De Santis, Economic Development Administrator 949- 644 -3207, Idesantis @newportbeachca.gov SUBJECT: A Temporary Extension of the Length of Time Permitted for the Display of Promotional Temporary Banners ISSUE: The Economic Development Committee (EDC) is recommending that the temporary relaxation of the zoning standard regulating the length of time that promotional temporary banners are permitted, which was adopted for 2009 as a way of assisting businesses during difficult economic times, be extended through 2010. RECOMMENDATION: Adopt the attached Resolution allowing businesses to display promotional temporary banners for 120 days per calendar year through December 31, 2010. DISCUSSION: Background: Section 20.67.090 of the Municipal Code allows banners up to four times per year, not to exceed 60 days total per year. In October of 2008 the City Council, at the recommendation of the EDC, voted to double the allotted frequency and allotted days through December 31, 2009, that is, to increase the length of display up to 8 times per year not to exceed 120 days total per year. The program was well received by the business community. They appreciated that the City was providing additional support to the business community during this economic downturn. The Newport Beach Chamber of Commerce reports that it received favorable comments on the program. The members of the EDC report that they did not notice or perceive any cluttering of the visual landscape because of the program. Promotional Temporary Banners January 12, 2010 Page 2 Planning Department reports that a number of businesses did take advantage of the extra time and that they have already received one inquiry about 2010. With the economy showing only mixed signs that a weak recovery may be starting, the Economic Development Committee voted unanimously at their December 16, 2009 meeting to recommend to the City Council that they extend the relaxation for one year through December 31, 2010. The attached Resolution would enact the temporary doubling of duration of the display of promotional temporary banners through December 31, 2010. Environmental Review: The temporary regulation is statutorily exempt from environmental review under Section 15061(b)(3)(General Rule) of the CEQA Guidelines, as it does not have the potential for causing a significant impact on the environment. The temporary regulation also qualifies for an exemption under City Council Policy K -3, in the category of minor changes to the Municipal Code that do not authorize physical development. Assistant City Mari4er RESOLUTION NO. 2010- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ADOPTING TEMPORARY STANDARDS FOR THE DISPLAY OF PROMOTIONAL TEMPORARY BANNERS. WHEREAS, the City Council established the Economic Development Committee to advise it on economic issues affecting the City of Newport Beach; WHEREAS, the Economic Development Committee, in its discussions regarding how the City might assist business during the current economic downturn, recommended a temporary extension to the length of time businesses are permitted to display promotional temporary banners; WHEREAS, the City Council wishes to cooperate with and support local businesses during difficult economic times, and is willing to relax a zoning standard for a limited period of time; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Newport Beach hereby adopts temporary standards for the display of promotional temporary banners, as follows: Section 1: Temporary Suspension of Standard Zoning Code Section 20.67.090 (A.)Table 2, Duration of Promotional Temporary Banners: "Up to four (4) times per year, not to exceed sixty (60) days total per year' is suspended. Section 2: Establishment of Temporary Standard Zoning Code Section 20.67.090 (A.)Table 2, Duration of Promotional Temporary Banners: "Up to eight (8) times per year, not to exceed one hundred twenty (120) days total per year" is substituted. Section 3: All Other Standards All other standards relating to the use, number, placement, maximum area, maximum height and permitting of temporary promotional banners shall remain in full force and effect. Section 4: Expiration of Temporary Standard Effective January 1, 2011, Zoning Code Section 20.67.090 (A.) shall return to the provisions in effect prior to the adoption of this Resolution, unless the City Council amends this section of the Municipal Code prior to that date. 1 ADOPTED this day of January, 2010.
