQA), 'the
State CEQA Guidelines, and City Council Policy K -3. an Initial Study has
been prepared for this amendment. Based upon the information contained in
the Initial Study, it has been determined that implementation of this
amendment will not result in 'a significant effect on the environment.
Therefore, a Negative Declaration has been prepared and is attached for the
Planning Commission "a information.
Background
The City amended the Recreational and Environmental Open Space Element of
the General Plan in 1985. Included within the Open Space Plan was a
recommendation that the Open Space Ordinance be amended to establish the
proposed system of active and passive recreation and open space areas.
At its meeting of May 5, 1988, the Planning Commission voted (all ayes) to
initiate this amendment and set this item for public hearing at its meeting •
of June 9, 1988.

A. The following active recreational uses shall be permitted in the 0-S(A)
District subject to the securing approval of a Use Permit in each case. Any
such use which was in existence prior to the property being reclassified to
Open Space may be continued or altered without securing a use permit
provided that there is no increase in the intensity of use:
(al) Residential structures for a watchman or caretaker and his family.
(b2) Public or private commercial recreational facilities, including
but not limited to golf courses, aquatic parks, tennis clubs and
yacht clubs or other similar uses, where an admission or use fee
or club membership fee is charged or required.
(e3) Night lighting other than normal parking or security lights.
(44) Other similar uses, which in the opinion of the Planning
Commission, would fulfill the intent of this Section. (Ord. 1730

B. In the O -S(P) District any construction or grading activity in
coniunction with the development or establishment of any use permitted by
Section 20.52.040 that requires the issuance of a building or rg ading_permit
shall be subject to the approval of a Use Permit in each case.
20.52.060 PARKING. Parking shall be provided in accordance with
the provisions of Title 20 or shall be established by the Planning

shall be permitted in the 0 -S (P) District:
(1) Marine and wildlife preserves.
(2) Public hiking trails or access ways.
(3) Public viewing facilities such as observation platforms or

nature study areas.
(4) Drainage channels, water courses, spreading grounds, settling
basins, reservoirs, power and utility lines, and any access
roads necessary to provide service to these facilities.
(5) Other similar uses, which in the opinion of the Planning Commis-
sion would fulfill the intent of this Section.

20.52.050 USES REQUIRING USE PERMIT.
• A. The following active recreational uses shall be permitted in the
O -S(A) District subject to the approval of a Use Permit in each case. Any
such use which was in existence prior to the property being reclassified
to Open Space may be continued or altered without securing a use permit
provided that there is no increase in the intensity of use:
(1). Residential structures for a watchman or caretaker and his
family.
(2) Public or private commercial recreational facilities, including
but not limited to golf courses, aquatic parks, tennis clubs and
yacht clubs or other similar uses, where an admission or use fee
or club membership fee is charged or required.
(3) Night lighting other than normal parking or security lights.
(4) Other similar uses, which in the opinion of the Planning
Commission, would fulfill the intent of this Section. (Ord.
1730 5 1 (part), 1977: Ord. 1485 5 1 (part), 1973).
B. In the 0 -S(P) District any construction or grading activity in
conjunction with the development or establishment of any use permitted by
Section 20.52.040 that requires the issuance of a building or grading
permit shall be subject to the approval of a Use Permit in each case.
20.52.060 PARKING. Parking shall be provided in accordance
with the provisions of Title 20 or shall be established by the Planning
• Commission. (Ord. 1730 5 1 (part), 1977: Ord. 1485 S 1 (part), .1973)
20.52.070 BUILDING HEIGHT. The building height limit shall be
as specified in Chapter 20.02. (Ord. 1730 5 1 (part), 1977: Ord. 1485 S 1
(part), 1973) .
SECTION 2. This Ordinance shall be published once in the official
newspaper of the City, and the same shall become effective thirty (30) days
after the date of its adoption.

• JUNE, 1988 PROGRESS REPORT
Our Park Crews performed the-'following tasks in addition to normal maintenance during
the month of June:
Irvine Terrace Park
Planted two ('2) Black Japanese Pines and installed signs and posts for annual
Okazaki ceremony.
Installed trees in boxes around temporary restrooms at Channel Park and McFadden
parking lot.
Newport Pier Parking Lot
Installed manual irrigation system to water Palms located on the beach behind wall
located along sidewalk at west side of parking lot.
Peninsula Park - Picnic Area
Built and installed 'four (4) picnic tables.
Bonita Creek Park
Accepted and took over maintenance of park.
• Grant Howald Community Youth Center
Performed preparation work for irrigation wires to be hooked up to automatic controller
to be located inside of youth center building. Automatic controller will service the
youth.center ballfield and passive park.
Corona del Mar Bluffs
In preparation of sidewalk to be installed by contractor. between Ocean Lane and Marguerite
Avenue, irrigation lines, sprinklers and valves were relocated.
Our Street Tree Divi'sion performed the following:
Trimmed 1,138 trees.
Planted 11 trees.
Removed 25 trees.
Root pruned 14 trees
Completed 18 Work Requests.
Areas being trimmed this month are Corona del Mar, Palms; 248 trees restaked at Bonita
Creek Park.

JUNE, 1988 PROGRESS REPORT
Special Interest Activities

On Saturday, June 11, the Seventh Annual Corona del Mar 5K took to the.�streets of
Old Corona del Mar. Over 2,200 runners participated in this popular community
run co- produced by the Corona del Mar Chamber of Commerce and the City. In addition
to the tremendous volunteer service put forth by the Chamber, the Corona del Mar
Kiwanis Club and countless individuals also contributed to make the race possible.
The Department wishes to' acknowledge Jim Wood who worked as the volunteer-race
coordinator. For the second straight year, Mr. Wood's attention to detail insured a
smooth, well coordinated race. Summer registration in fitness, tennis, gymnastics
and enrichment classes are all doing well with the majority of classes beginning
July 5.
Youth Activities
Ten girls' softball'teams have been formed based on registration as of June 25, 1988.
A change in this year's program required parent /coaches' meetings at all registration
areas, encouraging communication between recreation leaders and parents and con-
firming practice schedules. Playground activity programs will begin June 27 at
Grant Howald and Mariners Parks from 10:00 A.M. - 5:00 P.M., Monday'- Friday. During
the month, recreation leaders participated in'a, comprehensive training and orienta-
tion program;iwhich included activity instruction, softball fundamentals and a
presentation on crimes against juveniles conducted by the Police Department.
is Adult Sports /Aquatics
•
Registration for summer sailing and swimming classes is very strong for the first
two week period. Registration for instructional swimming classes has been significantly
strong at Corona del Mar High School. Should.cl.asses continue to receive sufficient
registration, swimming activities will continue to be offered at both sides of the
bay. Adult basketball and softball leagues continue to proceed on schedule with two
exceptions: Play will be suspended during the week of July 4 in observance of the
national holiday; play was suspended on June 21 in observance of the'Lakers' seventh
game championship decider.
Older Adults
On June 18, Oasis celebrated Founders Day as over 300 people paid tribute to community
volunteers and City officials who developed the Oasis facility. Lillian Lippit
coordinated the Friends of Oasis participation in this well received event. In
cooperation with the Long Range Planning Committee, staff is developing a survey as
a needs assessment tool.for planning future programs and services. In addition to
surveying the membership, the Commi.ttee wfl l also visit other communities and
senior centers. The July schedule for Oasis is attached.
