SUBJECT: Cost Recovery Ordinance — Chapter 3.36
Fee Resolution & Master Fee Schedule
RECOMMENDATION:
Staff recommends that City Council:
• 1. Introduce the attached Cost Recovery Ordinance amending Exhibit A to
Chapter 3.36 of the Newport Beach Municipal Code, and pass to second
reading; and
2. Adopt the attached draft Resolution updating the Master Fee Schedule.
DISCUSSION:
Background:
The City's first user fee study and cost allocation plan was conducted in 1995. In 2006,
the City contracted with Public Resources Management (PRM) to update the cost
allocation plan and cost of services study. PRM studied approximately a thousand
different services for which fees are imposed and calculated costs based on the City's
2006/07 budget expenditures. It had been more than ten years between cost studies,
processes and costs for many services had changed significantly, and PRM's findings
reflected the disparity between costs and fees charged was large for many fee based
services. In adopting the 2008 Fee Schedule, Council decided to phase in the full cost
recovery for fees with the most significant increases over a three year period.
Newport Beach Municipal Code Chapter 3.36 establishes the percentage of costs to be
• recovered from direct user fees and authorizes Council to modify the fee resolution
upon a determination that there has been a change in one or more of the cost factors
relevant to the calculation of the cost of providing the service. Chapter 3.36 also states

that cost studies should be conducted every five years. Between cost studies, PRM •
recommended the City annually update their cost calculations with the change in the
Consumer Price Index, Los Angeles- Riverside- Orange County (CPI).
With the adoption of the 2008 cost study and Fee Schedule, Council directed staff to
implement a 3 -year phasing to full cost recovery for several Recreation Department
services and for services with fees that exceeded $100 and the increase resulting from
the fee study increased that charge by 100% or more. The second of the three phases
was approved by Council on September 8 of this year, bringing the sixty -four (64) fees
subject to phasing to 67% of full cost recovery. Although the third and final phasing of
fees was scheduled for June of 2010, the City's recent budget challenges precipitate the
need to implement the final phasing to full cost recovery immediately. The attached
proposed resolution would implement the final phasing for the 64 fee based services to
full cost recovery.
The attached schedule of changes lists the 64 services being increased by the final
phasing, and are denoted with a "P ". In addition, several departments have provided
recommendations for Fee Schedule changes since the last Fee Schedule update,
based on changes in the level of service provided on existing fees and for new services
not listed on the fee schedule. Services for which service levels (and their associated
costs) have changed are indicated on the attached with a "C" followed by a " +" or ="
indicating how the cost has changed. •

The Building Department is recommending three additional services be added to the
Building Valuation Tables (Exhibit B) used to calculate construction permit fees. The
addition of Temporary Shoring, Fire Alarms and Fire Sprinkler Systems would establish
minimum values for these three types of construction activities.
The Police Department is recommending the City subsidize massage technician
licensing. The current cost recovery for those services is 100°/x, as established in
Chapter 3.36. The proposed subsidy requires amending Exhibit A of Chapter 3.36 and
the attached proposed ordinance for introduction reflects the Police Department's .
recommendation.

imposed by Government Code Section 66000 et.seq. for development related fees were
published in the Daily Pilot on November 14 and November 21. Additionally, the
Building Industry Association of Southern California was notified on November 24.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH AMENDING EXHIBIT "A"
TO CHAPTER 3.36 OF THE NEWPORT BEACH MUNICIPAL CODE
REGARDING THE RECOVERY OF COSTS FOR THE PERFORMANCE
OF CERTAIN MUNICIPAL SERVICES
WHEREAS, the City Council of the City of Newport Beach adopted
Ordinance No. 2008 -148, amending Chapter 3.36, Cost Recovery for User
Services, to the Newport Beach Municipal Code; and
WHEREAS, Chapter 3.36 establishes the percentage of cost to be
recovered for services and that the recovery shall be one hundred percent
(100 %) for all services unless another percentage is specified in
Exhibit "A" or otherwise limited by statute; and
WHEREAS, Section 3.36.030 provides that the City Council may
modify the cost recovery percentage for any service by amending Chapter
3.36; and
WHEREAS, the City Council desires. to update the percentage of •
cost recovery and actual fee for Massage Technician Permit Applications.
NOW, THEREFORE, the City Council of the City of Newport Beach
hereby ordains as follows:
SECTION 1: Exhibit `A" to Chapter 3.36 of the Newport Beach Municipal
Code shall be amended to read as shown in Attachment 1 hereto.
SECTION 2: If any section, subsection, sentence, clause or phrase of this
ordinance is, for any reason, held to be invalid or unconstitutional, such
decision shall not affect the validity or constitutionality of the remaining
portions of this ordinance. The City Council hereby declares that it would
have passed this ordinance, and each section, subsection, clause or phrase
hereof, irrespective of the fact that any one or more sections, subsections,
sentences, clauses and phrases be declared unconstitutional.
SECTION 3: The Mayor shall sign and the City Clerk shall attest to the
passage of this ordinance. The City Clerk shall cause the same to be
published once in the official newspaper of the City, and it shall be effective
thirty (30) days after its adoption.

Council of the City of Newport Beach, held on the 8"' day of December,
2009, and adopted on the day of 2010, by the

RESOLUTION NO. 2009-
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH AMENDING THE CITY'S MASTER SCHEDULE OF
FEES TO BE CHARGED FOR USER SERVICES
WHEREAS, in 2006, the City of Newport Beach retained Public Resources
Management ( "PRM "), to update the cost allocation plan and cost of services study for
City services previously conducted by KPMG Peat Marwick LLP in 1996; and
WHEREAS, the PRM study determined the actual cost of providing the services
including direct labor costs, administration or "overhead" costs and the cost of materials
and supplies based on 2006/07 actual costs for the majority of City fees for service; and
WHEREAS, the City Council adopted Ordinance 2008 -14, amending Chapter
3.36 (COST RECOVERY FOR USER SERVICES) of the Municipal Code; and
WHEREAS, Chapter 3.36 of the Municipal Code contains cost recovery
percentages for specific services contained in the 2006 PRM study and provides that the
City Council may modify the fee resolution to upon a determination that there has been
an increase or decrease in one or more cost factors relevant to the calculation of the
actual cost of providing the service; and
• WHEREAS, the City Council of the City of Newport Beach adopted Resolution
2008 -67 on July 8, 2008, adopting a Master Fee schedule for municipal services based
on the 2006 PRM study and Chapter 3.36 of the Municipal Code; and
WHEREAS, the City Council desires the Master Fee Schedule to be updated to
reflect the decreases and increases in costs, the cost recovery percentages established
by Chapter 3.36, and to add new fees for City services.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as
follows:
SECTION 1: The schedule of fees for service attached to this Resolution as Exhibit "A"
and the 2009 Building Valuation Table attached to the Resolution as Exhibit °B" are
hereby adopted. Except as provided in Sections 2 and 3 below, all fees in Exhibit "A"
shall become effective immediately.
SECTION 2: The fees for development related services imposed by this Resolution shall
take effect sixty (60) days following adoption of this Resolution.
SECTION 3: The fees for Massage Technician Applications shall become effective upon
the effective date of Ordinance No. 2009- updating Exhibit A of Chapter 3.36 to
reflect the subsidy of those services.
