was called to order at 7:00 P.M.

Roll call was taken. Commissioners Compton, Demmer, Grant,

Item #3 - Approval of Minutes - Meeting of February 6, 1990

Commissioner Grant referred to Public Comments, first para-
graph, third sentence, and corrected it to read "...that
the homeowners must approve baseball back stops..."

facility."

The agenda was adopted as presented with the addition of

He reported the Department periodically receives similar
requests and referred to Council Policy I -22 which addresses

guidelines on these matters.
Chair Taft opened the meeting to Public Testimony and
Delores Peffley, 48 Eagle Run, Irvine, addressed the
Commission. She stated she is requesting a plaque be placed
near the Newport Pier in memory of her son who died near
the site while instructing a flight student in a Cessna air-
plane in 1'986. She added that her son was the kind of young
man all parents want and who was working toward his.goal to
become a commercial pilot.
There being no further Public Testimony, discussion by the
Commission ensued. Commissioner Demmer explained that,
although this is a difficult and sensitive matter, it is
not City policy to place plaques on the beaches, parks,
etc. in memory of those fatalities that occur in our
recreation areas.
Director Whitley referred to Policy I -22 wherein the City
Council and this Commission determined only the pathway at
the Oasis Passive Park be the designated location for
plaques for community leaders.
Commissioner Herberts pointed out that benches, drinking
fountains and trees can be dedicated without plaques.
Commissioner Vandervort noted that since there will be re-
landscaping in front of the Newport Pier, it would be
timely to request a tree with no plaque.
Chair Taft extended his sympathy on behalf of the Commission
to Mrs. Peffley and advised her the Commission would be
happy to help her should she desire something without a
plaque.

Item #6 - Tree Removal Appeal, 1807 Irvine Avenue

Director Whitley referred to the report submitted along with
the attached invoices for the sewer line. He reported the

Street Tree Committee determined it should be retained.

Commissioner Herberts reported the same request came before
the Street Tree Committee two years ago. At that time it
was denied and the suggestion made to present the landscaping
plans to the committee which was never done. Both the Park
and Tree Maintenance Superintendent and Tree Maintenance
Supervisor are in favor of retaining the tree if the plumbin
problem can be resolved.
Chair Taft opened the meeting to Public Testimony and Mr.
Stephen Colby, 1807 Irvine Avenue, addressed the Commission.
He reported that it is very difficult to exit his driveway
due to the increased traffic on Irvine Avenue and that the
tree blocks the view of those driving toward the beach.
The tree also drops a gooey substance on cars parked,under
it. In addition, the tree roots could cause a fall and
subsequent injury.
Mr. Colby would like to upgrade his front yard but cannot
do any landscaping as long as the tree roots are all over
the yard. The roots have also done damage to the street
and driveway. Lastly, there are plumbing problems every
two months which are expensive and a nuisance.
Chair Taft asked Mr. Colby if he would be amenable to
putting another tree in and he replied he felt it would be
inappropriate at this site. He would agree, however, to
have one planted on his property.
Commissioner Herberts questioned the age of the lateral sewe
line inasmuch as the tree roots will invade broken clay
pipe; Mr. Colby stated he didn't know, however, it is an

older home.
There being no further Public Testimony, discussion by the
Commission ensued. Commissioner Konwiser referred to the
original request two years ago wherein the subject tree was
fully discussed and the decision made to retain the tree.
He felt that, although Irvine Avenue is a busy street, the
tree should not cause an exiting problem if one waited for
the red light. Commissioner Konwiser stated he was dramati-
cally influenced by the house and front yard and felt this
unique tree goes with the scape. He recommended Mr. Colby
come back to this Commission after the irrigation and

landscaping are completed.
Commissioners Vandervort, Taft and Compton felt the tree
should be removed since it restricts landscaping and there
is no place to stop on Irvine Avenue.

Commissioner Demmer felt tree removal is appropriate due
to the frequent and repeated sewer repair costs caused
by the tree roots.
Commissioner Herberts recommended trying'to remedy the situa-
tion by root pruning before removing the tree.

Mr. Colby advised he might be able to find a private party
who could remove the tree at less cost than City crews.

Director Whitley corrected the report submitted by stating

that the request is to remove five, not two, Ficus Nitida
trees, i.e., two on Pembroke and three on Cornwall.
Chair Taft opened the meeting to Public Testimony and Mrs.
Susann Jordan - Passmore, 1100 Pembroke Lane, addressed the
Commission. She reported she has lived at this address
for 19 years, 12 of which she has requested tree removals.
She stated the roots have caused major plumbing problems
at great expense; sprinklers, drains and pipes have been
broken; the fence may now be out of alignment; and children
slip on the berry droppings.
Commissioner Herberts noted she observed that the root

problem could be from the Pine and Eucalyptus trees on the
owner's property on Cornwall.
Mrs. Jordan - Passmore stated she was more concerned with
the trees on Pembroke due to the two area drains at this
location. The sewer line is on Cornwall.
Mr. John Passmore, 1100 Pembroke Lane, addressed the
Commission. He stated the Pine Tree roots are not as ex-
tensive as the Ficus roots and requested other trees be
planted which have a less destructive root system.
There being no further Public Testimony, discussion by the
Commission ensued. Commissioner Konwiser pointed out that
the Ficus Nitida is a common tree in.the City and, when
fully developed, makes an elegant street scene which this
Commission supports. This is always an emotional and
economical situation, however, no tree is perfect and free

of nuisances. He would recommend a compromise by removing
two or three trees, thereby retaining the street scene.

Commissioner Demmer pointed out that since there are nine
owners who do not have parkway trees in the area, it would
be tragic if five trees were removed. She felt alternatives
should first be tried to preserve the trees.
Commissioners Compton and Vandervort agreed with Commissione
Konwiser that five trees are too many to be removed, but
they would favor a compromise of removing two trees.
Commissioner Herberts stated she felt these are beautiful
trees which could be root pruned. She felt the number of
trees should not be the issue, but that a tree should only
be removed if there is a specific problem. She suggested
removing the tree closest to the light on Cornwall.

Item #8 - Tree Removal Appeal, 1618 Anita Lane

Following Director Whitley's brief review of the subject
report, Chair Taft opened the meeting to Public Testimony.
Pearl Cotliar, 1618 Anita Lane, addressed the Commission.
Ms. Cotliar reported the subject Ficus Nitida is about 30
years old and the roots have lifted the sidewalk and have
cracked her driveway near the main water line. Ms. Cotliar
added she has three trees which she likes and is ready to
start landscaping but needs the tree on the north side of
her driveway, which is causing the most damage, removed.
There being no further Public Testimony, public hearing was
closed. During discussion there was confusion as to which
tree was being requested to be removed and several
Commissioners realized they had looked at the wrong tree.

Item #9 - Basketball Court in Channel Place Park

Director Whitley reported the City Council at their Study
Channel
Session of February 12, 1990 asked this Commission to review
Place Park
the possibility of adding a basketball court at Channel
Place Park. It is recognized that the park is under utilize
l,
however, it has recently been refurbished with a restroom,
picnic area and retaining wall. There is room to add a
court which would need to be away from the residential units
Notice was sent and posted to residents in the area that thi
matter would be on tonight's agenda.
Chair Taft opened the meeting to Public Testimony and Mr.
Troy Davis, 44041 Channel Place, addressed the Commission.
Mr. Davis stated he felt the park should be left open for
soccer, T -ball, football, etc., which are popular for
children. Due to parking and noise concerns and that there
are plenty of courts nearby, he recommended no court be
installed.
Mr. Daniel Clark, 4404 Channel Place, addressed the Commis-
sion. He agreed with'Mr. Davis that a court would restrict
ball games and recommended none be installed.
There being no further Public Testimony, discussion by the
Commission ensued. Commissioner Demmer felt a basketball
court close to the sand adjacent to tot lot equipment would
not be compatible recreational usage. She also expressed
concern regarding the close proximity of the proposed court
to homes. She would be against a full basketball court at
this location as she favors•a large green area for flexible
recreational purposes.
Commissioner Herberts stated she likes the idea of providing
more activity but would prefer to hear from more residents
as to their feelings.
Commissioner Grant felt this is not an appropriate location
for a basketball court and since there has been no overwhelm;
ing request for one, it should be readdressed next year in
the normal capital budget request procedure.
Commissioner Vandervort noted there has been no major effort
supporting a court since residents were notified, however,
because more younger people•who are athletically oriented
live in this area, the Commission needs to be responsive
to their needs. Therefore, she would favor a half court.
Commissioners Comtpon and Konwiser felt a half court would
suffice.

Chair Taft observed he has rarely seen anyone during week-
days at the park and he would recommend a court or half
court so that the park would be more usable.

Item #10 - Acquisition of Parcel at 724 St. James Place

Director Whitley reported.City Council requested this
724 St. James
Commission consider acquisition of the subject parcel for

recreation purposes. He contacted the owner, who emphati-
cally stated he does not want to sell the property.
Commissioner Demmer stated she felt the Commission would
benefit by having the City Council minutes prior to Commis-
sion meetings in order to provide additional information
necessary to deny or support City Council requests.
Commissioner Herberts stated she would oppose pursuing the
parcel since its owner has other uses for his own property.

Commissioner Konwiser motioned to deny acquiring the prop-
erty at 724 St. James Place.
Commissioner Demmer suggested the Commission be aware of the
four zones that are established for the purposes of receivin
in lieu park fee funding, available funds presently accrued
in each zone, and the assessment of the existing property,
under discussion. She urged that correct procedures of
neighborhood and homeowner notification be adhered to when
i
park acquisition is an action item.
Both Commissioners Konwiser and Compton agreed the subject
site is inappropriate for a park due to its topography.
Commissioner Vandervort agreed with Commissioner Demmer that
the proper procedures should be followed, however, since
this land is not appropriate for a park, they should be
waived in this situation. Chair Taft concurred.
Commissioner Grant suggested that if there is any interest
generated for a site, then the proper procedures should be
followed.

III. PUBLIC COMMENTS
Parking at American Legion
Commissioner Demmer referred to the grassy portion of land
next to the American Legion and asked for a policy review
regarding parking on this area.
Director Whitley explained the Department policy is to
allow the American Legion to park on the turf when they have
an overflow program, in which case the Department is notifie
in advance and sprinkler heads are covered. There has been
no damage to the turf. He added that the American Legion
is on City leased property and they have been studying a
concept for the site for their purposes.
Commissioner Demmer recommended utilization of this site be
a discussion item at the Commission's April 3 meeting.
Dover /PCH Parcel
Commissioner Compton asked for an update on this parcel
which has been discussed at previous Commission meetings.
Jack Brooks explained Public Works is contacting Cal Trans
on the matter. Director Whitley also advised that The
Irvine Company owns many small parcels, of which this is
one, and when he receives.further information he will report
back to the Commission. In the meantime, some plants and
shrubs could be planted.
IV. DISCUSSION ITEMS
Item #11 - North Star Beach

Chair Taft reported'he feels this location is not being used
to its full potential and would make an excellent location
for an active park.
Commissioner Grant reported this was discussed at the Parks
and Open Space Acquisition Committee meeting. He explained
some of the restraints to be considered and noted that the
Dover Shores Community Association might be active against
any improvements. He reported Director Whitley felt that
the high salt content of the existing sand would require
import as was done at Bonita Creek Park.

Commissioner Compton reported this subject was also discusse
at the Recreation Program Committee meeting and they thought

picnic benchesland a volleyball court might'be appropriate.
Commissioners Vandervort, Herberts and Demmer agreed that
recreation playing fields are needed.
Commissioner Herberts recommended a low key day time use
with no lights, such as for the Bobby Sox program, but
would first confer with Frank Robinson, environmentalist.
Commissioner Demmer questioned if restrooms and parking
would need to be provided. Nancy Beard explained that
there is public parking above Polaris at Westcliff Park
and the restrooms at the Aquatic Center are open for the
public. In addition, it is doubtful if the Dover Shores
Community Association would favor a parking lot at the site.

Commissioner Grant felt the area should be more active than
benches and a volleyball court. He recommended an architect
be hired to draw conceptual plans, i.e., identify dimensions
and lay out alternatives with costs, for the Commission
to review.
Jack Brooks stated he would discuss the matter with
Director Whitley in order that a presentation can be made
for the May meeting.
Commissioner Demmer asked staff to provide dimensions, zones

and funds and make recommendations.
Chair Taft pointed out the area is owned jointly with the
County and felt that the County should be consulted before
the Commission makes recommendations and plans are drawn.
Commissioner Grant suggested the Dover Shores Community
Association and Frank Robinson, environmentalist, be con-
tacted for their input. He also recommended the Parks and
Open Space Acquisition Committee work with staff and the
architect.
Item #12 - Cal Trans West

Chair Taft reported there does not seem to be a lot of

interest from the Council on this site. The property is
bounded by PCH and Superior on the other side of Hoag

Hospital where access is difficult. The area is not a good
location for an active park and West Newport Park is located
nearby.

Commissioner Compton reported West Newport Oil is going to
develop in the area and he agreed with Chair Taft to defer
the matter to a later date for this'reason.
Item #13 - Status of Capital Projects FY 1989 -90

Commissioner Grant questioned the status of the Newport
Projects
Harbor High School pool refurbishment program. Nancy
Beard explained the lockers and shower room are not yet
completed.
Commissioner Grant announced the opening of the Marian
Bergeson Aquatic Center will be in late April or early May.
Commissioner Grant questioned the status on Little Corona
View Park and Jack Brooks explained the architect and
Public Works are preparing the plans. Commissioner Grant
requested that the Commission review the plans when they
are completed. Nancy Beard stated she will check on the
plans which will be reviewed by this Commission.
Chair Taft announced the'Lincoln facility will return to a
school site, but this should not affect our programs.
Item #14 - Park and Street Tree Division

Commissioner Grant questioned the priority of a picnic shade

structure built at Buffalo Hills Park. He also suggested
the goals be taken down and locked up when fields are not
in use to allow the turf to grow. Jack Brooks agreed to
handle the matter and also advised Irvine Terrace Park is
being hydroseeded.

Commissioner Herberts questioned if there will be exercise
classes at West Newport and Nancy Beard explained there will
be many classes, including exercise, at the Center.

Item #17 - Street Tree

Chair Herberts reported the committee reviewed five tree
requests. She passed out a letter from the National Arbor

Day Foundation congratulating the City as being named a
1989 Tree City USA. When the date and time are announced,
she will notify the Commission and encourage them to attend
the Arbor Day ceremony. -
Item #18 - Recreation Program

Commissioner Compton recommended new signage at Las Arenas
Tennis Courts. Nancy Beard stated staff feels the two signs
are adequate in addition to one posting the rules.
Commissioner Compton questioned signage at the Girl Scout
House which is a public facility. Nancy Beard explained
it is highly used by the Girl Scouts and scheduling for
the public would be a problem, however, it is allowed.
Commissioner Grant felt the Scout House should be re- signed
and publicized so others can use it. Nancy Beard will pursu

Commissioner Compton referred to West Newport Community
Center and requested Nancy Beard pursue the idea of an
Open House.
Commissioner Compton also questioned signage at the Marian
Bergeson Aquatic Center and requested the above items be
brought back at the Commission's April 3 meeting. Commis-
sioner Grant requested the sign at the Marian Bergeson
Aquatic Center be implemented before the dedication.
Item #19 - Oceanfront and Beach

Chair Vandervort reported the committee did not meet in
February. Concerning the recent oil spill, at Chair Taft's
request, she asked Director Whitley if there was anything
the Commission should do and he had advised volunteers are
not needed.
Commissioner Vandervort also reported "Speak Up Newport"
will meet at the Villa Nova Restaurant at 5:30 P.M. on
March 7 to give a full report on the oil spill.
Item #20 - Budget
Budget
Chair Taft reported they had a good meeting with the City
Manager on the operating budget which was slightly trimmed.
Nancy Beard reported a full time Human Services Coordinator
and a maintenance person will be funded for Oasis.

Item #21 - Parks and Open Space Acquisition
Chair Grant reported restraints on Mouth of Big Canyon were
discussed at their last meeting. Another meeting will be
set when information is received from the Department of
Fish and Game.
The Facility Inspection Forms were completed and given to
Director Whitley who will report back on what will and will
not be done.
Item #22 - Newport Shores Park
Chair Compton reported they are waiting for the budget to be
approved.
Item #23 - Chair's Report
Chair Taft reported the City Manager feels that since there
are negotiations underway with major property owners, i.e.,
The Irvine Company and West Newport Oil Company, it might
upset the park bond issue and recommended to the City
Council that the issue be tabled for the present time.
Item #24 - Commission Liaison Assignments
(a) No report from Commissioner Demmer on Friends of Oasis.
(b) No report from Commissioner Compton on Friends of the
Theatre Arts Center.
(c) Commissioner Herberts reported Art in Public Places at
McFadden Wharf is the Arts Commission's next project.
Discussion of the art work is delayed until there is
final approval from the Assessment District.
VI. SPECIAL, URGENT OR LAST MINUTE ITEMS
Commissioner Compton asked for an update on encroachments
from that committee. Commis'sioner Konwiser reported they
meet monthly and a meeting with the Study Session is schedul'
for March 12.
He explained that certain rights were traded many years ago,
particularly in the West Newport area. Criteria is needed
to resolve the specific situations among the Coastal
Commission, the City, and the respective homeowners. When
they have a definite recommendation as to criteria, permits,)
fees, etc., this will be transmitted to the Planning
Commission and then to the City Council and finally to the
Parks and
Open Space

There being no further business, the Parks, Beaches and

at 1618 Anita Lane. The matter was continued to the April meeting due to the
fact that the tree in question was unclear as to location, etc. As it turns
out, the appeal for tree removal is located in the parkway of the adjacent
residence at 1624 Anita Lane. A request to remove has been received from Mrs.
Frances Ciaccio to remove this tree.
For identification purposes, this tree is located between the driveways. A
visit to-the site is encouraged.

I am writing this letter to request the removal of
a tree which is on our parking strip bordering
my neighbor's (the Cotliars) driveway located at
1618 Anita Lane, Newport Beach.
The root system of the tree over the past few years
has been very destructive - undermining the sidewalk,
the Cotliar's driveway, our sprinkler_ system etc.
Trimming the tree & its roots doesn't seem to be
effective in slowing down the growth of the root
system & its continued destructive pattern. '

I am appealing the decision of the Street Tree Committee of
March 5, 1990 to deny removal of at least one of the two large ficus
trees in the parking strip in front of my residence. No one has
contacted me or discussed the problems with me and I have been given
no reason for the denial other than it was their decision to deny --
- -what was the reason?
• As a taxpayer since 1957 in Newport Beach I feel I am not being
given reasonable consideration. The city has replaced the sidewalk twice
in eight years to correct the raised sidewalk hazard and I'm sure at
great expense, but the trees keep growing and the roots keep enlarging
above the ground continuing a perilous condition.
I can understand a committee not wanting to remove a tree, but where
does reason prevail? The entire root system does not allow access
to our house from the street as they coverthe entire thirty foot frontage.
The trees are about twelve feet apart and the trunks are fifty -eight
inches in diameter and still growing!
We are still very concerned about the danger of people falling over
the roots at nigh s, you must be aware, there are NO street lights in
Corona del Mar. ken with the light we installed atgf sidewalk edge of
our property there is not sufficient light to show the hazardous
conditions of the parkway strip.
Can the committee give a good reason for not removing one tree? One
tree removal would give better access and allow passage from the street.
I would appreciate reconsideration and a reasonable explanation.

SUBJECT: BASKETBALL COURT AT 38th STREET PARK
The basketball courts located within 38th Street Park receive heavy play on
any day without rain. The quality of these courts and the location in the
proximity of the beach have made the courts very popular. Attempts have been
made to sign the facility with rules and regulations to encourage courtesy, etc.
It appears that local residents are still bothered by the heavy use at this
facility. Staff would like to discuss possible solutions with the Commission,
residents and users. Hopefully, a compromise can be reached on this problem.

I would like to register a complaint about the basketball courts at
the 38th Street Park. As a homexaner on Park In., My family and I have had
to live 'too closely with the noise and congestion the courts have brought
to our neighborhood.
These courts are frequented by 50 to 60 players each weekend,most
of whbm.are not local residents. Parking in our neighborhood is difficult
enough without the influx of players each week -end. n
The noise level frourthe basketball courts is quite loud, but the
worst of it is the constant bombarment of four - letter words our c4ildren
are forced to listen to. Theses courts are located too close to a residential
area.
I am afraid'that our park is becoming a hang -out for non- residents.
With the problem-of gang activities in Orange County, I•would hate to see
the city of Newport contributing to the problem by allowing a park to be
a gathering place for non - residents.
I would like to know why other courts in Newport have been closed,
• leaving the Park Lane courts to be over crowded.
How can we close these courts or replace it with grass,'trees and
picnic tables?

My wife and I are concerned about the increasing popularity
of the basketball courts at 38th Street Park. Our home at
3704 Park Lane was purchased prior to the remodeling of the
part in 1983. At that time there were courts on both ends of
the park. There was also a basketball court near 59th street
at the same park as the tennis courts. The amount of
basketball players at that time was small. Rarely were there
parking problems related to park use. Since that time the
38th Street Park has been remodeled with all the basketball
courts at one end of the park. The court near 59th street
has been closed. The amount of players and excess cars has
increased significantly. The majority of the players do not
appear to be local residents. The noise, day and night, ,has
increased. Frequently we are subjected to yelling and
extremely vulgar language, as well as fighting at the'park.
We have had to call the police on numerous .occasions for:
long lines of illegally parked cars in the red zone and double
parked, late night usage, and cars parked behind our garage
and in our alley owned by basketball players. The police
have also been summoned for fights between players.
We have heard that the basketball court near 59th street was
closed due to resident complaints. This, no doubt, has had
some effect on increased usage of the 38th Street Park courts.
Remodeling of the part: has also made these courts more attrac-
tive. Unfortunately the park has become a hang -out for loud,
vulgar people who are very poor examples to the younger
children, including our thirteen year old son, who frequents
the park. They also make it very difficult for local
residents to use the facilities.

We would like to know why the other, basketball court was closed.
We would also like to suggest closure•of the courts or replace-
ment with grass and trees, to make this already crowded
neighborhood more livable and less noisey. Parking and crowds
due to high density living space,. tourists etc. will not
go away. However, why should the City of Newport increase
C the problem by having these courts open to attract even more
nonresidents and rowdies?

SUBJECT: RULES AND REGULATIONS, CORONA DEL MAR HIGH SCHOOL
OLYMPIC POOL
On Monday evening, March 19, the Recreation Program Subcommittee and staff met
with many parties interested in the future activities at the Marian Bergeson
Aquatics Center. Due to the large number of demands staff is anticipating with
the opening of the Center, rules, regulations and fees will need to be in place
by the pool's completion date.
Staff will be following the priority use format previously established by our
facility and field reservation and rental system.
• We will establish non - profit and private fees. Under those fees will be further
qualifications of resident and non - resident. The pool fees established for non-
profit resident groups, such as local swim teams wishing to hold a swim meet in
the pool, will be the direct cost of lifeguards. State law mandates our staffing
of lifeguards. The City fully intends to adhere to these rules with little or
no deviation. We will, therefore, need to staff 3 lifeguards at pool,events.
The hourly cost will be approximately $25 to•$30 per hour. The price will in-
crease significantly' with private uses.
City use times have been well established and documented within the Agreement
between•the City and School District.(copy attached). It is the times within the
given City uses that will be prioritized,;including, the City instructional classes,
open swim times, various water polo and swim team groups, and any private needs.
As this facility is self- supporting in nature, all direct costs will be recoup -
erated.
The City has been approached by the "Swim For The Gold" Committee in regards to
forming a new fundraising group to be known as Friends of the Pool. Their request
is to continue fundraising for the pool and assist staff in establishing use
criteria and to assist- ' in the planning and administration of the pool. The group
will be addressing the Commission on April 3.
Please review the accompanying Agreement between the City and School District.
Any questions may be fielded by staff at your convenience.
Staff will have operational guidelines, rules and regulations for Commission approval
• at the May 1 meeting.

5 tion of the Pool are set forth in Exhibit A which is attached hereto and
6 incorporated herein by this reference. City and District agree that the
7 public bidding procedures relating to the award of contracts on public
8 works projects will be observed.
9 The District shall initiate the formal bid process within three (3)
10 years of the date of receipt by the District of funds from the "Swim For

dollars. In the event the actual cost of construction of the Pool
exceeds the projected amount, District shall be responsible for
paying all such excess amount pursuant to the District's written
agreement with the Committee.

6 instructors, lifeguards, and other necessary personnel during the times the
7 area is in use by City or in use by groups under the control of City.
8 C. At all times when the area and facilities are jointly used by
9 District and City, each party shall be responsible for supervision, public
10 safety; and control for the areas of the Pool assigned to it. During such
11 times, each party will assume responsibility for special equipment. necessary
12 in carrying out their-own program and will provide the necessary ir.'structors,
13 lifeguards, or other necessary personnel in the area in use by that party.
14 7. MAINTENANCE AND REPAIR
15 District agrees to maintain the Pool and all related facilities in good
16 order and repair and to keep the Pool in a neat, clean, orderly, safe, and
17 sanitary condition. The District's responsibility includes all maintenance
18 and rerpairs except as set out elsewhere in this Agreement.
19 8. POOL CLOSING
20 The determination of the times that it may be necessary to close the Pool
21 facilities for repairs and maintenance, will be made upon the mutual agreement
22 of both parties. The District will notify the City as soon as possible if
23 • danger to .public health and /or safety demands an emergency closure.

9. STORAGE
The City shall maintain on the Pool premises a separate storage area for
City equipment of not less than six (6) feet by eighteen (18) feet. The City
shall maintain such separate storage area in good order and repair.
10. OFFICE SPACE
District and City agree that City shall maintain at its own cost within
the Pool office a separate desk, chair and telephone connection for City use.
11. FEES
In consideration for City's execution of this Agreement, the;District
waivers all facility use costs associated with the new Pool upon completion of
the Pool.
12. HOLD HARMLESS
City shall indemnify and hold harmless District from and against any and
all claims arising from City's use of the Pool, or from any activity, work or
things done, permitted or suffered by City in or about the Pool or elsewhere
and shall further indemnify and hold harmless District from and against any
and all claims arising from any breach or default in the performance of any
obligation on City's part to be performed under the terms of this Agreement,
or arising from any negligence of the City, or any of City's agents,
contractors, or employees, and from and against all costs, attorney's fees,

representative of either party shall be of any effect unless it is in writing
and executed by the other party to be bound thereby.
14. NO WAIVER
The waiver by either party of the performance of any covenant, condition
or promise, including the time for performance thereof, shall not invalidate
this Agreement, nor shall it be considered a waiver of any other covenant,
condition or promise. The exercise of any remedy provided by law or by 'the
provisions in.this Agreement shall not exclude any other remedy, unless it is
expressly excluded.

15. SEVERABILITY
Invalidation of any one of the terms and /or provisions of this Agreement
by any judgment or court order shall in no way affect any of the other terms
and /or provisions of this Agreement, which shall remain in full force and
effect.
16. GOVERNING LAW
This Agreement shall be governed by the laws of the State of California
and shall be interpreted as if prepared by both parties hereto.

(GIRL SCOUT BUILDING)
THIS LEASE RENEWAL AGREEMENT is made and entered into

CITY OF NEWPORT BEACH, a chartered municipal corporation,
hereinafter referred to as "City ", and TIIE GIRL SCOUT COUNCIL OF
ORANGE COUNTY, a California corporation, successor in interest to
the Girl Scout Association of Newport Harbor and Newport Harbor
Girl Scout Council, hereinafter referred to as "Council";
RECITALS-
A. City and the Girl Scout Association of Newport Harbor,
predecessor in interest to Council, previously entered into a
lease effective December 1, 1947, of the following described real
• property:
Lots 3, 4, 5 and 6 in Block 117, Section "B ", of
Newport Beach, as shown on Miscellaneous Maps, Book
4, Page 27, Records of Orange County, California,
for a period of ten (10) years commencing on December 1, 1947,
and ending on November 30, 1957. The parties subsequently
entered into an agreement entitled Renewal of Lease dated October
14, 1957, whereby it was agreed that the original term of said
lease would be extended for an additional term of ten (10) years,
commencing on December 19 1957, and ending on November 30,
1967. Said lease was again extended for an additional term of
ten (10) years commencing on December 1, 1967, and ending
November 30, 1977. Said lease was again extended for an
. additional term of ten (10) years commencing on December 1, 1977,
and ending November 30, 1987.

NOW, THEREFORE, in consideration of their mutual promises and
• of the covenants and conditions to be kept.by each as set out in
said above - mentioned original lease, it is agreed as follows:
1. That the term of this lease renewal shall be for a
period commencing on December 1, 1987, and ending on March 15,
2000.
2. It is expressly understood and agreed between the
parties hereto that the improvements and buildings situated on
the above - described real property are owned by the City of
Newport Beach.
3. In addition to the consideration specified in the lease,
Council shall pay to City rent in the sum of one dollar ($1.00)
per year.
4. Council agrees that it will

full force and effect throughout the
term of this lease renewal
the following insurance policies:
(a) General Liability
Insurance Policy which insures and
indemnifies City against
liability or financial loss resulting from injury occurring to

Background:
The renewal of the subject Lease-was approved by the Parks, Beaches and Recreation
Commission at their meeting of September 1 with the listed modifications. The
established term ending-date of'March 15, 2000.is consistent with the termination
of Lease Agreements with American Legion•Post #291 and Marinapark residents.
The current agreement for use of the'Newport Nautical Museum is renewed annually
by the Museum and'Balboa Power Squadron. The simultaneous termination of all
facility lease.agreements-provides the City with future development and planning
options.

Use of the facilities is regulated by reservation requests through the Girl .
Scout Council of Orange County and is extended to Girl Scout troops and other
non - profit organizations. The Girl Scout usage includes;
..Over 800 girls and 350 adults within the Newport Beach area store Girl
equipment; e.g., tables, chairs, troop equipment and program supplies as
well as camping equipment to provide for some 58 troops.
..Over 100 girls and 40 adults gather weekday afternoons and evenings during
the school year to conduct troop meetings. 4
..Periodically adult volunteers meet for planning, training and workshops
for the Girl Scout program.
..Over 2200 Girl Scouts are accommodated during the year for troop overnight
stays 51 of 52 weekends a year, and nearly every day of school holidays
and vacation periods.

Other non - profit organizations have used the Girl Scout house for meetings,
dinners and workshops upon appropriate requests to the Girl Scout Council of
Orange County.
The above would indicate that maximum utilization is being made of the Newport
Beach Scout House except for weekday mornings during the school year, and these
times are reserved several days a month for janitorial service and general
maintenance and upkeep.
The Newport Beach Girl Scout House and lands surrounding it are designated for
educational, civic, recreational and community purposes.
The Girl Scout program is an informal educational and recreational program
carried out in small groups (troops) with adult leaders. It provides a wide
range of activities developed around the interests and needs of the girls. The
Newport Beach Scout House, . together with the other Scout Houses in Orange
County, provides the special ingredients necessary to stimulate an interesting
and challenging girl program.

for this is that other residents of Larkspur are preparing a petition that
has not been received to this date.

Dear Mr. Taft,
For over twenty five years the residents of the 200 block of
Larkspur (Old Corona del Mar) have refrained from planting trees
in the parkway. This restraint has not been due to lack of
sensitivity for neigborhood beautification or to a dislike of
trees. Rather, the parkways are treeless as it has been widely
held that the presence of trees would obstruct the view of the
ocean that is accessible to nearly every resident of the street.
For decades everyone has-appreciated the special and unique vista
of the ocean and entrance to Newport Harbor (the acknowledged
symbol of Corona del Mar) and has respected each others right to
access this view without needless obstruction.
Over the years the ocean view has come to mean more than a simple
pleasure for those on the block. Many of the newer residents
have paid a significant premium for properties with such a view.
However, whether the residents have lived in this neighborhood
for twenty years or twenty days, their property value is
inextricably tied to visual access of the ocean and jetty.
Unfortunately, the property owner at the corner of Larkspur and
Ocean Boulevard recently planted large Magnolia trees (Grande
Flora) in the parkway along the west end of Larkspur, obstructing
the view of nearly all the residents on the same side of the
street. These are not small trees and will likely grow to a
great height resulting in further obstruction. This is an
inconsiderate act; perpetrated without the consent of affected
neighbors or the written permission of appropriate city
authorities. Such action is patently inexcusable as the
consequences in terms of loss of property value and quality of
life for many in the neighborhood is potentially devastating. It
is shameful that one neighbor could infringe so thoughtlessly on
everyone else.
The City of Newport Beach should not blindly condone policies
that encourage tree planting activity by individuals,
particularly when it is painfully obvious of the detrimental
effect on property value and the psyche of unique neighborhoods.
If the City should allow these trees to remain on Larkspur, it
will set a precedent that will certainly impact other similar
neighborhoods (ie Marigold, Orchid etc) and may provoke
irreparable hard feelings and /or costly lawsuits.

We, the undersigned property owners in the 200 block of
Larkspur Ave., in Corona del Mar, kindly request that your
Commission review City Ordinance 13.09.010 which concerns the
planting of trees in public parkways. Our block has made an
effort through the years to plant and maintain greenery in such
a manner as to protect the ocean view for each house on the block.
We feel that this view adds more to the aesthetic value of the
neighborhood and monetary value of our properties than would trees
in the parkway.
Recently the staff of NBPBR followed the above mentioned ordi-
nance and permitted the planting of three magnolia trees in the
parkway alongside 3128 Ocean Blvd while none were planted in front
of the residence as is required in the ordinance. These three
trees now impact the view of six homes on Larkspur and will no doubt
affect more as they continue to grow. We request that NBPBR rescind
• that permission and abate the trees.
We also request that NBPBR adopt a policy of checking 'the neigh-
borhood for obstruction of views before granting permission for
planting in parkways on treeless streets such as the 200 blocks of
Larkspur, Marigold and Orchid as well as on Ocean Blvd.

13.09.040 Waiver Procedure.
13.09.010 Parkway Trees Required. Any person who constructs a new
building or who causes a building to be moved onto vacant land or who
causes- an increase in the original floor area of an existing main building by
more than 50% of its original size shall be responsible for planting trees in
the parkway abutting the building site in accordance with specifications
adopted by the Parks, Beaches and Recreation Commission. The
requirements of Title 19 shall govern tree planting in the new subdivisions.
(Ord. 1338 § 1 (part), 1970).
13.09.020 Costs. The costs of planting the required parkway trees shall
be shared by the adjacent property owner and the City in accordance with
the policies adopted by the Parks, Beaches and Recreation Commission.
(Ord. 1338 § I (part), 1970).
13.09.030 Maintenance. It shall be the responsibility of the abutting
property owner to water and fertilize the parkway trees adjacent to his ,
'property. The City shall' be responsible for pruning and spraying parkway

13.09.040 Waiver Procedure. Upon written application, the City
'Manager, or such other 'City official as he may'designate to act for him, may
grant a waiver from all or part of the requirements set forth in Section
13.09.010, if lie determines that because of the location, terrain or condition
of the property or the surrounding properties, the required tree planting is

RECREATION DIVISION
MARCH, 1990 PROGRESS REPORT
Adult /Youth Sports
The spring adult basketball season began fast week with 83 teams participating.
The 1990 Youth Track and Field Meet is scheduled for April 6 at Newport Harbor
High School beginning at 5:00 P.M. We are expecting 150 to 200 participants.
Two of our three youth basketball championship teams participated in the Orange
County Tournament. The Newport Heights "B" team won the Orange County Champion-
ship and will participate in the upcoming Southern Federation Champiion'ships in
April.
Youth Activities
The Community Youth Center staff, along with the CYC Booster Club, hosted ,a very
successful open house last month. Approximately 40 children and 25 adults were
entertained by a clown and a video produced by the CYC staff featuring many
of the CYC activities and participants.
Youth Council Update
Youth Awareness Week scheduled for May 21 through May 25 is now in the advanced
• planning stages. Applications for the students are now being printed and will be
out to the student bodies as soon as ,possible.
Contract Classes
Spring sessions have just begun. The Infant, Toddler Development Class was again
the first to fill with quite a waiting list. New classes which are doing well
include Kids in Commercials with 15 participants and French Classes with 19.
Tennis
The spring enrollment is up 15%. We have added, due to popular demand, additional
senior clinic classes. They are also doing very well. The ladies doubles clinic
is'back with 10 participants. Our Mr. Pee Wee Tennis Clinic scheduled for spring
break is full and staff is maintaining a waiting list. We have also registered
46 participants for our spring Round Robin program. We are up.25% from winter!
9th Annual CdM Scenic 5K
The 5K flyers should'be out by April 15. The committee is working hard finalizing
all details.

• will be representatives of non - profit organizations. Hoag Hospital will again
be a co- sponsor of the event.

The new Oasis pottery class registered 15 enthusiastic students for the first
time.ever.
West Newport Community Center now has a very successful exercise program on
Tuesdays and Thursdays. Creative writing, dance, brildge lessons and arts and
crafts classes are scheduled for the future.

MARCH, 1990 PROGRESS REPORT
• Our park crews performed the following tasks in addition to normal maintenance
during the month of March.
Jamboree Traffic Island Under Redevelopment Between Ford Road and Bison Avenue
1. Finished installing all new irrigation systems and a new irrigation con-
troller.
2. Planted (12) 24" box Canary Island Pines and (20) 24" box Liquidambar trees.
3. Tilled and final graded in preparation for hydroseeding.
Jamboree Traffic Island Between Ford Road and San Joaquin
Planted (10) 24" box Canary Island Pines.
Newport Boulevard Arterials Between Industrial Way and Pacific Coast Highway
Planted (8) 15 gallon Deodar Cedars.
Irvine Terrace Park
Prepared and final graded a 6,000 square foot area for hy6,oseeding of turf
seed. Hydroseeding by contract.
• Bayside Drive Slope Opposite Begonia Park
1. Arranged for the instal•lat* n of a new 1" water meter by the Water Depart-
ment. /
2. Designed for irrigation systems for the slope and ordered the needed
sprinkler materials.
Bayside Drive Parking Lot By Mar uerite
Started preliminary leg work in preparation for irrigating and landscaping the
planters ,(locating sleeves, gas lines, electrical lines, etc.).
Yacht Basin Off Harbor Island Drive
1. The planter that runs along Harbor Island Drive was irrigated by contract.
2. We installed irrigation wire, conduit as needed, and hooked these (2)
systems into the existing irrigation controller.
West Newport Park - 58th Street
1. Reinstalled the irrigation controller into the new restrooms maintenance
chase area.
2. Rebuilt (5) valve manifolds that were relocated to accommddate'the new
• restroom building.

3. Ran all irrigation wires into the chase area and connected them into the
controller.
is 4. Installed a new pump relay and pressure sensitive switch.
Mariners Park
At baseball diamond number 1, right field; seeded 10,000 square feet of area.
Park signs were installed at the following locations: Oasis, 1 sign; Newport
Beach Acquatic Center, 1 sign; Lookout Point, Corona del Mar bluffs, 1 sign;
West Newport Park, 1 sign.
Beek Park
Planted (12) 5 gallon azaleas, C6) 5 gallon Escallonias, (18) 1 gallon Day
Lilies.
Westcliff Monument Sign
Planted (15) 5 gallon Raphiolepsis "Pinki" dwarf around sign.
City Hall
Planted (48) 7 gallon rose bushes in planter in front of main lobby building.
Peninsula Park
• Overseeded with Fescue where needed in turf area.
For the Recreation Department, park crews performed the followin :
1. Installed 2 banners at West Newport Community Center.
2. Relocated 1 portable backstop from Lincoln Athletic field to Irvine Terrace
Park.
3. Work performed at Lincoln Athletic field as follows: Relocate 6 benches to
tract field area, relocated 4 soccer goals to parking area close to girls locker
room, next to gym building, removed 4 portable steel pipe soccer goals and trans-
ported for storage to Reservoir storage area.
Our Street Tree Division performed the following:
Trimmed 783 trees.
Planted 27 trees.
Removed 1 tree.
Root pruned 13 trees -.
Completed 15 work requests.
Areas being trimmed this month: Spyglass Hills, Poppy Avenue completed.
